amendment in the Himachal Pradesh Electricity Regulatory Commission (Renewable Power

Purchase Obligation and its Compliance) Regulations, 2010, namely:—

REGULATIONS

Short title and commencement.—(1) These regulations may be called the Himachal

Pradesh Electricity Regulatory Commission (Renewable Power Purchase Obligation and its

Compliance) (Third Amendment) Regulations, 2017.

(2) These regulations shall come into force at once.

Amendment of Regulation 4.—For the existing Regulation 4 of the Himachal

Pradesh Electricity Regulatory Commission (Renewable Power Purchase Obligation and its

Compliance) Regulations, 2010 (hereinafter called “ the said regulations”), the following

Regulation 4 shall be substituted, namely:—

“4.Quantum of Renewable Power Purchase Obligation (RPPO):—

(1) The distribution licensee shall, during each financial year, purchase such quantum of

electricity (in kWh) from renewable sources as is not less than the quantum of electricity (in kWh),

worked out as per the Table below:—

The RPPO will be on total consumption of electricity by an obligated entity, excluding

consumption met from hydro-electric sources of power.

Provided that for computing the Renewable Power Purchase Obligation (RPPO) of the

distribution licensee for a year under this sub-regulation, the following conditions shall also apply,

namely:—

(i) the total consumption of the distribution licensee for a year shall include the quantum

of electricity purchased, alongwith electricity generated, by itfrom various sources,

including the power purchased under REC mechanism for meeting its requirement for

consumption of electricity, and shall also include the transmission and distribution

losses, within the area of distribution licensee, for meeting such consumption in the

State during that year but shall not include the electricity purchased for the trading

purposes;

(ii) save as provided in the succeeding item (iii) under this sub-regulation, the quantum of

electricity to be considered as utilized by the distribution licensee from hydro-electric

sources for meeting its consumption during a year shall be computed at such

percentage of the total consumption in that year as is equal to the percentage derived

from the quantum of electricity purchased, including generated, from hydro-electric

sources, as envisaged in the tariff order for that year, for meeting the estimated

requirement for consumption in the State vis-a-vis the total estimated requirement for

that year for consumption in the State; and

(iii) the consumption of electricity to be considered as met from hydro-electric sources

shall not exceed the electricity purchased (in kWh), including electricity generated, by

the distribution licensee from hydro-electric sources in that year, after excluding the

dedicated sale of power to any person, other than its consumers, by the distribution

licensee specifically earmarked out of any such purchase from hydro-electric sources.

(1) Each Captive and Open Access User/Consumer shall, during the respective financial

year, purchase such quantum of electricity (in kWh) from the renewable sources, which shall not be

less than the quantum of electricity (in kWh), worked out as per the Table given in sub-regulation

(1):

Provided that for computing the Renewable Power Purchase Obligation (RPPO) of such

obligated entities for a year under this sub-regulation, the following conditions shall also apply,

namely:—

(i)

the total consumption of any such obligated entity shall include the quantum of

electricity purchased, including electricity generated, by it from various sources,

including the power purchased under REC mechanism for meeting its requirement for

consumption of electricity, and shall also include the transmission and distribution

losses incurred within the State for meeting such consumption in the following

manner, namely:-—

(a) in case the electricity is purchased by such obligated entity from sources outside

the State, the electricity purchased at the State periphery shall be considered as the

consumption of the obligated entity from such sources;

(b) in case the electricity is purchased, or generated, from generating sources located

within the State, the electricity (in kWh) injected for such obligated entity at the

generating bus bar shall be considered as its consumption;

(ii) the energy consumed by obligated entity, other than the distribution licensee, shall be

considered to have been consumed from the sources other than the hydro-electric

sources, unless such obligated entity establishes to the satisfaction of the State Agency

that such consumption was made from hydro-electric sources.

(2) The obligated entities may meet their Renewable Power Purchase Obligation (RPPO)

as per sub-regulations (1) and (2) of this regulation from any renewable sources, including:—

(i)

purchases from generating stations, based on renewable energy sources;

(ii) purchases from any other distribution licensee, which would arise from renewable

energy sources; and

(iii) the energy generated from its own renewable sources, if any, by the obligated entity:

Provided that the electricity purchased at pooled cost, as specified in the Central Electricity

Regulatory Commission (Terms and Conditions of Renewable Energy Certificate for Renewable

Energy Generation) Regulations, 2010, shall not be taken into account for offsetting such

obligations:

Provided further that the solar power purchase obligation shall be fulfilled from the

generation based on solar sources only:

Provided further that the power purchases under the power purchase agreements from

renewable energy sources, already entered into by the distribution licensees, shall continue to be

made till their present validity, even if the total purchases under such agreements exceed the

percentage as specified hereinbefore.

(4) The Commission shall specify the minimum percentage for Renewable Power

Purchase Obligation (RPPO) for the period beyond 31.03.2019, separately in due course of time.

(5) The Commission may, keeping in view the power supply constraints or other factors

beyond the control of the distribution licensee or for any other reasons, suo-moto or at the request

of an obligated entity, also revise the percentage targets for a year(s) for which Renewable Power

Purchase Obligations have been fixed as per sub-regulations (1)and (2) of this regulation.”

Amendment of Regulation 8.—In sub-regulation (1) of Regulation 8 of the said

regulations, for the words, bracket, sign and figure, “sub-regulation(1) of Regulation 4”, the words,

bracket, sign and figure, “sub-regulation(2) of Regulation 4” shall be substituted.

Omission of Annexure-1.—The existing Annexure-1 to the said regulations shall be

omitted.

