PART I—B
Jammu and Kashmir Government—Notifications.

J&K) was constituted by the Government vide Notification SRO-
146 of 1999 dated 26-04-1999 read with Notification SRO-340 of 1999
dated 13-08-1999 with the following terms of reference :––
(i) to inquire whether non-permanent residents have obtained
Permanent Resident Certificate in contravention of Jammu
and Kashmir Grant of PRC Act, 1963 (Act No. XIII of
1963) and other laws pertaining to the subject and the
circumstances thereof ;
(ii) if so, to identify the officers/officials who have
issued such certificates in violation of the law on the subject
; and
(iii) consequently to suggest measures for providing an effective
check to prevent such violation of the provisions of the
J&K Grant of Permanent Resident Certificates Procedure
Act, 1963.
Whereas, the said Commission of Inquiry regarding State Subject
Permanent Resident Certificates, J&K, has in all submitted five reports
with the latest report submitted vide letter No. COI SSC/99/658-62
dated 01-03-2013 to the Revenue Department. In these reports 136
persons have been found to be non-permanent residents of the State
against which permanent resident certificates of 6 persons have already
been cancelled by the Government. These 136 persons include 67
persons who even after due service did not choose to cause their
appearance before the Commission and therefore, the Commission
declared them as non-permanent residents of the State and
recommended that their Permanent Resident Certificates be
cancelled ;
Whereas, the Commission regarding Permanent Resident Certifcates,
J&K also identified 230 persons against whom complaints were filed
before the Commission for having fake Permanent Resident Certificates
but due to incomplete address details, the Commission could not finalise
its recommendations. The complainants were also not traceable to obtain
further details from them for updating the addresses of these
persons ;

Whereas, the lists furnished by the Commission for cancellation
of the PRCs have been categorised as under :–––
I
Annexure A
List of the persons/beneficiaries who have
been declared as Non-State Subjects by
the Commission.
II
Annexure B
List of persons who choose not to cause
their appearance despite service of notices
before the Commission and thus declared
as Non-State Subjects.
III
Annexure C
List of persons/beneficiaries in whose
favour the PRCs were issued by the
incompetent authorities and thus declared
as Non-State Subjects by the Commission.
Whereas, section 6 of the Jammu and Kashmir Grant of
Permanent Resident Certificate (Procedure) Act, 1963 provides as
under :––
(1)
The Government may, at any time, either on its own motion
or on an application made to it in this behalf, call for the
record of any case pending before or disposed by a
competent authority and may uphold or reverse the orders
of the competent authority or may pass any other orders
or give any directions as it may deem fit :
Provided that no orders prejudicial to an interested person
shall be passed without giving such a person a reasonable
opportunity to be heard.
(2)
If it appears to a competent authority that a substantial
question of law or public interest is involved in any
proceedings under this Act, it may report it to the
Government and the Government may pass any orders or
issue any directions, it may deem fit.
Whereas, the report of the Commission regarding State Subject/
Permanent Resident Certificates reveals that adequate opportunity
of being heard has been given by the Commission to the persons
whose Permanent Resident Certificates have been recommended for
cancellation ; and

Whereas, the Government, after having duly considered the reports
of the Commission submitted on 28-02-2011, 08-03-2012 and 01-03-2013
has accepted the findings of the Commission along with the
recommendations and has decided as under :––
1.
the Permanent Resident Certificates of the persons figuring
in Annexures A & B, who have been declared as non-
permanent residents by the Commission, shall be cancelled
besides initiating consequential action in terms of Rule 8 of
the J&K Grant of Permanent Resident Certificate (Procedure)
Rules, 1968 ;
2.
the Permanent Resident Certificates of persons figuring
in Annexure C in whose favour the Permanent
Resident Certificates have been issued by authorities not
competent/authorised to issue such certificates shall also be
cancelled ;
3.
the competent authorities shall be directed to verify the
entitlement of persons figuring in Annexure C for grant of
fresh Permanent Resident Certificates ;
4.
such persons figuring in Annexure C who after proper
verification by the competent authorities, are found non-
permanent residents, follow up action as provided under Rule
8 of the said rules shall be taken by the concerned Deputy
Commissioners and Tehsildars ; and
5.
a notice shall be issued in leading newspapers to the persons
against whom the complaints could not be disposed off due
to incomplete addresses. They shall be asked to submit their
objections/documents in support of their claim to be
permanent residents of the State within a period of fifteen
days from the date of issuance of the notice failing which
further action as warranted under rules shall be taken.
Now, therefore, it is hereby ordered that–––
a.
the Permanent Resident Certificates of persons figuring
in Annexures A, B & C are hereby cancelled and declared
as nonest ab-initio ;

