by clause (c) of sub-section (1) of the section 10 of Industrial Disputes
Act 1947, the Government referred this dispute for adjudication on the
following issues :––
i. Whether the disengagement of Shri Ghulam Mohi-ud-Din
Parray, Mushtaq Ahmad Sofi and Miss Sonobar Hassan is
legally justified ?
ii. If not, to what relief is entitled ?
3. Fundamentally and primarily reference which was made by the
authority to this Tribunal is based on report submitted by the Conciliation
Officer.
4. On receiving the reference from the Government. This Tribunal
has issued the notices to both sides for filing the statement of facts and
objections from other side workman/petitioners appeared and filed their
claim alleging therein that they have been engaged by the respondent on
daily wage basis in the year 1996, 1998 and 1999 respectively. The
petitioners look for Government employment on substantive basis and they
preferred to be engaged as daily wager/contractual basis having regard to
their poor family background. At the time of engagement no time was fixed
for engagement of petitioners as daily wager by the respondent. The
petitioners were allowed to continue in service for more than 12 to 15 years
and thereafter they have all of sudden disengaged in the year 2011. The
petitioners requested to allow them to continue in service in view of the
fact they had put in years together in service and are not in a position to get
employment somewhere else. But they have not been allowed to remain in
service. Hon’ble Supreme Court has held in so many cases that it would
not be permissible to decree the cry of the labour force, desirous of absorption
after for more than 240 days in an establishment. But in present matter
petitioners have worked with establishment. Petitioners had been
continuously working for a period of 12/15 years without any break in the
respondents institution. They ought to have been regularized since. But
unfortunately they have been disengaged by the respondent. The respondents

are in power and possession of the disengagement order which have not
been given to them, if at all they have passed any order since the respondent
institute is an industry in view of the definition clause of I. D. Act. When
petitioners have not been allowed to remain in service, they have approached
to the Assistant Labour Commissioner who is also Conciliation Officer.
Finally prayed for setting aside the disengagement of petitioners and direct
the respondent to reinstate them in service. Further prayed that respondent
be directed to pay the amount withheld by them till January, 2013.
5. Respondents also appeared but have not filed any objections as
per proceeding of the file. Thereafter the respondent did not bother to
appear before this tribunal as such an ex parte order was initiated against
them but later on they appeared and filed application for setting aside the
ex parte order. But again they remain failure to appear. As such application
for setting aside ex parte order was dismissed in default and ex parte
remained in force. Again they appear and filed application for restoration
of dismissed application for setting aside ex parte but again not appeared.
As such ex parte is remaining intact.
6. During the pendency Petitioner No. 1. expired, his legal heirs
moved an application to bring them on record as they are the only LR of the
deceased petitioner Ghulam Mohi-ud-Din. Notice of this application was
issued for filing of objection but no body appears and filed the objection.
As such they have been brought on record as LRs of the deceased.
7. The claim of the petitioners as reflected in the conciliation
proceeding and projected by the petitioners. As that petitioner were employed
by the respondent on daily wages basis in the Institute of Hotel Management
Catering Technology and Applied Nutrition, Rajbagh, Srinagar for more
than 12 years. They have never been disengaged and now they are entitled
for regularization as per the direction of Hon’ble Supreme Court but all of
sudden they have been terminated from the service without any notice or
any charge-sheet or conducting any enquiry. However, before the
Conciliation Officer during the conciliation proceeding principal of the
institute appeared who admitted that applicants were engaged purely on

need basis for 89 days and the arrangement continued till mid October,
2011 in term of their last appointment order the applicants were forced to
continue in the institution as outsource staff under the Hunar Sey Rozgar
Scheme as per the direction of Ministry of Tourism. The applicants instead
of accepting the offer discontinued themselves from the job after expiry of
their contractual terms. The principal of the institution declined to provide
regular appointment to the applicants in the light of the direction of
Government of India. Their regularization was discussed in the Board of
Governors meeting in the year 2009 but board being the incompetent to
create additional post referred to the Ministry of Tourism so finally
conciliation has failed and Conciliation Officer recommend the matter to be
referred to industrial dispute.
8. To prove the case of petitioners in ex parte they have been directed
to lead their evidence and they have been made examined. Petitioner Ghulam
Mohi-ud-Din, Mushtaq Ahmad Sofi and Sonober Hassan along with PW
Ghulam Mohd. Salmani, PW Riyaz Ahmad Kokiloo, Mohd. Ashraf Khan.
It is profitable to give brief resume of settlement of witnesses.
9. Petitioners Ghulam Mohi-Din stated on an affidavit that he has
been engaged on daily wager/contractual basis by the respondent and
deponent was allowed by the respondent to continue in service for period
of almost 15 years without any break and during this period he was working
with zeal and zest to the best satisfaction of his seniors. He was orally
disengaged from the service by the respondent on 14-10-2011 without any
reason and without any formal order of disengagement. Thereafter, he
requested to respondent to allow him to continue in service in view of the
fact that he has put years together in the service as he has continuously for
15 years without any break and he was expecting that services may be
regularized by the respondent but the respondent did not accept his request
and withheld his legal earned wage about 9000/- finally sought setting aside
and disengagement order.
10. Petitioner Mushtaq Ahmad Sofi stated on an affidavit that he
has been engaged on daily wager/contractual basis by the respondent and
deponent was allowed by the respondent to continue in service for period

