AWARD

The following reference was received for adjudication from the appropriate Government:

"Whether demands raised by Shri Shelender Tomar & 10 other workers c/o Shri J.C

Bhardwaj, President, H.P. AITUC, Saproon, District Solan, H.P. vide demand notice dated

11-12-2013 (copy enclosed) in respect of workers working the Dr. Y.S Parmar University

of Horticulture and Forestry, Nauni, District Solan, H.P. through M/s Cleanways, Sahib

Niwas, Sector-2, New Shimla for fulfilment of demands by the Vice Chancellor and

Registrar, Dr. Y. S. Parmar University of Horticulture and Forestry, Nauni, District Solan,

H.P. are legal and justified? If yes, what monetary benefits, past service benefits, seniority,

compensation and any other relief the concerned workers are entitled to from the above

university/employer?"

2.

In furtherance to the reference it is the averred case of the petitioners that the 127

workers mentioned in Annexure PA had been engaged by the respondent University directly, but

subsequently started showing them to be the workers of the contractor. The University had supplied

a list of workmen during the conciliation proceedings on 30-6-2014, admitting that 114 workmen

who had been working on the rolls of the University have been handed over to M/s Cleanways

(respondent No. 3).

3.

It is further the case of the petitioners that many of these workmen had been issued

appointment letters by the respondent University and they had been engaged on contractual basis.

Their names were transferred to the rolls of the contractor, which is nothing but an unfair labour

practice. The respondent University never obtained any permission from the appropriate authority

to outsource the work on contract basis. The action of the respondent University is stated to be a

sham and an ingeniune effort to deprive the workmen of their legitimate benefits like their

counterparts engaged as class-IV employees.

4.

It is further the case of the petitioners that the principal employer i.e. respondent

University had never applied for registration with the licencing authority under the Contract Labour

(Regulation and Abolition) Act, 1970. Even otherwise the perennial nature of work cannot be taken

through the contractor as it is prohibited under section 10 of the aforesaid Act. The workmen in fact

are directly employed by the respondent University and were entitled for the same salary and

2317

jkti=] fgekpy izns'k] 04 vxLr] 2021@13 Jko.k] 1943

benefits which were being paid to the directly employed class-IV employees of the respondent

University. The petitioners have been working continuously and were undergoing perennial work

for years together. The petitioners had also been deprived of their statutory benefits under PF and

ESI Scheme.

5.

Consequently, the workers had been constrained to submit a demand notice to the

respondent University on 16-12-2013 (Annexure PB) whereby they demanded that they be declared

to be the workers of the University and be absorbed therein. They have also demanded wages and

service conditions, as applicable to the Class-IV employees, directly employed by the University.

They had sought to clear the disparity in wages with directly employed workmen of the University

and the petitioners had also sought for the enforcement of the principles of "Equal pay for Equal

work".

6.

It is further averred that the controlling authority of these workmen were none others

but the officers of the University. The work is generally supervised by the technical staff of the

University. The job and work of these workmen shown to be on the rolls of the name lending

contractor, was also similar to the work being performed by the directly engaged/employed

workmen of the University. The work and conduct of these workmen has been excellent

throughout. The respondents are further stated to have voilated the provisions of section 25 (2)-(V)

(a) of the Contract Labour Act as they were being paid less wages as compared to the workmen

directly employed by the principal employer.

7.

The respondent University squarely falls under the domain and Article 12 of the

Constitution of India and it is infringing the fundamental rights of the workmen.

8.

It is thus prayed that the names of the workmen shown in Annexure PA may be

declared as Class-IV employees/workmen of the respondent University and they may be granted all

service benefits at par with the similar situated Class-IV employees/workmen of the respondent

University with retrospective effect i.e. from the date of demand notice has been issued

(16-12-2013) and the claim be allowed with costs throughout.

9.

While contesting the claim the respondents No. 1 & 2 have filed a joint reply, while

respondents No. 3 has filed a separate reply.

