100/िह.प्र-लो.स/1/2013: Įी लवण कुमार (इसमɅ इसके बाद “आवेदक” के Ǿप मɅ संदिभर्त) ने 2-मंडी

संसदीय िनवार्चन क्षेत्र से िहमाचल प्रदेश लोक सभा के उप-िनवार्चन] 2013 मɅ िनवार्चन लड़ा था िजसके

पिरणाम की घोषणा िदनांक 27.06.2013 को की गई थी। लोक प्रितिनिध× व अिधिनयम] 1951 (इसमɅ इसके

बाद “अिधिनयम” के Ǿप मɅ संदिभर्त) की धारा 78 के अनुसार उनसे यह अपेक्षा थी िक उनके ɮवारा

अनुरिक्षत िनवार्चन å यय के लेखे की स× यप्रित िजला िनवार्चन अिधकारी (डीसी)] मंडी के समक्ष] उक् त

िनवार्चन क्षेत्र के िलए िनवार्िचत अß यथीर् के िनवार्चन की तारीख से 30 िदनɉ के अंदर दािखल कर दी जाए

जैसा िक उक् त अिधिनयम की धारा 77 के अधीन अपे िक्षत है। इस प्रकार से] आवेदक के िलए यह अपेिक्षत

था िक वह डीईओ] मÖ डी के समक्ष िदनांक 30.07.2013 तक अपने िनवार्चन å यय का लेखा जमा करɅ।

आवदेक] िनवार्चनɉ का संचालन िनयम] 1961 (इसके बाद “1961 िनयम” के Ǿप मɅ संदिभर्त) के िनयम

89 के अधीन िजला िनवार्चन अिधकारी (डीसी) के समक्ष उक् त अिधिनयम की धारा 78 के अधीन यथा

िनधार्िरत िविध ɮवारा अपेिक्षत रीित से िनवार्चन å यय का अपना लेखा दािखल करने मɅ असफल रहा है

जैसा िक िजला िनवार्चन अिधकारी (डीसी) मÖ डी ने िदनांक 5.08.2013 की अपनी िरपोटर् मɅ उã लेख िकया

है जो आयोग मɅ 05.09.2013 को प्राÜ त हुई थी।

भारत िनवार्चन आयोग ɮवारा आवेदक को िदनांक 19.02.2104 को िनयम] 1961 के उपिनयम (5)

के अधीन एक नोिटस जारी िकया गया था िजसमɅ उसे इस संबंध मɅ कारण बताने को कहा गया था िक

क् यɉ न उसे उक् त अिधिनयम की धारा 10क के अधीन िनरिहर्त घोिषत कर िदया जाए तथा साथ ही इस

नोिटस की प्रािÜत के 20 िदनɉ के अंदर िनधार्िरत तरीके से अपने लेखे दािखल करने की उनसे अपेक्षा की

गई थी तथा नोिटस मɅ यह भी è पç ट िकया गया था िक ऐसा न करने पर वे तीन वषर् की अविध के िलए

िनवार्चन लड़ने से िनरिहर्त कर िदए जाएंगे। उक् त नोिटस आवेदक को 03 माचर्] 2014 को डेलीवर कर िदया

गया था।

िजला िनवार्चन अिधकारी (डीसी)] मÖ डी ने िदनांक 29.09.2014 के अपने पत्र संख् या ईएलएन-

एमएनडी-एफ(i)-23/2012/7405-06 के ɮवारा सूिचत िकया िक आवदेक ने िरपोटर् की तारीख तक िविध

ɮवारा अपेिक्षत रीित से िनवार्चन å यय का अपना लेखा दािखल नहीं िकया था। अत:] आयोग ने िदनांक

08.06.15 के अपने आदेश संख् या 100/िह.प्र-लो.स/1/2013 के ɮवारा आवेदक को उक् त अिधिनयम और

उसके अधीन बनाए गए िनयम और आदेश ɮवारा यथापेिक्षत रीित से िनवार्चन å यय का अपना लेखा

दािखल करने मɅ असफल रहने पर] धारा 10क के अधीन संसद के दोनɉ सदनɉ/राÏ य िवधान मंडलɉ का

िनवार्चन लड़ने से आवदेक को िनरिहर्त घोिषत कर िदया। आवदेक इस आदेश की तारीख से तीन वषर् की

अविध के िलए िनरिहर्त हो गए।

आवेदक ने लोक प्रितिनिध× व अिधिनयम] 1951 की धारा 11 के अधीन िदनांक 01.03.2017 को

एक आवेदन प्रè तुत िकया जो आयोग मɅ 17.03.2017 को प्राÜ त िकया गया और उसने उसमɅ बताए गए

कारणɉ के िलए िनरहर्ता हटाने हेतु अनुरोध िकया। अपील मɅ आवेदक ने िनà निलिखत िनवेदन िकया है:-

i.

