Combined Competitive Examination, 2013, containing 96 candidates in order

of merit who have been recommended to the Government for appointment

to the services on the basis of their merit-cum-preference and in terms of

Sub-Rule 8 of Rule 7 of J&K Reservation Rules, 2005 (SRO-294 of 2005),

is hereby notified for information of the candidates as per Annexure to this

notification.

The merit list so notified is without any prejudice to the outcome of

writ petition(s), if any, pending before any Competent Court of Law.

Note :– The recommendations in respect of remaining two candidates as

per their merit shall be notified separately/lateron. In respect of

one more candidate figuring at S. No. 82, the recommendation is

w. r. t. filing of an appeal in terms of regulation 5 (e) of the

desire, represent before the Commission within a period of ten

days after issuance of this notice positively with documents in

support of their claim, if any, of being eligible, so that the

representations are disposed of in accordance with the rules.

the candidates. However, in case, if any, candidate does not receive his/her

Admit Card in time, he/she may download the same from the Commission’s

website http://www.jkpsc.nic.in.

Further, the candidates are advised to adhere to the following

instructions during the examination :—

01.

Candidates shall carry Admit Card in the allotted examination centre

to secure admission to the Examination Hall. Always keep the

Examination Admit Card with you and show it to the supervisory

staff on duty as and when required/demanded.

02.

Do not write anything related or unrelated to examination on your

Admit Card.

03.

Candidates should be seated in the Examination Hall 20 minutes

before the commencement of the examination.

04.

Candidates should carefully read the instructions given on the back

side of the response sheet as well as on the question paper.

05.

Check the Admit Card carefully and bring discrepancy, if any, to

the notice of J&K Public Service Commission immediately.

06.

You are responsible for safe custody of this Admission Certificate

and in the event of any other person using this certificate the onus to

prove that you have not used the services of any impersonator shall

lie on you.

07.

Ensure that you are seated in the Examination Hall 20 minutes

before the scheduled time of commencement of the examination.

08.

Before entering into the campus of the Examination Hall, make sure

that you are not in possession of the Mobile Phone/Programmable

Calculators or any unauthorized/incriminating material. In case you

are found in possession of any unauthouized material during the

If you appear at a centre/venue other than the one notified/allotted

You should bring your own instruments viz. blue/black ball point

pen, drinking water bottle etc. No borrowing or exchange of articles

would be allowed in the Examination Hall.

11.

You shall not be permitted to leave the Examination Hall until

expiry of full time (i. e. two hours).

12.

In Examination Hall, you shall be provided an OMR answer sheet

and question booklet. You should read the instructions carefully on

the back side of OMR sheet before filling in the item Nos.1-8. Item

No. 9 is to be filled up by the invigilator.

13.

The examination is Multiple Choice Type. Each question will have

04 options marked as A, B, C & D. You should choose the correct

option and darken the corresponding oval on your OMR answer

sheet by blue or black ball point pen.

14.

The oval should be fully darkened, without causing any damage to

the response sheet.

15.

You should make your own arrangements of boarding and lodging,

PSC shall not defray any TA/DA expenses.

16.

Your candidature to examination is provisional, subject to the

fulfillment of eligibility criteria.

Note :–In case you find any discrepancy, in the test booklet in any question(s)

or the responses, a written representation explaining the details of

such alleged discrepancy, be submitted within three days, indicating

in Clubbed Writ Petition No. 44/2009 titled Chiranjeev Razdan

and Others Vs. State and others and in SWP No. 1350/2006

titled Parvez Ahmad Kirmani and Ors. Vs State and Others,

respectively/restoration of Government Order No. 359-Agri.

of 2005 dated 07.12.2005 and issuance of year-wise seniority

list thereof.

Government Order No. 283-Agri. of 2015

Dated 18-09-2015.

