STATEMENT OF OBJECTS AND REASONS

Ø

The Jammu and Kashmir Public Premises (Eviction of

Unauthorized Occupants) Act, 1988 provides for the eviction of

unauthorized occupants from the public premises and other

incidental matters. There are number of instances where public

premises of various Government Departments continue to remain

under unauthorized occupation in the absence of timely action

and remedial reasons due to busy schedule of the Civil Courts.

The Government Department/Agencies who let the public

premises are confronted with loss of energy and public money

owing to resultant litigation. Under the existing provisions of the

Act, it is the State Government or the Department/Agency

concerned on whom onus of proof lies that an occupant is

unauthorized, when it should have been vice-versa.

Ø

In order to overcome this situation and to ensure that the

unauthorized occupants are evicted from the Government/

Semi-Government/Public Sector Undertakings/Corporations/

Autonomous Bodies owned Quarters/Flat/Properties at an

earliest, the proposed amendment in sections 2, 4, 5, 12 &

19 will ensure early vacation of the public premises by the

unauthorized occupants. The appeal against the order of Estates

Officer lies to the District Magistrate concerned where the public

premises situate.

Ø

The object of the proposed legislation is to retrieve the Public

Premises expeditiously from the unauthorized occupants which

otherwise cause irreparable loss to the State exchequer besides

denying the eligible persons the right of user.

STATEMENT OF OBJECTS AND REASONS

Section 138 (1) of Transfer of Property Act, Samvat 1977 provides

that no transfer of immovable property shall be valid unless it is in

writing, registered and the registration thereof has been completed in

accordance with sub-section (3) of section 61 of the Registration Act.

Under the provisions of Alienation of Land Act and other laws governing

alienation of land, the transfer of immovable property in the State in

favour of the non-permanent residents of the State is totally prohibited.

The restriction created under sub-section (3) of section 138 of

the Transfer of Property Act, regarding taking possession of and transfer

of the immovable property for commencing any construction activity

is limited to “Kashmir Province” only. However, no such restriction

has been imposed in the Act for the aforesaid purpose in respect of

Jammu Division, with the result the land is being transferred to the

non-permanent residents of the State, through unrecognized modes ;

like power of attorney, agreement to sell etc. The situation in Jammu

Division has reached at an alarming levels, which warrants rectification

of the aberration in the principal legislation i. e. sub-section (3) of section

138 of the Transfer of Property Act.

Similarly in section 2 of Alienation of Land Act and section 5

of Transfer of Property Act, the words lease, sale, gift, bequest are

not properly defined with the result the said modes are not considered

as permanent/temporary alienation of immovable property. This has

resulted in making varying interpretations by the Hon’ble Courts

facilitating unlawful transfer of immovable property. It is, therefore,

expedient to remove the ambiguity, so as to safeguard the interests

of permanent resident of State, so far as alienation of immovable

property in the State is concerned.

Hence, the proposed amendments.

STATEMENT OF OBJECTS AND REASONS

The J&K Civic Laws (Special Provisions) Act, 2014 was

enacted which extended to the local areas of Jammu, Srinagar and Katra

town. In pursuance to the section 3 of the Act, the Government had

to formulate a policy to deal with or regulate the unauthorised

constructions in the aforementioned local areas. This policy should be

in consonance with the Master Plan as may be modified as reviewed

under sub-section (2) of section 12 of the J&K Development

Act, 1970.

The midterm revision of the Master Plans of Jammu, Srinagar

and Katra under J&K Development Act, 1970 has been undertaken

by the department but due to certain unavoidable circumstances the

deadlines projected for completion of the Master Plans could not be

accomplished, thereby causing a delay in finalization of the proposed

policy required under the Act for regularization of unauthorised

constructions to the extent possible within the ambit/framework of the

modified Master Plans.

As the term of the Act consequent to its extension vide

J&K Civic Laws (Special Provisions) (Amendment) Act, 2015 expired

on 31-12-2015, and the policy as required under the Act has not been

framed, so this Act be further extended up to 31st March, 2017.

“STATEMENT OF OBJECTS AND REASONS”

The Department of Rural Development and Panchayati Raj

proposes amendment in sections 4, 27, 40, 42(A) and 43 of Jammu

and Kashmir Panchayati Raj Act, 1989.

