(AMENDMENT) BILL, 2016

(AS INTRODUCED IN THE LEGISTLATIVE ASSEMBLY)

further to amend the Himachal Pradesh Tax on Entry of Goods into Local Area Act, 2010

(Act No. 9 of 2010).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-seventh Year

of the Republic of India as follows :—

Short title.—This Act may be called the Himachal Pradesh Tax on Entry of Goods

into Local Area (Amendment) Act, 2016.

Amendment of section 3.—In section 3 of the Himachal Pradesh Tax on Entry of

Goods into Local Area Act, 2010 (hereinafter referred to as the “principal Act”), in sub-section (4),

in clause (ii), for the words, figures and signs “Sr. Nos. 6 and 7”, the words, figure and signs “Sr.

No. 1(a)” shall be substituted.

Insertion of new section 4-A.—After section 4 of the principal Act, the following

new section shall be inserted, namely:—

“4-A. Levy of tax on e-commerce.—(1) Notwithstanding anything contained in section 3,

there shall be levied a tax on entry of goods specified in Schedule-II into local area made

through online purchase or transaction or through e-commerce.

(2) The tax shall be levied on the value of the goods in the manner prescribed and shall be

collected from the person-in-charge of the goods on behalf of the importer.”.

Amendment of section 6-A.—In section 6-A of the principal Act,—

(a) for sub-sections (1) and (2), the following sub-sections shall be substituted, namely:—

“(1) Every registered dealer shall furnish return in such manner as may be prescribed.

(2) Before filing of return under sub-section (1), a dealer shall deposit full amount of

tax due for each period as prescribed and shall furnish the proof of payment of

such tax to the Assessing Authority.”; and

(b)

in sub-section (3), the word “monthly” shall be omitted.

STATEMENT OF OBJECTS AND REASONS

A dealer who buys diesel and lubricants within the State pays Value Added Tax at the rate

of 16% and 13.75% respectively. When a dealer uses such fuel and lubricants in the manufacture of

taxable goods or captive generation of power, he is allowed an Input Tax Credit of 12% and 9.75%

respectively, because according to second proviso to sub-section (3) of section 11 of the Himachal

Pradesh Value Added Tax Act, 2005, Input Tax Credit on fuel and lubricants is allowed only to the

extent by which the tax paid in the State exceeds 4%. As a result a dealer has to pay only 4% tax.

Whereas, on the other hand if the dealer brings diesel and lubricants from outside the State, he is

liable to pay 12% Entry Tax and 2% CST. If such dealer uses the diesel and lubricants in

manufacturing of taxable goods for sale, then such dealer gets set off of 12% and final implication

of tax burden on such dealer is only 2% of the Central Sales Tax. Thus a dealer buying diesel and

lubricants within the State bears a higher burden vis-a-vis a dealer buying diesel and lubricants

from outside the State for using in manufacturing of taxable goods for sale. As a result dealer

prefers to buy from outside the State and the State gets no revenue from such class of dealers.

Therefore, set off on purchase of diesel and lubricants from outside the State is not justified.

Further, with a view to tap the revenue potential of the ever growing online shopping business it

is proposed that online purchases may be brought under the ambit of the Act ibid and the person-in-

charge of such goods shall be liable to pay the tax on behalf of the importer. Further, it is also

considered imperative that dealers registered under the different enactments administrated by the

Department should file combined returns and make payment of taxes during one given period only.

This will facilitate the dealers in managing their business easily and will also enable the department

to administer the Act more effectively. Thus, in order to achieve the desired objectives, it has been

decided to make suitable amendments in the Act ibid accordingly.

This Bill seeks to achieve the aforesaid objectives.

The provisions of the Bill when enacted are to be enforced through the existing Government

machinery and there will be no additional expenditure from the State exchequer.

MEMORANDUM REGARDING DELEGATED LEGISLATION

Clauses 3 and 4 of the Bill seeks to empower the State Government to make rules providing

for the procedure for filing of returns by the dealer and manner for levy of entry tax. The proposed

delegation of power is essential and normal in character.

further to amend the Himachal Pradesh Protection of Interests of Depositors (in Financial

Establishments) Act, 1999 (Act No. 19 of 2000).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-seventh Year

of the Republic of India as follows:—

1. Short title.—This Act may be called the Himachal Pradesh Protection of Interests of

Depositors (in Financial Establishments) Amendment Act, 2016.