10. The respondents No. 1 & 2 while contesting the claim have raised preliminary

objections that the petitioners could not have filed a joint reference/claim petition and they were

engaged by the contractor namely M/s Shimla Cleanways and thereafter by M/s Rainbow

Enterprises, Shimla and as such it was not maintainable qua the respondents No. 1 & 2. It is also

the grouse of the University that it being an educational institute does not fall under the jurisdiction

of this Court. The claim is also stated to be bad for want of necessary parties as the contractor and

the Principal Secretary, Horticulture to the Government of Himachal Pradesh have not been made

necessary parties.

11. It is also the case of the respondent University that as per the standing instructions

regarding engagement of labour on contractual basis, the labour had been engaged on contractual

basis under adhoc to do manual work on seasonal basis and that too only for a period of 89 days

before the work was awarded to M/s Shimla Cleanways and hence the present claim is not

maintainable.

12. It is also the objection of the respondent University that the labourer had been engaged

for seasonal work and that too for a period of 89 days and after the said period, their services were

automatically terminated in accordance with the terms and conditions of their appointment letters.

2318

jkti=] fgekpy izns'k] 04 vxLr] 2021@13 Jko.k] 1943

On this ground too, the present claim deserves to the quashed. One of the last preliminary

objections raised by the respondent University is that the Government of Himachal Pradesh has

imposed a ban on the engagement of the persons on daily wage basis or part time, contract, adhoc

except with the concurrence of the Finance Department vide letter dated 18-6-2014. The petitioners

cannot be taken on the rolls of the respondent University as they were the employees of the

contractor.

13. On merits, it the case of the respondent University that labourers were generally

engaged under adhoc projects going on in the respondent University, on contractual basis for a

specific spell of 89 days where after their services were automatically terminated in accordance

with the terms and conditions of their engagement letters and in this behalf undertaking on judicial

stamp papers were executed by the labourers with the concerned department of the University. The

respondent University introduced the outsourcing of unskilled labour through Government

registered contractor w.e.f. May, 2013, through open tenders. The Director Research of the

respondent University has got the name registered with the licencing authority. Prior to the said the

respondent University had been engaging labour as per the standing instructions issued in this

behalf for engagement of labourers on contractual basis implemented w.e.f. 1-1-2002 (Annexure

R-1). All engagements of labourers were made on a fixed salary on contractual basis for a period of

89 days in one spell or two spells in the entire year, after a break of at least 15 days in each spell.

They were engaged for essential seasonal jobs subject to availability of funds. However, after 2013,

the Director of Research floated tenders for outsourcing the unskilled labour service w.e.f. 1-5-2013

to 31-3-2014 in the first instance and the contract had been awarded to M/s Shimla Cleanways

(respondent No.3) till 2015 and thereafter w.e.f. April 2015 to 31-3-2017, the contract was awarded

to one M/s Rainbow Enterprises. The University has further reiterated that as per the instructions of

the Government issued by the Additional Chief Secretary Finance vide letter dated 18-6-2014,

engagement of persons on daily wage basis or part time, contractual or adhoc had been banned

except with the concurrence of the Finance Department.

14. It is denied that the petitioners at the first instance had been engaged directly by the

respondent University and their names had been transferred on to the rolls of the contractor due to

unfair labour practices. It is denied that the principal employer never applied for registration under

the Contract Labour Act. As per the respondent University, the Director of the respondent

University had been got registered with the licencing authority. It is further denied that the

petitioner were engaged by the respondent University for perennial and permanent nature of work.

It is averred by the respondent University that the labourers are not entitled to the benefits of annual

increments, leave etc. On the analogy of other regular Class-IV employees of the respondent

University. It is denied that they are entitled to same pay and perks, at par with the regular

Class-IV employees.

15. It is further the contention of the respondent University that they had outsourced the

labourer through Government registered contractor for the execution of seasonal field operations.

They were working on adhoc research projects and were not performing the work of Class-IV

regular employees of the University.

