No. SJE-A-B(1)-15/2012.—In exercise of the powers conferred by proviso to article 309 of

the Constitution of India, the Governor, Himachal Pradesh in consultation with the Himachal

Pradesh Public Service Commission, is pleased to make the following rules further to amend the

Himachal Pradesh, Department of Social Justice & Empowerment, Special Post Graduate Teacher

(PGT), Music Vocal (Visually Impaired) Class-II (Non-Gazetted) Recruitment and Promotion

Rules, 2015, notified vide Notification of even No. dated: 26-06-2015, namely:—

Short title and commencement.—(1) These rules may be called the Himachal

Pradesh, Department of Social Justice and Empowerment, Special Post Graduate Teacher (PGT),

Music Vocal (Visually Impaired) Class-II (Non-Gazetted), Recruitment and Promotion (1st-

Amendment)Rules, 2017.

(2) These rules shall come into force from the date of publication in the Rajpatra,

Himachal Pradesh.

Amendment of Annexure- "A".—In Annexure- "A" to the Himachal Pradesh,

Department of Social Justice and Empowerment, Special Post Graduate Teacher (PGT), Music

Vocal (Visually impaired) Class-II (Non-Gazetted) Recruitment and Promotion Rules, 2015 (here-

in-after referred to as the said rules),—

(a) the existing provisions against Col. No. 6 (2), shall be omitted;

(b) for the existing provisions against Col. No. 7, the following shall be substituted,

namely :—

"(a) Essential Qualification:—

(i)

A second class Master Degree in Music (Vocal) from any recognized

University with Music (Vocal) as one of the subject at the Graduation level.

Higher Education with Music (Vocal) as one of the subject at the Graduation level with

any one of the following:—

(a) Sangeet Visharad Examination of Gandharva Mahavidyalaya Mandal, Mumbai.

(b) Sangeet-vid Examination of India Kala Sangeet Vishwa Vidyalaya Khairagarh,

M.P.

(d) Sangeet Visharad Examination of Bhatkhande Sangeet Vidyapeeth, Lucknow

(Previously Morris College of Hindustani Music, Lucknow).

(e) Final examination of Madhya Sangeet Mahavidyalaya, Lashkar, Gwalior.

(f)

Final examination of Shankar Gandharva Vidyalaya, Gwalior.

(g) Sangeet Ratan Diploma awarded by the Director, Department of Education, M.P.

The new degree / diploma awarded by the concerned agencies/ institution in lieu thereof.

(ii) B.Ed. in Special Education (Visually Impaired) or PGPDSE (VI) (Post Graduate

Professional Diploma in Special Education) with General/Special B.Ed. from a

recognized Institution/ University.

(iii) The candidate must be registered with Rehabilitation Council of India (RCI).";

namely:—

"(a) Two years subject to such further extension for a period not exceeding one year as

may be ordered by the competent authority in special circumstances and reasons

to be recorded in writing.

(b) No probation in the case of appointment on contract basis, tenure basis, re-

employment after superannuation and absorption”;

(d) for the existing provisions against Col No. 15, the following shall be substituted,

namely:—

"Selection for appointment to the post in the case of direct recruitment shall be made

on the basis of interview/personality test, if the Himachal Pradesh Public Service

Commission or other recruiting agency/authority as the case may be, so consider

necessary or expedient on the basis of interview/personality test preceded by a

screening test (objective type) / written test or practical test or physical test, the

andard/syllabus, etc. of which, will be determined by the Commission/other recruiting

agency/authority as the case may be”;

(e) for the existing provisions against Col No. 15-A(IV), the following shall be

substituted, namely:—

“SELECTION PROCESS:

'Selection for appointment to the post in the case of contract appointment shall be

made on the basis of interview / personality test or if considered necessary or expedient

on the basis of interview/ personality test preceded by a screening test (objective type)/

written test or practical test or physical test, the standard/ syllabus, etc. of which, will

be determined by the concerned recruiting agency i.e. the Himachal Pradesh Public

Service Commission.”;

