election programme vide notification number SEC 16-70/2014-I-6136-6296 dated 05.12.2015, for

the conduct of elections to Panchayati Raj Institutions in the State of Himachal Pradesh under Rule
32 of the Himachal Pradesh Panchayati Raj Election Rules, 1994;
And whereas, the District Election Officer (Panchayat) Sirmour had subsequently issued a
notice for the conduct of above elections under Rule, 33 of the ibid Rules and fixed the date of poll
in Gram Panchayat Berma Papdi, Development Block Nahan District Sirmour on 03/01/2016 in
respect of all office bearers of PRIs;
And whereas, the District Election Officer (Panchayat) Sirmour has informed vide its letter
no PCN – SMR (Elections) 2015-40 dated 03.01.2016 that the Ballot box comprising of Polled
Ballot Papers in respect of Zila Parishad Ward No. 12 Kala Amb; and Panchayat Samiti Ward No.
12 Berma Papdi falling in the jurisdiction limits of Ward No. 5 of Gram Panchayat Berma Papdi
was supplied inadvertently during Counting of votes of office bearers of Gram Panchayat and was
detected when the said ballot box was opened. However, the ballot box was immediately sealed
without sorting and counting of the votes.
In view of facts submitted herein above the State Election Commission is of the considered
view that since the paper seal of ballot box pertaining to the members of Zila Parishad Ward No. 12
Kala Amb; and Panchayat Samiti Ward 12 Berma Papdi falling in the jurisdiction limits of Ward
No. 5, Gram Panchayat Berma Papdi, Development Block Nahan has been broken and thereby
vitiating the election process.
Therefore, the State Election Commission in exercise of the Powers vested in it under
Article 243-K of the Constitution of India, Section 160 of the H.P.Panchayati Raj Act, 1994 read
with Rule, 32 (5) of Himachal Pradesh Panchayati Raj Rules, 1994, do hereby invalidates the
process for the conduct of poll in respect of members of Zila Parishad Ward No. 12 Kala Amb; and
Panchayat Samiti Ward No. 12 Berma Papdi, in the jurisdiction limits of Ward No. 5, Gram
Panchayat Berma Papdi, Development Block Nahan and further orders that re-polling in respect of
members of Zila Parishad Ward No. 12 Kala Amb; and Panchayat Samiti Ward No. 12 Berma
Papdi in the jurisdiction limits of Ward No. 5, Gram Panchayat Berma Papdi, Development Block
Nahan shall be undertaken afresh on 6th January,2016 from 7.00 am to 3.00 pm. The counting of
these ballot papers shall be undertaken as per schedule already notified viz. on 7/1/2016. However,
the process of elections in respect of member ward number 5, Pardhan and Up Pardhan of Ward
No. 5, Gram Panchayat Berma Papdi, Development Block Nahan shall remain valid and complete
as election process has achieved a logical conclusion. It is further added that the inadvertently
opened ballot box comprising of the ballot papers in respect of aforesaid Wards of Panchayat
Samiti and Zila Prishad Ward be kept in safe custody under proper seal till further orders of the
State Election Commission.
Further, the District Election Officer (Panchayat) Sirmour is hereby directed to issue revised
notice on Form- 17, under Rule 33 and also make wide publicity for fresh poll in the respective
Ward of Gram Panchayat Berma Papdi by announcement through loudspeaker and beat of drum.
The indelible ink will be marked on the right hand fore-finger of the voters. The provisions of Act
and Rules or orders/directions made there under by the Commission shall apply to fresh poll as they
apply to the original poll.

NOTIFICATION
Shimla-2, the 18th December, 2015
No. Fish-A (3)-2/2015.—In exercise of the powers conferred by sub-section (1) of
section 3 of the Himachal Pradesh Fisheries Act 1976 (Act No. 16 of 1976), the Governor,
Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh
Fisheries Rules, 1979 notified vide this Department’s Notification No. Fish. A (3)-1/77, dated
15.11.1979 and published in the Rajpatra, Himachal Pradesh (Extra Ordinary) dated the 16th
February, 1980 and the same are hereby published for the general information of the public, as
required under sub section (5) of section 3 of the Act ibid;
If any person likely to be affected by these rules, has any objection(s) or
suggestion(s) with regard to the said draft these rules, he may send the same to the Director- cum-
Warden of Fisheries, Himachal Pradesh, Bilaspur-174001 within a period of thirty days from the
date of publication of the same in the Rajpatra, Himachal Pradesh;
The objection(s) or suggestion(s), if any, received within the above stipulated period, shall
be taken into consideration by the Government before finalizing these rules, namely:—
DRAFT RULES
1.
Short title and commencement.—(1) These rules may be called the Himachal
Pradesh Fisheries (Eighth Amendment) Rules, 2015.
(2) They shall come into force from the date of their publication in the Rajpatra,
Himachal Pradesh.
2.
Amendment of rule 3.—In rule 3 of the Himachal Pradesh Fisheries Rules 1979,
(hereinafter referred to as the said rules) after clause (v), the following clause (vi) shall be
inserted, namely :—
“ (vi) KOL DAM RESERVOIR:—
Impoundment formed by Koldam upto a level of 646M in the area falling in District of
