No. EDN (TE) A (3) 21/2015.—In exercise of the powers conferred by proviso to Article
309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the
Himachal Pradesh Public Service Commission, is pleased to make the Recruitment and Promotion
Rules for the post of Assistant Director (Administration & Accounts), Class-I, (Gazetted) in the
Department of Technical Education, Vocational & Industrial Training, Himachal Pradesh as per
Annexure-‘A’ attached to this notification, namely:--
1. Short title and commencement.— (1) These rules may be called the Himachal
Pradesh Technical Education, Vocational & Industrial Training Department, Assistant Director
(Administrative & Accounts), Class – I (Gazetted) Recruitment and Promotion Rules, 2016.
(2) These rules shall come into force from the date of publication in the Rajparta,
Himachal Pradesh.
2. Repeal & Savings.— (1)The Himachal Pradesh Technical Education, Vocational &
Industrial Training Department, Assistant Director Class–II, (Gazetted) Recruitement & Promotion
Rules, 1997 notified vide this Department notification No. EDN (TE)B (2) 1/1995 dated 21-07-
1997 are hereby repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action
taken under these rules so repealed under sub-rule 2 (1) supra shall be deemed to have been validly

(1) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if
any, prior to regular appointment to the post shall be taken into account towards the
length of service as prescribed in the Recruitment & Promotion Rules subject the
condition that the adhoc appointment/ promotion in the feeder category had been made
after following proper acceptable process of selection in accordance with the
provisions of R&P Rules:
Provided that in all cases where a junior person becomes eligible for consideration
by virtue of his/her total length of service (including the service rendered on adhoc

basis, followed by regular service/appointment) in the feeder post in view of the
provision referred to above, all persons senior to him/her in the respective
category/post /cadre shall be deemed to be eligible for consideration and placed above

Provided that all incumbents to be considered for promotion shall possess the
minimum qualifying service of at least three years or that prescribed in the R & P
Rules for the post, whichever is less:
Provided further that where a person becomes ineligible to be considered for
promotion on account of the requirements of the preceding proviso, the person(s)
junior to him/her shall also be deemed to be ineligible for consideration for such
promotion;
Explanation.—The last proviso shall not render the junior incumbent(s) ineligible for
consideration for promotion if the senior ineligible person(s) happened to be Ex-
Servicemen recruited under the provisions of Rule-3 of the Demobilized Armed Forces
Personnel (Reservation of vacancies in Himachal State Non-Technical Service) Rules,
1972 and having been given the benefit of seniority thereunder or recruited under the
provisions of Rule-3 of the Ex-Serviceman (Reservation of vacancies in the Himachal
Pradesh Technical Services) Rules, 1985 and having been given the benefit of seniority
there-under.
2. Similarly, in all cases of confirmation, adhoc service rendered on the feeder post, if
any, prior to the regular appointment/promotion against such post shall be taken into account
towards the length of service, if the adhoc appointment/promotion had been made after proper
selection and in accordance with the provision of the R&P Rules:
Provided that inter-se-seniority as a result of confirmation after taking into account adhoc
service rendered as referred above shall remain unchanged.
12. If a Departmental Promotion Committee exists, what is its composition?.—
Department Promotional Committee to be presided over by the Chairman, Himachal Pradesh
Public Service Commission or a member thereof to be nominated by him.
13. Circumstances under which the Himachal Pradesh Public Service Commission is
to be consulted in making recruitment.— As required under the Law.
14. Essential requirement for a direct recruitment.—Not applicable.
15. Selection for appointment to post by direct recruitment.—Not applicable.
16 Reservation.— The appointment to the service shall be subject to orders regarding
reservation in the service for Scheduled Castes/Scheduled Tribes/Other Backward Classes/other
categories of persons issued by the Himachal Pradesh Government from time to time.
17. Departmental Examination.—Every member of the service shall pass a departmental
examination as prescribed in the H.P. Departmental Examination Rules, 1997, as amended from
time to time.
18. Power to relax.— Where the State Government is of the opinion that it is necessary or
expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with
the Himachal Pradesh Public Service Commission relax any of the provision(s) of these Rules with
respect to any Class or Category of person(s) or post(s).