Amendment of Section 2.—In section 2 of the Himachal Pradesh Protection of

Interests of Depositors (in Financial Establishments) Act, 1999 (Act No. 19 of 2000) (hereinafter

referred to as the ‘principal Act’),—

(A) for clauses (b) and (c), the following clauses shall be substituted, namely:—

“(b) “Deposit” includes and shall be deemed always to have included any receipt

of money or acceptance of any valuable commodity by any Financial

Establishment to be returned after a specified period or otherwise, either in

cash or in kind or in the form of a specified service with or without any

benefit in the form of interest, bonus, profit, or in any other form, but does

not include—

(i)

amount raised by way of share capital or by any way of debenture, bond

or any other instrument covered under the guidelines given, and

regulations made, by the Securities and Exchange Board of India,

established under the Securities and Exchange Board of India Act,

1992, (15 of 1992)

(ii) amounts contributed as capital by partners of a firm,

(iii) amounts received from a Scheduled bank or Co-operative bank or any

other banking company as defined in clause (c) of section 5 of the

Banking Regulation Act,1949, (10 of 1949)

(iv) any amount received from—

(a) the Industrial Development Bank of India,

(b) a State Financial Institution,

Industrial Development Bank of India Act, 1964, (18 of 1964) or

(d) any other institution that may be specified by the Government in

the behalf,

(v) amount received in the ordinary course of business by way of—

(a) security deposit,

(b) dealership deposit,

(d) advance against order for goods or services,

(vi) any amount received from an individual or a firm or an association of

individuals not being a body corporate, registered under any enactment

relating to money lending which is for the time being in force in the

State, and

(vii) any amount received by way of subscription in receipt of a Chit;

Explanation-I.—‘‘Chit’’ has the meaning as assigned to in clause (b) of

section 2 of the Chit Funds Act, 1982 (40 of 1982).

Explanation-II.— A transaction is not a Chit within the meaning of this

clause, if in such transaction,—

(i)

some alone, but not all, of the subscribers get the prize amount without

any liability to pay future subscriptions, or

(ii) all the subscribers get the Chit amount by turns with a liability to pay

future subscriptions.

Explanation.—Any credit given by a seller to a buyer on the sale of any

property (whether movable or immovable) shall not be deemed to be a deposit for

the purposes of this clause;

firm or a company registered under the Companies Act, 1956 (1 of 1956 18 of

2013) or Companies Act, 2013, carrying on the business of receiving deposits

under any scheme or arrangement or in any other manner but does not include a

corporation or a co-operative society owned or controlled by any State

Government or the Central Government, or a banking company as defined under

clause (c) of section 5 of the Banking Regulation Act, 1949;’’; (15 of 1992) and

(B) after clause (e), the following new clause shall be inserted, namely:—

“(f) “Designated Court” means the Designated Court constituted under

section 6.”.

Insertion of new sections 13A, 13B, 13C, 13D, 13E, 13F and 13G.—After section 13

of the principal Act, the following new sections shall be inserted, namely:—

13A. "Report and return by Financial Establishments.—(1) Every Financial

Establishment which commences or carries on its business as such in the State on or after the

commencement of this Act, shall make a report to the District Collector and the Superintendent of

Police of the district, mentioning the details about its authority to carry on such business, the

location of the Financial Establishment in the State and its main branch office, if any, wherever

situated, permanent address of every person responsible for the management of, or conducting of

the business or affairs of, the Financial Establishment in the State and such other particulars as may

be prescribed.

(2) Such report shall be made within seven days from the date on which a Financial

Establishment commences or carries on its business as such in the State :

Provided that a Financial Establishment which has been carrying on its business as such

prior to the commencement of this Act shall make such report within seven days from the date of

such commencement.

(3) Every Financial Establishment shall furnish a quarterly return within one month of the

expiry of each quarter of a financial year to the District Collector and the Superintendent of Police

of the district in respect of its business and financial position, the area of its investment and the

location of investments of moneys made by it within and outside the State, if any, and such other

particulars as may be prescribed.

(4) Whoever contravenes the provisions of this section shall be punishable with fine which

may extend to fifty thousand rupees.

