EXN-F(18)-2/2001.—In exercise of the powers conferred by sub-section (1) of section 15
of the Himachal Pradesh Taxation (on Certain Goods Carried by Road) Act, 1999 (Act No. 16 of
1999), the Governor, Himachal Pradesh is pleased to make the following amendments in Schedule-
I appended to the aforesaid Act, with immediate effect, namely:--
AMENDMENT
In Schedule-1 appended to the Himachal Pradesh Taxation(on Certain Goods Carried by
Road) Act, 1999, in item No.22, for the words, signs and figures “Rs. 7.50 per 10 litres or part
thereof”, the words, figures and signs “Rs. 2.00 per 10 litres” shall be substituted.

No.EXN-F(10)-20/2014-Loose.—Whereas, the Governor, Himachal Pradesh is satisfied
that it is expedient in the public interest so to do that VAT, on Fabrication of body of trucks and
buses and on sale of LED bulbs, be reduced from 13.75% to 5 % and also to exempt VAT on
Energy Efficient Chullahs certified by the Energy & Resources Institute (TERI) or approved by the
Ministry of New & Renewable Energy (MNRE) under the Himachal Pradesh Value Added Tax
Act, 2005;

Now, therefore, the Governor, Himachal Pradesh in exercise of the powers conferred by
section 10 read with sub-section(1) of section 6 and section 9 of the Himachal Pradesh Value
Added Tax Act,2005 proposes the following amendments in SCHEDULE-‘A’ and SCHEDULE-'B'
appended to the said Act;
If any interested person likely to be affected by the proposed amendments has any
objection(s) or suggestion(s), he may send the same to the Excise and Taxation Commissioner,
Himachal Pradesh, Shimla-171009 within a period of 10 days from the date of its publication in the
Rajpatra, Himachal Pradesh; and
Objection(s)/suggestion(s), if any received within the above stipulated period shall
be taken into consideration by the Government before finalizing the same,
namely:--

PROPOSED AMENDMENTS IN SCHEDULE 'A'
In the Himachal Pradesh Value Added Tax Act,2005 (hereinafter referred to as the said
Act), in SCHEDULE 'A', in Part-II- 'A' , after item No.37 and 66, the following items 37-A and 66-
A shall respectively be inserted, namely:--
" 37-A Fabrication of body of trucks and buses
66-A LED bulbs .".

PROPOSED AMENDMENTS IN SCHEDULE 'B'
In the said Act, in Schedule 'B', after item No.18, the following item shall be inserted,
namely:--
"18-A
Energy Efficient Chullahs certified by the Energy & Resources Institute(TERI) or

(1) of the Drugs and Cosmetics Act, 1940 and in consultation with the Hon'ble Chief Justice of the
High Court of Himachal Pradesh, the Governor, Himachal Pradesh is pleased to designate all the
Courts presided over by the Sessions Judge in the State of Himachal Pradesh within their territorial
limits, as Special Courts for trial of offences relating to adulterated drugs or spurious drugs and
punishable under clauses (a) and (b) of section 13, sub-section(3) of section 22. Clauses (a) and (c)
of section 27, section 28, section 28A, section 28B and clause (b) of sub-section (I) of section 30 of
the Act ibid and other offences relating to adulterated drugs/ spurious drugs w.e.f. the date of
publication of the notification in the Rajpatra, H.P. (e-gazette).

OTHER TERM AND CONDITIONS
1.
The LPG distributors will ensure to give rebate of Rs15/- and Rs.7.50 for 14.2 kgs and
5kgs per cylinder respectively to the consumers if he himself takes delivery from
Godown.
2. The LPG Distributors shall not charge the price of LPG refill more than the price fixed
y the District Magistrate Shimla.
3.
The LPG distributors shall maintain proper record of receipt and distribution of LPG
refill and will issue cash memo to every consumer showing consumer No. cost of refill
and additional charges separately in the cash memo and will keep duplicate of the same
in record for inspection purpose and will obtain signature of the consumer on each cash
memo for having received the refill by the consumer
4.
The LPG distributors will distribute LPG refill strictly with in their respective
area/jurisdiction as allotted by the concerned oil company from time to time.
5.
The LPG distributors shall display rate of LPG refills at a conspicuous place of
business as required under the provisions of the H.P.Commodities Price Marking and
display Order,1977 and under the provisions of the LPG(Regulation of Supply and
Distribution)Order,2000.
6. The LPG distributors shall book the refill of the consumer of telephone also as will as
in person
7. The LPG distributors shall make LPG available at the door steps of the consumer
strictly according to the booking.
8. The LPG distributors shall ensure immediate redresser of the complaints lodged by the
consumer for leakages and other reason.
9. The LPG distributors shall ensure to supply LPG refill to the consumers at standard
weight, sealed and equipped safety cap.
10. The LPG distributors shall issue Termination voucher to the consumer immediately
and release the security amount when he is shifted from one place to another.
11. The LPG distributors shall furnish monthly report to The Distt. Controller, Food Civil
Supplies & Consumer Affairs Shimla on the Performa already supplies to them which
should reach in the office of DC,FCS & CA Shimla by fifth of each month positively
12. The LPG distributors shall distribute LPG refills during the shortage strictly on the
directions of the Distt. Magistrate, DC,FCS & CA ,SDM and Inspectors Food and
Supplies of the area concerned.
13. No LPG distributors shall store gas refill on the road side or at any other unauthorized
places and shall store refills only at Godowns and strictly adhere to the direction given
by the Explosive Department.

Proclamation under order 5, rule 20 CPC
Smt. Saubhagya Attri, widow of Shri Bhawani Dutt Attri etc. residents of Village Garkhal,
Tehsil Kasauli, District Solan, H.P. have filed an aplication along with un-registered will dated
7-11-2005, copy of death certificate, copy of Legal heirs etc. before the undersigned stating therein
that Shri Bhawani Dutt Attri has executed a un-registered Will on dated 7-11-2005 in the presence
of Shri Duli Chand Jangra resident of Sanawar, Kasauli and Shri Gita Ram, Ex-Chairman BDC,
Dharampur Block, during his life time in favour of the applicants. The Will has been written by of
Shri Devender Kumar Sharma, Document Writer, Kasauli on dated 7-11-2005. Shri Bhawani Dutt
Attri had subsequently died on 18-9-2007. The applicants have now requested to register the said
un-registered Will under section 40 & 41 of the Indian Registration Act, 1908 before the
undersigned.