233, 234 and proviso to Article 309 of the Constitution of India read with sub-section (1) of
section 4 of the Himachal Pradesh Judicial Officers (Pay, Allowances and Conditions of Service)
Act, 2003 (Act No. 10 of 2003) and all other powers enabling him in this behalf, the Governor
of Himachal Pradesh, in consultation with the High Court of Himachal Pradesh and Himachal
Pradesh Public Service Commission, is pleased to make the following rules further to amend
the Himachal Pradesh Judicial Service Rules, 2004, namely:—
1.
Short title.—These rules may be called the Himachal Pradesh Judicial Service (2nd
Amendment) Rules, 2016.
2.
Amendment of rule-3.—be rule-3 of Rule-3 of the Himachal Pradesh Judicial
Service Rules, 2004 (hereinafter referred to as the "said rules", for sub- rule (3), the following
sub-rule shall be substituted, namely :—
"(3) With effect from the date of commencement of these rules, the existing cadres
specified in column (2) below shall stand designated as the cadres specified in the
corresponding entries in column (1) below and they shall accordingly constitute the
service:—

Amendment of rule-5.—In rule-5 of the said rules, at the end of the Table, the
following provision shall be inserted, namely:—
"Reservation for the persons with disability,—
3% reservation to the categories of the Additional District Judges and Civil
Judges: —
Reservation shall be provided to the candidates:
(a) suffering from blindness of low vision provided that the disability is not 75% and
more,
(b) suffering from hearing impairment, provided that such impairment is not of 60
decibel or more after hearing aid/surgical correction.
(c) suffering from locomotor disability.
(Note: Persons with functional dominant hand can also be considered):

Provided further that the candidate,-

should not have any mental retardation of any degree and major mental illness like
Schizophrenia or affective disorder and chronic psychosis,

Substitution of Table under rule 5.—In rule 5 of the said rules, for the existing

5.
Amendmen t of rule 7.—In rule-7 of the said rules, for sub-rule (2), the following
sub- rules shall be substituted, namely :—
"(2) The selected candidates having a higher qualification like Post Graduation in Law at
the time of entry in service shall be given three advance increments.
(3) The pay of the member of the service shall be fixed where necessary under the
provision of the rules in force in Himachal Pradesh, from time to time, provided
that where the increment of a member is withheld for his failure to pass the
departmental examination, he shall not be entitled before he passes the departmental
examination by the prescribed standard, to the re-fixation of pay on the basis of
enhancement in his substantive or officiating pay the time scale of the post held by
him prior to his appointment to the service. However, during this period he may be
allowed his substantive pay from time to time if the same happens to be more than his
officiating pay in the service.".
6.
Amendmen t of rule 14.—For rule-14 of the said rules, the rule shall be substituted,
namely:—
"14. Age of superannuation:—The age of superannuation of a member of the service
shall be 60 (sixty) years.
Provided that before the completion of 58 (fifty eight) years, service record of the
officer will be evaluated and his suitability, potential and fitness for being retained in
service upto the age of 60 (sixty) years shall be determined and in case he is not found
suitable and fit, he shall be compulsorily retired at the age of 58 (fifty eight) years.".

Pradesh Essential Services (Maintenance) Act, 1973 (Act No-5 of 1973), the Governor of Himachal
Pradesh, in order to ensure public safety, the maintenance of public order or services necessary for
the life of community, hereby declare that the Himachal Pradesh Road Transport Corporation
Services (Transport Services) shall be an employment to which the provisions of the aforesaid Act
shall apply with immediate effect.
The Governor, Himachal Pradesh, in exercise of powers conferred by section 4 of the Act
ibid, is further pleased to authorize and direct the Secretary (Transport) to order that any person or
persons engaged in the employment of Himachal Road Transport Corporation shall not depart out
of such area or areas as may be specified in such order.
The Governor of Himachal Pradesh, in exercise of powers conferred by sub-section (3) of
section 7 of Act ibid, is further pleased to authorize the Managing Director, Himachal Road
