In exercise of the powers conferred upon me under sections ‘9’

and ‘9A’ of the Jammu and Kashmir State Land Acquisition Act, Svt. 1990,

I, Subhash Chander Dogra (KAS), Collector, Land Acquisition

(Sub-Divisional Magistrate), Mahore, hereby require all the interested persons

i. e. land owners and indenting department to appear personally or through

authorized agent/agents to file their objection/objections, if any, with regard

to the measurement and title of compensation of land to be assessed within

15 days from the date of issuance of this notification. The land is being

acquired for construction of Shajroo to Mulas PMGSY road situated at

the undersigned on 23-12-2015 at 11.00 A. M. at D. C. Office Complex,

Ramban and state the nature of their respective interest in the land, the

amount and particulars of their claims to compensation for such interest,

and their objections (if any) to the quantum and measurement of land. It is

required that all such claims and objections are made in writing.

Executive Engineer, PWD (R&B) Div., Ramban (Indenting

Department) is also requested to send his authorized representative before

the undersigned on above said date, time and venue to putforth his objection,

if any, to the measurement made and to the amount of the tentative

compensation that may be assessed.

It may be taken into notice by all that no claim or objection whatsoever

will be entertained after above said date.

1. For and on behalf of the Governor of J&K State, sealed tenders

affixed with Rs. 5.00 (Rupees five only) revenue stamps are invited from

Registered Contractors/Firms/Suppliers for the supply of items as mentioned

in Group A, B, C & D for the year 2016-17 as given hereunder :

Tender can be obtained from the Office of the Superintendent,

District Jail, Kathua on cash payment or against Bank Draft of equivalent

amount from any Nationalized Bank in the name of the Superintendent,

District Jail, Kathua, for Rs. 500/- (non-refundable) per tender on any

working day during office hours till 15-05-2016.

3.

The tenders shall be received in the Office of Superintendent,

District Jail, Kathua on or before 16-05-2016 up to 2.00 P. M. along with

samples wherever required and the envelope containing tenders

for each group separately should be superscribed as “tender for

group A, B, C and D of this NIT”. Tender affixed with seal of the firm

should be sent either by post or delivered personally against proper receipt

on or before the scheduled date and time.

4.

The rates qouted in the tender shall be F. O. R. District Jail,

Kathua and written both in words and figures inclusive of all taxes and

VAT where applicable.

5.

The tenders will be opened on 18-05-2016 in the Office of the

Superintendent, District Jail, Kathua at 01.00 P. M. by the District Level

Purchase Committee in presence of the tenderers or their authorized

representatives who may like to be present. In case of any unforeseen/

unavoidable circumstances, the tenders will be opened on any other

convenient date to be notified separately.

6.

Tender should be filled within one ink or clear typing, but no

overwriting or alteration should be made therein. Correctuins, if any, done

must be signed.

7.

Tenderer should sign the tender at each page at the end and if

there is any space left blank in the tender, the same must be marked cross.

8.

Conditional tender will not be accepted/entertained.

9.

Tenders without CDR/FDR shall not be entertained and shall be

straightway rejected. Besides, samples of the various items as per the

enclosed Annexures (wherever applicable) should be sent along with the

tender/offer. The samples should bear the name of the firm/supplier clearly.

10.

The tender must be accompanied by the earnest money in the

shape of CDR/FDR of a recognized bank duly pledged to the Superintendent,

District Jail, Kathua as specified hereunder for each group.

The tenderer should be a registered one and should append the

Sales Tax Clearance Certificate from the Sales Tax Department, PAN

and TIN number is also to be submitted along with tender form.

12.

Soon after the acceptance of the tender is communicated to the

successful tenderer, the contract shall be binding on him and he shall have

to make an agreement with the department. the earnest money/CDRs of

the tenderer who backs out or withdraws his tender or fails to abide by the

terms and conditions of NIT, shall be forfeited under rule, besides taking

other remedies which may be available to the department under law.

13.

The successful tenderer shall have to arrange the supplies within

the period mentioned in the supply order.

14.

If successful tenderer fails to supply the goods of the prescribed

specifications or fails to deliver the goods within the stipulated time as

specifically mentioned in the supply order, the department shall be at liberty

to arrange the supplies otherwise, after giving at least 07 days notice to the

successful tenderer. The extra costs so involved will either be made good

from other bills of the contractor, if any, or by way of forfeiture of the

amount of earnest money deposited with the department or other remedies

which may be available to the department under law for the time being in

force in the State.

15.

In the case of rejection/replacement of supplies, the loss so caused

shall be entirely borne by the supplier. The rejected goods/stores shall have

to be lifted by the supplier within one week and the department shall in no

case be responsible for any loss or damage while these are in the Jail

premises.

16.

The material so ordered and supplied should be according to the

approved specifications/samples and shall first be inspected, accepted and

then take on stock and after its verification, the payment shall be made. No

advance payment shall be made.

17.

Bank Commission charges on account of Bank Drafts shall be

borne by supplier.

18.

The contract/supply order can be repudiated at any time if the

supplies shall not be made in accordance with the approved sample,

specification, size or brand by the successful tenderer.

19.

The rate contract shall remain in force for one year from the

date of entering into the agreement or till the finalization of the new rate

contract.

20.

The supplier shall not sublet the contract or any part thereof to

any other firm or agency.

21.

Purchase Committee reserves the right to accept or reject any

tender without assigning any reason.

22.

All legal proceedings arising out of any dispute between the parties

shall have to be instituted in courts situated in Kathua. In case of any

dispute, the decision of the Director General of Prisons shall be final and

binding upon both the parties.
