further to amend the Himachal Pradesh Municipal Corporation Act, 1994 (Act No. 13 of

1994).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-seventh Year

of the Republic of India as follows :—

Short title and commencement.— (1) This Act may be called the Himachal Pradesh

Municipal Corporation (Second Amendment) Act, 2016.

(2) It shall be deemed to have come into force on 4^th day of October, 2016.

Amendment of section 6.—In section 6 of the Himachal Pradesh Municipal

Corporation Act, 1994, in clause (a), in the proviso, for the words “twenty five”, the words “thirty

seven” shall be substituted.

Repeal of H.P. Ordinance No. 4 of 2016 and savings.— (1) The Himachal Pradesh

Municipal Corporation (Second Amendment) Ordinance, 2016 is hereby repealed.

(2) Notwithstanding such repeal any action taken or any thing done under the Ordinance

so repealed shall be deemed to have been done or taken under the corresponding provisions of this

Act.

STATEMENT OF OBJECTS AND REASONS

Section 6 of the Himachal Pradesh Municipal Corporation Act, 1994 (Act No. 13 of 1994)

provides for delimitation of wards for the purpose of election of Councillors in the Municipal

Corporation including maximum number of seats to be filled by election. Presently, there is a

provision to make a maximum of twenty five wards in a Municipal Corporation and population in

each ward shall not be less then 3000. Now, it is seen that in many wards, the population has

increased many folds. It is difficult for an elected councillor to cater to the demands and need of

such high numbers, therefore, in order to ensure proper civic amenities, balanced growth and

people’s participation, the maximum number of wards are required to be increased. Present tenure

of the Municipal Corporation, Shimla is going to expire in the month of May, 2017 and a period of

around eight months is required by the Deputy Commissioner/State Election Commission for

delimitation/reorganization of wards so that all pre- election formalities are completed.

Since, the Himachal Pradesh Legislative Assembly was not in session and the Himachal

Pradesh Municipal Corporation Act, 1994 (Act No. 13 of 1994) had to be amended urgently,

therefore, the Governor, Himachal Pradesh, in exercise of the powers under clause (1) of article 213

of the Constitution of India promulgated the Himachal Pradesh Municipal Corporation (Second

Amendment) Ordinance, 2016 (Ordinance No. 4 of 2016) on 4^th day of October, 2016 and the same

was published in the Rajpatra, Himachal Pradesh on the same day. Now, the said Ordinance is

required to be replaced by a regular enactment.

This Bill seeks to replace the aforesaid Ordinance without any modification.

further to amend the Himachal Pradesh Transfer of Land (Regulation) Act, 1968 (Act No.

15 of 1969).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-seventh Year

of the Republic of India as follows :—

Short title.— This Act may be called the Himachal Pradesh Transfer of Land

(Regulation) Amendment Act, 2016.

Amendment of section 3.—In section 3 of the Himachal Pradesh Transfer of Land

(Regulation) Act, 1968, in sub-section (1),—

(a) in second proviso, in clause (b), after the words and sign “for securing loan, to any”,

the words and signs “Nationalized Commercial Bank or to any Co-operative Bank,

having its headquarter within the State or to any” shall be inserted. ; and

(b) in third proviso, for the words, sign and figures “Land Acquisition Act, 1894”, the

words, signs and figures “the Right to Fair Compensation and Transparency in Land

Acquisition, Rehabilitation and Resettlement Act, 2013” shall be substituted.

STATEMENT OF OBJECTS AND REASONS

The Himachal Pradesh Transfer of Land (Regulation) Act, 1968 regulates the transfer of

land in the State of Himachal Pradesh in the interest of persons belonging to Scheduled Tribe.

Further second proviso to sub-section (1) of section 3 of the Act allows mortgage of land by

such persons for securing loan from Co-operative Land Mortgage Bank or any Co-operative

Societies, all members of which belong to Scheduled Tribe but persons belonging to such

community can not mortgage their land for securing loan from any Nationalized Commercial

Bank or Co-operative Bank of the State. In case, such person intends to secure loan from any

Nationalized Commercial Bank or Co-operative Bank of the State, he will have to meet the

requirements of sub-section (1) of section 3 of the Act. For obtaining approval of the State

Government under section 3 (1), a person belonging to Scheduled Tribe has to follow the

procedure specified under the Act ibid and the rules made thereunder which is time consuming

and causes great inconvenience. Even Scheduled Banks are also facing great hurdle in

extending credit facilities to the members of such community in the State due to this provision.

Thus, in order to overcome this difficulty, it has been decided to make suitable amendments in

the Act ibid so that the members of Scheduled Tribe community may be able to secure loan from

STATEMENT OF OBJECTS AND REASONS

Section 3 of the Himachal Pradesh Electricity (Duty) Act, 2009 provides for levy of

electricity duty on consumption or supply of energy in the manner specified therein, but in case of

consumers availing short term open access facility and availing power from Indian Energy

Exchange (IEX), the computation of electricity duty is not feasible in percentage terms as the

Indian Energy Exchange (IEX) rates varies from day to day basis and many times in the same day

over different time slots resulting into loss of revenue to the State Exchequer. Thus, in order to

overcome this problem, it has been decided to levy electricity duty on the consumers availing short

term open access facility and availing power from Indian Energy Exchange (IEX) at a fixed rate @

51 paise per Kwh instead of percentage terms by making suitable amendments in the Act. This has

necessitated amendment in the Act ibid.