16. It is also the case of the respondent University that it was facing acute financial crises

and had sought additional grant-in-aid amounting to 42.46 crore to defray the payment of arrears of

employees pending from the year 2011 onwards including retiral benefits of retirees. The

respondent University had also sought permission of the State of Himachal Pradesh to raise a loan

amounting to 8 crores from the State Bank of Patiala at Nauni for the release of salary and pension

of the employees and retirees of the respondent University vide letter dated 20-2-2017. The

petitioners thus cannot be absorbed into the establishment of the University. Rest of the contentions

raised by the petitioners have been denied.

2319

jkti=] fgekpy izns'k] 04 vxLr] 2021@13 Jko.k] 1943

17. The respondent No. 3 has raised preliminary objections vis-a-vis maintainability, mis-

joinder and non-joinder of necessary parties and the petitioners having concealed material facts

from this Tribunal. The claim is also stated to be not maintainable due to the own acts, conduct,

omission and acquiescence of the petitioners. On merits, it is the contention of the respondent No. 3

that he was awarded the work contract to provide the workmen on outsource basis in the year 2013

and since then many new contractors had been awarded work but the petitioners had deliberately

only made the replying respondent only as a party. The petitioners never objected nor raised any

protest when the replying respondent was awarded work and voluntarily kept on working on the

rolls of the respondent No. 3. The replying respondent had been paying salary as per the contract

and was also paying their requisite contribution for the period he had been awarded the contract.

The other averments in the claim were denied since they pertained to the respondent University.

18. While filing rejoinder to the reply filed by respondents No. 1 & 2, the petitioners

controverted the averments in the reply filed by respondents No. 1 & 2 and further reiterated those

in the statement of claim.

19. I notice that on 25-10-2017, the following issues came to be framed by my Learned

Predecessor:

1.

Whether the demands raised by Shri Shelender Tomer & 10 other workers vide

demand notice dated 11-12-2013 in respect of workers working in respondent

university through respondent No 3 are legal and justified as alleged?

. .OPP.

2.

If issue No. 1 is proved in affirmative, to what relief of service benefits the aforesaid

petitioners/workers are entitled?

. .OPP

3.

Whether the claim petition is not maintainable as alleged?

. . OPR.

4.

Relief :

20. I have heard the Ld. Counsel for the parties and gone through the material placed on

record. My findings on the issues framed are thus:—

Issue No. 1

Partly yes

Issue No. 2

Per operative part

Issue No. 3

No

Relief :

Reference is partly allowed in favour of the petitioners and against

the respondents per operative part of the award.

REASONS OF FINDINGS

Issues No. 1 & 2 :

21. Both these issues being correlated and intermingled are being taken up together for

decision.

22. Though, many demands were raised by the workers vide demand notice dated

11-10-2013 but the substantive relief claimed in the statement of claim is that these workmen be

declared as Class-IV/workmen of the respondent University and all service benefits be granted to

2320

jkti=] fgekpy izns'k] 04 vxLr] 2021@13 Jko.k] 1943

them at par with the similar situate Class-IV employees of the respondent University with

retrospective effect i.e. with effect from the date when the demand notice was raised.

23. At the very outset it would be relevant to point out here that admittedly the petitioner

workmen cannot claim parity with the regular Class-IV employees of the respondent University, as

the workmen have come to be appointed on contract basis (on daily wage basis) by the respondent

University and as such they were never either appointed as Class-IV employees, nor were they

working against any such substantive posts, having been appointed regularly by the respondent

University.

24. The main dispute, however, hinges upon the fact as to whether the workmen were

engaged by the University and as such continued to be their workmen and as to whether the action

of the respondent University in handing over to the contractor M/s Shimla Cleanways from the year

2013 is legally sustainable or not.

25. It is primarily the case of the workers that they had been initially engaged by the

University directly and it was only in the year 2013 that their services were transferred to the

contractor and that too without any notice regarding the change of their service conditions.

They had been working with the respondent University regularly, though, they were given artificial

breaks but the work was of perennial nature.