उसकी अनुपिèथित मɅ छापे के दौरान रिजè टर को या तो पुिलस ɮवारा उठा िलया गया है या

वह खो गया है।

ii.

रिजè टर को न देकर कुछ छुपाया नहीं गया है और यह िकसी प्रकार से आवेदक को लाभ नहीं

पहुंचाएगा।

iii. समè त िनवार्चन å यय का कुल योग 5]20]000/-Ǿ है।

आयोग ने िदनांक 11.05.2017 के अपने पत्र ɮवारा आवेदक को å यिक्तगत सुनवाई का अवसर

िदया तािक वह अपना मामला प्रè तुत कर सके।

आवेदक िदनांक 29.06.2017 को अधोहè ताक्षरी] जोिक अिधिनयम की धारा 19क के अधीन आयोग

ɮवारा अधोहè ताक्षरी को प्र× योिजत शिक्तयɉ के कारण इस मामले मɅ आवेदन पर िवचार करने वाले सक्षम

प्रािधकारी हɇ] के समक्ष प्रè तुत हुआ।

जोिक अिधिनयम की धारा 19क के अधीन आयोग ɮवारा अधोहè ताक्षरी को प्र× योिजत शिक्तयɉ के

कारण इस मामले मɅ आवेदन पर िवचार करने वाले सक्षम प्रािधकारी हɇ] के समक्ष प्रè तुत हुआ।

å यिक्तगत सुनवाई मɅ] आवेदक ने अपने आवेदन मɅ िकए गए िनवेदनɉ को दोहराया। मुख् य िनवेदन

िनà निलिखत थे:-

i.

आवेदक को गलत तरीके से िन हर्िरत िकया गया था।

ii.

िनवार्चन व यय के लेखा के िरकॉडर् को आरओ के समक्ष प्रस तुत िकया गया था।

iii. िदनांक 14.06.2013 को सीआईडी पुिलस के छापे मɅ िनवार्चन å यय का लेखा रिजè टर कहीं

खो गया था और इसकी सूचना िदनांक 19.06.2013 को आरओ को दे दी गई थी।

iv. रिजè टर को न देकर कुछ छुपाया नहीं गया है और यह िकसी भी प्रकार से आवेदक को लाभ

नहीं पहुंचाएगा।

v.

आवेदक ने कुछ प्रिक्रया× मक चूक के कारण िनरहर्ता के दो वषर् की अविध पहले ही पूरी कर

ली है िजसके िलए आवेदक पूणर् Ǿप से उƣरदायी नहीं था।

िदनांक 29.06.2017 को आयोग मɅ प्राÜ त िदनांक 29.06.2017 के अपने अß यावेदन मɅ आवेदक

ɮवारा उठाए गए िबÛ दुओं और å यिक्तगत सुनवाई के दौरान आवेदक ɮवारा िकए गए मौिखक िनवेदनɉ पर

मɇने िविधवत िवचार िकया है। प्राथीर् ने िनवेदन िकया िक उसने िदनांक 19-02-2014 के आयोग के नोिटस का

िविधवत Ǿप से उƣर दे िदया था। इसके अितिरक् त, आवेदक ने िनवेदन िकया िक िदनांक 14.06.2013 को

उसके कायार्लय पिरसर मɅ उसकी अनुपिèथित मɅ मारे गए छापे के दौरान या तो पुिलस ɮवारा संदभार्धीन

रिजè टर ले िलया गया था या छापे के दौरान वह कहीं खो गया था] क् यɉिक पुिलस छापे के दौरान वहां बहुत

भीड़ थी। यह छापा सीजेएम] मÖ डी ɮवारा जारी िकए गए सचर् वारंट के कायार्Û वयन से संबंिधत था जो

भारतीय दंड संिहता की धारा 292] 465,469,471 के अधीन िदनांक 14.06.2013 की एफआईआर सं. 12/2013,