(f) for the existing provisions against Col No. 15-A (VII) (c), the following shall be

substituted, namely:—

"Contract Appointee will be entitled for one day's casual leave after putting one month

service. However, the contract employee will also be entitled for 135 days Maternity Leave,

10 days Medical Leave and 5 days Special Leave. A female contract appointee shall also be

entitled for maternity leave not exceeding 45 days (irrespective of the number of surviving

children) during the entire service, in case of miscarriage including abortion, on production

of medical certificate issued by the authorized Government Medical Officer. He/she shall

not be entitled for Medical Re-imbursement and LTC etc. No leave of any other kind except

above is admissible to the contract appointee:

Provided that the un-availed Casual leave, Medical Leave & Special Leave can be

accumulated up to the Calendar Year and will not be carried forward for the next Calendar

Year and in Annexure 'B' of the said rules.”;

Section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

And whereas the Forest Land/ Waste Land shown in the said schedule is the property of the

Government or over which the Government has proprietary rights or the Government is entitled to

the whole or any part of the Forest Produce therein;

Now, therefore, in exercise of the powers conferred by Sub- Section (1) of Section-29 of the

Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of Chapter-IV of

NOTIFICATION

Shimla-2, the 22^nd February, 2018

No. TCP-F (5)-1/2018.—In exercise of the powers conferred by section 87 of the Himachal

Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor, Himachal

Pradesh proposes to make the following rules further to amend the Himachal Pradesh Town and

Country Planning Rules, 2014, notified vide this Department Notification No. TCP-A (3)-1/2014-I,

dated 1-12-2014 and published in the Rajpatra, Himachal Pradesh on 1st December, 2014. These

are hereby published in the Rajpatra, Himachal Pradesh for the information of the general public;

If any person, likely to be affected by these rules has any objection(s) or suggestion(s) with

regard to these rules, he may send the same to the Additional Chief Secretary (TCP) to the

Government of Himachal Pradesh, Shimla by post or on e-mail address [email protected], within a

period of thirty days from the date of publication of the said draft rules in the Rajpatra (e-Gazette)

of Himachal Pradesh;

The objection(s) or suggestion(s), if any, received within the above stipulated period shall

be taken into consideration by the State Government, before finalizing these rules, namely :—

Short title.—These rules may be called the Himachal Pradesh Town and Country

Planning (Amendment) Rules, 2018.

Amendment of rule 34.—In rule 34 of the Himachal Pradesh Town and Country

Planning Rules, 2014 (hereinafter referred to as the ‘said rules’), after sub-rule (1), the following

sub-rule shall be inserted, namely:—

“(2) Wherever any un-authorized part of a building is sealed under the provisions of sub-

section (1) of Section 39-B of the Himachal Pradesh Town & Country Planning Act, 1977,

the Officer of the Government empowered in this behalf shall ensure that.—

(a) the sealing is done in such a manner that the sealed portion is rendered nonusable. This

may be done by sealing all the doors and windows by way of brick-walls,

breaking/sealing the stair-case leading to the un-authorized portion and taking such

measures as may be considered essential;

(b) if the un-authorized portion is sealed to the satisfaction of the Officer of the

Government empowered in this behalf, the remaining portion of the building may be

allowed to be used temporarily and services be re-connected if the violator/owner

agrees to remove the part of remaining un-authorized portion of the building within a

period of one year after obtaining an Undertaking in Form 25-A appended to these

rules:

Provided that no sealing may be done on the part of building which has been approved

by the Competent Authority.

Explanation.—Notwithstanding anything contained in Interim Development Plan and

Development Plans prepared for Planning Areas and Special Areas and in areas refered under

Appendix-I appended to these Rules, the provisions contained in this sub-rule shall apply alongwith

Form 25-A.

3. Insertion of form 25-A.—In the said rules after form 25, the form 25-A shall be

inserted as under:—

That I shall seal the un-authorised portion of the building on my own as per directions of the

Competent Authority and the entire expenditure involved in sealing of the unauthorized portion of

the building shall be borne by me, be it related to material or labour. In case sealing is done by the

Competent Authority, the entire expenditure shall be paid by me to the Competent Authority,

failing which the same shall be recovered from me as arrears of land revenue.
