No. Rev-D (G) 6-69/2011-II.—In exercise of the powers conferred by section 13 of the
Himachal Pradesh Village Common Lands Vesting and Utilization Act, 1974 (Act No 18 of
1974) and section 26 of the Himachal Pradesh Ceiling on Land Holdings Act, 1972 (Act No.
19 of 1973), the Governor of Himachal Pradesh proposes to make the following rules further to
amend the Himachal Pradesh Lease Rules, 2013 and the same are being published in Rajpatra,
Himachal Pradesh for general information of the public;
If any person likely to be affected by these amendments has any objection(s) or
suggestion(s) to make in respect of these rules, he may send the same to the Addl. Chief
Secretary (Revenue) to the Government of Himachal Pradesh, Shimla-2 within 30 days from the
date of publication of these draft rules in the Rajpatra, Himachal Pradesh;
Objection(s) or suggestion(s), if any, received within the period specified above, shall
be considered by the State Government before finalizing these rules, namely:—
DRAFT RULES
1.
Short-title and commencement.—(1) These rules may be called the Himachal
Pradesh Lease (Amendment) Rules, 2015,

(2) They shall come into force from the date of their publication in Rajpatra Himachal
Pradesh.
2.
Amendment of rule -7.—In rule 7 of the Himachal Pradesh Lease Rules, 2013
(hereafter referred to as the 'said rule'), after the existing proviso the following proviso shall be
inserted, namely:—
"Provided further that the lease in case of diverted forest land may be sanctioned by
the Government, on the basis of Essentiality Certificate, No Objection Certificate as
per Form''C'' & "D" appended to the lease rules and approval for diversion of forest
land granted by the Central or State Forest Departments, only after calculation and
assessment of lease rent/amount by the concerned Deputy Commissioner-Cum-
Collector, without observing any other codal formalities".

Amendment of rule-8.—In rule 8 of the said rules, (a) for the existing proviso
appearing under sub-rule (i), the following provisos shall be substituted:—
"Provided that for the Hydro Electric Projects (HEPs) and other infrastructure
projects for which Government forest land has been diverted by the State or Central
Government, the lease rent/ amount shall be charged @ Re. 1 per Sqmt. Per annum
and for other Government land (non-forest land), the lease rent/amount shall be
charged at the existing rate of 10% of the current circle rate:
Provided further that in respect of power and other infrastructure projects, where the
lease of diverted Government forest land has been sanctioned or granted on annual
lease rent basis on the existing rates as per prevailing rules prior to 31-12- 2015, the
lease rent/amount shall be charged on the revised lease rate of Re. 1/- per sqmt. per
annum after 01-01-2016 on uniform rates without any further concessions:
Provided further that the projects already executed or implemented or which are
to be executed in the State under 100% funding from the State or Central
Government Departments including the power projects of Himachal Pradesh State
Electricity Board and Himachal Pradesh Power Corporation Limited, the
Government or diverted forest land on lease shall be provided to such projects on
token lease rent of Re. 1/- per bigha per month for entire lease period."
(b) In sub-rule (iii) after clause (d), the following proviso shall be inserted, namely:—
"Provided that the concessional lease rent/amount for categories (a) to (c) shall be
charged @ Re 1/- per month as token lease rent and for category (d) shall be
charged @ 20% of the current circle rates of the demised land in lump sum and
Re. 1/- per month as token lease money for the period for which the land is
granted on lease."
4.
Insertion of new rule 18-A.—After rule 18 of the said rules, the following rule
shall be inserted, namely:
"18-A Penalty:—The lessee shall be liable to pay additional amount as penalty
for non execution of lease deed or non- payment of lease amount or non-
renewal of lease within the stipulated period @ 10% of the existing lease rent/
amount and also in the event of non-compliance of the terms and conditions of lease
deed or contravention of the provisions of Himachal Pradesh Lease Rules, 2013."

Mehatpur-Basdehra to that of Municipal Council notified vide this Departments’ notifications of

even number dated 11.5.2015 was published in the Rajpatra, H.P. (Extra-ordinary) dated 15.5.2015
for inviting objections from the affected persons of said Nagar Panchayat through Deputy
Commissioner, Una and the Director of the Urban Development Department within 30 days;
And whereas, the objections received within the specified period through the Deputy
Commissioner, Una has been considered and decided by the State Government;
And whereas, the Director, Urban Development and Deputy Commissioner, Una have
recommended finalization of the said declaration;
Now, therefore, in exercise of powers conferred by second proviso to sub-section (2) of
section 3 of the Himachal Pradesh Municipal Act, 1994 (Act No. 13 of 1994), the Governor,
Himachal Pradesh is pleased to up-grade the Nagar Panchayat, Mehatpur-Basdehra to that of
Municipal Council, Mehatpur-Basdehra and also to amend Schedule-I of the said Act by deleting
entry at Sr. No. 16 from part-II of the schedule and to insert it at Sr. No. 30 in part-I of the
schedule, namely:-
