by the Public Health Engineering/Irrigation and Flood Control

Department under endorsement No. PS/CS/PHE/2630/2012 dated

15-10-2012, the undersigned had assumed the charge of the post of the

Chairperson, Jammu and Kashmir State Water Resources Regulatory

Authority on the 18th October, 2012 A. N.

As section 142(1) of the Jammu and Kashmir Water Resources

(Regulation and Management) Act, 2010 prescribes a term of 3 years for

the Chairperson and other Members from the date they enter upon their

office, the undersigned hereby relinquishes the charge of the said post today

the 17th October, 2015 A. N.

Tender Notice

Sealed tenders affixed with revenue stamps worth Rs. 6/- are invited

for and on behalf of the Government of Jammu and Kashmir from the

interesting parties for the supply, providing and fitting of rollers and

compressors as detailed in the Tender Form. The tenders F. O. R.

Government Press Stores, Srinagar, inclusive of all charges (like providing,

fitting, and taxes wherever applicable) should reach the office of the

undersigned by or before 21-01-2016 up to 2.00 P. M. The tenders shall

likely to be opened on 23-01-2016 at 12 Noon by the Unit Purchase

Committee in presence of tenderers or their representatives who may like

to be present on the occasion. In case the last date of receipt of tenders

happens to be a holiday due to unavoidable circumstances, the tenders shall

be received and opened on the next working day at 2.00 P. M. and shall be

deemed to have been extended to that date. The tenderers should attach

an earnest money minimum of 2% of their quoted value of tender or `15000/-

in the shape of CDR/FDR, pledged to the General Manager, Government

Press, Srinagar. Before submitting the tenders, the interesting parties are

advised to inspect/examine the above mentioned job (detailed in NIT

Annexure) on spot thoroughly for proper assessment.

P-1/16 of 2016.––Whereas, after the general elections held in

November-December, 2014, for the purpose of constituting a new Legislative

Assembly for the State of Jammu and Kashmir, the Peoples Democratic

Party-Bharatiya Janata Party Coalition Government of Jammu and Kashmir

was sworn in on 1st March, 2015, with Shri Mufti Mohammad Sayeed as

the Chief Minister of the State ;

And, whereas, Shri Mufti Mohammad Sayeed passed away at the

All India Institute of Medical Sciences, New Delhi on 7th January, 2016 ;

And, whereas, despite efforts having been made in this behalf, the

ruling Coalition Government has not come up with a new leader to take up

the office of Chief Minister ;

And, whereas, there is likelihood that it would take some more time

before Government can be formed and, thereby, causing an interregnum

for the time being ;

And, whereas, as a consequence, I, N. N. Vohra, Governor of the

State of Jammu and Kashmir, am satisfied that a situation has arisen in

which, for the time being, the Government of the State cannot be carried

on in accordance with the provisions of the Constitution of Jammu and

Kashmir (hereinafter referred to as the State Constitution).

Now, therefore, in exercise of the powers conferred by section 92 of

the State Constitution and of all other powers enabling me in that behalf,

and with the concurrence of the President of India, I hereby proclaim

that I––

(a) assume to myself all the functions of the Government of the

State and all powers vested in or exercisable by anybody or

authority (other than the powers vested in or exercisable by

the High Court) in the State ; and

(b) make the following incidental and consequential provisions

which appear to me to be necessary or desirable for giving

effect to the objects of this proclamation :––

(i) the operation of the following provisions of the State

Constitution is hereby suspended, namely, sections 35 to

41 (both inclusive), so much of section 43 as relates to the

allocation among the Ministers of the Business of

the Government of the State, section 44, sub-section (1)

of section 53, sections 54 to 60 (both inclusive),

sub-section (2) of section 61 so far as it relates to

clause (c) of and the first proviso to section 58 and to

section 60, sections 64, 65, 66, 67, 71 and 72, sections 74,

sections 84 to 88 (both inclusive) and so much of

section 137 as relates to the laying of the report with a

memorandum before the Legislature of the State ;

(ii) the Legislative Assembly of the State shall remain under

suspended animation till such time as this proclamation is

revoked or varied in this regard by a subsequent

proclamation ;

(iii) in the exercise of the powers of the Legislature to make

laws under or by virtue of this proclamation, I shall prepare

such bills as I may deem necessary and declare in respect

of any Bill so prepared that I assent thereto ;

(iv) in the exercise of the powers of the Legislative Assembly

to make grants under sub-section (1) of section 83 of the

State Constitution, I shall, as often as I may deem it

necessary and pending due appropriation by law, make,

by notification in the official Gazette––

(a) grants in advance in respect of the estimated

expenditure or grants in respect of supplementary or

additional expenditure for the period during which this

proclamation may be or is in force ;

(b) grants for meeting any expected demands ; and

(v) any reference in the State Constitution to Acts or laws of

or made by the Legislature of the State shall be construed

as including a reference to Acts or laws made by me in

were an Act of the Legislature of the State.

This Proclamation shall come into effect from the 8th January, 2016.

Now, therefore, in exercise of powers vested in me under the said

Proclamation, I, N. N. Vohra, Governor of the State of Jammu and Kashmir,

hereby enact in the Sixty-Sixth Year of the Republic of India as

follows :––

1. Short title, extent, duration and saving.––(1) This Act may

called the Jammu and Kashmir Delegation of Powers Act, 2016.

(2) It extends to the whole of the State.

(3) It shall come into force at once and shall remain in force

during the period of operation of Proclamation No. P-1/16 of 2016 dated

9th of January, 2016, but its expiry under the operation of this sub-section

shall not affect the validity of anything done, any action taken or any power

exercised (including any order made or proceedings taken) by virtue of the

provisions of this Act.

2. Delegation of powers.––During the continuance in force of this

Act, the powers exercisable by a Minister under any law, rule or order for

the time being in force, shall, notwithstanding anything to the contrary

contained in any such law, rule or order, be exercised by such person or

authority as the Governor may by order, from time to time, direct.

(Gazetted Service) Recruitment Rules, 1978, as amended vide SRO-297 of

2006, the following amendments shall be made ; namely :––

1. Against Class-III, Category ‘A’ in column (5) under the

heading qualification and method of recruitment, at the end of

entry (a), the following proviso shall be added :

“Provided that for promotion against 10% of the vacancies

preference shall be given to available eligible persons

having an additional qualification of post-graduation in

the relevant field of Engineering.”

2. Against Class-IV, Category ‘A’ in column (5) under the heading

qualification and method of recruitment, at the end of

entry (a), the following proviso shall be added :

“Provided that for promotion against 5% of the vacancies

preference shall be given to available eligible persons

having an additional qualification of post-graduation in

the relevant field of Engineering.”

3. Against Class-III, Category ‘B’ in column (5) under the heading

qualification and method of recruitment, at the end of

entry (1), the following proviso shall be added :

“Provided that due weightage shall be given to the persons

having an additional qualification of Post-graduation in

the relevant field of Engineering.”

The reservations granted in terms of these provisions, however, shall

have only prospective effective and shall apply only to future vacancies

which may become available from the date of notifications of the revised

rules as and when issued.