Whereas, in terms of the (revised) Jammu and Kashmir Agriculture

(Gazetted) Service Recruitment, Rules as notified vide SRO-179 of 1988

dated 02.06.1988, the post of Agriculture Extension Officer (AEO) and

equivalent Class-VII was to be filled up 50% by direct recruitment and

50% by promotion. However, vide SRO-433 of 2007 dated 28.12.2007, the

quota has been altered by prescribing 80% posts to be filled by promotion

and 20% by direct recruitment ; and

Whereas, the initial constitution of Class-VII, in pursuance of

Rule 3(2) of the said rules, notified vide Government Order No. 31-Agri. of

2005 dated 18.02.2005 and subsequent placements ordered vide Government

Order No. 38-Agri. of 2005 dated 18.2.2005, became a subject matter of

litigation before the Hon’ble High Court in the case titled “Qasim Gani Vs

State and Ors.” in SWP No. 184/2005 and the Hon’ble Court vide its

judgment dated 19.2.2007, while deciding the writ petition, quashed the

impugned orders and held as under :––

“under the 1978 rules the posts of AAs were meant for direct

recruits. Since no quota was fixed for the in-service candidates

the appointment by promotion on these posts was not permissible

under the rules. Thus the promotion and posting of the respondents

against such posts was dehors the rules. This being the position

they cannot be treated to have been validly appointed against the

posts. In such circumstances, it cannot be said that the respondents

were holding the posts validly and they cannot be treated to form

the initial constitution of the service. Their appointment to the posts

shall take place from the date the posts became available for them.

Since they claim the promotional posts they shall get substantive

appointment on the posts when such posts became available for

them. The action amounts to clear violation of the rules and settled

legal position in this behalf. Such an action if allowed will defeat

not only the rights of the petitioner but will amount to gross violation

of the 1978 Rules.

In such circumstances, I find force in the petition, the same is

allowed and the impugned orders/seniority list are hereby quashed.

The official respondents are directed to reconsider the matter and

re-fix the seniority of the petitioners and private respondents in

accordance with the rules and observations made above.”

Whereas, as a compliance of the said orders of the Hon’ble High

Court, Government Order No. 279-Agri. of 2008 dated 07.10.2008 came

to be issued, vide which the officers including non-gazetted officials

were promoted in one go to various classes, without clearance of the

DPC/PSC without any final seniority. Aggrieved with the Government Order

No. 279-Agri. of 2008, issued in supersession of all previous orders on the

subject, it came to be challenged in various writ petitions filed before the

Hon’ble High Court at Jammu and Srinagar ; and

Whereas, the Hon’ble High Court at Jammu in the clubbed writ

petitions No. 44/2009, titled Chiranjeev Razdan and Others Vs State and

others, vide its order dated 8.04.2010, and in another clubbed writ petitions

SWP No. 1350/2006 titled Parvez Ahmad Kirmani and Ors. Vs State and

Others at Srinagar, vide judgment dated 29.04.2011, has directed the State

respondents to place the matter before the DPC/PSC for regularization of

officers in accordance with the rules ; and

Whereas, in pursuance of the above directions of the Hon’ble High

Court, a proposal for regularization in Class-VII (First Gazetted

Entry Level Post) of Non-Gazetted Officials, was placed before the

DPC/PSC, consequent upon whose recommendations, Government Order

No. 113-Agri. of 2013 dated 19.03.2013, has been issued. Pursuant to the

said Government order, the officers have been regularized in Class-VII in

accordance with SRO-179 of 1988 dated 02.06.1988 which, for the first

time provided a quota of 50% by promotion for Class-VII posts ; and

Whereas, in furtherance to the compliance/implementation of the

orders of the Hon’ble High Court, the final seniority of the officers appointed,

directly and by promotion up to 18.10.1988 in Class-VII has been notified

vide Government Order No. 277-Agri. of 2015 and 278-Agri. of 2015

dated 11.09.2015 and the proposal for regularization of the officers from

Class-VII, against the available Class-VI posts and for Class-V to

Class-IV, III, II is required to be placed before the DPC/PSC for

consideration ; and

Whereas, on examination of the matter, it has been noted that earlier

in 2005, on the recommendations of the DPC/PSC, vide Government

No. 25-1] The J&K Govt. Gazette, 22nd Sept., 2015/31st Bhad., 1937.

