No FFE-A(B)2-6/2014.—In exercise of the powers conferred by proviso to Article 309 of

theConstitution of India, the Governor, Himachal Pradesh is pleased to make the Recruitment and

Promotion Rules for the post of Multipurpose Worker (MPW), Class-IV (Non-Gazetted)

Ministerial Services, in the Department of Forests, Himachal Pradesh as per Annexure-‘A’

Attached to this notification, namely :-

1. Short title and Commencement.—1. These rules may be called the Himachal

Pradesh, Forest Department, Multipurpose Worker (MPW), Class-IV (Non-Gazetted) Recruitment

and Promotion Rules, 2016.

2. These rules shall come into force from the date of publication in the Rajpatra,

Himachal Pradesh.

ANNEXURE-‘A’

RECRUITMENT AND PROMOTION RULES FOR THE POST OF MULTIPURPOSE

WORKER, CLASS-IV (NON GAZETTED) IN THE DEPARTMENT OF FORESTS, H.P.

Name of the post.—Multipurpose Worker

Number of posts .—50 (Fifty)

Classification.—Class-IV (Non Gazetted)

4. Scale of Pay.— (i) Pay band for regular incumbents.— Rs. 4900-10680+ Rs. 1300/-

Grade pay.

(ii) Emoluments for contract employees.—Rs. 6200/- as per details given in Col. 15-A.

5. Whether “Selection or Non- Selection post”.—Not applicable

6. Age for direct recruitment.—Between 18 and 45 years

Provided that the upper age limit for direct recruits will not be applicable to the candidates

already in service of the Government including those who have been appointed on ad-hoc or on

contract basis:

Provided further that if a candidate appointed on ad-hoc basis or on contract basis had

become over-age on the date when he/she was appointed as such he/she shall not be eligible for any

relaxation in the prescribed age limit by virtue of his/her such ad-hoc or contract appointment :

Provided further that upper age limit is relaxable for Scheduled Castes/ Scheduled Tribes/

Other categories of persons to the extent permissible under the general or special order(s) of the

Himachal Pradesh Government:

Provided further that the employees of all the Public Sector Corporations and Autonomous

Bodies, who happened to be Government Servants before absorption in Public Sector Corporations/

Autonomous Bodies at the time of initial constitution of such Corporations/ Autonomous Bodies

shall be allowed age concession in direct recruitment as admissible to Government servants. This

concession will not, however, be admissible to such staff of the Public Sector Corporations/

Autonomous Bodies who are/were subsequently appointed by such Corporations/ Autonomous

Bodies and who are/were finally absorbed in the service of such Corporations/ Autonomous Bodies

after initial constitution of the Public Sector Corporations/ Autonomous Bodies.

(i) Age limit for direct recruitment will be reckoned on the first day of the year in which

the post(s) is/ are advertised for inviting applications or notified to the Employment

Exchanges, as the case may be.

(ii) Age and experience in the case of direct recruitment relaxable at the discretion of the

Recruiting Authority in case the candidate is otherwise well qualified.

7. Minimum Educational & other Qualification required for direct recruit(s).—(a)

Essential Qualifications.—(i) He /She should be 8th pass from an Institute recognized by the

Government of HP.

(ii) He/She must have an experience in Gardening for one year

He/She should have experience of housekeeping/ cooking for at least one year

(b) Desirable Qualification.—Knowledge of customs, manners and dialects of Himachal

Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

Whether age and Educational Qualification(s) prescribed for Direct recruit(s)

will apply in case of the promotee(s).— Age.— Not applicable.

Educational Qualification.— Not applicable

9. Period of probation, if any.—Two years subject to such further extension for a period

not exceeding one year as may be ordered by the competent authority in special

circumstances and reasons to be recorded in writing.

10. Method of recruitment, whether by direct recruitment or by promotion,

secondment, transfer and the percentage of posts, to be filled in by the various methods.—

100% by direct recruitment on a regular basis or by recruitment on contract basis, as the case may

be, failing which by transfer.