26. Per contra the stand of the respondent University was that before awarding of contracts

to M/s Shimla Cleanways, the workers had been engaged on contractual basis under adhoc projects

to do manual work, on seasonal basis and that too only for a period of 89 days and as such no

seniority of the labourers was maintained.

27. It was also sought to be portrayed that the Government of Himachal Pradesh has

imposed a ban for the engagement of persons on daily wage basis or part time, adhoc except with

the concurrence of the Finance Department of the Government of Himachal Pradesh, vide letter

dated 18-6-2004.

28. While substantiating their respective claims the petitioners have examined two

witnesses namely Hem Raj (PW-1) and one Praveen Kumar (PW-2). Both happens to be the

President and General Secretary of workers union respectively. Apart from tendering their

affidavits by way of evidence (Ex. PW-1/A and Ex. PW-2/A), which is nothing but a reiteration of

the facts mentioned in the statement of claim, PW-1, Shri Hem Raj, has placed on record the list of

workers covered under reference vide Ex. PW-1/B. He has also placed on record the copy of the

demand notice Ex. PW-1/D and the reply filed by the University Ex. PW-1/F. A seniority list of the

workers handed over to the contractor by the University has also been placed on record vide Ex.

PW-1/G. Apart from other documents PW-1 has placed on record the copies of appointment letters

Ex. PW-1/R-1 and Ex. PW-1/R-2. Letters regarding service of DPL/beldar as mark P-3. Certificate

dated 17-10-2015 Mark P-4 and the copy of the worksheet of contractual labour Mark P-7.

29. Praveen Kumar, PW-2 has also, apart from tendering his affidavit in evidence placed

on record the appointment letters vide Ex. PW-2/B and Ex. PW-2/C.

30. The University had come to be proceeded ex-parte vide an order dated 20-8-2018 and

as such could not cross-examine the witnesses examined by the petitioners. However, the

respondent University was allowed to examine the witnesses by recalling both of them with the

avowed objective of adjudicating the list completely, once and for all.

2321

jkti=] fgekpy izns'k] 04 vxLr] 2021@13 Jko.k] 1943

31. In the cross-examination both the witnesses have denied that the workers had been

engaged for seasonal work. They have denied that they were never on the rolls of the University.

Both the witnesses state that the University had issued appointment letters to them and other

workers.

32. The respondent university on the other hand has merely examined one Senior Assistant

from the office of Directorate of Research UHF, as RW-2. He has palced on record the standing

instructions issued by the University regarding employing labour on contractual basis vide Ex. RW-

2/A, which had been further reiterated in the year 2002 vide Ex. RW-2/B. He has also placed on

record some instructions issued by the Government of Himachal Pradesh regarding appointment on

secondment basis from various Boards/Corporations vide Ex. RW-2/C.

33. As per this witness, in the year 2013 tenders were invited to outsource the unskilled

labour service for a period of one year and the tender had been awarded to M/s Shimla Cleanways,

per notification dated 13-4-2013 (Ex. RW/D). Thereupon the work was outsourced from 13-8-2014

to 31-5-2015 vide Ex. RW-2/E and thereupon unskilled labour work was being outsourced on

yearly basis as per the tender issued to the lowest bidder.

34. He has not deposed a word as to whether the labour so engaged was engaged only for

seasonal work or they had been engaged only for 89 days, prior to the year 2013. Though, in his

cross-examination he does admits that the petitioners had been working with the University even

prior to the outsourcing. He thereupon hastened to add that the labourers had been appointed for 89

days and that too on contractual basis. He has denied that the petitioners have worked for periods

ranging from 8-12 years. He admits that the University had sufficient work prior to outsourcing and

even today the same work is being taken from the workers. He denies that the University has not

been registered under the Contract Labour (Regulation & Abolition) Act before outsourcing the

services of the petitioners but he cannot produce the documents today. He admits that the seniority

list prepared before the Labour Officer relating to workers who were handed over to contractor

bears his signatures. He denies having knowledge that the persons working on 89 days contract for

more than five years have been regularized by the Government including those working in Boards,

Corporations and other autonomous bodies.

