Scheme for Constitution and Administration of the Himachal Pradesh Patrakar Kalyan Yojna, 2017

by abolishing the Himachal Pradesh Journalists Welfare Fund Scheme, 2006, as under:—

1. Short title and Commencement.—(i) This Scheme shall be called the Himachal

Pradesh Patrakar Kalyan Yojna, 2017.

(ii) It shall come into force with effect from the date of its publication in the Rajptra of

Himachal Pradesh or e-Gazette.

Definitions.—

(a) “Adverse Situation” means unfavorable or critical situation due to ill health and major

accidents etc.

(b) “Committee” means the Committee constituted for the purpose of administration of

the Yojna as provided in the point no. 4;

Himachal Pradesh;

(d) “Government” means the Government of Himachal Pradesh;

(e) “Patrakar Kalyan Fund” means a fund created with the amount of `1,00,00,000/-

(Rupees One Crore) only and amount accumulated in old Himachal Pradesh Journalists

Welfare Fund Scheme, 2006 amounting to `31,85,018/- (Thirty one lakh eighty five

thousand and eighteen) only for the purpose of providing financial assistance to

serving accreditated journalists and retired accreditated journalists;

(f) “Permanent incapacitation” means incapacitation which renders the serving

accreditated journalist wholly unfit for working as such by an accident and suffering

from incurable diseases;

(g) “Retired Accreditated Journalist” means an accreditated journalist who had retired

after rendering a minimum service of at least twenty years as accreditated journalist

with the Government of Himachal Pradesh and had attained the age of fifty eight (58)

years and has not taken up any other gainful employment after such retirement other

than journalism;

(h) “Serving Accreditated Journalist” means a working Journalist who has been given

accreditation by the Government of Himachal Pradesh as per the provisions of

Himachal Pradesh Press Correspondents Accreditation and Recognition Rules.

3. Purpose of the Yojna.—The purpose of the Yojna shall be to provide financial

assistance to the serving accreditated journalists and retired accreditated journalists in adverse

situations as accidents and illness etc.

4. Constitution and Administration of the Yojna.—(i) The Yojna will be administered

by the Government and will be operated by the Committee comprising of the following:—

(a) Hon’ble Minister-in-Charge of the Information and Public Relations, Chairman

Himachal Pradesh.

(b) The Administrative Secretary of Information and Public Relations Member to the

Government of Himachal Pradesh.

(d) The Director (I&PR), Himachal Pradesh Member Secretary

The Committee shall discharge the following functions, namely.—To decide,

approve and sanction a lump sum grant as financial assistance to the serving accreditated journalists

and retired accreditated journalists or their dependents/legal heirs in adverse situations viz. death,

illness, major accident etc. of the serving accreditated journalist and retired accreditated journalist

and permanent incapacitation of the serving accreditated journalist.

Assistance in Adverse Situations.—In emergent cases, the Director, Information and

Public Relations, Himachal Pradesh would be the authority to grant financial assistance of

`25,000/- (Rupees Twenty five thousand) only from the fund of the Yojna as an immediate

financial assistance to serving accreditated journalists and retired accreditated journalists or their

dependents/legal heirs on production of documentary proof regarding death certificate, illness or

accident etc. and subsequently its ex-post-facto approval would be obtained from the Committee.

Criteria for financial assistance to serving accreditated journalists and retired

accreditated journalists from the H.P. Patrakar Kalyan Yojna, 2017:—

(a) Financial assistance to serving accreditated journalist:—

(i)

in case of permanent incapacitation

for further service while performing

field duties as journalist

` 1 lakh (Rupees one lakh) only.

(ii) in case of death while performing field ` 2 lakh (Rupees two lakh) only.

Duties

(iii) in case of death during attack or any

untoward incidence of violence

` 3 lakh (Rupees three lakh) only.

(iv) in case of medical emergency or cancer upto ` 50,000/- (Rupees fifty thousand),

only as per emergent need for major

disease as kidney transplant, heart disease

etc.

(b) Financial assistance to retired accreditated journalist,.—

(i)

in case of death

` 50,000/- (Rupees fifty thousand) only.

(ii) in case of medical emergency

upto ` 50,000/- (Rupees fifty thousand)

or cancer,

only as per emergent need for major

disease as kidney transplant, heart disease

etc.