11. In case of recruitment by promotion, secondment, transfer, grades from which

promotion/ secondment/ transfer is to be made.— By transfer from amongst the Class-IV

officials, with 2 years regular service in the grade, working in the identical pay scale of this post

strictly on the basis of inter-se seniority.

12. If a Departmental Promotion Committee exists, what is its composition?.— Not

applicable.

13. Circumstances under which the H.P.P.S.C. is to be consulted in making

recruitment.—As required under the Law.

14. Essential requirement for direct recruitment.—A candidate for appointment to any

service or post must be a citizen of India.

15. Selection for appointment to the post by direct appointment.—Selection for

appointment to the post of direct recruitment shall be made on the basis of vivavoce test if the

recruiting authority, so consider necessary or expedient by a written test or practical test, the

standard syllabus etc. of which, will be determined by the recruitingauthority.

15-A Selection for appointment to the post by contract appointment.—

Notwithstanding anything contained in these rules, contract appointment to the post will be made

subject to the terms and conditions given below:-

(I) Concept .—(a) Under this policy, the Multipurpose Worker in Forest Department

HP will be engaged on contract basis initially for one year which may be extendable year-to-year

basis :

Provided that for extension/ renewal of contract period on year-to-year basis, the concerned

HOD shall issue a certificate thatm the service and conduct of the contract appointee is satisfactory

during the year and only then his period of contract is to be renewed/extended.

(b) Post falls outside the purview of the HPPSC/ HPSSSB.—The Conservator of

Forests of concerned circle after obtaining approval of the Government to fill up vacant posts under

direct recruitment on contract basis will advertise the details of the vacant posts in at least two

leading newspapers and invite applications from candidates having the prescribed qualifications

and fulfilling the other eligibility conditions as prescribed in these Rules.

R&P Rules.

II. Contractual Emoluments.—The Multipurpose Worker appointed on contract basis

will be paid consolidated fixed contractual amount @ Rs. 6200/- per month(which shall be equal to

the minimum of the pay band + Grade pay of the post). An amount of Rs 190/- (3% of the

minimum of pay band+grade pay of the post) as annual increase in contractual emoluments for the

subsequent year(s) will be allowed if contract is extended beyond one year.

III. Appointing/Disciplinary Authority.—The Divisional Forest Officer of the concerned

Division will be the Appointing and Disciplinary Authority.

IV. Selection Process.—Selection for appointment to the post, in the case of contract

appointments, will be made on the basis of viva-voce test or if considered necessary by written test

or practical test, the standard/ syllabus etc. of which will be determined by the concerned

Recruiting Agency i.e. Forest Department.

V. Committee for Selection of Contractual Appointments.—For selection of the

contractual appointees there shall be a Circle wise Selection Committee constituting of the

following:-

(i)

Conservator of Forests --- Chairman

(ii) Divisional Forest Officer --- Member

(iii) Divisional Forest Officer/ --- Member

Assistant Conservator of Forests.

VI) Agreement.—After selection of a candidate, he/she shall sign an agreement as per

Annexure-‘B’ appended to these Rules.

VII Terms and Conditions .—(a) The contractual appointee will be paid fixed

contractual amount of Rs. 6200/-per month (which shall be equal to the minimum of the pay band +

grade pay of the post). The contract appointee will be entitled for increase in contractual amount @

Rs. 190/- (3% of the minimum of pay band+grade pay of the post) for further extended years and

no other allied benefits such as seniority/selection scale etc. will be given.

(b) The service of the contract appointee will be purely on temporary basis. The

appointment is liable to be terminated in case the performance/ conduct of the contract appointee is

not found satisfactory.

Provided that the un-availed Casual Leave, Medical Leave and Special Leave can be

(d) Unauthorized absence from the duty without the approval of the Controlling Officer

shall automatically lead to the termination of the contract. However, in exceptional cases where the

circumstances for unauthorized absence from duty were beyond his/her control on medical

grounds, such period shall not be excluded while considering his/her case for regularization but the

incumbent shall have to intimate the controlling authority in this regard well in time. However,

Contract Appointee shall not be entitled for contractual amount for the period of absence from

duty:

Provided that contract appointee shall submit the certificate of illness/fitness issued by the

Medical Officer, as per prevailing instructions of the Government.

