Shimla, H.P. was issued on 17-09-2019 through a public notice issued under Section 226(2) of
HPMC Act, 1994 for inviting objections/suggestions from the owners of the land in question;
And whereas, S/Sh. Dalip Thakur and Chaman Lal and Roop Ram Co-owner of Kh. No.
549 & 550 while raising objections for declaration of above path as ambulance road have stated
that the work for the construction of above ambulance road was undertaken during the year 2011,
but the work could not be completed by the Municipal Corporation Shimla till now. The nature of
land proposed to be put in use for the purpose of construction of said road has now been changed
on account of construction of building by respective owners of the land and accordingly requested
for withdrawal of the public notice referred to above. One of the objector i.e. Sh. Roop Ram has
also filed a Suit before the Civil Court wherein the defendant Sh. Rakesh Kumar has been
restrained from interfering/carving out any path over the suit land i.e. Kh. No. 549;
And whereas, the objectors being represented through their Counsel were heard in detail by
the then Commissioner, Municipal Corporation Shimla but the order could not be passed by him
before relinquishing the charge of the Commissioner. As per record, the site was also got inspected
through the Patwari of Municipal Corporation Shimla who has reported that the ambulance road is
being constructed on Kh. No. 549, 551/1 & 593. So far as the contention raised by Sh. Roop Ram
qua the civil litigation is concerned, as per record the learned Court has restrained only. Sh.
Rakesh Kumar the private party from carving out any path over the suit land i.e. Kh. No. 549.
However, S/Sh. Roop Ram, Dalip Thakur and Chaman Lal, the co-owners of Kh. No. 549 & 550
by way of joint affidavit dated 03-02-2011 have given “No Objection Certificate” for the
construction of ambulance road which is available on record and the same has been taken into
consideration. Hence, the objections now raised by the objectors are not sustainable in view of the
fact that they have given No Objection Certificate by way of an affidavit as referred to above.
Moreover, the land comprising in Kh. No. 550 does not fall in the alignment of aforesaid
Ambulance Road.
And whereas, both the parties i.e. objectors and beneficiary were given fresh opportunity to
present their cases. The objector namely S/Sh. Roop Ram, Dalip Thakur and Chaman Lal Dhanta
were represented through their counsels, but they did not produce any additional evidence in
support of their contention. Sh. Kishore Kumar s/o Sh. Attar Sing, r/o Roop Colony, Lower
Panthaghati submitted the list of beneficiaries vide representation dated 07-12-2020 and stated that
they have no access to the road and access to even reach to their houses. The list of beneficiaries so
furnished is signed by 12 persons of the area. Both the parties admitted that the Municipal
Corporation Shimla has already incurred sufficient funds for the construction of aforesaid road.
Now therefore, in exercise of the powers conferred upon me under Section 226(2) of the
Himachal Pradesh Municipal Corporation Act, 1994, I Ashish Kohli, HAS, Commissioner,
Municipal Corporation Shimla having found no substance in the objections so raised by the
objectors through their counsels do hereby declare ambulance road from Junga road (Chaili Bus
Stand) to Chauhan Niwas, Roop Colony i.e. RD 0/0 to 0/300 leading through Kh. No. 549, 551/1
& 593 having 3.00 meter width in Mohal Shiv Nagar, Teh. & Distt. Shimla, H.P. in the larger
public interest.
