dated 12th October, 2018, the Governor, Himachal Pradesh is pleased to notify the terms and
conditions of appointment of Sh. Ramesh Chand Dhawala, MLA as Deputy Chairman, State
Planning Board, as under :—
1.
He shall not be paid any salary by the office of State Planning Board and he will
draw salary and other allied allowances from H.P. Vidhan Sabha as admissible to
Members of Legislative Assembly under relevant Rules/Acts.

He shall be entitled to TA/DA and also the road mileage allowance which shall be
borne by the State Planning Board at the rates as per entitlement as Member of
Legislative Assembly for touring in connection with the affairs of the State Planning

He shall be entitled to rent free semi-furnished residence or in lieu thereof H.R.A.
at the rate of Rs. 2500/- per month. If the accommodation is provided by H.P.
Vidhan Sabha, the same shall be semi-furnished by the State Planning Board.
4.
He shall be entitled to the use of official car maintenance and propulsion of which
shall be borne by the State Planning Board. He may use his private vehicle for
official purpose as per given system and rates.
5.
He shall be paid sumptuary allowance @ 15,000/-(Rs. Fifteen thousand) per month.
6.
Free telephone facility, one in office and one at residence will be provided by the
State Planning Board. Residential phone facility shall be provided only if no such
facility is provided by the Vidhan Sabha in the residential accommodation allotted
by the Vidhan Sabha. Provided that the difference between the actual telephone
allowance admissible under the H.P. Legislative Assembly (Allowance & Pension
of Members) Act, 1971 in respect of telephone provided by the H. P. Vidhan
Sabha and the actual telephone charges for above provided by State Planning Board
shall be reimbursed by the State Planning Board.
7.
He shall be provided with Secretariat Assistance in the shape of personal staff by
the State Planning Board.
8.
Reimbursement of actual electricity and water charges at the residence minus
Rs. 1000/- per month shall be borne by the State Planning Board.
9.
He shall be entitled to all facilities from H.P. Vidhan Sabha in accordance with the
provision of Act ibid, in addition to above facilities.

No. HOME(G)-A(3)-1/2016.—The Governor, Himachal Pradesh in exercise of powers
conferred by proviso to article 309 of the Constitution of India and in consultation with the
Himachal Pradesh Public Service Commission, is pleased to make the Recruitment and Promotion
Rules for the post of Deputy District Attorney, Class-I (Gazetted) in the Department of Prosecution,
Himachal Pradesh as per Annexure- ''A'' attached to this notification, namely:—
1.
Short title and commencement.—(1)These rules may be called the Himachal
Pradesh, Prosecution Department, Deputy District Attorney, Class-I (Gazetted) Recruitment and
Promotion Rules, 2018.
(2) These rules shall come into force from the date of publication in the Rajpatra (e-
Gazette), Himachal Pradesh.

2.
Repeal and savings.—(1) The Himachal Pradesh Prosecution Department, Deputy
District Attorney, Class-I (Gazetted) Recruitment and Promotion Rules, 2010 notified vide this
Department Notification No. Home (Prose) A(3)-1/2009, dated 12th January, 2011 are hereby
repealed.
(2) Notwithstanding such repeal, any appointment made or anything done or any action
taken under the rules so repealed under sub rule (1) supra, shall be deemed to have been validly
made, done or taken under these rules.

allowed with the special permission of the Legal Remembrancer/Secretary (Home) to prosecute,

plead or defend cases on behalf of other States, Union of India and autonomous bodies of Himachal
Pradesh Government and fee may be charged from them by the State Government. The 2/3rd of the
said fees charged by the State Government for conducting civil cases on behalf of other States,
Union of India and autonomous bodies, shall be paid to the Deputy District Attorney concerned:
Provided that for the purpose of promotion every employee shall have to serve at least one
tenure in the Tribal/Difficult/Hard areas and remote/rural areas subject to adequate number of
post(s) available in such areas:
Provided further that the proviso (I) supra shall not be applicable in the case of those
employees who have five years or less service left for superannuation except posting/transfer in
remote/rural areas. However, the condition of five years shall not be applicable in cases of
promotion:
Provided further that Officers/Officials who have not served atleast one tenure in
Tribal/Difficult/Hard areas and remote/rural areas shall be transferred to such area strictly in
accordance with his/her seniority in the respective cadre.
Explanation-I.—For the purpose of proviso(1) supra the “term” in Tribal/Difficult/Hard
areas/remote/rural areas shall mean normally three years or less period of posting in such areas
keeping in view the administrative exigencies convenience.
Explanation-II.—For the purpose of proviso(I) supra the Tribal/Difficult Areas shall be as
under:—

Explanation-III.—For the purpose of proviso (I) supra the Remote/Rural Areas shall be as
under:—
(i) All stations beyond the radius of 20 Kms. from Sub Division/Tehsil headquarters
(ii) All stations beyond the radius of 15 Kms. from State Headquarters and District head
quarters where bus service is not available and on foot journey is more than 3 (three)
Kms.
(iii) Home town or area adjoining to area of home town within the radius of 20 Kms. of the
employee regardless of its category.
(II) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if
any, prior to regular appointment to the post shall be taken into account towards the length of
service as prescribed in these Rules for promotion subject to the condition that the adhoc
appointment/promotion in the feeder category had been made after following proper acceptable
process of selection in accordance with the provisions of R&P Rules:
Provided that in all cases where a junior person becomes eligible for consideration by virtue
of his total length of service (including the service rendered on adhoc basis followed by regular
service/appointment) in the feeder post in view of the provisions referred to above all persons
senior to him in the respective category post/cadre shall be deemed to be eligible for consideration
and placed above the junior person in the field of consideration;
Provided further that all incumbents to be considered for promotion shall possess the
minimum qualifying service of atleast three years or that prescribed in Recruitment & Promotion
Rules for the post whichever is less:
Provided further that where a person becomes ineligible to be considered for promotion on
account of the requirements of the preceding proviso, the person(s) junior to him shall also be
deemed to be ineligible for consideration for such promotion.
Explanation.—The last proviso shall not render the junior incumbents ineligible for
consideration for promotion if the senior ineligible person(s) happened to be Ex-serviceman who
have joined Armed Forces during the period of emergency and recruited under provisions of Rule 3
of Demobilised Armed Force Personnel (Reservation of Vacancies in HP State Non Technical
Services) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under
the provisions of Rule-3 of Ex-servicemen (Reservation of Vacancies in the Himachal Pradesh
Technical Service) Rules, 1985 and having been given the benefit of seniority thereunder.
(2) Similarly in all cases of confirmation, continuous adhoc service rendered on the feeder
post if any, prior to the regular appointment against such post shall be taken into account towards
the length of service if the adhoc appointment /promotion had been made after proper selection and
in accordance with the provisions of Recruitment & Promotion Rules:
Provided that inter-se-seniority as a result of confirmation after taking into account adhoc
service rendered shall remain unchanged.