(e) An official appointed on contract basis who has completed three years tenure at one

place of posting will be eligible for transfer on need based basis wherever required on

administrative grounds.

(f) Selected candidate will have to submit a certificate of his/her fitness from a

Government/ Registered Medical Practitioner. Women candidate pregnant beyond 12 weeks will

stand temporarily unfit till the confinement is over. The women candidate will be re-examined for

the fitness from an authorized Medical Officer/ Practitioner.

(g) Contract appointee will be entitled to TA/ DA if required to go on tour in connection

with his/her official duties at the same rate as applicable to their regular counterpart official at the

minimum of the pay scale.

(h) Provisions of service Rules like FR, SR, Leave Rules, GPF Rules, Pension rules and

Conduct Rules etc. as are applicable in case of regular employees will not be applicable in the case

of Contract Appointees. They will be entitled for emoluments etc. as detailed in this column.

16. Reservation.— The appointment to the service shall be subject to orders regarding

reservation in the service for Scheduled Caste/Scheduled Tribe/Other Backward Classes/other

categories of persons issued by the Himachal Pradesh Government from time to time.

17. Department Examination.— Not applicable

18. Power to Relax.—Where the State Government is of the opinion that it is necessary or

expedient to do so, it may, by order for reasons to be recorded in writing relax any of the provisions

of these Rules with respect to any class or category of person(s) or post(s).

1. That the FIRST PARTY shall remain in the service of the SECOND PARTY as a

Multipurpose Worker on Contract basis for a period of one year commencing on day of

_________ and ending on the day of _______. It is specifically mentioned and agreed

upon by both the parties that the contract of the FIRST PARTY with SECOND

PARTY shall ipso-facto stand terminated on the last working day i.e. on _______ and

information notice shall not be necessary:

Provided that for further extension/renewal of contract period on year to year basis the

concerned HOD shall issue a certificate that the service and conduct of the contract

appointee was satisfactory during the year and only then the period of contract is to be

renewed/ extended.

Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh,

Public Service Commission, is pleased to make the Recruitment and Promotion Rules for the post of

Reeling Demonstrator, Class-III (Non-Gazetted), in the Department of Industries. Himachal Pradesh as

per Annexure-A attached to this notification, namely:—

1. Short title and commencement.—(I) These rules may be called the Himachal Pradesh

Department of Industries, Reeling Demonstrator, Class-III (Non-Gazetted) Recruitment and Promotion

Rules, 2016.

(II) These rules shall come into force from the date of publication in the Rajpatra, Himachal

Provided further that upper age limit is relaxable for Scheduled Castes/ Scheduled Tribes/ Other

categories of persons to the extent permissible under the general or special order(s) of the Himachal

Pradesh Government:

Provided further that the employees of all the Public Sector Corporations and Autonomous

Bodies who happened to be Government Servants before absorption in Public Sector Corporations/

Autonomous Bodies at the time of initial constitution of such Corporations/ Autonomous Bodies shall

be allowed age concession in direct recruitment as admissible to Government servants. This concession

will not, however, be admissible to such staff of the Public Sector Corporations/ Autonomous Bodies

who were/are subsequently appointed by such Corporations/ Autonomous Bodies and who are/were

finally absorbed in the service of such Corporations/ Autonomous Bodies after initial constitution of the

Public Sector Corporations/ Autonomous Bodies.

(1) Age limit for direct recruitment will be reckoned on the first day of the year in which the

Post(s) is/ are advertised for inviting applications or notified to the Employment

Exchanges or as the case may be.

