No. Shram(F)4-3/2017-Loose.—In continuation to this Department Notification of even

number dated 21^st May, 2013, the Governor of Himachal Pradesh is pleased to introduce the

English Speaking Training Course under Skill Development Allowance Scheme 2013 for which

the eligibility Criteria are as under:—

English Speaking Training Course will be imparted

the

selected

Training

Institutes

the

Department

Technical

Education

and

the

Education

Department

Himachal

Pradesh

Government, respectively.

Duration of the Course

The duration of the English training course will be

of maximum period of 6 months (minimum two

hours daily period basis).

Selection of Curriculum

The Department of the Higher Education, Himachal

Pradesh will prepare/frame the syllabus for the

English Speaking Training Course.

Certification

After completion of training course certification will

be done by the Principal of the concerned

institute. The curriculum and examination procedure

will be designed/framed by the Department of

Education and Technical Education.

Budget Provision

The Course will govern under the Skill Development

Allowance Scheme, 2013 and the Department of

Technical Education and the Department of Higher

Education of Himachal Pradesh will create corpus

fund for the purpose of meeting expenses related to

this Course, from the fee collected from trainees to

whom Skill Development Allowance will be given by

the Labour & Employment Department of Himachal

Pradesh @ Rs. 1000 per month and @ Rs. 1500 per

month in case of 50% or more permanent

Specially Abled Persons, for their Skill Development.

Eligibility Criteria

Same as of the Skill Development Allowance

Scheme, 2013.

Faculty

The Department of Technical Education and the

Department of Higher Education of Himachal

Pradesh will utilize the services of existing faculty

or engage fresh faculty for running the training

course whose salary/ remuneration will be paid from

the corpus fund generated by these Departments.

Trainees

Further, this training course will be imparted to the

students of Final Years of respective Institutes as

well as for outside interested eligible applicants. The

concerned training institutes will maintain record of

the trainees/ students pursuing English Speaking

and issue Certificate after completion of Training

course.

Nodal Department

The Department of Labour & Employment will

function as a Nodal Department and constitute a

Committee of all the concerned Departments

(Technical

Education,

Higher

Education

and

Rashtriya Madhmik Siksha Abhiyaan) for a period

six

months

for

monitoring

the

smooth

implementation of the Scheme, will publize the

new Scheme/changes and coordinate with the

concerned Departments. This Department will also

disburse Skill Development Allowance to all the

eligible beneficiaries pursuing English Speaking

Training Course, as per the provisions of the Skill

Shimla-2, the 19th July, 2018

No. UD-A(3)-5/2012.—Whereas the draft Himachal Pradesh Urban Development Rules,

2018 were published in the Rajpatra (e-Gazette), Himachal Pradesh vide this department

notification of even number dated 12-3-2018 for inviting objection(s) and suggestion(s) from the

persons likely to be affected thereby, as required under sub-section (1) of Section 305 read with

Section 279 of the Himachal Pradesh Municipal Act, 1994 (Act No. 13 of 1994);

And whereas, objection(s) and suggestion(s) have been received within the stipulated period

by the State Government in this behalf and the same have been considered;

Now, therefore, in exercise of powers conferred by sub-section of section 305 read with

section 279 of the Himachal Pradesh Municipal Act,1994 (Act No.13 of 1994), the Governor,

Himachal Pradesh is pleased to make the following Rules, 2018 namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal

Pradesh Municipalities Executive Officer/Secretary (Recruitment, Promotion and other conditions

of Services) Rules, 2018.

(2) These rules shall come into force from the date of publication in the Rajpatra (e-

Gazette), Himachal Pradesh.

(3) These rules shall apply to the posts specified in Column No. 2 of Annexure-I.

2. Definitions.—(1) In these rules unless the context otherwise requires,—

(a) "Act" means the Himachal Pradesh Municipal Act, 1994 ;

(b) "Annexure" means an Annexure appended to these rules ;

in Annexure-II of these rules in respect of the category of service ;

(d) "Director" means the Director, Urban Development Department, Himachal

Pradesh;

(e) "direct recruitment" means an appointment by selection other than by

promotion/transfer/secondment;

(f) "Government" means the Government of Himachal Pradesh ;

(g) "Municipality" means—

(i) a Nagar Panchayat and Municipal Council constituted under the Himachal

Pradesh Municipal Act, 1994; and

(ii) a Municipal Corporation constituted under the Himachal Pradesh Municipal

Corporation Act, 1994 ;

(h) "member" means a member of the service ; and

(i) 'Service' means a municipal service constituted by the Government under the

provisions of the Himachal Pradesh Municipal Services Act, 1994, the

Himachal Pradesh Municipal Corporation Act, 1994 and the Himachal

Pradesh Municipal Act, 1994 in the manner specified under these rules.