35. RW-1 Shri Bhupesh Janartha happens to be one of the first contractors who was

outsourced the aforesaid work in the year 2013. As per him he was awarded a work contract to

provide workmen on outsource basis for the year 2013. The petitioners had joined him and never

protested when the work was awarded to him. He has been paying salaries to the workmen as per

the contract and has been complying with all the labour laws.

36. As per him his firm is registered with the Labour Department under the Shops and

Commercial Establishment Act. He has not even brought the registration certificate. Though he

submits that he does have a licence under the Contract Labour Act but the same has not been

produced on record. In his cross-examination, though he further admits that the licence has not

been issued by the Labour Officer Solan. Per him, he had applied for the same but since the

principal employer had not filled in form V, which is a condition precedent for issuance of the

licence, it had not been issued to him. He feigns ignorance of the workers having been engaged by

the University earlier, though, he submits that the preference was given to the workers already

working with the principal employer.

37. The testimony of the witnesses and the documentary evidence clearly goes to show

that the workmen initially came to be engaged by the respondent University on daily wages

(contract basis). It is not only clear from Ex. PW-1/R-1 and Ex. PW-1/R-2, PW-2/B and Ex. PW-

2/C, which happens to be the appointment letters of various workmen but also other such letters,

2322

jkti=] fgekpy izns'k] 04 vxLr] 2021@13 Jko.k] 1943

Annexure P-23 dated 17-7-2003, Annexure P-23/1 dated 9-8-2007, Annexure P-24 dated

17-2-2006. The said factum is actually further corroborated by the documents placed on record by

the respondent themselves, more particularly the standing instruction regarding engagement of

labour issued vide Ex. RW-2/A and even Ex. RW-2/B.

38. The conjoint reading of Ex. RW-2/A and Ex. RW-2/B shows that apparently the

workers were engaged on contractual basis. They came to be engaged for two spells of 89 days

each and thereafter given fictional breaks to save itself from the process of regularization. It may

well be said that the change effected by the respondent University may be a subterfuge adopted

by the respondent University to deny the legitimate claim of the workmen, as was also sought to

be urged by the AR for the petitioner by placing reliance upon a judgment of the Hon'ble Supreme

Court titled as Bhilwadi Dugdh Utpadak Sehkari Sabha Ltd. Vs. Vinod Kumar Sharma (2011)

LLR 1019.

39. Though, the University has raised a plea that the workers were engaged for seasonal

work but no evidence worth the name has been led by the respondent University to substantiate its

claim. Except for a Senior Assistant who has been examined as RW-2, none has appeared in the

witness box. This witness has nowhere deposed that the workers/labourers had been engaged for

seasonal work. The plea of seasonal work having been raised should have been proved on record

but the respondent University has miserably failed to do so. A bare glimpse of PW-1/G goes to

show that the workers mentioned therein had been working with the University for the period

ranging from 1997 till 2013. Ex. PW-1/G is purportedly a list of workers handed over to

M/s Shimla Cleanways. The senior most worker mentioned therein one Sunita Devi apparently

came to be engaged in the year 1997 and likewise workers had been engaged in 2003, 2004, 2005,

2006 and 2007. It is thus clear that the workers have been working continuously and

uninterruptedly with the respondent University, even if they were engaged on contractual basis or

for 89 days, they had been working with the respondent University after being given fictional

breaks all along.

40. Admittedly, the services of the said workers had been handed over to respondent No. 3

who had been awarded the work contract for providing labour on outsource basis which is also

admitted even by respondent No.3.

41. What thus emerges from the evidence on record is that admittedly the service

conditions of the workers/labourers who were working with the respondent University came to be

changed in the year 2013 which was in gross voilation of the provisions of section 9-A of the

Industrial Disputes Act, 1947. No notice whatsoever had been issued to the workmen likely to be

effected by such change. Admittedly, the respondent University was altering the existing rules of

engagement i.e from contract to outsourcing and that the same would squarely falls within Clause-9

of the 4th Schedule of the Act and any such change in respect of any workmen was thus entitled to

be notified to such workmen, which was admittedly not done. The respondent University issued Ex.

