Whereas, the land, specifications whereof are given in Annexure “A”

to this notification, is required for public purposes i. e. for construction of

Pakal Dul Hydroelectric Project ; and

Whereas, on the basis of the indent placed by General Manager,

Chenab Valley Power Project (P) Limited, Pakal Dul Hydroelectric Project,

Kishtwar vide No. CVPP/PDHEP/L/Land/2013/394-96 dated 02-09-2013,

a notification under section 4 (1) was issued by Collector, Land Acquisition

(ADC), Kishtwar vide No. ADCK/LA/253-58/14 dated 24-10-2014 for

land measuring 267 Kanals 06 Marlas situated at Village Loharna, Tehsil

Dachhan, District Kishtwar ; and

Whereas, the Collector, Land Acquisition (ADC), Kishtwar vide

No. ADCK/LA/15/1346 dated 24-01-2015 reported that the notification

issued by him under section 4 (1) of the J&K State Land Acquisition Act,

was served upon the interested persons for filing objections, if any, to the

proposed acquisition but no objection was received within the stipulated

period as required under sections 5&5-A of Land Acquisition Act ; and

Whereas, the case was received in the Revenue Department from

Financial Commissioner (Revenue), J&K vide letter No. FC-LS/LA-4373/

2015 dated 13-03-2015 for issuance of declaration under sections 6&7 of

the Land Acquisition Act. Since, the General Manager, Chenab Valley

Power Project (P) Limited, Pakal Dul Hydroelectric Project, Kishtwar was

not competent to place the indent, the case was returned to the Financial

Commissioner, Revenue vide Revenue Department’s letter No. Rev./LAJ/

04/2015 dated 23-11-2015 asking him to obtain the requisite indent from the

J&K State Power Development Department ; and

Whereas, pursuant to the Revenue Departnent’s letter referred to

above, the Financial Commissioner (Revenue), J&K vide his letter

No. FC-LS/LA-4373/2015 dated 23-12-2015 has made available the

indent placed by Chief Engineer, Karthai-I&II (PDC) vide No. CE/Karthai/

HEPs//292-95 dated 26-10-2015 duly authorised by Power Development

Department vide No. PDD/IV/43/2015-1 dated 23-10-2015 ; and

Whereas, the report furnished by Collector, Land Acquisition (ADC),

Kishtwar vide letter referred to above duly endorsed by Deputy

Commissioner, Kishtwar vide No. DCK/LA/315-18 dated 24-01-2015 read

with No. ADCK/LA/173-75/15 dated 09-11-2015, Divisional Commissioner,

Jammu vide his letter No. 502/2353/Acq./Loharna/Pakal Dul/Kishtwar/15/

2386-88 dated 11-02-2015 read with No. 502/2353/Acq/Loharna/Pakal Dul/

Kishtwar/15/2112-15 dated 18-11-2015 and Financial Commissioner

(Revenue), J&K vide his No. FC-LS/LA-4373/2015 dated 13-03-2015 read

with even number dated 23-12-2015, have been examined and it has been

found that the land owners did not file any objection to the proposed

acquisition ; and

Whereas, the Government is satisfied that the land particulars whereof

are mentioned in Annexure “A” to this notification, is required for public

purposes i. e. for construction of Pakal Dul Hydroelectric Project.

Now, therefore, in pursuance of section 6 of the J&K State Land

Acquisition Act, Samvat 1990, it is declared that the land measuring 267

Kanals 06 Marlas situated at Village Loharna, Tehsil Dachhan, District

Kishtwar, details whereof are indicated in Annexure “A” to this notification

is required for public purposes viz. for construction of Pakal Dul

Hydroelectric Project. Further, the Collector, Land Acquisition (ADC),

Kishtwar is directed under section 7 of the said Act to take order for

acquisition of the said land after giving prescribed notice to the interested

person(s) as required under the Land Acquisition Act/Rules thereunder.