This Bill seeks to achieve the aforesaid objective.

(Act No. 9 of 2010).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-seventh Year

of the Republic of India as follows :—

Short title and commencement.— (1) This Act may be called the Himachal Pradesh

Tax on Entry of Goods into Local Area (Second Amendment) Act, 2016.

(2) It shall be deemed to have come into force on 1^stday of September, 2016.

Amendment of section 3.—In section 3 of the Himachal Pradesh Tax on Entry of

Goods into Local Area Act, 2010 (hereinafter referred to as the “principal Act”), in sub-section (4),

in clause (ii), after the words and signs “of Schedule-II”, the words and signs “when such goods

are used in manufacturing, processing, conversion, job-work, assembling, packing or captive

generation of power” shall be inserted.

3. Amendment of section 8.—In section 8 of the principal Act, after sub-section (2), the

following proviso shall be inserted, namely :—

“Provided that no set off shall be available on goods mentioned at serial No.1(a) of

Schedule-II when such goods are used in manufacturing, processing, conversion, job-work,

assembling, packing or captive generation of power.”.

Repeal of H.P. Ordinance No. 3 of 2016 and savings.— (1) The Himachal Pradesh

Tax on Entry of Goods into Local Area (Second Amendment) Ordinance, 2016 is hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the Ordinance

so repealed shall be deemed to have been done or taken under the corresponding provisions of this

Act.

It was proposed to exclude diesel and lubricants from set off on goods which were brought

into the State and on which VAT had been paid or would become payable by way of amending

clause (ii) of sub-section (4) of section 3 of the Himachal Pradesh Tax on Entry of Goods into

Local Area Act, 2010. This was done with the intention to discourage the purchase of diesel and

lubricants by manufacturers from outside the State as the manufacturers buying diesel within the

State were at a disadvantage vis-a-vis the manufacturers buying diesel from outside the State. In

addition, the State was also losing revenue on this account. Accordingly the Himachal Pradesh Tax

on Entry of Goods into Local Area (Amendment) Act, 2016 (Act No.11 of 2016) was enacted.

However, inadvertently the implications of the same on the business of petrol pump owners and

dealers dealing in sale of lubricants after purchasing these items from outside the State was

overlooked. On account of this amendment such Petrol Pump owners and dealers dealing in

lubricants for sale also became liable to pay Entry Tax thereby leading to cost escalation. This

could further lead to diversion of trade thereby causing huge loss of revenue to the State

exchequer. Thus, in order to overcome this disadvantageous situation it was decided to promulgate

an Ordinance and further to amend sections 3 and 8 of the Act ibid.

Since, the Legislative Assembly was not in session and the amendment in the Himachal

Pradesh Tax on Entry of Goods into Local Area Act, 2010 had to be made urgently, therefore, His

Excellency the Governor, Himachal Pradesh, in exercise of powers under article 213 (1) of the

Constitution of India promulgated the Himachal Pradesh Tax on Entry of Goods into Local Area

(Second Amendment) Ordinance, 2016 (Ordinance No. 3 of 2016) on 06-09-2016 which was

published in the Rajpatra, Himachal Pradesh on 07-09-2016. Now, the said Ordinance is being

replaced by a regular legislation without any modification.

This Bill seeks to achieve the aforesaid objectives.

further to amend the Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12 of 2005).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-seventh Year

of the Republic of India as follows :—

Short title.—This Act may be called the Himachal Pradesh Value Added Tax (Second

Amendment) Act, 2016.

Amendment of section 56.—In section 56 of the Himachal Pradesh Value Added Tax

Act, 2005, in sub-section (3),—

(a) in clause (i) at the end, for the word “and” the word “or” shall be substituted. ; and

(b) after proviso to clause (j), the following new clause (k) shall be inserted, namely :—

“(k) of any such particulars in respect of any such statement, return, accounts,

document, evidence, affidavit or deposition for the purpose of sharing of

information with the Central Board of Excise and Customs, Department of

Revenue, Ministry of Finance, Government of India in pursuance of

Memorandum of Understandings executed between the State Government and

the Central Board of Excise and Customs :

Provided that the State Government may in revenue interest allow sharing of

information of any such particulars in respect of any such statement, return, accounts,

document, evidence, affidavit or deposition with any other Department of the State or

the Central Government.”.

STATEMENT OF OBJECTS AND REASONS

The Central Board of Excise and Customs, Department of Revenue, Ministry of Finance,

Government of India has proposed an institutionalized data sharing mechanism through use of

Memorandum of Understandings. Such a non-intrusive data sharing mechanism would be an

effective tool to profile business entities common to both the Central Board of Excise and Customs

and the Department of Excise and Taxation, Himachal Pradesh. Such initiatives on similar lines

have already been taken by some other States. The benefits of such an exchange have also been

spelt out and it has also been informed that the States of Delhi, Rajasthan and Tamil Nadu have

already entered into similar Memorandum of Understandings. Further, it will also be in the

revenue interest of the Government, if such, a non-intrusive data sharing mechanism is also adopted

to share information with other departments of the State and the Central Government. There is no

doubt that such arrangement would be highly beneficial to the organizations and will lead to higher

and effective realization of revenue. Thus, in order to implement such data sharing mechanism

through use of Memorandum of Understandings, it has been decided to make enabling provisions

in the Himachal Pradesh Value Added Tax Act, 2005. This has necessitated amendment in the Act

ibid.

The Bill seeks to achieve the aforesaid objectives.