without any break and he was expecting that services may be regularized
by the respondent but the respondent did not accept his request and withheld
his legal earned wage about 13500/- finally sought setting aside and
disengagement order.
11. Petitioner Sonober Hassan stated on an affidavit that she has
been engaged on daily wager/contractual basis by the respondent and
deponent was allowed by the respondent to continue in service for period
of almost 13 years without any break and during this period she was working

for 13 years without any break and she was expecting that services may be

and withheld her legal earned wages about 13500/- finally sought setting
aside and disengagement order.
12. PW Ghulam Mohd. Salamani stated on an affidavit that petitioners
were working with the respondent’s office along with him. So they are well
known to him. He retired from the services as storekeeper on 31-01-2010.
Petitioners were appointed by the respondent department on daily wages
basis. Petitioner namely Ghulam Mohi-ud-Din Parray was appointed
on 06-02-1996 and Mushtaq Ahmad Sofi was appointed on 30-10-1998
whereas Sonober Hassan was appointed on 02-11-1999. As such they were

any break and thereafter they were all of sudden disengaged from the
services by the respondent without any reason. Petitioners requested the
respondent to allow them to continue in service but respondents decline
their request.
13. PW Riyaz Ahmad Kokikloo stated on an affidavit that petitioners
were working with the respondent’s office along with him so they are well
known to him. He retired from the services as ex-office Superintendent on
30-04-2014. Petitioners were appointed by the respondent department on
the daily wage basis. Petitioners namely Ghulam Mohi-ud-Din parray
appointed on 06-02-1996 and Mushtaq Ahmad Sofi was appointed on
30-10-1998 whereas, Sonober Hassan was appointed on 02-11-1999 as
such they were allowed to continue in services for a period of about 12-15
years without any break and thereafter they were all of sudden disengaged

were working with the respondent’s office along with him so they are
well known to him. He retired from the services as Ex. Accounts Incharge
on 29-02-2008 petitioners were appointed by the respondent department on
daily wages basis. Petitioners namely Ghulam Mohi-ud-Din Parray
was appointed on 06-02-1996 and Mushtaq Ahmad Sofi was appointed
on 30-10-1998 whereas, Sonober Hassan was appointed on 02-11-1999.

to 15 years without any break and thereafter they were all of sudden
disengaged from the services by the respondent without any reason.

but respondents decline their request.
15. This is the whole sum and substance of both side evidence
produced by them during the proceedings.

–––––––—–––––––––––––––––––––––––––––––––––––––––––––––———
16. I have thoughtfully considered argument advance by the
representative of the parties and has a minute study and appreciation of the
evidence both oral as well as documentary available on case file.
17. This court has to return the findings within the circumscribed
limits of the term of reference identified by the competent authority appointed
by the Government and we are not supposed and expected to travel beyond
the terms set up for adjudication what is required to be settled precisely is
to be finding out legality or otherwise action of respondent management in
this case. Termination of services of the petitioner’s by respondent is legally
valid or not. In case where the action as taken up by respondent in terminating
the services of the petitioners is held illegal assuming for the sake of
argument then it is to be seen what appropriate relief can be given to the
petitioners on account not of such illegal action.
18. Briefly petitioners were employee of the respondent’s institute
which definitely covered under section 2 (s) of the Industrial Disputes Act
and there was no dispute on this point because principal himself admitted
before the Conciliation Officer that they have been engaged on daily wage
and remained in continues service with the institution for more than 12
years. The grievances of the petitioners are that they regularly worked
with the management for more than 12 years and they are entitled for
regularization but all of sudden they have been disengaged whereas other
employees who are junior to them have regularized. As such they have
been preference over petitioners. No notice was given to them before
disengagement and no inquiry was conducted. As they are obedient, hard
worker there is nothing against them for the last 15 years. They worked to
the satisfaction of the seniors after 15 years of the service they have been
asked, to opt this scheme.
19. Now the question arises that Petitioners No. 1 was appointed on
daily wages basis in the year 1996 for 89 days and order was extended
from time to time and he remained in service up to 2011. Whereas, Mushtaq
Ahmad Sofi was appointed on contract basis and his services were also
8
The J&K Govt. Gazette, 10th Sept., 2015/19th Bhad., 1937.

