NOTIFICATION
Shimla-9, the 24th October, 2017
No. PCH-HA(1)19/2008-II.—WHEREAS the draft Himachal Pradesh Panchayati Raj
(General) Amendment Rules, 2017 were published in the Rajpatra, Himachal Pradesh dated 24th
July, 2017 for inviting objections and suggestions from the general public, vide this department
notification of even number dated 21st July, 2017 as required under the provisions of section 186 of
the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994);

AND WHEREAS no objection/suggestion has been received in this behalf during the
stipulated period;
NOW, THEREFORE, in exercise of the powers conferred by section 186 of the Himachal
Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994), the Governor of Himachal Pradesh is
pleased to make the following rules, namely:–
1.
Short title.—These rules may be called the Himachal Pradesh Panchayati Raj
(General) Amendment Rules, 2017.
2.
Amendment of rule 18.—In rule 18 of the Himachal Pradesh Panchayati Raj
(General) Rules, 1997 (hereinafter referred to as the ‘said rules’), for sub-rule (3), the following
sub-rule shall be substituted, namely :—
“(3) The Gram Sabha, in its meeting to be convened in the month of January, shall
consider and pass the budget for the following financial year and in its meeting to be
convened in the month of April, shall consider the accounts of the preceding financial
year and annual audit note and replies, if any, made and the report of administration of
preceding financial year. The Gram Sabha shall also consider a three monthly report of
the business submitted by the Gram Panchayat in the four general meetings and item-
wise income and expenditure incurred by the Gram Panchayat during past three
months shall be placed before the Gram Sabha. Income and expenditure statement of
the ongoing development works being executed by Gram Panchayat shall also be
placed in the meetings in Form-34 for consideration and approval.”.
3.
Amendment of rule 21.—In rule 21 of the said rules, after sub-rule (2), the following
proviso shall be inserted, namely:—
“Provided that no entry with regard to separation of family shall be made in the
Pariwar Register unless having access to the toilet to the family so separated.”.
4.
Amendment of rule 105.—In rule 105 of the said rules, for sub-rule (6), the following
sub-rule shall be substituted, namely:—
“(6) Except Deputy Commissioner of the District, the Zila Parishad may require any
officer/official of the Agriculture, Animal Husbandry, Education, Fisheries, Food and
Supplies, Health and Family Welfare, Horticulture, Industries, Irrigation and Public
Health, Public Works, Revenue, Rural Development, Social Welfare Departments or
any other Department of the State or the Central Government or Semi Government
Organization serving at the district level or Non Government Organization or Public
Sector Undertaking or Private Companies serving within the jurisdiction of the district
to attend its meeting and tender advice etc. in respect of any matter which concerns the
said Department or Non Government Organization or Public Sector Undertaking or
Private Companies to which such officer/official belongs and every such officer/
official shall comply with such requisition.”.
5. Amendment of rule 121.—In rule 121 of the said rules, after sub-rule (2), the
following new sub-rule shall be inserted, namely:—
“(3) A Panchayat may acquire any property after the prior approval of the Director.”.

6. Amendment of rule 137.—In rule 137 of the said rules,–
(a) in sub-rule (1), for the words, signs and figures “No person shall be employed by a
Panchayat, if he is a near relative (father, grandfather, father-in-law, maternal or
paternal uncle, son, grandson, son-in-law, brother, nephew, brother-in-law, wife, sister,
sister’s husband, mother, daughter, niece, mother-in-law, daughter-in law and husband)
of any of its members or if he has been convicted of any criminal offence involving
moral turpitude. No employee of the Panchayat shall be retained in service after he has
attained the age of 58 years.”; the following words and signs shall be inserted,
namely:–
“ (i) that no office bearer shall be included in the selection committee, if he is a
near relative (father, grand father, father-in-law, maternal or paternal uncle, son,
grandson, son-in-law, brother, nephew, brother-in-law, wife, sister, sister’s
husband, mother, daughter, niece, mother-in-law, daughter-in-law and husband)
of any of the candidate who has applied for any post in the Panchayat;
(ii) that no person shall be employed by a Panchayat if he has been convicted of any
criminal offence involving moral turpitude; and
(iii) that no employee of the Panchayat shall be retained in service after he has attained
the age of superannuation as is applicable in the case of Government servants for
their retirement.” shall be substituted.”; and
(b) in sub-rule (2), after the word “employees”, the sign and words “where such provision
has not been prescribed in the specific appointment and conditions of services rules”
shall be inserted.
7. Amendment of rule 141.—In rule 141 of the said rules, for the sign and words
“articles and money” wherever occur the words, “and articles” shall be substituted.

schedule inserted to this Notification have been enquired into and recorded as required under Sub-
Section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

Government or over which the Government has proprietary rights or the Government is entitled to

the Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of Chapter-
IV of the Act shall apply to the said Forest Land/ Waste Land and shall hereafter be called as
“Protected Forests” under the provisions of Sub-Section (2) of Section-29 of the Act ibid.

FORESTS DEPARTMENT
NOTIFICATION
Shimla-2, the 9th October, 2017
No.FFE-B-F(14)-13/2013.—Whereas the nature and extent of the rights of the
Government and of private persons in or over the Forest Land/Waste Land specified in the
schedule inserted to this Notification have been enquired into and recorded as required under Sub-
Section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);
And whereas the Forest Land/ Waste Land shown in the said schedule is the property of the
Government or over which the Government has proprietary rights or the Government is entitled to
the whole or any part of the Forest Produce therein;
Now, therefore, in exercise of the powers conferred by Sub-Section (1) of Section- 29 of the
Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of Chapter-IV of
the Act shall apply to the said Forest Land/ Waste Land and shall hereafter be called as “Protected
Forests” under the provisions of Sub-Section (2) of Section-29 of the Act ibid.
