NOTIFICATION

Shimla-2, the 4th June, 2020

No. FFE-B-F(14)-16/2020.—WHEREAS, the nature and extent of the rights of the

Government and of the Private Persons in or over the forest land or waste land specified in the

SCHEDULE appended to this Notification have been enquired into and recorded, as required under

sub-section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

AND WHEREAS, the forest land or waste land shown in the said SCHEDULE is the

property of the Government or over which the Government has proprietary rights or the

Government is entitled to the whole or any part of the forest produce therein;

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) of Section 29

of the Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of

Chapter-IV of the said Act shall apply to the said forest land or waste land and shall hereafter be

called as “protected forests” under the provisions of sub-section (2) of section-29 of the Act ibid.

Shimla-2, the 4th June, 2020

No. FFE-B-F(14)-21/2020.—WHEREAS, the nature and extent of the rights of the

Government and of the Private Persons in or over the forest land or waste land specified in the

SCHEDULE appended to this Notification have been enquired into and recorded, as required under

sub-section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

AND WHEREAS, the forest land or waste land shown in the said SCHEDULE is the

property of the Government or over which the Government has proprietary rights or the

Government is entitled to the whole or any part of the forest produce therein;

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) of Section 29

of the Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of

Chapter-IV of the said Act shall apply to the said forest land or waste land and shall hereafter be

called as “protected forests” under the provisions of sub-section (2) of section-29 of the Act ibid.

PRADESH AMENDMENT ORDINANCE, 2020

Promulgated by the Governor of Himachal Pradesh in the Seventy-first Year of the

Republic of India.

AN ORDINANCE, to amend the Contract Labour (Regulation and Abolition) Act, 1970

(Act No. 37 of 1970) in its application to the State of Himachal Pradesh.

WHEREAS, the Legislative Assembly of Himachal Pradesh is not in session and the

Governor of the State of Himachal Pradesh is satisfied that the circumstances exists which render it

necessary for him to take immediate action;

Abolition) Himachal Pradesh Amendment Ordinance, 2020.

2. Amendment of Section 1.—In Section 1 of the Contract Labour (Regulation and

Abolition) Act, 1970 (Act No. 37 of 1970), in its application to the State of Himachal Pradesh, in

sub- section 4, for the word “twenty” wherever occurs, the word “thirty” shall be substituted.

THE INDUSTRIAL DISPUTES (HIMACHAL PRADESH

AMENDMENT) ORDINANCE, 2020

AN ORDINANCE, to amend the Industrial Disputes Act, 1947 (Act No. 14 of 1947) in

its application to the State of Himachal Pradesh.

WHEREAS, the Legislative Assembly of Himachal Pradesh is not in session and the

Governor of the State of Himachal Pradesh is satisfied that the circumstances exists which render it

necessary for him to take immediate action;

NOW, THEREFORE, in exercise of the powers conferred by clause (1) of article 213 of

the Constitution of India, the Governor of Himachal Pradesh is pleased to promulgate the following

Ordinance:—

1.

Short title.—This Ordinance may be called the Industrial Disputes (Himachal Pradesh

Amendment) Ordinance, 2020.

2.

Amendment of Section 22.—In Section 22 of the Industrial Disputes Act, 1947, in its

application to the State of Himachal Pradesh (hereinafter referred to as the “principal Act”), in sub-

sections (1) and (2), after the words "public utility service", the words "and non-public utility

service" shall be inserted.

3.

Amendment of Section 25F.—In Section 25 F of the principal Act, in clause (b), for

the words "fifteen days", the words “sixty days” shall be substituted.

4.

Amendment of section 25K.—In Section 25 K of the principal Act, in sub-section (1),

for the words "one hundred", the words "two hundred" shall be substituted.

AN ORDINANCE to amend the Factories Act, 1948 (Act No. 63 of 1948) in its

application to the State of Himachal Pradesh.

WHEREAS, the Legislative Assembly of Himachal Pradesh is not in session and the

Governor of the State of Himachal Pradesh is satisfied that the circumstances exists which render it

necessary for him to take immediate action;

NOW, THEREFORE, in exercise of the powers conferred by clause (1) of article 213 of

the Constitution of India, the Governor of Himachal Pradesh is pleased to promulgate the following

Ordinance:—

1. Short title.—This Ordinance may be called the Factories (Himachal Pradesh

Amendment) Ordinance, 2020.

2. Amendment of section 2.—In section 2 of the Factories Act, 1948, in its application to

the State of Himachal Pradesh (hereinafter referred to as the "principal Act"), in clause (m),—

(a) in sub-clause (i), for the word "ten", the word " twenty" shall be substituted; and

(b) in sub-clause (ii), for the word "twenty", the word "forty" shall be substituted.

3. Amendment of section 65.—In section 65 of the principal Act, in sub- section (3), in

clause (iv), for the words "seventy-five", the words “one hundred and fifteen subject to the

condition that overtime shall have to be paid twice the rate of ordinary wages" shall be substituted.

4.

Amendment of section 85.—In section of the principal Act, in sub-section (1), in

clause (i), for the words “ten” and “twenty”, the words “twenty” and “forty” shall be substituted

respectively.

5.

Insertion of section 106 B.—After section 106 A of the principal Act, the following

section shall be inserted, namely:—

"106 B. Compounding of offences.- Any offence punishable under this Act with fine

only and committed for the first time, may subject to any general or special order of

the State Government, be compounded by the Chief Inspector, either before or after the

institution of the prosecution, on realization of such amount of composition fee as he

thinks fit, but not exceeding the maximum amount of fine fixed for the offence; and

where the offence is compounded,—

(a) before the institution of prosecution, the offender shall not be liable to

prosecution, for such offence and shall, if in custody, be set at liberty; and

(b) after the institution of the prosecution, the composition shall have the effect

of an acquittal of the accused with whom the offence has been

compounded.”.
