Shimla-2, the 24^th May, 2016

No. EDN-(B)-B(2)-2/2013-II.—In exercise of the powers conferred by proviso to Article

309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the H.P.

Public Service Commission, is pleased to make the following Rules, further to amend the Himachal

Pradesh, Higher Education Department, Post Graduate Teacher Class-III (Non Gazetted)

Recruitment and Promotion Rules, 2010 notified vide Notification No. EDN-A-Kha (3)-3/98

Part-II dated 20.9.2010, namely:--

Short titled and Commencement.—(1) These rules may be called the Himachal

Pradesh Higher Education Department, Post Graduate Teacher, Class-III (Non Gazetted)

Recruitment and Promotion (First Amendment ) Rules, 2016.

(2) These rules shall come into force from the date of publication in the Rajpatra Himachal

Pradesh.

Amendment of Annexure - "A".—In Annexure "A" to the Himachal Pradesh, Higher

Education department, Post Graduate Teacher, Class-III (Non-Gazetted) Recruitment and

Promotion Rules,2010,-

(a) for the existing provisions against column No. 15, the following shall be substituted,

namely:--

"Selection for appointment to the post in case of direct recruitment shall be made on the

basis of viva-voce test, if H.P. Public Service Commission Shimla or other recruiting

authority, as the case may be, so consider necessary or expedient by a written test or

practical test, the standard/syllabus etc. of which will be determined by the Commission or

other recruiting authority, as the case may be.";

(b) for the existing provisions against column 15-A (1)(b) the following shall be

substituted, namely:--

"POST FALLS WITHIN THE PURVIEW OF H.P. PUBLIC SERVICE COMMISSION

SHIMLA:

The Director of Higher Education, Himachal Pradesh after obtaining the approval of the

Government to fill up the vacant posts on contract basis will place the requisition with the

concerned recruiting agency i.e H.P. Public Service Commission Shimla ." ;

No. Fish-A(3)-2/2015.—Whereas, the draft Himachal Pradesh Fisheries (Eighth

Amendment) Rules, 2015 were published in the Rajpatra, Himachal Pradesh on 7th January, 2016,

for inviting objections and suggestions from the general public, vide this Department Notification

of even number dated 18th December, 2015, as required under sub-section (5) of section 3 of the

Himachal Pradesh Fisheries Act, 1976 (Act No. 16 of 1976);

And whereas, no objection(s) or suggestion (s) has been received in this behalf during the

stipulated period;

Now, Therefore, in exercise of the powers conferred by section 3 of the Himachal Pradesh

Fisheries Act, 1976 (Act No. 16 of 1976), the Governor, Himachal Pradesh, is pleased to make the

following rules further to amend the Himachal Pradesh Fisheries Rules, 1979 notified vide this

Department Notification No. Fish- A (3)-1/77, dated 15/11/1979 and published in the Rajpatra,

Himachal Pradesh (Extra-Ordinary) dated the 16th February, 1980, namely:—

Short title and commencement.—(1) These rules may be called the Himachal

Pradesh Fisheries (Eighth Amendment) Rules, 2015.

(2) They shall come into force from the date of their publication in the Rajpatra,

Himachal Pradesh.

Amendment of rule 3.—In rule 3 of the Himachal Pradesh Fisheries Rules 1979,

(hereinafter referred to as the ' said rules'), after clause (v), the following clause (vi) shall be

inserted, namely :—

“ (vi) KOL DAM RESERVOIR:—

Impoundment formed by Koldam upto a level of 646M in the area falling in District of

Bilaspur, Shimla, Solan and Mandi of Himachal Pradesh and it shall be divided into following

supersession of this Department Notification No. PBW(B&R)(B)24(1)91-I dated 5.2.2001, the

Governor, Himachal Pradesh is pleased to direct that the powers of the Director, Town and Country

Planning under sections 30, 30-A, 31, 34, 38, 39, 39-A, 39- B, 39-C, 81 and 83-A of the Himachal

Pradesh Town and Country Planning Act, 1977, (Act No. 12 of 1977) shall be exercised by the

Commissioner, Municipal Corporation, Dharamshala with respect to the Municipal Corporation

Area Dharamshala till further orders. The exercise of the powers shall be subject to the following

conditions:--

1. That the development permission is in accordance with the provisions of the Himachal

Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), Himachal

Pradesh Town and Country Planning Rules, 2014, Regulations contained in the

Development Plan for Dharamshala Planning Area and rules framed in this behalf

issued by the State Government and the Director, Town and Country Planning

Department from time to time. Wherever necessary the Municipal Corporation,

Dharamshala will amend its housing bye-laws to bring them in consonance with the

provisions of Development Plan for Dharamshala Planning Area framed by the Town

and Country Planning Department, Himachal Pradesh.

2. The Municipal Corporation, Dharamshala shall function under the overall control of

the Additional Chief Secretary/Secretary (TCP) to the Government of Himachal

Pradesh in respect of the powers delegated above.