Explanation.— Service includes the service as a probationer or apprentice

provided that such service is followed by confirmation without any break

and shall also include joining time.

(2) All other words and expressions used herein but not defined shall have the same

meanings respectively as assigned to them in the Act.

3. Nationality, Domicile and Character of persons to be appointed to a service.—

The candidate for appointment to any service or post must be a citizen of India.

4. Number of posts, Classification and scales of pay.—(1) The number of posts and

scales of pay of various posts shall be as specified in Columns (3) & (4) of Annexure-I or as may

be notified by the Government from time to time.

(2) The classification of the posts shall be as under :—

Executive State Municipals Services

Secretary

5. Recruitment and Promotion.—(1) The method of recruitment, promotion and other

matters connected therewith shall be as specified in Columns (5) to (9) of Annexure-I of these

rules.

(2) The direct recruitment shall be made by appointing authority on the recommendations

of a Selection Committee constituted under sub-rule (3).

(3) The Government may, from time to time, by notification, constitute a Selection

Committee consisting of at least three members.

(4) While making recruitment under sub–rule (2) the general instructions of the

Government regarding reservation in service for members of the Scheduled Castes, Scheduled

Tribes, Backward Classes and for any other category in relation to the services under it shall be

applicable to the services.

(5) An incumbent who foregoes promotion, shall be debarred from promotion for a period

of 2 years and shall rank junior to all those who may have been promoted during this period.

(6) A person appointed to the service shall not be deemed to have been appointed to any

civil post under the State Government.

(7) Recruitment on contract basis shall be made in accordance with the provisions made in

the Annexure –II and III.

6. Age on entry.— No person shall be appointed to a service by direct recruitment if he

Provided that in the case of candidates belonging to the Scheduled Castes, Scheduled Tribes and

other Backward Classes, the maximum age limit shall be such as may be fixed by the Government

from time to time.

7. Physical Fitness.—A person appointed to the service by direct recruitment shall

produce a certificate of physical fitness from a Government Medical Practitioner before joining the

service. Such person shall, before being examined, make and sign declaration in Form specified for

Government servants and Medical Officer shall examine him and furnish a certificate in Form

specified in the case of Government servants.

8. Disqualifications.—No person, —

(a) who has entered into or contracted a marriage with a person having a spouse

living; or

(b) who, having a spouse living has entered into or contracted a marriage with any

other person;

shall be eligible for appointment to a service :

Provided that the Government may, if satisfied that such marriage is permissible under

the personal law applicable to such person or on the basis of any other justified

grounds, exempt any person from operation of this rule.

9. Liability to transfer.— Member of the service shall be liable to serve at any place in

the State of Himachal Pradesh.

10. Probation.—(1) A person appointed to any post in a service shall remain on probation

for a period of two years and there will be no probation period for a contract appointee:

provided that—

(a) any period, after such appointment, spent on secondment on a corresponding or a

higher post shall count towards the period of probation; and

(b) any period of officiating appointment shall be reckoned as the period spent on

probation, but no person who has so officiated shall, on the completion of the specified

period of probation, be entitled to be confirmed, unless he has been appointed against a

permanent vacancy.

(2) If, in the opinion of the Appointing Authority, the work, or conduct of a person

appointed to any post in the service during the period of his probation, is not satisfactory, it may –

(a) if such person is appointed by direct recruitment, dispense with his services ;

(b) if such person is appointed by promotion—

(i) revert him to his former post ; or

(ii) deal with him in such a manner as the terms and conditions of the previous

appointment provide for; or

(iii) extend his period of probation for one year and thereafter pass such order as it

would have passed on the expiry of the first period of probation :

Provided that the total period of probation including extension, if any, shall not

exceed three years.

(3) On the completion of the period of probation of person, the Appointing Authority may,

if his work or conduct has, in its opinion, been satisfactory—

(a) confirm such person from the date of his appointment, if appointed against a

permanent vacancy ; or

(b) Confirm such person from the date from which a permanent vacancy occurs, if

appointed against a temporary vacancy ; or

vacancy.

11. Seniority of the members of the service.—The seniority inter-se of the members of

the services shall be determined separately for every category by the length of their continuous

service on a post in the said category :

Provided that in the case of members appointed by direct recruitment, their inter-se-seniority shall

be in the order of merit determined by the service selection committee or any other recruiting

authority, as the case may be :

Provided further that in the case of two or more members appointed on the same date, a member

appointed by direct recruitment shall be senior to a member appointed otherwise.

12. Punishment and Appeals.—The Disciplinary Authority and Appellate Authority for

the purpose of these rules shall be as specified in Annexure-II and Annexure-III of these rules.