13B. Compounding of offence.—(1) An offence punishable under section 5 may, before

the institution of the prosecution, be compounded by the Competent Authority or after the

institution of the prosecution, be compounded by the Competent Authority with the permission of

the Designated Court on payment of the entire amount due to the depositors with or without

interest.

(2) Where an offence has been compounded under sub-section (1), no proceeding or

further proceeding, as the case may be, shall be taken or continued against the offender in respect

of the offence so compounded and the offender, if in custody, shall be discharged forthwith.

13C. Anticipatory bail not to be granted.—Notwithstanding anything contained in section

438 of the Code of Criminal Procedure, 1973, (2 of 1974) no Court shall grant anticipatory bail to

any person under this Act.

13D. Protection of action taken in good faith.—No suit or other proceedings shall lie

against the Government or the Competent Authority or an officer or employee of the Government

for anything which is, in good faith, done or intended to be done under this Act.

13E. Power to remove difficulties.—(1) If any difficulty arises in giving effect to the

provisions of this Act, the Government may, by order, make such provisions not inconsistent with

the provisions of this Act as may appear to be necessary for removing the difficulty :

Provided that no order shall be made under this section after expiry of a period of two years

from the date of commencement of this Act.

(2) Every order made under this section shall be laid, as soon as may be after it is made,

before the State Legislature.

13F. Special Public Prosecutor.—The Government shall, by Notification, appoint one or

more Advocates of not less than ten years standing practice as Special Public Prosecutor for each of

the Designated Court for the purpose of conducting cases.

13G. Procedure and powers of Designated Court regarding offences.—The Designated

Court may take cognizance of the offence without the accused being committed to it for trial and in

trying the accused person, shall follow the procedure prescribed in the Code of Criminal Procedure,

1973 (2 of 1974) for the trial of warrant cases by Magistrates.

(2) The provisions of the Code of Criminal Procedure, 1973 shall, so far as may be, apply

to the proceedings before a Designated Court and for the purposes of the said provisions, a

Designated Court shall be deemed to be a Magistrate.’’.

STATEMENT OF OBJECTS AND REASONS

In order to control the activities of Non-Banking Financial Companies in the State and to

protect the interests of the depositors in these companies, the State Government has enacted “The

Himachal Pradesh Protection of Interests of Depositors (in Financial Establishments) Act, 1999

(Act No. 19 of 2000)”. The Reserve Bank of India has recommended some more provisions to be

incorporated in the Act ibid . These recommendations have been examined and it is considered that

the incorporation of these new provisions would help to remove certain infirmities in the existing

legislation and make it more deterrent and effective. This has necessitated amendments in the Act,

ibid.

This Bill seeks to achieve the aforesaid objective.

STATEMENT OF OBJECTS AND REASONS

Section 5 of the Himachal Pradesh Panchayati Raj Act, 1994 provides for meetings and

quorum of the Gram Sabha. According to sub-section (3) of this section, for the purpose of quorum

in any general meeting of Gram Sabha representation of at least one-third of the total number of the

families represented by one or more members is required and decision has to be taken by a majority

of members present and voting. It has been observed that in most of the Gram Sabhas, the

proposals relating to developments are not approved in the meetings for want of quorum and

resultantly, development of the Gram Panchayat is adversely affected. Thus, in order to overcome

this hurdle, it is considered in larger public interest that the quorum for the general meeting of the

Gram Sabha is reduced to one-fourth so that developmental works of the Gram Panchayat are not

hampered for want of quorum. As such, it has been decided to amend the Act ibid accordingly.

This Bill seeks to achieve the aforesaid objectives.

Act, 2007 (Act No.2 of 2008).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-seventh Year

of the Republic of India as follows:—

Short title.—This Act may be called the Shimla Road Users and Pedestrians (Public

Safety and Convenience) Amendment Act, 2016.

Amendment of section 2.—In section 2 of the Shimla Road Users and Pedestrians

(Public Safety and Convenience) Act, 2007, (hereinafter referred to as the ‘principal Act’), in sub-

section (1), in clause (b), after the words “and Ridge”, the words “excluding area notified by the

State Government as permitted parking place in front of the Metropole” shall be inserted.