However, the Collector concerned shall be personally responsible for

proper title verification of all types of land involved in the case, in respect

of all the interested persons/rightful claimants in accordance with the relevant

laws/rules in force, while making final award in the case.

Gharota falls under the territorial jurisdiction of Sub-Divisional Magistrate,

vide SROs-235 and 236 of 2009 dated 11-08-2009 to exercise the

powers under sections 6&7 of the Land Acquisition Act, 1990 (Svt.)

is satisfied after considering the report furnished by the Collector,

Land Acquisition, Assistant Commissioner (Revenue), Jammu vide

letter No. LA/ACR/PMGSY/2015-16/634-35 dated 23-11-2015 that

the land is required for public purpose viz. for construction of road

under PMGSY at Village Gharota, Tehsil Bhalwal, District Jammu.

Now, therefore, it is declared under section 6 of the said Act, that the

aforementioned land is needed for public purpose.

Auction Notice

An open auction for extraction/collection/disposal of Guchhies

(Morels) from the demarcated, undemarcated and berune line forests of

Nowshera, Rajouri and Poonch Forest Division of West Circle for the

year 2016-17 shall be held in the Forest Complex Panja Chowk, Rajouri on

23rd May, 2016 at 1.30 P. M. The indenting bidder shall have to deposit

earnest money of Rs. 30,000/- in the shape of CDR pledged to the

undersigned before start of auction proceedings.

Terms and Conditions :

Ø Earnest money of the successful bidder and the 2nd highest shall

be retained and earnest money of rest of the bidder will be returned

within a week’s time after the auction proceedings are over.

Ø The successful bidder shall have to deposit 50% of the contract

value within 07 days from the date the sanction of contract is

communicated to him. The balance 50% of the contract value shall

be recovered in the following instalments :–––

a. 25% on or before 31st June, 2016 or issuance of 1st F-25

whichever is earlier.

b. 25% on or before 31st August, 2016 or issuance of 2nd F-25

whichever is earlier.

Ø The successful bidder shall have to deposit security not less than

10% of contract value at the time of signing of agreement in the

shape of CDR/FDR pledged to the Divisional Forest Officer, Rajouri.

The earnest money deposited by the successful bidder will be

counted towards the security money.

Ø An interest @ 9% shall be imposed on belated payments, if any.

Ø The successful bidder shall have to enter into an agreement with

the undersigned in respect of Rajouri, Nowshera and Poonch Forest

Divisions within seven days from the date of sanction of contract is

communicated to him. Failing to execute the agreement within the

stipulated period, the earnest money deposited by the successful

bidder shall be forfeited in favour of the department and the contract

will be allotted to the second highest bidder. Any loss on this account

shall be made good from the successful bidder in terms of land

revenue rules besides blacklisting.

Ø The department reserves the right to accept or reject any offer

without assigning any reason thereof.

Ø Blacklisted contractor/defaulters and Government debtors are not

be permitted to offer bids.

Ø Permit No. 7 to be issued by the contractor shall have to be

got printed by the contractor at his own cost in the form prescribed

by the DFO concerned and the same must be stamped

from the concerned DFO before use. The used and unused

books of Form-7 shall have to be return to the DFO concerned by

31-03-2017, otherwise the security money paid by the contractor in

part or in full will be liable to be forfeited at the discretion of Divisional

Forest Officer, Rajouri.

Ø The contractor will be responsible for the observance by himself

and his agents of the terms and conditions of the agreement.

Ø All the taxes including Dharats Sale Tax, Income Tax, Surcharge

etc. payable shall be paid by the contractor including TDS @

applicable during the year.

Ø The successful bidder will have no right to remove any other MFP

or forest produce from the forest under the garb of this contract

and if any such instance comes to the notice, the same shall be

dealt within the provisions of J&K Forest Act.