RW-2/D without notifying the same to the workmen and as such it is in voilation of section 9-A of

the Act.

42. The respondent University has tried to draw support in changing the service conditions

of the workmen by falling back upon a notification issued by the Government of Himachal Pradesh

on 18-6-2004, placed on record as Ex. RW-2/C to contend that the State Government had directed

all the Boards/Corporations /University in Himachal Pradesh not to fill any vacant post by direct

recruitment without prior concurrence of Finance Department. Even engaging persons on contract,

adhoc, daily wage or part time was also banned except with the concurrence with the Finance

Department. I am afraid the said notification also does not auger to the benefit of respondent

2323

jkti=] fgekpy izns'k] 04 vxLr] 2021@13 Jko.k] 1943

University. First none prevented the respondent University from getting approval of the Finance

Department and in case the approval was not forthcoming even then the respondent University was

duty bound to have followed the provisions of section 9-A of the Act which is otherwise mandatory

in nature and any non-compliance thereto, renders any change in service condition void-ab-nitio.

The Hon'ble Supreme Court has also held so, that too as far back as the year 1999, in Lokmat

Newspaper Pvt. Ltd. Vs. Shankar Parsad (AIR 1999) SC 2423. The respondent University thus had

to atleast issue a notice of such change to the workmen, prior to changing their condition which

admittedly was not done.

43. The action of the respondent University cannot be sustained. Though, the fact remains

that the workers were only unskilled labourers and they cannot claim parity with Class-IV

employees of the University but will have to be considered to be the workmen directly engaged by

the University i.e daily waged workers (contract basis). It has thus to be presumed that the workers

were working directly with the respondent University from the respective dates of their initial

engagements. They shall however be entitled to seniority and continuity in service from the dates of

their engagement and the action of the respondent University in engaging them through outsourcing

after 2013 without any notice is void-ab-nitio as has been held by the Hon'ble Supreme Court in

Lokmat Newspaper, discussed hereinabove supra. The workers shall be however entitled to

regularization as per the regularization policy of the State Government applicable to similar

situated contract workers i.e daily wages (engaged on contract basis) at the relevant time.

44. Though, the AR for the petitioner has placed reliance upon a judgment of the Hon'ble

Supreme Court titled as G.B Pant University of Agriculture and Technology. Pantnagar. Nanital

Vs. State of Uttar Pradesh and Ors. (2000 LLR 1189). Hindalco Industries Ltd Vs. Association

of Engineering (2008 LLR 509 and Kanpur Electricity Supply Co. Ltd Vs. Shamim Mirza (2009

LLR 226). The aforesaid judgments pertained to the factors determining the control and supervision

by the principal employer and its effect thereto. Since, the change of service conditions otherwise

have already been held to be bad, the ratio of the aforesaid judgments will not be applicable to the

facts and circumstances of the present case. The issue is thus decided against the respondents.

Final order/Relief :

For the foregoing reasons discussed herein supra, the reference is partly answered in favour

of the petitioners and against the respondent University. Though, the petitioner and the other

workmen cannot be declared as Class-IV employees of the University, as prayed for, nor can they

claim parity in respect of service conditions, but it is held that the petitioners/workers were working

directly with the respondent University though only as daily wagers (contract basis) from the

respective dates of their initial engagements. They shall however be entitled to seniority and

continuity, in service from the dates of their engagement and the action of the respondent

University in engaging them through outsourcing after the year 2013, without any notice is held to

be illegal. The reference is disposed off in the aforesaid terms. The workers shall be however

entitled to regularization as per the regularization policy of the State Government applicable to

similar situated workers i.e. daily wagers (contract basis) at the relevant time. Let a copy of this

award be sent to the appropriate government for publication in the official gazette. File, after

completion, be consigned to records.

Announced in the open Court today on this 4th day of May, 2021.