(2) Age and experience in the case of direct recruitment, relaxable at the discretion of the

recruiting authority in case the candidate is otherwise well qualified:

Minimum educational and other qualifications required for direct recruits.—(a)

Essential Qualification.— B.E./B.Tech. Degree or Diploma of atleast 03 years duration in Textile

Technology from an institution duly recognized by the Himachal PradeshGovernment/ Central

Government.

(b) Desirable Qualifications.—(i) Certificate or Capsule Course in silk reeling technology

from Govt. recognized institution.

(ii) Post Degree/ Diploma working experience of at-least one year in Govt. registered silk

reeling unit.

(iii) Knowledge of customs, manners and dialects of Himachal Pradesh and suitability for

appointment in the peculiar condition prevailing in the Pradesh.

13. Circumstances under which the Himachal Pradesh Public Service Commission is to

be consulted in making recruitment.—As required under the Law.

14. Essential requirement for a direct recruitment.—A candidate for appointment to any

service or post must be a citizen of India.

15. Selection for appointment to the post by direct appointment.—Selection for

appointment to the post in the case of direct recruitment shall be made on the basis of viva-voce test if

the recruiting authority so consider necessary or expedient by a written test or practical test, the

standard/ syllabus, etc. of which, will be determined by the recruiting authority.

15-A. Selection for appointment to the post by contract appointment.—Notwithstanding

anything contained in these Rules contract appointments to the post will be made subject to the terms

and conditions given below:-

CONCEPT :

(a) Under this policy the Reeling Demonstrator in the Department of Industries, H.P. will be

engaged on contract basis initially for one year, which may be extendable on year to year

basis :

Provided that for extension/renewal of contract period on year to year basis the concerned

HOD shall issue a certificate that the service and conduct of the contract appointee is

satisfactory during the year and only then his/her period of contract is to be renewed/extended.

(b) POST FALLS WITHIN THE PURVIEW OF HPSSSB:—

The Director of Industries, H.P. after obtaining the approval of the Government to fill up the

vacant posts on contract basis will place the requisition with the concerned recruiting agency i.e.

Himachal Pradesh Subordinate Service Selection Board, Hamirpur.

CONTRACTUAL EMOLUMENTS :

The Reeling Demonstrator appointed on contract basis will be paid consolidated fixed

contractual amount @ Rs. 8310/-- per month. (which shall be equal to minimum of the pay band +grade

pay). An amount of 249/- (3% of the minimum of the pay band+grade pay of the post) as annual

increase in contractual emoluments for thesubsequent year(s) will be allowed if contract is extended

beyond one year.

(III)

APPOINTING/ DISCIPLINARY AUTHORITY :

The Director of Industries, H.P. will be the appointing and disciplinary authority.

(IV)

SELECTION PROCESS:

Selection for appointment to the post in the case of contract appointment will be made on the

After selection of a candidate, he/she shall sign an agreement as per Annexure-B appended to

these rules.

(VII) TERMS AND CONDITIONS:

(a) The Contract Appointee will be paid fixed contractual amount @ 8310/- per month (which

shall be equal to minimum of the pay band+grade pay). The contract appointee will be

entitled for increase in contractual amount @ 249/- (3% of the minimum of the pay

band +grade pay of the post) for further extended years and no other allied benefits such as

senior/ selection scales etc. will be given.

(b) The service of the Contract Appointee will be purely on temporary basis. The appointment

is liable to be terminated in case the performance/conduct of the contract appointee is not

found satisfactory.

Provided that he/she shall submit the certificate of illness/fitness issued by the Medical

Officer, as per prevailing instructions of the Government.

(e) An official appointed on contract basis who has completed three years tenure at one place

of posting will be eligible for transfer on need based basis wherever required on

administrative grounds.

(f) Selected candidate will have to submit a certificate of his/her fitness from a Govt./

Registered Medical Practitioner. Women candidate pregnant beyond twelve weeks will

stand temporarily unfit till the confinement is over. The women candidate will be re-

examined for the fitness from an authorized Medical Officer/ Practitioner.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection with

his/her official duties at the same rate as applicable to Regular counterpart officials at the

minimum of pay scale.

