Whereas, notification as required under sub-section (1) of

section 4 of the J&K Land Acquisition Act, Svt. 1990 was issued

by the Collector, Land Acquisition, Assistant Commissioner (Revenue),

Pulwama vide Notification No. 35 of 2015 dated 25-08-2015 ;

Whereas, the Collector has reported that the owners/interested

person in respect of land particulars of which are mentioned above

did not participate in the private negotiation and one of them

Shri Mohd Munwar Bhat S/o Ab. Gani has filed objection to the

acquisition of the above-mentioned land on 19-08-2015 wherein he

has alleged that alignment of the road has been changed vis-a-vis

notification under section 4 (1) issued on 25-08-2015. The Collector

then called the objector to provide him an opportunity of being heard

under section 5 (i) of the Act but the objector did not turn up to

in the Collector. Therefore, the objections were examined ex parte

from the perusal of the record, it was found that the objector is the

owner of land under Khasra No. 52/min only and he is not an

No. 14] The J&K Govt. Gazette, 7th June, 2016/16th Asad., 1938. 207

–––––––––––––––––––––––––––––––––––––––––––––––———–––––––––

interested person in respect of other land under acquisition. Perusal

of the record also reveals that no change in alignment of road has

been made in these Khasra Nos. However, the notification under

section 4 was not correct due to wrong calculation of the land under

acquisition, while carrying out fresh calculation of (Istageraj) of the

area, variation in the area was found same has been proposed for

notification under sections 6&7. However, area of Khasra No. 52

increased for the reason that the land under the Khasra No. falls

at the take off point of the road from Pulwama-Shopian Road and

the width of the road has to be increased at that point for smooth

flow of traffic. For the reason, only 2 Marlas additional land under

Survey No. 52 has been added for acquisition. For these reasons

the Collector has recommended that objection may be rejected and

notification under sections 6&7 of the Act be issued. After perusing

the record on the file and report of the Collector this office is satisfied

that the objections are baseless and that the land is required for public

purposes viz. construction of Circular Road from Drusoo-Chartipora

Road to Pulwama-Shopian Road at Village Bonura, Tehsil and District

Pulwama.

Now, therefore, the objections raised to proposed acquisition are

hereby rejected and it is declared under section 6 of the said Act

that the land aforementioned is needed for public purposes. The

Collector, Land Acquisition, Assistant Commissioner (Revenue),

Pulwama is directed under section 7 of the said Act to take order

for acquisition of the land of which specifications are given above.

The Collector is further allowed to take the possession of aforementioned

land after completion of all formalities including those under sections

9 and 9(A) and 17 of the J&K Land Acquisition Rules and to finalize

the final award.

STATEMENT OF OBJECTS AND REASONS

The Brick Kilns (Regulation) Act, 2010 was passed by the State

Legislature in the year 2010, after a prolonged period during which there

was no piece of legislation to monitor and oversee the established Brick

Kilns due to which a large number of Brick Kilns have been established

on the prime agriculture land and have very bad and detrimental effects

on the human lives and agriculture production. A huge chunk of

agricultural lands are being converted for commercial/non-agricultural

purposes like-wise the establishment of Brick Kilns in the State without

getting any permission from the competent authority, as envisaged under

the provisions of Jammu and Kashmir Agrarian Reforms Act, 1976,

due to which the purpose of the agriculture and livelihood of the

agriculturists seems to be forfeited. As such the incorporation of the

amended provisions would impose the restrictions on the use of

agricultural lands for non-agriculture purposes and also would prove a

safeguard to the agriculturists viz-a-viz minimize

the loss to the agriculture sector. Further, keeping in view the interest

of existing Brick Kiln Manufacturers the time for relocation for the

Brick Kilns is required to be extended for further 2 years which are

established on the land prohibited under the Principal Act.

Hence, the Bill.

STATEMENT OF OBJECTS AND REASONS

The Government has notified many amnesty schemes from time

to time to provide succour to the trading community whose business

had suffered due to turmoil in the State and huge demands on account

of interest and penalty were raised against them. The Government

notified the last amnesty scheme vide SROs 172 and 173

dated 07-05-2007 to cover the assessment periods up to 2004-05.

A large number of dealers could not take the benefit of the scheme

owing to various reasons and the Government is seized of the matter

that there was eminent necessity to provide relief to the remaining

dealers against whom huge demands are pending.

The Hon’ble High Court, Jammu and Kashmir at Jammu in its

interim order dated 04-06-2012 in WPPIL No. 13/2011 titled Balvinder

Singh and another Vs. State and others placed an embargo on grant

of amnesty by the Government. The Government pleaded before the

Hon’ble High Court for modification of the order so that a formal

scheme for the purpose is notified. The Hon’ble High Court modified

the order on 02-03-2016 allowing the Government to declare amnesty

with respect to penalty only.

The purpose of the Government is to provide complete relief to

the trading community, industrial sector and transporters by remitting

interest and/or penalty which may not be possible under the existing

law/existing circumstances.

Hence the Bill.

STATEMENT OF OBJECTS AND REASONS

The salaries and allowances of the Members of the State

Legislature and Ministers are governed under the Salaries and

Allowances of Members’ of the Jammu and Kashmir State Legislature

Act, 1960 and the Jammu and Kashmir Ministers and Ministers of State

Salaries Act, 1956 respectively. At present, the Members, Chief

Minister, Minister and Ministers of State are entitled to monthly

salary including allowances at the rate of ` 80,000/-, ` 90,000/-,

` 85,000/- and ` 80,000/- respectively. The demand of Hon’ble Members

of the State Legislature for enhancement of their salaries and allowances

was on examination found genuine keeping in view the price hike of

all the essential commodities and increase in the cost of living. An

assurance to increase the salary of the members of the State Legislature

was held out by the Government on the Floor of the House.

The Bill seeks to enhance the salaries and allowances of the

said dignitaries. The salary of the Chief Minister and Ministers is

being enhanced from ` 45,000/- and ` 40,000/- to ` 70,000/- and

` 65,000/- per month respectively. The monthly salary of the Ministers

of State is being enhanced from ` 35,000/- to ` 60,000/- per month.

The allowances of Hon’ble Ministers is governed by the Jammu

and Kashmir Ministers’ (Sumptuary and Constituency Allowance) Rules,

1987. For increasing the allowances of Hon’ble Ministers, necessary

amendments would be made subsequently in the said rules. However,

the Salaries and Allowances of Hon’ble Members of the State

Legislature are governed by the Salaries and Allowances of Members’

of the Jammu and Kashmir State Legislature Act, 1960. The Bill,

therefore, seeks to increase the salary and allowances of Hon’ble

Members of the State Legislature from ` 80,000/- to ` 1,60,000/- per

month.

Hence the Bill.