Amendment of section 3.—In section 3 of the principal Act, in sub-section (1), in

clause (iii), after the first proviso, the following provisos shall be inserted, namely:—

“Provided further that a Member of the Legislative Assembly of Himachal Pradesh

who is residing in Metropole and permitted to ply his vehicle upto Metropole may park his

vehicle in the permitted parking place in front of Metropole:

Provided further that the Speaker of the Himachal Pradesh Legislative Assembly, the

Chief Justice of Himachal Pradesh High Court, former Chief Minister of Himachal Pradesh,

Ministers of Himachal Pradesh, Judges of Himachal Pradesh High Court and former

Speaker of Himachal Pradesh Legislative Assembly may be permitted to ply their vehicle

on portion of Core Mall Road from Shimla Club to Indira Gandhi State Sports Complex:”.

4. Amendment of section 8.—In section 8 of the principal Act, in sub-section (5), for the

figures “3000”, the figures and sign “10,000” shall be substituted.

STATEMENT OF OBJECTS AND REASONS

In order to restore the sanctity of Shimla Mall Road by preventing its use as a thorough fare

and to regulate traffic in the interest of public safety and convenience on sealed and restricted roads

of Shimla Town, the Shimla Road Users and Pedestrians (Public Safety and Convenience) Act,

2007 was enacted. A proposal was received from the Deputy Commissioner, Shimla to earmark

parking place in front of Metropole for Members of the Legislative Assembly of Himachal Pradesh

who are residing in Metropole. The Deputy Commissioner, Shimla has submitted that a meeting

was convened by the Hon’ble Speaker, Legislative Assembly with the Members of Legislative

Assembly and in the said meeting it was pointed out by the Hon'ble Members that there is a great

hardship to them being resident of Metropole as there is no parking place for them in front of

Metropole. Thus, it has been requested that they may be permitted to park their vehicles in front of

Metropole. The proposal has been examined and the demand of the Hon’ble Members is considered

genuine. Therefore, it has been decided to make a provision in the Act ibid which may enable them

to park their vehicles in front of Metropole at the notified parking place. Further, it has also been

considered just and reasonable to permit some dignitaries to ply their vehicle upto Indira Gandhi

State Sports Complex. Besides this, it is also considered necessary to enhance the amount of daily

fee of vehicles permitted for film shooting on portion of Sealed Road or Core Mall Road from Rs.

3000/- per day to Rs.10,000/- per day. This has necessitated amendments in the Act ibid.

This Bill seeks to achieve the aforesaid objectives.

further to amend the Himachal Pradesh Value Added Tax Act, 2005(Act No.12 of 2005).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-seventh Year

of the Republic of India as follows:--

Short title.—This Act may be called the Himachal Pradesh Value Added Tax

(Amendment) Act, 2016.

Amendment of section 11.—In section 11 of the Himachal Pradesh Value Added Tax

Act, 2005 (hereinafter referred to as the ‘principal Act’), in sub-section (16),—

(a) in clause (a), the word ‘‘twice” shall be omitted.; and

(b) in clause (b), for the word “fifty”, the words “twenty five’’ shall be substituted.

Insertion of new section 14-A.—After section 14 of the principal Act, the following

new section shall be inserted, namely:—

''14-A. Application for grant of Provisional Registration Certificate.—(1) Any person

intending to apply for registration in the State may make online application in the

prescribed form alongwith scanned copies of the prescribed documents.

(2) On receipt of application under sub-section (1), the prescribed authority shall grant

Provisional Registration Certificate within three working days in the prescribed form.

(3) After issue of the Provisional Registration Certificate, the prescribed authority shall

direct the applicant to produce evidence and documents in respect of the particulars given in the

application and also the accounts relating to the business for verification. On production of the

evidence, documents and accounts, it shall verify the particulars given in the application and on

being satisfied about the correctness of the particulars, it shall issue a Permanent Registration

Certificate in the prescribed form not later than thirty days from the date of receipt of application

for grant of Registration Certificate.

(4) If the prescribed authority is satisfied that the particulars given by the applicant in his

application are incorrect or that the applicant has misrepresented certain facts, it shall, after giving

the applicant an opportunity of being heard and recording the reasons in writing, reject the

application and cancel the Provisional Registration Certificate issued under sub-section(2) not later

than thirty days of the date of receipt of application.”.