(h) Provisions of service rules like FR SR, Leave Rules, GPF Rules, Pension Rules & Conduct

Rules etc. as are applicable in case of regular employees will not be applicable in case of

contract appointees. They will be entitled for emoluments etc. as detailed in this column.

16. Reservation.—The appointment to the service shall be subject to orders regarding

reservation in the service for Scheduled Castes/ Scheduled Tribes/Other Backward Classes / other

TERMS :

The Member of the Committee will be honorary and will work without any remuneration

from the Committee. An official member of Committee, when required to attend a meeting of the

Committee in any capacity may claim his traveling expenses from the State Government. A non-

official member may claim traveling expenses in view of the terms and conditions annexed as

Annexure A.

FUNCTIONS AND DUTIES :

The Committee will be advisory and consultative body and would act as a connecting link

between the port Haj Committee, Mumbai and ‘Hajji’s friends’. Its main duties will be:—

(i) To collect and disseminate information useful to intending pilgrims;

(ii) To appoint ‘Hajji’s Friends’ and Sub-Committee in Districts;

(iii) To advise and assist intending pilgrims in all matters including inoculation,

Vaccinations, medical inspection, issue of Pilgrim passes, depositing advance, and to

cooperate with the local authorities concerned in such matters;

(iv) To negotiate and co-operate with railway authorities for the purpose of traveling

facilities for pilgrims;

(v) To bring the grievances of the pilgrims of the notice of the authorities concerned and to

suggest remedies, and;

(vi) To do such other things which they consider would help intending Haj Pilgrims in their

pilgrimage to Haj.

MEETING :

The committee shall meet from time to time as the Chairperson or the Member Secretary

may determine subject to the condition that as far as possible it will meet twice in a year before the

Haj day and once after the Haj is over. The date of the meeting will be fixed by the Member

Secretary in consultation with the Chairperson. The notice of the time and place of the meeting and

agenda will be drawn-up by the Member Secretary and will be issued to such members at least 10

days in advance. The number of members required to make a quorum at any meeting of the State

Committee shall be one-third of its members. If at any meeting it is deemed necessary to transact

the business on the agenda, the meeting will not be postponed.

The term of the Committee will be three years.

The Headquarters of the Committee shall be at Shimla.

CHANGE OF RULES :

The Himachal Pradesh State Haj Committee has been constituted on the pattern of the

Central Government ‘The Haj Committee Act, 2002 (No. 35 of 2002). Therefore, in case, any

doubt arise on any point, the proposal for clarification or change of rules of the aforesaid provision

may be submitted for consideration to the State Government.

ANNUAL REPORT

A brief on the work of the Committee and of any organization that may be established under

its control will be communicated annually, six months after the Haj day, for the information of the

Government of India.

Travelling Allowance:-

(a)

Journey by rail:

They will be treated at par with government servants of the first grade, and will be entitled

to actual rail fare of the class of accommodation actually used but not exceeding the fare in which

the Government servants of the first grade are normally entitled.

(b)

Journey by road:

They will be entitled to actual fare travelling by taking single seat in a public bus, and if the

journey is performed by Motorcycle/ Scooter, with in Himachal Pradesh and outside. Himachal

Pradesh mileage allowance at @ Rs. 2.00 per Km., or if journey is performed by full taxi/ own Car,

the Chairperson / Members will be entitled to mileage allowance at @ Rs. 8.00 per Km. within

Himachal Pradesh and outside Himachal Pradesh as decided by Finance Department from time to

time.

Daily allowance:

1. A member shall draw daily allowance for the entire absence from his permanent place

of residence beginning with departure from the place and ending with return to that

place at the rate applicable to Grade-I Officers of the State Government.

2. He shall draw allowance for each day of the meeting at the highest rates as admissible

to Government servant of the first grade for the respective locality.

3. In addition to daily allowance for the day(s) of the meeting , a member shall also be

entitled to daily allowance for halt on tour and out station in connection with the affairs

of the Committee as under:—

(a) It the absence from headquarters Nil dose not exceed 6 hours.