Ø All movement of Guchhies within the limits of Forest Division

concerned will be covered by Form-7 issued by the contractor or

his/their authorized agents. In case of inter-divisional movement of

Guchhies and when check post/posts is/are to be crossed, issuance

of Form-25 is a must as per provision of section 15 of the J&K

Forest Act. Form-25 will be issued on the basis of Form-7 issued

by the contractor and the release made by the competent authority.

Ø As soon as the acceptance of the contract is communicated to the

successful bidder, the contract shall be complete and binding on

him. A formal deed incorporating the terms of contract shall be

executed by the successful contractor later on, failing to execute

the formal deed shall not prevent the terms of contract from being

enforced against him.

Ø Any produce left in the Forest Division for transportation after

31-03-2017, will have to be reported to the concerned DFO or Range

Officer concerned on or before 31-03-2017 and got checked/

weighed and no claim after this date shall be entertained and

thereafter it shall be presumed that no balance stocks are left.

Ø In case of dispute, if any, arises between the contractor and the

department, the decision of Chief Conservator of Forests, Jammu

shall be final and binding on both the parties.

possession ; and

Whereas, in this connection, Case FIR No. 137/2010 under

section 7/25 A. Act, sections 18, 19 and 20 of the Unlawful Activities

(Prevention) Act, 1967, was registered in Police Station, Kokernag and

investigation initiated ; and

Whereas, during the course of investigation, on the basis of statements

of witnesses, the seizure memo and other evidence collected, the

Investigating Officer has established a prima facie case against the accused

persons under sections 18, 19 and 20 of the Unlawful Activities (Prevention)

Act, 1967 apart from other offence ; and

Whereas, the Authority appointed by the State Government under

sub-section (2) of section 45 of the Unlawful Activities (Prevention)

Act, 1967 has independently scrutinized the Case Diary file and all other

relevant documents relating to the case and has come to a definite conclusion

that this is a fit case for accord of prosecution sanction against the accused

persons ; and

Whereas, after perusing the Case Diary, the relevant documents and

also taking into consideration the observations/views of the Authority

appointed under sub-section (2) of section 45 of the Unlawful Activities

(Prevention) Act, 1967, the State Government is of the view that there is

sufficient material and evidence available against the accused persons for

their prosecution under the aforesaid provisions of law.

Now, therefore, in exercise of powers conferred by sub-section (l) of

section 45 of the Unlawful Activities (Prevention) Act, 1967, the State

Government hereby accords sanction for launching prosecution against the

below mentioned accused persons for the commission of offences punishable

SRO-117.––In exercise of powers conferred by sub-section (2) of

section 3 of the Jammu and Kashmir Entry Tax on Goods Act, 2000

(Act No. IV of 2000), the Government hereby exempt from payment of

entry tax, leviable under the said Act, one automatic chapatti machine and

its accessories to be imported into the State by International Society of

Krishna Consciousness, Udhampur (an orphanage and boarding school)

for daily use in the said orphanage subject to the condition that the

President, International Society of Krishna Consciousness, Udhampur

certifies that the equipment so imported is exclusively meant for the

aforesaid purpose.

SRO-118.––In exercise of the powers conferred by sub-section (2)

feet) of marble to be imported into the State by Jamia Islamia Arabia,

Reyaz-ul-Uloom and Jamia Reyazus-Salihat, Reyaz Nagar Near Darhali

Bridge, Rajouri, J&K for the construction of Jamia Masjid, Reaz-

ul-Aloom, Rajouri subject to the condition that the management undertakes

that goods so imported are exclusively meant for the aforesaid purpose.

the Jammu and Kashmir Levy of Tolls Act, Samvat 1995 (Act No. VIII

of 1995), the Government hereby exempt from payment of levy of tolls

leviable under the said Act, 6000 sq. ft. (six thousand square feet)

of marble to be imported into the State by Jamia Islamia Arabia,

Shrine Board certifies that the Langars/Bhandaras are being set up by the

NGOs with his prior permission.