extended from time to time till 2011. Ms. Sonober Hassan was appointed
on temporary basis on need basis for 89 days and her appointment will
reviewed after the expiry of the term. As such she was not appointed on
daily wages or contract basis.
20. In terms of evidence on records adduced by the petitioners
comprises of the statement of two petitioners and a witness it is abundantly
clear that petitioners and witness have deposed in one voice that the
petitioners were terminated verbally by the management of the institution
and no notice was given to them neither they have been charged-sheeted
nor any inquiry has been conducted which is clearly against the provisions
of I. D. Act. Evidence of the petitioners is convincing on the point that they
have continuously worked in the institution for more than 12 years, workers
have completed more than 240 days in a calendar year continuously. So
they were conferred with the right of workman and the respondent
management therefore in turn was under obligation to observe the mandate
and the procedure laid down under section 25-F of the Industrial disputes
Act before terminating their services or before retrenchment of the petitioner
of whatsoever. Section 25-F provides that where any workmen continuously
to worked for more than 240 days in a year he acquires some right and
privilege in defending the case of retrenchment and under this section it is
provided that no workmen employed in any industry shall be retrenched by
the employer until the workmen has been given one month’s notice indicating
reason for retrenchment. Further, more termination of a workman without
conducting any inquiry without payment of retrenchment compensation and
one month’s pay in lieu of notice is liable to set aside and workmen will be
entitled to reinstatement.
21. So it is clearly established that petitioners have been terminated
by the employer, whereas, they were demanding to be regularized as juniors
to them have been regularized. Whereas, petitioner Ms. Sonober Hassan
was engage on temporary, basis at the time of her appointment. She along
with other petitioners have remained in services for a long period. But
employer have not observed the mandate of the section 25-F of Industrial
Disputes Act. So termination is in violation of provision of Industrial Disputes

Act, as it is without any notice or inquiry so is not legally justified termination.
In support of my contention, laid my hand on an authority of Himachal
Pradesh High Court 2008 Page held as under :––
“Reinstatement with back wages when termination of services of
workmen not legal termination of workmen without conducting
any enquiry and without issuing one month notice held to be violative
of the service rule and section 25-F of the Industrial Disputes
Act, 1947 workmen placing an affidavit to the effect that he was
not gainfully employed after its retrenchment-same not rebutted
by the employer by placing any material on record-workmen held
entitled for reinstatement with full back wages and also interest
@ 9% per annum from date he was allowed to resume duties.”
22. In view of the above, the termination of the petitioners by the
respondent management is illegal, invalid, unwarranted and uncalled for
and against the principle of natural justice. Therefore, the termination of
the petitioners by respondent management is hereby set aside and
respondents are directed to reinstate the petitioners 2 and 3 fourthwith
admittedly, the petitioners have rendered services for more than 240 days
in calendar years as required. There is nothing sustainable accepting the
averment that the petitioners had left the services at their own. Petitioners
were working purely on temporary basis. Even otherwise, taking over all
view of the matter as well as evidence brought on record, it is clear that
petitioners have not worked anywhere else.
23. During the pendency of the reference Petitioner No. 1 Ghulam
Mohi-ud-Din expired and his LR were brought on record so they are entitled
for gratuity, leave salary, retrenchment compensation and other benefits of
the retirement. They are not entitled for reinstatement. As such respondents
are hereby directed to pay the full amount of back wages and other
retirement benefit uptil his death.
24. So far back wages in question is concerned, I realized that
admittedly as come in evidence that they remain unemployed during the

pendency of the case. So, I think to grant full back wages is just and proper.
Hence, respondents are hereby directed to pay full wages from date of
termination till their reinstatement. Accordingly, an award is passed in favour
of the petitioners and against the respondents. Copy of the award be sent
to the Government of J&K through its Commissioner/Secretary, Labour
Department for information and for its publication in the Government
