ORDINANCE No. 1 of 2016.

THE HIMACHAL PRADESH TOWN AND COUNTRY PLANNING

(AMENDMENT) ORDINANCE, 2016.

Promulgated by the Governor of Himachal Pradesh in the Sixty-seventh Year of the

Republic of India.

An Ordinance further to amend the Himachal Pradesh Town and Country Planning Act,

1977 (Act No. 12 of 1977).

WHEREAS, the Legislative Assembly of Himachal Pradesh is not in session and the

Governor is satisfied that circumstances exist which render it necessary for him to take immediate

action;

NOW, THEREFORE, in exercise of the powers conferred by clause (1) of article 213 of the

Constitution, the Governor, Himachal Pradesh is pleased to promulgate the following Ordinance:--

1. Short title, commencement and duration.—(1) This Ordinance may be called the

Himachal Pradesh Town and Country Planning (Amendment) Ordinance, 2016.

(2) It shall come into force on such date as the State Government may, by notification,

appoint.

(3) This Ordinance shall remain in force for a period of one year from the date of its

commencement.

2. Insertion of new section .30-B.(Act No. 12 to 1977.—After section 30-A of the

Himachal Pradesh Town and Country Planning Act, 1977 (herein after referred to as “the

principal Act”), the following section shall be inserted, namely:--

“30-B. Exemption in respect of development of certain lands or buildings.-(1)

Notwithstanding anything contained in the Himachal Pradesh Town and Country

Planning Act, 1977 or any other law for the time being in force, the Government or

any Officer or Authority, vested with the powers of Director, may, on application,

by order, exempt development on any land or building or class of lands or buildings

developed on or before the date of commencement of this Ordinance from all or any

of the provisions of the Himachal Pradesh Town and Country Planning Act, 1977 or

any rule or regulation made thereunder upto such extent and on payment of such

regularization fee as specified under sub-section (8).

(2) The application under sub-section (1) shall be made within forty five days from

the date of commencement of this Ordinance in Appendix-I, which can also be

downloaded from the official website “www.tcphp.in” of the Department and

may be submitted alongwith payment of one thousand rupees which shall be

decided within a period of one year from the date of commencement of this

Ordinance.

(3) After passing of order under sub-section (1), permission shall be deemed to have

been granted for such development of land or building.

(4) Nothing contained in sub-section (1) shall apply to any application made by any

person who does not have any right over the land or building referred to in sub-

section (1).

(5) Any person aggrieved by any order passed under sub-section (1) by any Officer

or Authority may, prefer an appeal to the Appellate Authority within thirty days

from the date of receipt of order. The condition of one year stipulated under

sub-section (2) shall not apply in appeals and such appeals shall be decided by

the Appellate Authority within a period of six months from the date of filing

thereof.

(6) The fee under this section shall be credited to the State Government and

concerned Urban Local Bodies or Special Area Development Authorities

(SADAs) in the ratio of 50:50 and shall be deposited through Treasury

Challan in the Government account and by way of demand draft to the Urban

Local Bodies or Special Area Development Authorities (SADAs)

respectively.

(7) Before grant of exemption under sub-section (1) the following guidelines and

principles shall be kept in view to ensure compliance thereof, namely:-

(a) the buildings shall be regularized on the basis of “as is where is”, provided

30% of the open space is available in the permissible set backs required for

providing basic civic services:

Provided that a structural stability audit shall be mandatory for all kind

of buildings to be regularized, except those buildings which comprises of

two floors and have a built up area not exceeding 150 M², provided such

building is in self occupation for the residential purpose:

Provided further that for number of storeys exceeding two, a structural

stability audit shall be carried out by the Committee(s), to be constituted by

the Director;

(b) deviations and un-authorized constructions shall be measured at each floor

level and regularization fee shall be calculated and paid by the applicant for

each floor accordingly ;

un-authorized constructions in the Green Area and Heritage Area as defined

under Interim Development Plans or Development Plans as notified by the

State Government from time to time;

(d) deviations and un-authorized constructions falling in Green Area and

Heritage Area as delineated in the Interim Development Plans (IDPs) or

Development Plans (DPs) shall be regularized which have taken place

prior to the notification (s) of delineation of such areas;

(e) the exemptions shall also be granted for such buildings, which have been

constructed above the valley view i.e. the buildings which are 1.50 Metre

above the road level;

(f) no fee shall be charged under the Himachal Pradesh Municipal Corporation

Act, 1994 or the Himachal Pradesh Municipal Act, 1994, as the case may

be, in respect of unauthorized construction regularized under this section

after payment of regularization fee;

(g) developments carried out in lands or buildings owned by individuals in

Himachal Pradesh Housing and Urban Development Authority (HIMUDA)

Colonies, where such Colonies are maintained and administered by the

Urban Local Bodies (ULBs), shall be considered for exemption;

(h) developments or constructions carried out without permission or in

deviation to approved plan, if not exempted under this section, shall face

disconnection of services and demolition;

(i) exemption shall not be granted in respect of such buildings or lands for

which competent authorities have already granted relaxations or were

retained under the previous Retention Policies;

(j) the competent authority shall ensure that the roof of buildings to be

exempted and regularized under this section is rendered totally ineffective

for further vertical construction in future;

(k) un-authorized constructions carried out on the area and pockets kept for

parks, sewerage or any other facility in any approved map of sub-division

of land by the competent authorities shall not be regularised;

(l) parking floor(s) as per approved plan, if converted to any other use like

residence or shop etc. shall not be regularized;

(m) no exemption shall be allowed in case the owner has encroached upon any

land owned by the Government or Local Authority or Board or Corporation

or Institution or any Authority constituted under the Himachal Pradesh

Town and Country Planning Act, 1977 or on other’s land; and

(n) no exemption shall be allowed on the land lying below Highest Flood Level

(HFL) as delineated in the Development Plans.

(8) The regularization fee for regularization of deviations and un-authorized

constructions shall be charged as per Table given below:-

(B) The regularization fee as specified under clause (A) of this sub-section shall be

increased by 100% for Commercial, Hotel, Tourism, Industrial or other uses:

Provided that the change of land use fee, as specified under the Himachal Pradesh

Town and Country Planning Rules, 2014, shall be charged separately in addition to the

above specified fee, as the case may be, by the competent authorities.”.