b.
the persons figuring in Annexures A & B are hereby
declared as non-permanent residents of the State of
Jammu and Kashmir ;
c.
the concerned Deputy Commissioners and Tehsildars shall
proceed forthwith against the persons figuring in Annexure
A & B in terms of Rule 8 of the J&K Grant of Permanent
Resident Certificate (Procedure) Rules, 1968 for
consequential action ;
d.
the authorities competent to issue Permanent Resident
Certificates in respective districts shall verify entitlement
of the persons figuring in Annexure-C for grant of fresh
Permanent Resident Certificates under rules within a
period of two months and those not found entitled to such
certificates shall also be proceeded against in terms of
Rule 8 ; and
e.
the State Crime Branch shall register cases against the
persons detailed in Annexures A, B & C and investigate
as to how and under what circumstances they have
obtained the PRCs despite being non-permanent residents
of the State of Jammu and Kashmir and also against the
authorities who have issued Permanent Resident
Certificates without competence/authorisation besides
those in whose favour such certificates were issued.

Whereas, notification as required under sub-section (1) of section
4 of Land Acquisition Act, Svt. 1990 was issued by the Collector,
Land Acquisition (Assistant Commissioner, Rev.), Poonch vide his
No. DCP/LA/1860-68 dated 04-02-2015 ;
Whereas, the Collector, Land Acquisition (Assistant Commissioner,
Rev.), Poonch has recommended the case for issuance of notification under
section 6 and directives under section 7 of the Land Acquisition Act, Svt.
1990 vide his letter No. DCP/LA/1998 dated 16-02-2015 ;
Whereas, the case comes within the pecuniary jurisdiction of the
undersigned in terms of SRO-236 of 2009 dated 11-08-2009 ;
Whereas, undersigned is satisfied after considering the report
furnished by the Collector, Land Acquisition (Assistant Commissioner, Rev.),
Poonch, that the land is required for public purpose viz. for construction of
road from Bedar to Balnoi at Village Rajpura under PMGSY, Tehsil Mandi,
District Poonch.
Now, therefore, in exercise of the powers conferred upon the
undersigned in terms of SRO-236 of 2009 dated 11-08-2009, it is declared
under section 6 of the Land Acquisition Act, Svt. 1990 that the land
aforementioned is needed for public purpose. Further, the Collector, Land
Acquisition (Assistant Commissioner, Rev.), Poonch is directed under section
7 of tthe said Act, to take order for acquisition of the land of which
specifications are given above.

SRO-202.––In exercise of the powers conferred by the proviso to
section 124 of the Constitution of Jammu and Kashmir, the Governor hereby
makes the following rules, namely :––
1. Short title and commencement.––(1) These rules may be called
the Jammu and Kashmir Special Recruitment Rules, 2015.
(2) They shall come into force at once.

PART III
Laws, Regulations and Rules passed thereunder.

2. Definitions.––In these rules unless the context otherwise
requires,––
(a) ‘appointee’ means a person who has been appointed under
these rules ;
(b) ‘Service Selection Board’ means the Service Selection Board
constituted under the Jammu and Kashmir Decentralization
and Recruitment Act, 2010 and the rules framed thereunder ;
(c) ‘Government’ means the Jammu and Kashmir Government ;
(d) ‘post’ means a post borne on the establishment of any
department of the Government ;
(e) ‘selection agency’ means the Public Service Commission or
Service Selection Board, as the case may be ;
(f) ‘Selection Committee’ means Selection Committee or
Committees constituted under rule 5 of these rules ; and
(g) Words and expressions used in these rules but not defined
shall have the same meaning as assigned to them in the Jammu
and Kashmir Civil Services (Classification, Control and Appeal)
Rules, 1956.
3. Application of the rules.––These rules shall apply to all
non-gazetted posts borne on the establishment of any department or service
of the Government and such gazetted post, as may be notified by the
Government from time to time.
4. Reference of vacancies.––All the departments shall refer the
existing vacancies and also the vacancies that would accrue during the
year to the concerned selection agencies within a period of one month from
the date of issuance of these rules indicating therein the district-wise breakup
of available vacancies in each cadre viz. State, Divisional and District cadre.
5. Appointment under these rules.––(1) Notwithstanding anything
to the contrary contained in any rule or order for the time being in force