Patrakar Kalyan Fund.—(i) Patrakar Kalyan Fund shall be created with a sum of

` 1,00,00,000/- (Rupees One Crore) only as approved by the Government which shall be kept in a

nationalized bank in a separate bank account, which will be maintained by the Director (I&PR);

and funds accumulated in old Himachal Pradesh Journalists Welfare Fund Scheme amounting to

`31,85,018/- (Rupees Thirty one lakh eighty five thousand and eighteen) only will now be placed in

Patrakar Kalyan Fund.

(ii) The amount available in the fund shall be drawn by the Director, Information and

Public Relations, Himachal Pradesh only to grant financial assistance to serving accreditated

journalists and retired accreditated journalists or their dependents/legal heirs (in case of death).

Eligibility for availing financial assistance from the Patrakar Kalyan Fund.—The

serving accreditated journalist or retired accreditated journalist beneficiary or their dependent/legal

heir shall be eligible for availing assistance from the fund,

(a) in the event of death of a serving accreditated journalist or retired accreditated

journalist, financial assistance will be released in favour of the surviving spouse,

his/her dependent, children or legal heir as the case may be or in the event of

unmarried or single serving accreditated journalist or retired accreditated journalist, the

financial assistance will be released in favour of his or her dependent father or mother

as an immediate relief;

Provided that while considering the request for financial assistance, the Committee

shall take into consideration the financial condition of the applicant(s) and also take

into consideration supporting document or other evidence which should be called for

before sanction or recommendation of the financial assistance.

(b) In the event of medical emergency or any other adverse situation, assistance will be

released to serving accreditated journalists and retired accreditated journalists as the

case may be, on need basis after taking approval of committee for the same. In this

case serving accreditated journalist or retired accreditated journalist will be required to

produce relevant documents in support with claims;

Provided that serving accreditated journalist or retired accreditated journalist while

availing medical assistance or claim form the Patrakar Kalyan Fund shall have

tosubmit an undertaking that he or she had not claimed it from his or her media

organization and a certificate in this respect may be taken from the employer of his or

her media organization that he or she had not taken medical benefits or claim from

their respective media organization.

new H.P. Patrakar Kalyan Yojna, 2017 hence those who are already subscribers of

Himachal Pradesh Journalists Welfare Fund Scheme, 2006 will now be considered as

member under this new Scheme.

(d) Serving accreditated journalists or retired accreditated journalists whose annual family

income is less than ` 1, 80, 000/- (Rupees One lakh eighty thousand) only shall be

eligible for availing assistance from H.P. Patrakar Kalyan Yojna. In this behalf serving

accreditated journalists or retired accreditated journalists will have to submit annual

family income certificate as certified by the competent Revenue Officer not below the

rank of Tehsildar (Class-I)/Sub Divisonal Magistrate of the area with their application

for availing financial assistance from the H.P. Patrakar Kalyan Yojna.

10. Procedure for application for availing financial assistance from the Yojna:—

(a) An application for financial assistance from the Yojna shall be made in the prescribed

form-I attached with this Yojna. The State level serving accreditated journalist and

retired accreditated journalist shall submit their application directly to the Director

(I&PR). The District/Sub divisional level serving accreditated journalists or retired

accreditated journalists shall submit the same through the concerned District Public

Relations Officer of the District. The District Public Relations Officer along with his

comments shall forward such applications completed in all respects to the Director

(I&PR). The Director (I&PR) as a Member Secretary of the Yojna shall place the

complete case before the Committee for approval and further action.

(b) On the recommendation of the Committee, amount of assistance would be sanctioned

out of fund of the H.P. Patrakar Kalyan Yojna, 2017.

11. Annulments/revocation of assistance.—Financial assistance sanctioned under the

Yojna shall be liable to be recovered at any time, with interest at prevailing rates, if it is found in

future that the assistance was obtained on the basis of false information or by way of suppression or

misrepresentation of facts.

12. Auditing of funds of the Yojna.—The accounts of the Yojna shall be maintained by

the Director, (I&PR) in accordance with settled principles of accountancy and all payments from

the Yojna shall be made by ‘Account payee’ cheque or through RTGS as the case may be. The

account of Yojna shall be got audited from time to time from the Local Auditor by the Director

(I&PR).

13. Powers of committee.—The Committee is empowered to make recommendations for

necessary changes, amendments, modifications in the Yojna to remove any hardships faced in the

implementation of the Yojna, keeping in view the basic objectives of the Yojna intact.

14. Power to amend the Yojna.—The Government of Himachal Pradesh shall be

empowered to amend the Himachal Pradesh Patrakar Kalyan Yojna, 2017 as and when required as

per recommendations of the Committee.

