election programme for the conduct of elections to Panchayati Raj Institutions in the State of
Himachal Pradesh under Rule 32 of the Himachal Pradesh Panchayati Raj Election Rules, 1994;

And whereas, the District Election Officer (Panchayat) Shimla had issued a notice for the
conduct of above elections under Rule, 33 of the ibid Rules and has fixed the date of poll in Gram
Panchayat Badhal Development Block Jubbal & Kotkhai District Shimla on 01/01/2016 in respect
of all office bearers of PRIs;
And whereas, the District Election Officer (Panchayat) Shimla has informed vide its letter
no PCH – SML (General Elections) 2015-14085 dated 01.01.2016 at 3.03 pm that 29 ballot papers
for the post of Pradhan Gram Panchayat Badhal were stolen just before the start of the poll. It was
further added that out of the 29 stolen ballot papers, as much as 22 ballot papers were recovered
and 7 ballot papers were still not recovered and the Returning Officer has cancelled all above 29
ballot papers issued to the polli.ng party and new ballot papers were issued in place of above;
And whereas, the matter was placed before the State Election Commission and after
examining all aspects and taking all material circumstances into account the Commission has
arrived at a conclusion that an Electoral Offence has been committed and in such circumstances the
result for the post of Pradhan cannot be ascertained fairly. Further, it is apprehended that stolen
ballot papers may be inserted in the ballot box kept for the purpose of insertion of ballot papers
pertaining to Members of Panchayat Samiti and Zila Parishad;
In view of facts submitted herein above the electoral process in respect of all the offices
pertaining to Gram Panchayat Badhal have been vitiated. Therefore, the State Election Commission
in exercise of the Powers vested in it under Article 243-K of the Constitution of India, Section 160
of the H.P.Panchayati Raj Act, 1994 read with Rule, 32 (5) of Himachal Pradesh Panchayati Raj
Rules, 1994, hereby invalidates the process for the conduct of poll and further order that polling in
respect of all the offices of Panchayati Raj Institutions pertaining to Gram Panchayat Badhal shall
be undertaken afresh on 5th January,2016 from 7.00 am to 3.00 pm. The counting in respect of all
the office bearer of Gram Panchayat shall be done immediately after the polling is over at the Gram
Panchayat Headquarters and counting in respect of Panchayat Samiti and Zila Parishad Members
shall be undertaken as per schedule already notified.
Further, the District Election Officer (Panchayat) Shimla is hereby directed to issue revise
notice under Rule 33 and also make wide publicity of fresh poll in the respective Panchayat by
announcement through loudspeaker and beat of drum. The indelible ink will be marked on the right
hand fore-finger of the voters. The provisions of Act and Rules or orders/directions made there
under by the Commission shall apply to fresh poll as they apply to the original poll.

And whereas, the District Election Officer (Panchayat)-cum-Deputy Commissioner Una had
issued a notice for the conduct of above elections under Rule, 33 of the ibid Rules and had fixed the
date of poll in Gram Panchayat Badoh, Development Block Gagret, District Una on 01/01/2016 in
respect of all office bearers of PRIs;
And whereas, the District Election Officer (Panchayat) Una has informed vide its letter no
PCH – SML (General Elections) 2015-14085 dated 02.01.2016 at 2.13 a.m. and the report of
Returning Officer (Panchayat) – cum – Sub Divisional Magistrate , Amb, District Una vide its
letter number DEG –Panch- Election 2015-16 – 8679 -81 dated 02.01.2016, informed State
Election Commission that incident of violence has been reported by ARO ( Badoh ) Una. The
report of RO and ARO mentioned that when counting of votes for the post of Pradhan was in
process, some people tried to rush into the counting hall. During this two people intruded into the
counting hall and pushed the ARO away and fled away. Subsequently, it was found that as many as
50 number of polled ballot papers of Pradhan post were missing. It was further mentioned that the
ARO had declared the results of ward members and Up Pradhan of Badoh Panchayat. However, the
result for the post of Pradhan was not declared. After receiving the report Returning Officer- cum-
SDM , Amb , District Una, rushed to the spot with police force and rescued the polling party safely.
As the ballot papers for the post of Pradhan were missing, the result of the Pradhan was not
declared. He also stated that FIR has been lodged in this regard.
And whereas, the Commission has also received a report from the Election Observer
Development Block Gagret, Dr. Pardeep Kumar Sharma, stating that in Gram Panchayat Badoh,
election for the post of Pradhan, Up Pradhan and for the post of three ward members were held.
The Process for counting of votes was going on peacefully and result for the post of three ward
member and UP- Pradhan was declared. Counting of votes for the post of Pradhan was also almost
complete and result was compiled on From 34 by the ARO. At that time some people tried to rush
into the counting hall and police tried to stop them. However, some of them managed to intrude
into the Counting Hall. They later fled away from the Hall. When recounting of votes was carried
out by the ARO it was found that 50 numbers of polled ballot papers of Pradhan’s post were
missing. The ARO had immediately informed the returning officer and the Police. FIR was also
register in this regard.
And whereas, the State Election Commission after examining all aspects of the incident and
taking all material circumstances into account, the Commission has arrived at a conclusion that an
Electoral Offence has been committed under section 158 O & P of the HP Panchayati Raj Act,
1994 and in such circumstances the result for the post of Pradhan could have not been ascertained
fairly. The public interest expects and demands a fair, transparent, free Elections.
In view of above facts it is evident that the electoral process in respect of the post of
Pardhan Gram Panchayat Badoh has been vitiated. Therefore, the State Election Commission in
exercise of the Powers vested in it under Article 243-K of the Constitution of India, Section 160 of
the H.P.Panchayati Raj Act, 1994 read with Rule, 32 (5) of Himachal Pradesh Panchayati Raj
Rules, 1994, hereby invalidates the process for the conduct of poll of the post of Pradhan Gram
Panchayat Badoh, Sub Division Amb, District Una and further orders that polling for the post of
Pradhan only in Gram Panchayat Badoh, Sub Division Amb District Una shall be undertaken afresh
on 5th January,2016 from 7.00 am to 3.00 pm. The counting of votes shall be done immediately
after the polling is over at the Gram Panchayat Headquarters. However, the process of the election
for the post of ward members, UP Pradhan for which result had already been declared prior to the
occurrence of said incidence stands completed and shall remain valid.
