No. EXN-F(10)-36/2017.—In exercise of the powers conferred by section 10 of the
Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12 of 2005) the Governor of Himachal
Pradesh proposes to make following amendment in SCHEDULE 'D' appended to the Act ibid and
the same are hereby published in the Official Gazette(e-Gazette), Himachal Pradesh for the
information of general public;
If any person likely to be affected by the proposed amendment has any objection(s) or
suggestion(s) to be made with regard to the same, he may send the same to the Excise and Taxation
Commissioner, Himachal Pradesh, Shimla-1710009 within a period of ten days from the date of
publication of this Notification in the Rajpatra, Himachal Pradesh;
Objection(s)/suggestion(s), if any, received within the above stipulated period, shall be

AMENDMENTS IN SCHEDULE 'D'
In SCHEDULE 'D' appended to the Himachal Pradesh Value Added Tax Act, 2005 (Act
No.12 of 2005), in column No. 3 of the commodity shown against serial number 1 " Motor-spirit
(Petrol of all kinds including Aviation Turbine Fuel but excluding Diesel)," for the existing figure
and signs "27%", the figures and signs "26%" shall be substituted. Further, in column No. 3 of the
commodity shown against serial number No. 2 "Diesel" for the existing figures and signs "16%" ,
figures and signs "15%" shall be substituted.

OFFICE ORDER
Dated : the 14th August, 2017
No. PCH-SML(4)14/2010-Krangla-8901.—Whereas Shri Mohan Lal, Pradhan GP
Krangla Development Block Nankhari was suspended vide Office Order No. PCH-SML(4)14/2010
Krangla-13616 dated 09-01-2017 on being found guilty in the perliminary inquiry on account of 19
charges. The regular inquiry was ordered vide Office order No. PCH-SML(4)14/2010 Krangla-
13659-666 dated 11-01-2017 to the Inquiry Officer i.e. Sub-Divisional Officer (C), Rampur. All
charges leveled against the said Panchayat Pradhan pertained to financial irregalarities.
Whereas this office received the regular inquiry report conducted by Sub-Divisional Officer
(C), Rampur vide Office Letter No. RMP Reader 2017-57 dated 26-07-2017. Charges 1 to 19
leveled against Shri Mohan Lal, Pradhan GP Krangla Development Block Nankhari were inquired
into minutely by the Sub-Divisional Officer (C), Rampur during the regular inquiry. In absence of
documents and evidences charges No. 1 to 5 and 11 could not be proved during the regular inquiry,
Inquiry report of the Inquiry officer i.e. Sub-Divisinal Officder (C) Rampur confirms and proves
charges No. 6 to 10 and 12 to 19 on the basis of documents. witnesses and evidences on record.
I have gone through the Inquiry Report and the reply to the show-cause notice furnised by
charged Pradhan. Of the 19 charges, 13 stand proved. The main charge which is clear on all
13 points is that the payment has been made without assessment report. This assessment report is a
must as per Rules 106(1) of the Himachal Pradesh Panchayati Raj (Finance, Budget, Accounts,
Audit, Works, Taxation and Allowances) Rules, 2002. Furthermore, for some works it was found
they were not complete and in the case of charge No. 10, not available for assessment. So, it appers
that not only has there been a procedural violation in making these payments but also a waste of
public money. In response to the show casue notice, a reply was received from the charged
Pradhan. Some of the key points of the reply are.—
(i)
He has agreed that assessment has not been done and can be done now i.e. he admits to
procedural violation.
(ii) He admits that he has paid money as "recoveries" on these works. This is again, a tacit
admission.
(iii) He has claimed works exist on the spot which and is so, procedural violations don't
matter. However, as is clear from the inquiry reports, these works like those in charge
No. 10, which have not been completed and yet payment has been made. Similar is the
case of work No. 17 and 19.
(iv) He has claimed that due to the TAs being busy with work of other works, assessment
could not be carried out. However, for certain works payment has been done within a
month or two of the muster roll.
(v) He aslo claims why BDO Office released second installment. However the ultimate
responsibility lies with people, executing the work and making payments on the
ground. In this there is a joint responsibility of the Pradhan. Technical staff and
Panchayat Secretary.

Based on the above discussion, it appears, beyond doubt, there has been a gross procedural
violation in the manner of payments. If it had happened for one or two works, it could still be
viewed liberally but in this case it appears to be the norm. In some cases, funds have been drawn
without work completion. This is the worst scenario-where neither work is completed and also
funds are drawn out.
The conduct of the technical staff and Panchayat Secretaries is under scruity. Procedings
have been initiated against hem as well.
Keeping the grave nature of the charges which include procedural violation leading to
financial embezzlement and tacit admission of the same by him using section 146(1)(b) &
clarification (b) of Himachal Pradesh Panchayati Raj Act, 1994 the charged Pradhan stands
removed from his post of Pradhan.
Therefore, I Rohan Chand Thakur, IAS Deputy Commissioner, Shimla by the powers vested
in me under section 146(1)(b) of Himachal Pradesh Panchayati Raj Act, 1994 remove Shri Mohan
Lal, Pradhan GP Krangla Development Block Nankhari from the post of Panchayat Pradhan. I also
order Shri Mohan Lal to immediately handover any moveable and immoveable property, stamps,
records and cash if any pertaining to Gram Panchayat Krangla to Panchayat secretary.