15. General.—Grant of financial assistance from the Yojna to any serving or retired

accreditated journalist is not a matter of right. Assistance shall be extended depending on the

Committee’s satisfaction regarding the eligibility or merits of the cases and the financial resources

available for the purpose. The Committee reserves the right to reject or accept any application

without assigning any reasons thereof.

ANNEXURE A

GRANT-IN-AID PLAN/SCHEME FOR WORSHIP/PRAYERS AND MAINTENANCE OF

THE RELIGIOUS INSTITUTIONS THROUGH REVOLVING FUND

Objective :

Himachal Pradesh has a rich heritage of religious institutions. The State government is

determined to preserve and promote it. In the past, many religious institutions had their own land

and the income generated from this land was used to maintain the temple and for daily

prayers/worship etc. After the implementation of various land reform laws many religious

institutions have lost their landed estates being vested in the tenants Government and thus resulted

into paucity of income, Due to this the maintenance as well as regular prayer/worship in the temple

have been hampered. Thus, for this purpose the Himachal Pradesh government has created the

revolving fund Scheme. The objectives of the scheme are mentioned below:—

(a) Regularizing the daily prayers/worship etc in their religious institutions.

(b) Proper maintenance of the religious institutions.

Conduct of Revolving Fund :

The Director, Language art and culture department as per rule of finance department issued

from time to time would invest the amount of revolving fund with the highest interest paying

nationalized/Co-operative banks in fixed deposit account and its interest would be utilized for

implementation of this plan. Thus the religious institution could be provided with one time grant-

in-aid under this scheme on the above serial number 3 out of total interest received. The fixed

deposit account and saving bank account would be operated by the Director, Department of

Language art and Culture Himachal Pradesh.

3. Mode of Grants from the Revolving Fund :

The grants could be provided in two forms:-

(a) Annual grant: For the regular maintenance of religious institutions along with daily

prayers/worship etc, every year a fixed amount would be provided in the form of grant.

(b) One time grant for the creation of assets. To increase the income of the religious

institutions a onetime grant would be provided for the creation of assets with which

these religious institutions could be self-sufficient, this would be enacted in the

following ways:-

(1) Build up sarai, buildings, shops, parking, toilets etc on the barren land owned by

these institutions.

(2) Any other work that could provide regular income to these religious institutions.

(Those religious institutions availing one time grant would not be entitled for

yearly grant.)

4. Eligibility :

Only those religious institutions are eligible for availing grant out of revolving fund whose

lands are vested in the tenants Government under various land reform acts. Exclusion:—

(a) The temples which are included in ‘Himachal Pradesh Hindu Public Religious

Institutions and Charitable Endowment Act, 1984 schedule-1

And

‘The Himachal Pradesh Ancient and Historical Monuments and Archaeological Sites

and Remains Act, 1976’ under which state protected Monuments

And

under the ‘Ancient Monuments and Archaeological sites and remains act, 1958’

centrally protected monuments are not eligible for grant.

(b) The religious institution with individual/personal ownership would also not be eligible

for grant.

6. Procedure/Process :

(a) Head or Kardar of the eligible religious institution would submit desired documents

along with proposal on the prescribed forms to the District Language Officer:—

(1) For receiving annual grant

(a) To avail grant for the first time.

2. Description of prescribed land (Form-2)

3. Copy of Jamabandi and Tatima on which the religious institution is

situated.

4. Four coloured photographs of the religious institution. (5x7 inch

minimum in size) covering all the four direction must be enclosed. The

photograph of the building must be clearly visible from top to bottom.

5. Any other certificate or document which is necessary for the satisfaction

of department during or after examine the proposals, is required may be

demanded.

(b) Thereafter for availing annual grant:-

1. The utilization certificate of grant given in previous grant years (Form-3)

and cash book to the District Language Officer for securitizing the utilization of

previous provided grant for verification. The District Language Officer will

recommend the grant-in-aid for next year if the documents are found satisfactory.

4. Any other such certificate or document which would be required during or after

the scrutiny of the proposals can be demanded by the department.

Department is not under any compulsion to provide grant to religious institution

every year this will depend on the amount available in the revolving fund and

would be subject to amendment from time to time.

6. The grant would be provided on the basis of ‘first come and first serve’.

If the department finds the religious institutions economically self-dependent or

became self-dependent now then grant-in-aid would not be considered in such

cases.

8. If any applying institution has not maintained the cash book and vouchers in

account system, then as the first time applicant, would be given exemption. There

after this, accounting system will have to be maintained with immediate effect

only then they would be given the grant.

2. The creation of assets for availing one time grant.

(a) For availing one time grant following formalities should be fulfilled.