è त्री अिशç ट Ǿपण (प्रितषेध) अिधिनयम की धारा 6 तथा आईटी अिधिनयम की 66(ड), 67(क) के अÛ तगर्त

था। उसने बताया िक उसने िरटिनर्ंग ऑिफसर को इस तØ य के बारे मɅ सूिचत कर िदया था िक रिजè टर

िदनांक 19.06.2013 को नहीं िमल पाया था और उसने नए िसरे से िनवेदन िकया िक उसे एक नया

रिजè टर जारी कर िदया जाए तािक व ह अपने िनवार्चन å यय का लेखा दािखल कर सकɅ । यɮयिप, आवेदक

के अनुसार, डीसी मÖ डी ने कोई उƣर नहीं िदया और नए रिजè टरɉ को देने मɅ उÛ हɉने अपनी असमथर्ता

å यक् त की िक å यय प्रेक्षक, िजÛ हɅ रिजè टर हè ताक्षिरत करना था, वह पहले ही िनवार्चन-क्षेत्र छोड़ चुके थे।

आवेदक ने यह भी उã लेख िकया है िक उसने िदनांक 30 जुलाई, 2013 को अपना लेखा दािखल कर िदया था।

िनयम 90 के अधीन कुल å यय िनधार्िरत सीमा के भीतर पाया गया है।

इस मामले के तØ यɉ एवं पिरिèथितयɉ की समग्रता तथा आवेदक के िनवेदनɉ को Ú यान मɅ रखते हुए,

मेरा यह सुिवचािरत मत है िक Û याय का Ú येय पूरा हो जाएगा यिद िनरहर्ता की अविध कम करके वह

अविध कर दी जाए जो उसने पहले ही पूरी कर ली है।

अत:, अब, इस संबंध मɅ िनवार्चन आयोग ɮवारा प्र× यायोिजत शिक्तयɉ का प्रयोग करते हुए, लोक

प्रितिनिध× व अिधिनयम, 1951 की धारा 11 के अधीन, अधोहè ताक्षरी एतɮɮवारा आदेश देता है िक उक् त

अिधिनयम की धारा 10क के अधीन िदनांक 08.06.2015 को आवेदक पर अिधरोिपत की गई िनरहर्ता की

अविध कम करके 5 अक् तूबर, 2017 को शािमल करते हुए इस तरीख तक की अविध के िलए कर दी जाए

और शेष अविध के िलए िनरहर्ता हट जाएगी।

ORDER

100/HP - HP/1/2013: Sh. Lawan Kumar (hereinafter referred to as the “Applicant”)

contested the Bye-election to the Lok Sabha of Himachal Pradesh, 2013 from 2-Mandi

Parliamentary Constituency, result whereof was declared on 27.06.2013. As per Section 78 of the

Representation of People Act, 1951 (hereinafter referred to as the “Act”), he was required to file

true copy of the account of his election expenses maintained as required under Section 77 thereof,

before the District Election Officer(DC), Mandi, within thirty days from the date of election of the

returned candidate for the said constituency. Thus the applicant was required to submit a/c of

election expenses before the DEO, Mandi by 30.7.2013.

The Applicant failed to file his account of election expenses in the manner required by law

as stipulated under the said Section 78 of the Act, before the District Election Officer(DC), Mandi

as reported by the District Election Officer(DC), Mandi vide his Report dated 5.8.2013 received in

the Commission on 5.9.2013 under Rule 89 of the Conduct of Election Rules, 1961(hereinafter

referred to as “1961 Rules”).

A Notice dated 19.02.2014 was issued to the Applicant by the Election Commission of

India, under sub-rule (5) of Rule 89 of the 1961 Rules, asking him to show cause as to why he

should not be disqualified under section 10A of the Act and also requiring him to submit his

accounts in the prescribed manner within 20 days of the receipt of notice, failing which it was made

clear in the notice that he would be disqualified from contesting elections for a period of three

years. The said notice was delivered to the Applicant on 3^rd March, 2014.