Amendment of section 16.—In section 16 of the principal Act, in sub-section (6), for

the existing proviso, the following provisos, shall be substituted, namely:—

“Provided that where the dealer is filing monthly returns, a sum equal to Rs.1000/- per day

shall be charged as penalty till the default continues, but such penalty shall not exceed Rs. 50,000/-:

Provided further that where a dealer has closed down his business or has left the business

without getting his Registration Certificate cancelled, the Assessing Authority shall suspend his

Registration Certificate immediately, and thereafter no further incremental penalty as applicable

shall be imposed.”.

Insertion of new section 27-A.—After section 27 of the principal Act, the following

new section shall be inserted, namely:—

“27-A. Special provision for settlement of pendency and arrears.—Notwithstanding

anything contained in this Act, if the Government considers it necessary and expedient

in public interest so to do, it may in respect of a dealer who for reasons beyond his

control could not submit the statutory forms required for assessment, for assessment

cases up to a financial year, it may notify a Settlement Scheme for such cases for a

particular period and allow partial waiver of the tax amount and complete or partial

waiver of the interest and penalty amount for non-submission of such statutory

forms.”.

Insertion of new section 49-A.—After section 49 of the principal Act, the following

new section shall be inserted, namely:—

"49-A. Advance Ruling.—(1) The Commissioner may constitute an ‘Authority’ for

Advance Ruling, consisting of at least one Additional Commissioner or Joint

Commissioner, one Zonal Collector and one Deputy Commissioner (Legal) or

Assistant Commissioner (Legal) to clarify the rate of tax in respect of any goods or the

eligibility to tax of any transaction or eligibility of deduction of input tax or liability of

deduction of tax at source under the Act, in respect of any case or class of cases as the

Commissioner may specify.

(2) Any registered dealer seeking advance ruling under this section, shall make

application to the Authority in such form, accompanied by proof of payment of such fee and paid in

such manner as may be prescribed.

(3) On receipt of application, the Authority shall cause a copy thereof to be forwarded to

the Assessing Authority concerned and call for its findings on the question raised and any other

information or records as required by it.

(4) The Authority may, after examining the application and any records called for, by

order, either admit or reject the application:

Provided that the Authority shall not allow the application where the question raised in the

application,—

(i)

is already pending before any officer or other authority of the Department or Appellate

Tribunal or any Court; or

(ii) relates to a transaction or issue which is designed apparently for the avoidance of tax:

Provided further that no application shall be rejected under this sub-section unless an

opportunity of being heard is given and where the application is rejected, reasons for such rejection

shall be recorded in the order.

(5) The question on which the advance ruling may be sought shall be in respect of,-

(a) classification of any goods under the Act;

(b) applicability of a notification issued under the provisions of the Act having a

bearing on the rate of tax;

goods under the provisions of the Act;

(d) notifications issued, in respect of tax under the Act;

(e) admissibility of input tax credit of tax paid or deemed to have been paid;

(f) determination of the liability to pay tax on any goods under the Act; or

(g) whether applicant is required to be registered under the Act;

(6) No proceedings before the Authority (including the pronouncement of advance ruling)

under this section shall be questioned or shall be invalid on the ground merely of the existence of

any vacancy or defect in the constitution of the Authority.

(7) A copy of every order made under sub-section (4) shall be sent to the applicant and the

officer concerned.

(8) Where an application is admitted under sub-section (4), the Authority shall, after

examining such further material as may be placed before it by the applicant or obtained by the

Authority, pass such order as deems fit on the questions specified in the application, after giving an

opportunity of being heard. The Authority shall pass order within ninety days of the receipt of

application and a copy of such order shall be sent to the applicant and the officer concerned.

(9) The order of the Authority shall be binding only,-

(i) on the applicant who seeks the advance ruling;

(ii) in respect of the goods or transaction in relation to which it is sought; and

(iii) in the proceedings before the officers of the Department (other than the Commissioner

and the Appellate Tribunal) relating to such applicant.

(10) The order passed under sub-section (8) shall be binding as aforesaid unless there is a

change in law or facts on the basis of which the order was passed.

(11) Where the authority, on a representation made to it by any officer or otherwise find that

an order passed by it was obtained by fraud or mis-representation of facts, it may, by order, declare

such order to be void-ab-initio, and thereupon, all the provisions of the Act shall apply to the

applicant, as if, such order had never been passed.

(12) The Authority shall, for the purpose of exercising its powers regarding discovery and

inspection, enforcing the attendance of any person and examining him on oath, issuing

commissions and compelling production of books of account and other records, have all the powers

of a civil court under the Code of Civil Procedure, 1908 (5 of 1908).