1. Application (From-1)

2. Description of prescribed land.

3. Copy of Zamabandi and aks Tatima of land in which the religious institution

is proposed to be built the structure (Sarai, Shops, Parking etc.).

4. The copy of zamabandi and aks Tatima on which the religious institutions is

to be built.

5. Four copies of drawing and estimate of proposed construction.

6. Four coloured photographs of religious buildings (5x7 inch minimum in size)

covering all the four direction must be enclosed. The photograph of the

building must be clearly visible from top to bottom.

7. Attested copies of the pictures and the other certificates, Form-4 etc. which

are issued by the Patwari.

8. No Objection Certificate issued by the Panchayat on Form-5 for proposed

structure.

9. Any other such certificate which is required during the investigation or after

the investigation should also be provided for the satisfaction of department.

10. Four copies of estimates and drawings of proposed construction plan of

religious institution. The estimates and drawing would only be accepted

which are prepared by the junior Engineer of Block Development office.

11. Grantee would provide declaration relating to grant according to form-8.

(b) Procedure for the one time grant-in-aid.

1. The District Language Officer will send the proposal after scrutiny according

to rules and forward to the directorate regularly with recommendation.

2. The engineering branch of department would check the proposals.

3. Archaeological Engineer can enhance or decrease the estimate on his level

with justification and place before the screening committee.

4. In the month of April in a financial year the following screening committee

would scrutinize and review all the received proposals (annual or one time)

and recommend the grant for each proposal as per rules.

After this the proposal would be disposed of in the following manner:-

1. The proposal amounting up to rupees 10 Lakh would be sanctioned by

Director Language and Culture.

2. The proposals exceeding the amount of 10 Lakh rupees sanction would

be sent to the government.

5. The grant-in-aid would be provided in two instalments.

1. 50% grant-in-aid after sanction of proposal.

2. Rest 50% on the completion of work.

3. Due to fewer working days in the Tribal area grant would be released in

one instalment.

6. It is mandatory for the representative of the religious institutions to ensure

that the amount sanction by the department and the remaining expenditure of

the proposed work would be meet-out in form of public participation.

7. The grant would be provided to the Block Development Officer through

concerned Deputy Commissioner, who will make the payment on progress

report of work and requirements of the applicant. In every such sanctioned

case, the copy of the approved estimate and sanction letter would be

endorsed to the District Language Officer and the applicant. The Sanction

letter with the copy of approved estimate shall be forwarded to Block

Development Officer.

8. The organizations execute the approved construction work under supervision

of the concerned Junior Engineer of Block Development Office. The

construction work would be done in accordance with (works code manual

issued by H.P. govt. from time to time) the, rural development department

and the instruction issued by government of Himachal Pradesh time to time.

9. The Junior Engineer of Block Development Office will ensure the execution

of work on the basis of estimate approved by Department of Language Art

and Culture. In case the temples applicant does not work according to the

approved estimate then he will immediately report to the concerned B.D.O or

the sub-divisional officer and a copy of this would be sent to the department

without any delay subsequently the officer’s of the department would inspect

the work and prepare a report and submit to Secretary Language Art &

Culture for final decision.

10. If there is found any violation of the rules and regulations of grant-in-aid by

the applicant then entire amount shall be recovered in along with interest in a

single instalment.

11. The construction work would be checked/inspect from time to time by the

officers of Department of Language, Art and Culture. The officers can

suggest for necessary changes in the on going work to left the temple

authorities which shall be immediately binding for them. The inspecting

officers will submit inspection report with photograph of the every inspected

religious institution to directorate.

12. The Grant-in-aid must be utilized within one year otherwise department of

Language & Culture will be entitled to recover the entire amount along with

interest in a single instalment.

13. If the Director is satisfied the period can be extended up to one year keeping

in view of certain circumstance.

14. After completion of the construction work religious institution must submit

the utilization certificate (Form-7)

15. The following information must be displayed each grantee organization by

putting a sign Board near the religious institution or Monuments regarding

the grant allotted by the department.

7. Assessment grant amount :

1. The total interest received on revolving fund deposit in bank during the last financial

year in the month of April shall be utilized for Grant-in-aid.

2. Minimum 70% of this interest amount would be protected for the yearly grant

proposals.

3. Remaining 30% shall be considered for one time grant.

4. In case number of proposals exceed and due to lack of funds (money) that year the one

time grant-in-aid proposals could not be provided then they would be provided with

yearly grant-in-aid for that year and they would keep receiving the amount till they

would not be provided one time grant. Priority list of one time grant will be prepared

and the grant would be sanctioned on first come first serve basis.