The elections to the Halqa Panchayats are due in July, 2016 and

for conducting fresh elections of Halqa Panchayats the process has

been initiated however the need has been felt to amend Panchayati

Raj Act so far it relates to following two issues :––

(a) Election of Sarpanch ;

(b) Constitution of Block Development Council.

sub-section (4) of section 4 of the Panchayati Raj Act provides as

under :––

The Sarpanch shall be elected directly by the electorate

of Halqa Panchayat in such manner as may be prescribed.

As per the said provision of the Act, the Sarpanch is to be elected

directly by the electorate of Halqa Panchayat. However, it has been

observed that the electing of Sarpanch directly by the electorate of

Halqa Panchayat has created problems in the field as it has been found

that in larger number of cases there is a drift between Panches and

Sarpanches as Sarpanch gets elected directly and there is lack of

confidence from the Panches on him or vise-versa which hampers the

process of implementation of various schemes on the ground level and

accordingly it has been felt necessary to amend the above said provision

of the Principal Act to the extent that the Sarpanch shall be elected

by the Panches of the Halqa Panchayat from among themselves which

is procedure at highest level of governance like Ministers in the State

and Central Government remain MLAs and MPs also.

Further, the provision relating to the constitution of Block

Development Council has been laid down in sub-section (1) of

4

[No. 12-6

––––––––––––––––––––––––––––––––––––––––––––––—–––—————

section 27 of the Panchayati Raj Act, 1989 which is reproduced as

under :––

27. Constitution of Block Development Council.––(1) For

every Block in the State, Government shall, by notification,

constitute a Block Development Council bearing the name of

the block.

There are some blocks which comprises of less than 10 Panchayat

Halqas, as such it would not be feasible to have a Block Development

Council for every such block. Further, to have an enhanced

representative character it would therefore be in the fitness of things

to have Block Development Council in Blocks where there are maximum

number of Panchayat Halqas which can be determined on the basis

of number of Panchayat Halqas, population and geography of the area

which will be notified by the Government from time to time.

The need has been felt to amend Panchayati Raj Act to

provide for,––

A. Election of Sarpanches by Panches instead of direct

elections and he shall continue to remain as Panch

also ;

B. To amend the Act to the extent that we can have a

single Block Development Council for more than one

block on the basis of population, number of Panchayat

Halqas and geography of the area, which will be

notified by the Government from time to time.

The matter has been examined in this department and submitted

the Amendment Bill to the Law Department for vetting. The Law

Department vetted the Draft Bill and advised to the Department of

Rural Development and PR to append “Statement of Objects and

Reasons” with the Bill and process it for orders of the Cabinet for

introduction in the ensuing session of the State Legislature.

–––––––—–––––––––––––––––––––––––––––––––––––––––––––––———

The Secretary to Government, Department of Rural Development

and Panchayati Raj, with the prior approval of the Hon’ble Minister

for Rural Development and Panchayati Raj, placed the matter before

the Cabinet for consideration and approval of the above two amendments

in the Jammu and Kashmir Panchayati Raj Act, 1989 and for introduction

of the Bill in the current session in the State Legislature.

However, the Cabinet vide its Decision No. 33/05/2016

dated 23-06-2016 observed as under :––

“The Cabinet discussed the proposal and directed that the

same be put up before the Group of Ministers on Economic

Affairs constituted vide Government Order No. 368-GAD

of 2016 dated 12-04-2016 for further examination.”

The Draft Bill was considered by the Group of Ministers on

25-06-2016. The Group of Ministers after threadbare discussion on each

clause of the Bill recommended that clause 3 of the Bill pertaining to

amendment of section 27 of the Jammu and Kashmir Panchayati Raj

Act, 1989 be deleted and instead the Rural Development Department

shall undertake an exercise for rationalization of blocks. The rest of

the clauses of the Bill were cleared by the Group of Ministers.

Accordingly, the Secretary to Government, Department of Rural

Development and Panchayati Raj, with the prior approval of the Hon’ble

Minister for Rural Development and Panchayati Raj, place the matter

before the Cabinet for consideration and approval of the only amendment

in the Jammu and Kashmir Panchayati Raj Act, 1989.