relating to the method of recruitment and conditions of service for
recruitment in any service, or to any post, under the Government––
(i) the appointments to all non-gazetted posts borne on the
establishment of any Department or Service of the Government
shall be made by the Government on temporary basis on the
basis of the selection made by the Selection Committee,
consisting of––
(a) Chairman or a member of the Services Selection Board
to be nominated by the Chairman.............Convenor ;
(b) District Head
of
the
indenting
office/
Department...........
Member ;
(c) One officer of, or above, the rank of Deputy Secretary
to the Government from the concerned Department
................. Member ; and
(ii) the appointments to the gazetted posts, notified under rule 3 of
these rules shall be made by the Committee, consisting of––
(a) a member of the Public Selection Commission to be
nominated by the Chairman..............Convenor ;
(b) subject matter experts to be co-opted by the Chairman
Public Service Commission..............Member :
Provided that nothing hereinabove shall apply to the posts
which have been referred to the Public Service
Commission or the Services Selection Board on the date
of issuance of these rules.
(2) The Selection Committees referred to in sub-rule (1) shall make
the selections as per the provisions of the Jammu and Kashmir Reservation
Act, 2004 and rules framed thereunder.
6. Eligibility.––Eligibility for appointment shall be the same as
prescribed under the rules of recruitment applicable to the relevant post or
service.

7. Mode of selection.––(1) The selection agency shall invite
applications for recruitment under these rules in respect of district, division
or State cadre posts. After assessing the merit of the candidates in a fair
and transparent manner, the selection agency shall prepare a select list
which shall not exceed the number of vacancies so advertised and furnish
the same to the appointing authority within a period of three months from
the date of reference of the vacancies.
(2) The selection agency shall also prepare a waiting list up to 20%
of the total number of selected candidates and forward the same to the
concerned appointing authority.
(3) The appointing authority shall issue appointment orders strictly in
accordance with the select list furnished by the selection agency within a
period of 15 days positively.
8. Nature of Appointment.––(1) A person appointed under these
rules shall be initially on probation for a period of five years and after
completion of five years his service shall be declared as permanent subject
to passing of such tests, or successfully undergoing such training, as provided
under the Jammu and Kashmir Civil Services (Classification, Control and
Appeal) Rules, 1956 or as prescribed under the relevant recruitment rules
governing the post/service to which he has been appointed.
(2) The appointee shall have to necessarily work for a period of five
years on the post against which he has been appointed and such appointee
shall not be eligible for transfer for whatsoever reason during the temporary
service of five years :
Provided that any person appointed against any available vacancy on
the basis of being a resident of backward area or an area adjoining Line of
Actual Control shall serve in such areas for a period of not less than seven
years.
9. Fixation of pay.––(1) During the period of first five years, the
appointee shall be entitled to the minimum of scale of pay along with the
grade pay applicable to the post against which he is appointed.

(2) Every appointee shall after completion of five years period on
probation be entitled to fixation of pay in the time scale of pay applicable to
the post against which he is appointed.
10. Increments, dearness allowance and other allowances.––
(1) The persons appointed under these rules shall be entitled to annual
increments, Dearness Allowance, House Rent Allowance and City
Compensatory Allowance after successful completion of their five years’
service on consolidated salary.
(2) These appointees shall be entitled to the benefits under the Medical
Attendance Rules and Leave Rules from the date of their appointment
itself.
11. Seniority.––(1) The seniority of persons appointed under these
rules shall reckon from the date of their appointment.
(2) The period spent on probation/consolidated salary shall also reckon
for purposes of calculating the qualifying service of these appointees for
pensionery and other benefits provided under rules.
12. Other conditions of service.––In the matter of other conditions
of service like age, qualification, discipline, conduct and other allied matters,
a person appointed under these rules shall be governed by the recruitment
rules of the service to which the post occupied by him belongs, besides
other rules, regulations and orders in vogue in the State Civil Services in
general.