(b) If the absence from headquarters exceeds 70% 6 hours but not exceed 12 hours.

Conveyance allowance:

A member, who resides at a place where the meeting of the Committee is held, will not be

entitled to travelling and daily allowance on the scales indicated above, but will be allowed only the

actual cost of conveyance hire, subject to a maximum of Rs. 20% per day. Before the claim as may

be considered necessary Officer himself obtaining such details as may be considered necessary, that

the actual expenditure was not less than the amount claimed.

If such a member uses his own car, he will be granted mileage allowance, at the rates

admissible to Officers of the first grade subject to a maximum Rs. 20/- per day.

4. The member will be eligible for travelling allowance for the journey actually

performed in connection with the meeting of the Committee, from and to the place of their

permanent residence to attend a meeting of the Committee or return to the place than the place of

his permanent residence after the conclusion of the meeting. Travelling allowance shall be worked

out on the basis of the distance actually travelled or the distance between the place of permanent

residence and the venue of the meeting whichever is less.

5. The provision of rules 4.17 and 6.17 and 6.1 of the Himachal Pradesh treasury Rules

will apply mutatis-mutandis in the case of over payment made on account of travelling allowance

to non-official members.

6. Official Members:

The Official members shall be entitled to the travelling and daily allowance admissible to

them according to the rules governing them.

Ind-II(F)11-2/2007-I.—he Governor, Himachal Pradesh is pleased to exclude boilers from

certain provisions of the Boilers Act, 1923 for the rapid industrialization of State.

Now, therefore, in exercise of the powers conferred by sub-section (3) of section 34 of the

Boilers Act, 1923 (No. 5 of 1923), the Government of Himachal Pradesh hereby excludes boilers

which have been installed or which will be installed in future from the operation of the provision of

Section 7,8,9,10,11,12,13,14,15,16,17,18,19,20,20-A,21,22 and section 23 subject to the following

conditions, namely:—

(1) Before the use of boiler, the owner of the boiler may apply to the General Manager,

District Industries Centre of the concerned district along with the following documents to have the

boiler registered—

(a) As per the provisions of clause (c) of sub-section (1) of section 14 of the Boilers Act,

1923, all necessary documents as provided in regulation 4 of the Indian Boiler

Regulations 1950 along with the applications for registration of the Boiler.

(b) A certificate from the “Boiler Engineer” with regard to the boiler for the period and

maximum pressure for which it can be safely used.

“Boiler Engineer” shall be a person:—

(i) Who is a graduate in graduate in Mechanical or Production or Power Plant or

Metallurgical Engineering from a recognized institution;

(ii) has a minimum five years experience singly or cumulatively in the following

fields related to boilers,-

(I) Design;

(II) Manufacture;

(III) Commissioning;

(IV) Operation and maintenance;

(V) Inspection and certification during manufacture or operation and

(iii) Is registered with DIC as a “Boiler Engineer”

(2) Thereafter, an annual certificate from “Boiler Engineer”, as given below shall be

submitted to the “DIC” with regard to that boiler mentioning the pressure at which it can be safely

used for a further period of 12 months.

regulations framed thereunder and shall be liable and responsible for any act or omission or

commission committed against the provision of said Act, rules & regulations, including

deregistration as “Boiler Engineer”.

(5) If the owner of boiler violates any provision of the Boilers Act, 1923, regulations and

rules framed there under or any of the above provisions, in addition to penal provisions in the

Boilers Act, 1923, a penalty of Rs. 5000 shall be imposed on him. For any subsequent offence,

besides penalty of Rs 5000, penalty of Rs. 500/- per day shall be additionally imposed and/ or

restriction can be imposed on the use of boiler. The General Manager, DIC shall be competent to

impose the penalty or stop the use of the boiler. The owner may file an appeal with the Director

Industries within 30 days of the order passed by the General Manager DIC whose orders shall be

final.