13. Departmental Examination.—The Government may by a notification published in

the Rajpatra(e-Gezette), Himachal Pradesh direct that the person(s) appointed to a post or category

of posts as may be specified therein shall be required to pass a departmental examination, the

details and syllabus for which and consequences for failure to pass it, shall also be specified in the

said notification.

14. Power to relax.—Where the Government is of the opinion that it is necessary or

expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the

provisions of these rules with respect to any class or category of persons.

15. Interpretation.—If any doubt arises relating to the interpretation of the rules, it shall

be referred to the Government whose decision thereon shall be final.

16. Repeal and savings.— (1) The Himachal Pradesh Municipalities Executive Officer/

Secretary (Recruitment, Promotion and other conditions of Services) Rules, 1997, notified vide

Notification No. LSG.A(3)-5/96-A, dated 19-8-1997 and published in the Rajpatra, Himachal

Pradesh (Extraordinary) dated 1-9-1997 and any rules, regulations and bye-laws relating to the

municipal services in force in the municipalities immediately before the commencement of these

rules, are hereby repealed.

(2) Notwithstanding such repeal, any appointment made or any thing done or any action

taken under the rules, regulations or bye-laws so repealed under sub-rule (1) supra, shall be deemed

to have been validly made or done or taken under these rules.

Selection for appointment to the post by direct recruitment on contract basis-

Notwithstanding anything contained in these rules, contract appointments to the post will be made

subject to the terms and conditions given below :—

(I) CONCEPT.—(a) Under this policy the Executive Officer/Secretary in the

Department of Urban Department, Himachal Pradesh will be engaged on contract basis initially for

one year, which may be extendable on year to year basis:

Provided that for extention/renewal of contract period on year to year basis, the Director (Urban

Development) Himachal Pradesh shall issue a certificate that the service and conduct of the

contract appointee is satisfactory during the year and only then his period of contract is to be

renewed/extended.

(b) Filling up of posts—The Secretary (Urban Development) to the Government of

Himachal Pradesh after obtaining the approval of the the Government to fill up the posts on

contract basis will advertise the details of the vacant posts in atleast two leading newspapers and

invite applications from candidates having the specified qualifications and fulfilling the other

eligibility conditions as prescribed in these rules.

(III) APPOINTING/DISCIPLINARY AUTHORITY.—The Secretary (Urban Develop-

ment) to the Government of Himachal Pradesh will be appointing and disciplinary authority.

(IV) SELECTION PROCESS.—Selection for appointment to the post in the case of

Contract Appointment will be made on the basis of viva-voce test or if considered necessary or

expedient by a written test or practical test the standard/syllabus etc. of which will be determined

by the concerned recruiting agency.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS.—

As may be constituted by the concerned recruiting agency.

(VI) AGREEMENT.—After selection of a candidate, he/she shall sign an agreement as per

Annexure-A.

(VII) TERMS & CONDITIONS.—(a) The contractual appointee will be paid fixed

corresponding cadre of employees, appointed/working on a regular basis, in the relevant pay band

Provided that he/she shall submit the certificate of illness/fitness issued by the Medical Officer, as

per prevailing instructions of the Government.

(e) An official appointed on contract basis who have completed three years tenure at one

place of posting will be eligible for transfer on need based basis wherever required on

administrative grounds.

(f) Selected candidate will have to submit a certificate of his/her fitness from a

Government Medical Practitioner. Women candidate pregnant beyond 12 weeks will stand

temporarilly unfit till the confinement is over. The women candidate will be re-examined for fitness

from an authorized Medical Officer/Practitioner.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection

with his/her official duties at the same rate as applicable to regular counterpart officials at the

minimum of pay scale.

(h) Provisions of service rules like FRSR, Leave Rules, GPF Rules and Conduct Rules as

are applicable in case of regular employees will not be applicable in case of contract appointee.

They will be entitled for emoluments etc. as detailed in this column.

NOTICE

Whereas an application for declaring building situtated in Ward No. 5, Mohalla Orian Wala,

Khasra No. 941& 942 Up, Mohal Una Khas as per Jamabandi of the year 2012-2013 as unsafe has

been received from r/o Ward No. 5, at the Jan Manch programme held at Una on 3rd June, 2018.

That as per report J.E., M.C. Una, Tehsildar and S.H.O. Una, the said building is unsafe and the

safety of the public is endangered by reason of the said building.

Whereas, keeping in mind the issue of public safety the building needs to be demolished. I

do hereby direct and require you within thirty days of this notice to demolish the south-east corner

of the said building or to appear in the Court of S.D.M.Una on the 3rd August, 2018 next and to

show why this order should not be made absolute.