Order No. 359-Agri. of 2005 dated 07.12.2005 read with Government Order

No.14 Agri. of 2007 dated 23.01.2007, 124 officers in Class-VI were

regularized in Class-V in accordance with the rules, resulting in availability

of vacancies in Class-VI but due to the issuance of the Government Order

No. 279-Agri. of 2008, which had superseded all the Government orders

on the subject, including the Government Order No. 359-Agri. of 2005

issued on the recommendations of the DPC/PSC, the process of

regularization could not be carried forward. The Government Order

No. 359-Agri. of 2005 dated 07.12.2005 could not have been superseded

by an executive order, as it was issued on the recommendations of the

DPC/PSC (a constitutional body) and already acted upon ; and

Whereas, it was also felt that the Hon’ble High Court had kept

Government Order No. 279-Agri. of 2008 dated 07.10.2008 in force, subject

to the outcome of DPC/PSC till the matter is considered in accordance

with the rules. The DPC/PSC has already been convened and consequent

upon its recommendations, 67 non-gazetted officers, have been cleared for

promotion to Class-VII in whose case orders of promotions have also been

issued vide Government Order No. 113 of 2013 dated 19.03.2013 as stated,

hereinabove. The Government Order No. 279-Agri. of 2008 did not

withstand the scrutiny of the DPC/PSC, as a large number of non-gazetted

officers, who were promoted without consultation of the DPC/PSC, not

only in Class-VII but also in Class-VI, V, IV and III from different dates,

have not yet been cleared at the entry gazetted level (Class-VII) which is

a pre-requisite for consideration for promotions to the higher classes in the

service, as promotion to the higher classes in the gazetted service cannot

be granted unless an officer is a substantive member of that service at the

initial level ; and

Whereas, the matter regarding validity of Government Order

No. 359 of 2005 was also taken up with the Law Department, who vide

their U. O. dated 15.09.2015 opined as under :––

“Returned. By Government Order No. 359 of 2005, the department

has accorded promotion to the officers of Class-VI to Class-V

enlisted in Schedule of J&K Agriculture (Gazetted Service on

the basis of recommendation of DPC/PSC. Government Order

No. 279-Agri. of 2008 itself lays down that the placement of the

officers of different categories, is subject to clearance from DPC/

PSC. Further, Hon’ble High Court has also directed for taking up

the matter of regularization of officers of different categories of

the DPC/PSC for its confirmation. As per section 133 of the

Constitution of Jammu and Kashmir, the Jammu and Kashmir Public

Service Commission shall have to be consulted on the principles

to be followed in making appointments to the civil services and

post and in making promotions. The consultation of PSC is a

mandatory requirement for making promotions to different

categories of gazette service. Department has to submit a proposal

for regularization of officers of different categories and it cannot

ignore the earlier recommendations of PSC/DPC while forwarding

its recommendations. A Government order cannot supersede the

recommendations of PSC on the basis of which Government Order

No. 359-Agri. of 2005 was issued. Government Order No. 359 of

2005 will be a basis for submitting fresh proposal to the Public

Service Commission for formulating its recommendations.”

Whereas, in view of the above settled position on the matter and

also that Government Order No. 279-Agri. of 2008 did not withstand the

scrutiny of DPC/PSC, the Government Order No. 359-Agri. of 2005, vide

which promotions have been accorded to the officers from Class-VI to

Class-V, on the recommendations of the DPC/PSC, is required to be restored

and a year-wise seniority list of Class-V members of the service to be

notified. This shall enable the department to place the proposal of

regularization of hundreds of officers before the DPC/PSC and shall be in

furtherance of the implementation of the orders of the Hon’ble High Court.

Now, therefore, it is hereby ordered that Government Order

No. 359-Agri. of 2005 dated 07.12.2005, issued on the recommendations

of the DPC/PSC, is hereby restored.

Consequent upon the above, the year-wise final seniority list of the

members of the service in Class-V, as appointed vide Government

Order No. 359-Agri. of 2005 dated 07.12.2005, is also notified (forming

Annexures A to H to this Government Order) for placing the proposals

before the DPC/PSC for consideration of eligible officers for promotion to

Class-IV, III, II, as the case may be. Consequently, the available vacancies

in Class-VI and Class-VII can also be filled in accordance with the rules,

through the DPC/PSC.

The date of birth recorded in the seniority list shall not be considered

for purposes of retirement of officers etc. but shall be based on the actual

records/entries made in the service records in accordance with the rules.

This also issues without prejudice to the outcome of the writ petition(s)

pending, if any, before any competent court(s) of law and shall be subject

to the outcome of such petition(s).
