Bill No. 8 of 2018

THE HIMACHAL PRADESH POLICE (AMENDMENT) BILL, 2018

(AS INTRODUCED IN THE LEGISLATIVE ASSEMBLY)

A

BILL

further to amend the Himachal Pradesh Police Act, 2007 (Act No. 17 of 2007)

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-ninth Year of

the Republic of India as follows:—

159

jkti=] fgekpy izns'k] 09 vizSy] 2018@19 pS=] 1940

1. Short title.—This Act may be called the Himachal Pradesh Police (Amendment) Act,

2018.

2.

Amendment of Section 17.—In section 17 of the Himachal Pradesh Police Act,

2007 (hereinafter referred to as the “ principal Act”),—

(a) for sub-section (1), the following shall be substituted, namely:—

"(1) The State Government shall create and effectively maintain a Directorate of

Forensics Services dedicated to provide independent forensic reports to the Police and

Investigating Agencies, which shall be comprised of a Forensic Science Laboratory at

the State–level, a Regional Forensic Science Laboratory for every Police Range and a

Mobile Forensic Science Unit for every Police District, with appropriate equipments

and scientific manpower, in accordance with the guidelines laid down by the

Directorate of Forensic Science Services or the Bureau of Police Research and

Development. The Directorate shall be headed by the Director General (Forensics),

the State Forensic Science Laboratory by the Director, the Regional Forensic Science

Laboratory by the Regional or the Range Director and District Mobile Forensic Unit

by the Deputy Director or the Assistant Director.".

(b) After sub-section (1), the following sub-section shall be inserted, namely :—

"(1A) The Directorate of Forensics Services shall have a Finger Print Bureau to be

headed by an Officer not below the rank of Director, Forensic Science. The Bureau

shall maintain computerized searchable databanks of fingerprints, including those

collected in the course of investigation by the Bureau, the Directorate of Forensics

Services or the District Police. The State Finger Print Bureau shall coordinate activities

with similar agencies in other States and the Government of India. The Finger Print

Bureau shall provide training to Investigation Officers of the District Police and

develop standard operating procedures for lifting, developing and matching finger

prints in various circumstances, and shall publish a Finger Printing Manual for the

purpose.”.

3.

Amendment of Section 84.—In section 84 of the principal Act, sub-section (3) shall

be omitted.

__________

STATEMENT OF OBJECTS AND REASONS

The Himachal Pradesh Police Act, 2007 has been enacted to consolidate laws relating to the

establishment and management of Police and matters connected therewith. In Chapter-II of the Act

ibid., the authorities at different levels in the Railway Police, the State Intelligence and Criminal

Investigation Departments, State Police Training Academy and Police Training Colleges and

Schools etc. have been specified. Whereas, in the case of Organization of Technical and Support

Services, no such authorities have been specified under section 17 of the Act ibid. Therefore, the

competent authorities are also required to be specified accordingly for the said organization.

Presently, the Finger Print Bureau is under the control of the Criminal Investigation

Department, and the Directorate of Forensics Services has no control on the functioning of the said

Bureau due to which there is lack of coordination between the Directorate of Forensics Services

and the Finger Print Bureau. Thus, in order to have an effective control of the Directorate of

160

jkti=] fgekpy izns'k] 09 vizSy] 2018@19 pS=] 1940

Forensics Services on the said Bureau it has been proposed to transfer the Finger Print Bureau to

the Directorate of Forensics Services for better coordination and control. This will increase the

efficiency in the administration of criminal justice. This has necessitated the proposed amendments

in the Act ibid.

This Bill seeks to achieve the aforesaid objectives.

(JAI RAM THAKUR)

Chief Minister.

___________

STATEMENT OF OBJECTS AND REASONS

The Himachal Pradesh Hindu Public Religious Institutions and Charitable Endowments

Act, 1984 was enacted to provide for better administration of the Hindu Public Religious

Institutions and Charitable Endowments and for protection of the properties of such institutions.

However, many authorities actively involved in the administration of the Hindu Public Religious

Institutions and Charitable Endowments were not included in the Act. Therefore, such authorities

170

jkti=] fgekpy izns'k] 09 vizSy] 2018@19 pS=] 1940

are required to be included in the Act. Accordingly, the definitions and the procedure to appoint

such authorities are being substituted through the proposed legislation. Further, there have been

instances of encroachment on the land and premises belonging to the temple trusts, hence,

provisions are being made to empower the Commissioner (Temple) to authorise other officers to

make an application for taking up proceedings under appropriate laws before the Competent

Authority. This is likely to ensure speedy eviction of encroachments. The number of devotees to

religious shrines are increasing day by day, hence, to provide better administration, the

maximum number of trustees are being increased to 25 from the present number of 20. A

provision is being made for earmarking receipt upto fifteen percent for the consturction,

maintenance and upgradation of Gau-sadans or for Gau-vansh samvardhan. It will enable the

shelter and proper care to the abandoned cattle wealth of the State. The proposed legislation aims at

improving the administration of the Hindu Public Religious Institutions and Charitable

Endowments.

Since, the Legislative Assembly was not in session and amendment in the Himachal

Pradesh Hindu Public Religious Institutions and Charitable Endowments Act, 1984 had to be made

urgently, therefore, His Excellency the Governor, Himachal Pradesh in exercise of the powers

under article 213(1) of the Constitution of India, promulgated the Himachal Pradesh Hindu Public

Religious Institutions and Charitable Endowments (Amendment) Ordinance, 2017 on 7th October,

2017, which was published in the Rajpatra (e-Gazette), Himachal Pradesh on the 11th October,

2017. Now, a regular legislation is being brought in place of said Ordinance.

This Bill seeks to achieve the aforesaid objectives.

(JAI RAM THAKUR)

Chief Minister.

STATEMENT OF OBJECTS AND REASONS

The Chief Whip and the Deputy Chief Whip are responsible for administering the whip

system that ensures the members to attend the meetings of the House of Legislature. These Whips

perform some very important duties concerning the mapping, monitoring and management of

Government business in the House. Another important function of the said Whips is to constantly

feel the pulse of the House and apprise the leader of the House about the happening in the House.

The Chief Whip and the Deputy Chief Whip keep in close touch with the Whips of the other parties

also on the matters concerning the business in the House.

In view of the multifarious functions being performed by the Chief Whip and the Deputy

Chief Whip, there is a proposal to enact a law to regulate their salaries and allowances and other

benefits as presently there is no law in this regard.

This Bill seeks to achieve the aforesaid objectives.

STATEMENT OF OBJECTS AND REASONS

Notification dated 26-03-2016 has enacted an Act namely the Real Estate (Regulation and

Development) Act, 2016. This Act has come into force with effect from 1st May, 2016. The

objectives of the said Act includes the regulation and promotion of the real estate sector and to

ensure sale of plots, apartments, buildings or real estate projects etc. in a transparent manner.

Further, it is also useful to protect the interests of the consumers in real estate sector and to

establish an adjudicating mechanism for speedy dispute redressal and also to establish the

Appellate Tribunal to hear appeals from the decisions, directions or orders of the Real Estate

Regulatory Authority and the adjudicating officer and for matters connected therewith or incidental

thereto.

Presently, the registration of Promoters, Estate Agents and construction of Colonies and

Apartments etc. are being regulated as per provisions of Chapter-IX-A and IX-B of the Himachal

Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977). However, consequent upon

enactment of the Real Estate (Regulation and Development) Act, 2016, it is imperative to omit the

related provisions from the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12

of 1977). In order to streamline the process of planning permission and ease of doing business, it is
