PANCHAYATI RAJ DEPARTMENT
NOTIFICATION
Shimla-171002, the 28th April, 2016
NO.PCH-HA(4)1/94.—In exercise of the powers conferred by sections 160 and 186 of the
Himachal Pradesh Panchayati Raj Act, 1994 (Act No.4 of 1994) read with clause (2) of article 243
K of the Constitution of India, the Governor of Himachal Pradesh in supersession of this
Department Notification No.PCH-HA (4) 1/ 94 dated 17th December, 1994, proposes to make the
following rules regulating the conditions of service and tenure of office of the State Election
Commissioner and the same are hereby published in the Rajpatra, Himachal Pradesh as required
under sub-section (3) of section 186 of the Act ibid for general information and for inviting public
objections, if any, and the said rules shall be taken into consideration by the Government after
15 days of their publication;
Any person likely to be affected by these rules may file objection (s) or suggestion (s) with
regard to these rules to the Director of Panchayati Raj, SDA Complex, Kasumpti, Shimla-171009
within the above stipulated period;
The objections and suggestions, if any, received within the above stipulated period shall be
taken into consideration by the State Government, before the finalization of the said rules,
namely:—
DRAFT RULES
1.
Short title.—These rules may be called the State Election Commissioner (Conditions
of Service) Rules, 2016.
2.
Definitions.—(1) In these rules, unless the context otherwise requires,—
(a) “Act” means the Himachal Pradesh Panchayati Raj Act, 1994 (Act No.4 of 1994) ;
(b) “Government” means the Government of Himachal Pradesh ;
(c) “Judge of the High Court” means the Judge of the High Court of Himachal Pradesh.
(d) “State Election Commissioner” means the State Election Commissioner appointed
under articles 243-K and 243-ZA of the Constitution of India read with section 160 of
the Himachal Pradesh Panchayati Raj Act, 1994.
(2) The words and expressions used but not defined in these rules shall have the meaning
respectively as assigned to them in the Act.
3.
Status & Salary.—The status of the State Election Commissioner shall be equal to
that of a Judge of the High court and he shall be paid such salary as is admissible to the Judge of
the High Court:

Provided that if a person who, immediately before the date of assuming office as the State
Election Commissioner, was in receipt of or, being eligible so to do, had opted to draw, a pension
(other than a disability or wound pension) in respect of any previous service under the Government
of the Union or State, his salary in respect of service as the State Election Commissioner shall be
reduced,—
(a) by the amount of that pension; and
(b) if he had before assuming office, received, in lieu of a portion of the pension due to
him in respect of such pervious service, the commuted value thereof, by the amount of
that portion of the pension:
Provided further that when a person is appointed as the State Election Commissioner while
in service of the Government he shall retire from service on attaining the age of superannuation
and, thereafter, his salary shall be reduced in accordance with the foregoing proviso.
4.
Term of office.—The State Election Commissioner shall hold office for a term of five
years from the date on which he assumes his office:
Provided that he may, at any time, by writing under his hand addressed to the Governor,
resign his office.
5.
Leave.—(1) A person, who immediately before the date of assuming office as
the State Election Commissioner was in service of Government, shall be entitled to the
leave during his tenure of office but not thereafter, in accordance with the rules for the time
being applicable to the service to which he belonged. He shall be entitled to carry forward
the amount of leave standing at his credit on such date.
(2) Any other person, not in service of the Government, if appointed as the State Election
Commissioner shall be entitled to the leave in accordance with such rules as are applicable to the
Judge of the High Court.
(3) The power to grant or refuse leave to the State Election Commissioner and to revoke or
curtail leave granted to him shall vest in the Governor.
6.
Leave encashment.—The State Election Commissioner shall be entitled for leave
encashment as is admissible to the Judge of the High Court:
Provided that when a retired person is appointed as the State Election Commissioner and
has received leave encashment after his superannuation, he shall be entitled for the difference, if
any in accordance with such rules as are applicable to the Judge of the High court.
7.
Other conditions of services.—Save as otherwise provided in these rules, the State
Election Commissioner shall be entitled to such medical facilities, rent free furnished
accommodation or house rent allowance in lieu thereof, telephone facilities, sumptuary allowance,
free conveyance facilities, daily allowance while on tour and LTC as is admissible to the Judge of
the High Court.
8.
Post retirement benefits.—The State Election Commissioner shall be entitled to
receive such post retirement benefits as is admissible to the Judge of the High Court.

9.
Re-appointment.—The State Election Commissioner shall not be eligible for re-
appointment on the expiry of the term specified in rule 4 of these rules.
10. Repeal and savings.—(1) The State Election Commissioner (Conditions of Service)
Rules, 1994 are hereby repealed.
(2) Notwithstanding such repeal, any appointment made or anything done or any action
taken, under the rules so repealed, shall be deemed to have been validly made, done or taken under
the corresponding provisions of these rules.

GAD-B(A)1-5/2013 (Kangra).—Whereas, the Governor of Himachal Pradesh is of the
opinion that it is necessary to do so that in District Kangra a new Sub-Division (Civil) to be known
as “Fatehpur” may be created by excluding the entire Tehsil Fatehpur, having 19 Patwar Circles,
from Sub Division (C) Jawali and 8 Patwar Circles of Tehsil Nurpur from Sub- Division (C)
Nurpur.
Now, therefore, in exercise of the powers conferred by section 6 of the Himachal Pradesh
Land Revenue Act, 1954 (Act No. 6 of 1954) and section 5 of the Registration Act, 1908 (Act No.
16 of 1908) read with sub-section (3) of section-7 of the Code of Criminal Procedure 1973, the
Governor of Himachal Pradesh, in consultation with the High Court of Himachal Pradesh, is
pleased to exclude the entire area of 19 Patwar Circles of Tehsil Fatehpur from Sub Division (C)