Council Nahan For regulating the Posting of Bills Hoarding, Advertisements Sign board, in

exercise of the power conferred by section 202 (0) read with section 217 of the Himachal Pradesh

Municipal Act, 1994(13 of 1994) having been confirmed by State Govt., as required under Section

217 of the aforesaid Act are here by published for general information, namely.—

BYE LAWS TO REGULATE POSTINGS OF BILLS, HOARDINGS, ADVERTISEMENTS

OF MUNICIPAL COUNCIL NAHAN

Short title commencement and application.—These Bye-Laws may be called the

Municipal, Council Nahan (Regulation of Posting of Bills and fixing of advertisement

hoardings, sign boards etc) Bye-Laws, 2008

(1) These shall come into force on the date of their publication in the Rajpatra, Himachal

Pradesh.

(2) These shall apply to Nahan Municipal Council area

Definitions.—In these bye laws unless the context otherwise requires:—

(a) “Act” means the Himachal Pradesh Municipal Act 1994

(b) “Bills” means any poster, notice and advertisement printed on paper of Board or

painted on Hoardings, Sign boards or walls etc. and hung on poles etc.

(d) “Schedule” means the schedule indicating the rate in respect of sign Boards.

Prohibition of sticking, fixing hanging or painting bills, posters, advertisement, notice

etc.:- No person shall without the written permission of the Executive Officer, Municipal Council

Nahan stick, fix or hung or cause to be fixed stick, or hung or paint bills, posters, advertisement,

notice over any place or property whether private or public in public street or road in contravention

of the following conditions:—

Hoarding shall not be allowed in the required width the national/state high ways and

other scheduled roads as they cause traffic hazard and are against the instructions of

the Govt. of India and Hon,ble Himachal Pradesh High Court.

ii.

No hoardings, advertisements shall be put on the valley side above the road

level(including on the roofs of buildings) to preserve the aesthetics scenic beauty and

the views of hills.

iii. No hoardings, advertisements shall be put at the place where it affects endangers the

growth of flora and fauna.

iv. No hoardings shall be located in thickly wooded area and no wire of any kind shall be

placed on trees.

No Hoardings advertisements shall exceed dimension size of 16 Sq. meters.

vi. No Hoardings advertisements shall be against the guidelines of the PWD.

vii. No Hoardings advertisements shall be located near a water source.

viii. No Hoardings advertisements shall be in the form of writing engraving mailing and

carving on any natural animate or inanimate object.

ix. No Hoarding advertisement shall be Located to the road. No Hoarding advertisement

should be located on a sharp “U” turn and blind turns and

The beauty of nature formation such as hills, rivers, trees and rocks shall not be

destroyed by indiscriminate installation of commercial advertisements.

Exemption.—Subject to the condition mentioned in Bye Laws 3 private boards may

be erected on respective premises by Govt. Offices, Association or mercantile firms, for posting

their own notices, advertisements etc.

Prohibition of displaying indecent pictures or languages. Advertisement containing

indecent pictures or languages shall not be allowed. Executive Officer Municipal Council Nahan

shall be the authority to decide as to the decency or other wise of the advertisements and the appeal

against the decision shall be made to the president Municipal Council Nahan whose decision shall

be final.

Fee for permission.—(i) fee @ Rs 300/- per sqm. shall be payable for every

permission granted under bye-laws No.3 above per annum.

(ii) Cloth Banners @ Rs.100/- Per Month per banner.

When a person desires to remove the advertisement, he will put the space as it was

before.

Penalties.—Whoever contravenes any of these bye-laws shall be punishable with fine

which may extend to Five thousand Rupees and when the contravention is a continuing one, with

further fine which may extend to Rupees 200/- for every day, after the first day during which such

contravention continues.

Council, Joginder-Nagar and also to amend Schedule-l of the said Act by deleting entry at Sr.

No.27 from Part-ll of the Schedule and to insert it at Sr. No. 31 in Part-l of the Schedule, namely:-

“Sr. No.31. Municipal Council, Joginder-Nagar”.

Consequent upon up-gradation of above mentioned Nagar Panchayat namely-Joginder-

Nagar to that of Municipal Council, Joginder-Nagar the Governor, Himachal Pradesh, in exercise

of powers conferred by section 305 (1) of the Himachal Pradesh Municipal Act, 1994 (Act No. 13

of 1994), is further pleased to up-grade the post of Secretary, Nagar Panchayat to that of Executive

Officer, of this Municipal Council.

to authorise payment and appropriation of certain further sums from and out of the

Consolidated Fund of the State of Himachal Pradesh for the services for the financial year ending

on the 31^st day of March, 2017.

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-eighthYear of

the Republic of India as follows:—

Short title.—This Act may be called the Himachal Pradesh Appropriation Act, 2017.

Issue of a further sum of `39,36,55,09,737 out of the Consolidated Fund of the

State of Himachal Pradesh for the financial year 2016-2017.—From and out of the Consolidated

Fund of the State of Himachal Pradesh, there may be paid and applied sums not exceeding those

specified in column (3) of the Schedule amounting in the aggregate to the sum of

` 39,36,55,09,737 (Rupees Three Thousand Nine Hundred Thirty Six Crore, Fifty Five Lakh, Nine

Thousand, Seven Hundred, Thirty Seven) only towards defraying the several charges which will

come in course of payment during the financial year 2016-2017 in respect of the services and

purposes specified in column (2) of the Schedule.

Appropriation.—The sums authorized to be paid and applied from and out of the

Consolidated Fund of the State of Himachal Pradesh by this Act shall be further appropriated for

the services and purposes expressed in the Schedule in relation to the period specified under section

2 of this Act.