(13) The Authority shall be deemed to be a civil court for the purposes of section 195, (2 of

1974) but not for the purposes of Chapter XXVI of the Code of Criminal Procedure, 1973, and

every proceedings before the Authority shall be deemed to be a judicial proceedings within the

meaning of sections 193 and 228 (45 of 1860) and for the purpose of section 196 of the Indian

Penal Code.

Explanation.—For the purpose of this section,—

(i) ‘Advance Ruling’ means the determination, by the Authority, of a question specified

under sub-section (1) and (5) of this section; and

(ii) ‘Authoirty’ means the Authority for advance ruling constituted under sub-section (1)

of this section.”.

Amendment of section 50-A.— In section 50-A of the principal Act, in sub-section

(1), for the words and sign “next higher authority,” , the words, letters and signs “Commissioner

prior to blocking the uploading of forms VAT-XXVI and VAT-XXVI-A and ” shall be substituted.

STATEMENT OF OBJECTS AND REASONS

Section 11 of the Value Added Tax Act, 2005 provides for Input Tax Credit. Sub-section

(16) of this section deals with false claims of Input Tax Credit. The penalty for the same is twice

the amount of such false claim or credit in addition to tax and interest payable which is considered

unreasonable and excessive and is also not easily recoverable. Thus, it is proposed to reduce this

penalty to equal to the amount of such false claim. Further, this sub-section provides penalty for

incorrect claim of Input Tax Credit due to wrong calculation without any intention to affect revenue

interest adversely. The penalty for the same is fifty percent of the amount of such claim or credit in

addition to the tax and interest payable which is also considered unreasonable. Thus, the penalty for

incorrect claims is proposed to be reduced to twenty five percent of the amount of such claim. It

has been felt that process of registration of dealers should be simplified and a provisional TIN

number may be provided after the dealer completes the codal formalities. Keeping this in view, it is

proposed that a provision for provisional registration may be inserted in the Act ibid wherein the

applicant may be provided a provisional TIN number within three days of the online application for

such provisional registration on receipt of requisite documents and fees.

Further, section 16 of the Act provides for payment of tax, filing of returns and penalties for

non-furnishing of returns with no upper cap which is not considered just and proper, because in

case of dealers who have closed down their business without getting the Registration Certificate

cancelled and their whereabouts are not traceable, the penalty in such cases will continue to be

imposed for an unending period and thereby leading to unnecessary mounting of arrears with no

chance of recovery in sight. Thus, it is proposed to fix maximum limit of penalty for non-

furnishing of returns. It is also felt that there is urgent need to take some remedial steps for early

disposal of cases which are pending assessment due to want of statutory forms. With the Goods and

Services Tax regime around the corner it is even more important to dispose of the old cases so that

manpower and resources of the Department are diverted to scrutiny of new cases. Therefore, it is

proposed to make provision for notifying of a Settlement Scheme to enable the settlement of such

cases by partially or fully waiving of the penalty and interst. In order to ensure uniformity in the

levy, assessment and collection of tax with regard to classification of goods under different entries

of various Schedules to the Act ibid or the rate of tax applicable to such goods etc. thereby avoiding

conflicting orders being passed by the different Assessing Authorities, ‘Advance Ruling’ is

considered a perfect measure. As such, it has also been proposed to make a provision of ‘Advance

Ruling’ in the Act ibid which will be a Tax Payer friendly and will afford for greater clarity to the

dealers in respect of their prospective tax liabilities.

Further, section 50-A provides for locking of TIN and suspension of e-services in respect of

the dealers who fail to pay any tax, penalty or interest payable under the Act ibid or fail to furnish

returns by the prescribed dates etc.. It has been observed that some Assessing Authorities are

arbitrarily blocking the facility of uploading Forms VAT-XXVI and VAT-XXVI-A appended to

the Himachal Pradesh Value Added Tax Rules, 2005 and thereby causing inconvenience to the

dealers. Thus, in order to ensure that the powers are not misused, it has been proposed that approval

for blocking of the facility of uploading above forms shall be obtained by the Assessing

Authorities from the Commissioner. This has necessitated amendments, in the Act ibid.

This Bill seeks to achieve the aforesaid objectives.