(A) Yearly grant Assessment:

On the basis of annual grant, land vested in the tenants and government (The land would not

be covered. Whose the compensation had been given) would be on the basis of difference of

quantity and income and expenditure.

Grant will be fixed on the basis of classifications mentioned in the above two schedules:

1. On the basis of vested land 1/3rd of the amount as shown in against schedule-A.

2. On the basis 2/3rd of the net income shown against schedule-B.

3. Thus by adding 1/3+2/3=1 to the resultant amount would be provided in the shape of

grant.

4. The amount of grant rupees 100 would be rounded off. That means less than 50 the

previous 100 and More than 50 next 100 would be rounded off.

(B) One time grant for asset creation.

Director will not sanction more than 75 percent of total estimated amount checked by the

archaeological engineers of the Department and its maximum limit will not be more than 25 Lakh.

In view of the importance of work if more amount is required than the prescribed limit then the

Deputy Commissioner will have to make special recommendation with relevant reasons.

Total estimated expenditure on the proposed work and the remaining amount if any out of

the sanctioned amount of the Department will have to be ensured by public -participation by the

applicant.

8. The expenditure of Annual grant items :

1. The amount of grant would be given to eligible religious institutions mainly for

worship-Prayer and maintenance. The grant could be utilized for purchase of items

related to worship as practiced by the religious institution. Grant could also be utilized

for maintenance of religious institutions. Maintenance will include sanitation, water,

electricity, and minor repair works of the religious institution.

Grant could also be utilized for the security of temple to purchase the CCTV system

and its maintenance.

3. Grant will not be used any major repair of religious institution and its premises or

alteration and reconstruction of structure and its maintenance.

4. Grant will not be utilized for the payment of salary and allowances of the newly or

previously appointed employees.

5. Grant will not be utilized for Bhandaras, ceremony, yajna etc.

9. Tenure/Duration :

The amount of grant for the religious institution will be payable only once in a year for

worship-Prayers and maintenance. The grant proposals should be forwarded to the department by

every religious institution for the financial year in the month of April after completing prescribed

formalities of the scheme.

10. Utilization Certificate :

(A) In the process of yearly grant:-

1. The grantee religious institutions will submit three attested copies of utilization

certificate (Form-3) of the given grant-in-aid to the concerned District Language

Officer. The District Language Officer would forward two copies to the

Directorate and retain one copy in them record for the future reference. The

photocopies of the vouchers of utilized grant along with the utilization certificate

should be submitted which would be verified by the chairman of the institution on

which basis utilization of grant will be ensured.

2. The grant sanctioned for the first time under yearly plan to any religious

institution, there often in the month of April, particulars of bill vouchers inclusive

of cash book and utilization certificate would be provided by the managing

committee of the previous year to the District Language Officer, The District

Language Officer will check are these documents and after his satisfaction the

proposals would forward to Directorate for sanction. The proposals presented

would not be considered without utilization certificate.

3. The full particulars of entire income and expenditure of the institution will be

enlisted in the cash book by the committee. All the entire bills/vouchers will be

preserved which would be inspected/verified by the District Language

Officer/Officers by the Department in any time.

(B) Proposals for construction of Assets.

(1) After Completion of fifty percent of assigned work a certificate on form 6 would

be sent to the Department which would be verified by the Block Development

officer.

(2) The second and last instalment would be issued after the receipt of the prescribed

certificate.

(3) Three copies of utilization certificate of total amount of grant (Form-7) after

verification by the Deputy Commissioner would be sent to Director Language Art

& Culture. The applicant will attach self attested vouchers of the grant given to

him along with the certificate which would ensure the proper utilization of grant.

All the vouchers would be entered in the cash book and maintained properly

which would be inspected or verified by the concerned District language officer

or officers of Department in any time.

11. Inspection and violation of rules:

(a) The concerned officers of Department of Language Art & Culture shall be at liberty to

observe the working of construction form time to time. These officers may ask for

necessary changes to the related committees which shall be binding for them. The

inspecting officer will submit its inspection report with photographs immediately to

Directorate in respect of each religious institution, Junior Engineer/Conservation

Assistant of department will scrutinize the above work all the grantee religious

institutions and Archaeological Engineer will inspect at least ten percent of the above

work.

(b) The Grant-in-aid sanctioned for the items of the estimate must be utilized for the same

works. Otherwise the department will be authorized to recover the entire amount along

with interest.