The District Election Officer(DC), Mandi intimated vide his letter No. ELN-MND-F(1)-

23/2012/7405 – 06, dated 24.09.2014, that the Applicant had not filed his account of election

expenses in the manner required by law upto the date of report. Therefore, the Commission, vide

its Order No. 100/HP – HP/1/2013, dated 08.06 2015, disqualified the Applicant from contesting

election to the Houses of the Parliament/State Legislatures under section 10A of the Act for failure

to lodge his account of election expenses in the manner as required by the said Act and the Rule and

Order made thereunder. The Applicant stood disqualified for a period of 3 years from the date of

the order.

The Applicant has preferred an application dated 1.3.2017 received in the Commission on

17.3.2017 under Section 11 of the Representation of the People Act, 1951 for the removal of the

disqualification for the reasons stated therein. In the Appeal, the Applicant made the following

submissions;

(i)

The register had been either taken by the police or misplaced during police raid in

his absence.

(ii)

There is nothing to hide by not supplying the register and this in any manner will not

benefit the applicant.

(iii)

The grant total of all election expenses is Rs.5,20.000/-

The Commission afforded the Applicant an opportunity of being heard in person and

present his case vide its letter dated 11.5.2017.

The Applicant appeared on 29.6.2017, before the undersigned, who is the Competent

Authority to consider the Application in the case, by virtue of the powers delegated to the

undersigned by the Commission under section 19A of the Act.

In the personal hearing, the Applicant reiterated the submissions made in the Application.

The main submissions were the following:—

i.

The Applicant wrongly disqualified.

ii.

The records of account of election expenses submitted before the RO.

iii.

The register of account of election expenses misplaced during the CID Police raids

on 14.6.2013 and this was brought to the notice of the RO on 19.6.2013.

iv.

There is nothing to hide by not supplying the register and this in any manner will not

benefit the applicant.

v.

The Applicant has already been undergone a period of two years of disqualification

for some procedural lapse for which the Applicant was not wholly responsible.

I have duly considered the oral submissions, made by the Applicant during the personal

hearing and the points raised by him in his representation dated 29.6.2017 received in the

Commission on 29.6.2017. The Applicant submitted that he had duly replied to the Commission’s

notice dated 19.02.2014. Applicant further submitted that the register under reference was either

taken by the police during their raid conducted in his absence on his office premises on 14.06.2013

or has been misplaced during the raid, as a huge gathering was there during the raid. The raid was

in connection with the execution of search warrant issued by the CJM, Mandi in case FIR

No.12/2013 dated 14.6.2013 u/s 292,465, 469, 471 of IPC, Section 6 of Indecent Representation of

Women (Prohibition) Act and 66(E), 67(A) of IT Act. He stated that he had informed the

Returning Officer about the fact that registers could not be located on 19.06.2013 and made a fresh

request that fresh registers be issued so that he could lodge his account of election expenses.

However, as per the Applicant, DC, Mandi, did not respond and expressed his inability to give fresh

registers on the ground that Expenditure Observer, who was supposed to sign the registers had

already left the constituency. The Applicant has also stated that he lodged his account on 30^th July,

2013.The total expenditure is seen to be well within the ceiling prescribed under Rule 90.

Having considered the submissions of the Applicant and the totality of the facts and

circumstances of the case, I am of the considered view that, the ends of justice will be met if the

disqualification period is reduced to the period already undergone.

NOW, THEREFORE, in exercise of the powers delegated in this regard by the Election

Commission, the undersigned hereby orders, under Section 11 of the Representation of the People

Act, 1951, that the disqualification imposed on 8.6.2015, under Section 10A of the said Act, on the

Applicant be reduced to the period up to and including 5^th October, 2017, and the disqualification

for the remaining period shall stand removed.

Government and of private persons in or over the Forest Land/ Waste Land specified in the

schedule inserted to this Notification have been enquired into and recorded as required under Sub-

Section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

And whereas the Forest Land/ Waste Land shown in the said schedule is the property of

the Government or over which the Government has proprietary rights or the Government is entitled

to the whole or any part of the Forest Produce therein;

No. FFE-B-F(14)-38/2013.—Whereas the nature and extent of the rights of the

Government and of private persons in or over the Forest Land/ Waste Land specified in the

schedule inserted to this Notification have been enquired into and recorded as required under Sub-

Section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

And whereas the Forest Land/ Waste Land shown in the said schedule is the property of

the Government or over which the Government has proprietary rights or the Government is entitled

to the whole or any part of the Forest Produce therein;

Now, therefore, in exercise of the powers conferred by Sub- Section (1) of Section-29 of

the Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of Chapter-
