AWARD
The brief facts collected from statements of the witnesses
produced by the applicant workmen and their documents placed on
the file, are summarised as under :––
The applicants as mentioned above from S. No 1 to
S. No. 5 were the employees of the Management ITDC and
Gulmarg SKI Project and Sound and Light Shalimar, who worked
there for 17-30 years continuously. They were appointed in these
establishments of ITDC in 1972 and were retrenched in the
year 2002 on the plea that due to reasons beyond the control of
ITDC Management both the projects in the Valley have become
defunct and non-functional and there is no possibility of revival
of the said establishments in the near future. The applicant
workmen raised an industrial dispute under section 2-A of
Industrial Disputes Act, 1947 through their individual applications
before Conciliation Officer (Deputy Labour Commissioner),
Kashmir Division, Srinagar on 18-06-2003 regarding their illegal

termination by the management, represented by Chairman/
Managing Director and Senior Vice-President, ITDC, and
accordingly the management closed down establishments in
Shalimar as well as Gulmarg and according to the management
there was no work to be provided to the workmen and
consequently their services were treated as surplus and were
retrenched from service.
That the applicant workmen were not the only employees
who were appointed/working in the sound and light show, SEL
Shalimar and Gulmarg SKI Project. Actually the total number
of employees working there were sixteen (16) in number, who
were appointed along with these applicant workmen whose
names are as under :––

Shri M. N. Raina
4.
Shri Mehar Singh
5.

7.
Gh. Hassan Sheikh
These employees were not terminated/retrenched in the
SEL Shalimar and Gulmarg Project, but they were transferred
to other units of ITDC, Delhi, before effecting retrenchment of
the above-mentioned applicant workmen.
It may not be out of place to mention here that in their
appointment orders, some terms and conditions were mentioned
including the terms and conditions at S. No. 7 and 8.

The J&K Govt. Gazette, 8th July, 2016/17th Asad., 1938.

–––––––—–––––––––––––––––––––––––––––––––––––––––––––––———
S. No. 7 mentions that your services are transferrable
anywhere in India and abroad to any other unit of the corporation
and S. No. 8 of the terms and conditions mentions that during
the winter closure of Sound and Light show, you will be required
to serve in any other unit of the corporation every year.
In view of these terms and conditions mentioned at
S. No. 7 and 8, all these employees used to be transferred to
Delhi to work in other units of the corporation for the whole
winter season.
That the said Conciliation Officer tried his best to bring
the parties to an amicable settlement but the non-applicant
management adopted a rigid attitude by not attending and
participating in the conciliation proceedings. Consequently,
conciliation failed and the Conciliation Officer submitted failure
report to the State Government under section 12 (4) of Industrial
Disputes Act and the Government referred the matter in dispute
to this forum under SRO-244, dated 26-07-2004, with the
following references :––
a. Whether the closure of Sound and Light Show
Shalimar is illegal in the eyes of Law ?
b. Whether the termination of employees and their
re-engagement on the contractual basis in the same
concern is illegal ?
c. If so, whether the retrenched workmen are entitled
to reinstatement with full back wages, and
consequential benefits ?
ISSUE (a) : Whether the closure of Sound and Light Show Shalimar

[No. 14-1
––––––––––––––––––––––––––––––––––––––––––––––—–––—————
A notice was issued on 1-11-2002 by the management to the applicant
workmen wherein it has been mentioned that the sound and light show and
Gulmarg SKI Project have become totally non-functional and on this very
ground the corporation is going to retrench the services of employees. It
was not only the SEL Shalimar Unit and Gulmarg SKI Project which were
affected by the militancy related events at that time, but every State and
Central Government Departments and establishments were adversely
affected at that time. It was the policy of State and Central Government to
provide relief and packages to the people in general and also to provide
employment to the unemployed persons of the State. But at this stage the
ITDC resorted to retrenchment of the employees of SEL Shalimar and
Gulmarg SKI Project in order to add to the miseries of the employees. It
was against the policy of the State Government and violation of the basic
fundamental rights of the Constitution of India.
Moreover, in the second para of the said termination notice the reason
for retrenchment has been shown as unavoidable circumstance. Keeping
in view the legal explanation of the term “unavoidable circumstances” on
the basis of which the services of the employees were terminated by the
management, were not unavoidable at all because every department was
facing the similar circumstances that time from 1989 and none of the
department has taken such a harsh action against its employees. The
corporation could have passed appropriate orders for the voluntary
retirement of the applicant workmen and given them all the retirement
benefits or it could have transferred these employees to Delhi for their
adjustment in different units like other seven employees who had been
already adjusted in its different units at Delhi before the retrenchment of
the present applicant workmen. It may not be out of place to mention here
that the present applicant workmen were promoted, transferred to other
units during their service tenure in accordance with the para 7 and 8 of
their appointment orders and also during winter closure of the sound and
light show, the present applicant workmen were invariably transferred to
Delhi to serve in other units of corporation every year as per the terms and
conditions of their appointment orders. Moreover, the applicant workmen

were treated as the full-fledged employees of the corporation by the
management till the date of their illegal termination. Discrimination has
been meted out between the two groups of the workmen, who belong to
the same unit of SEL Shalimar and Gulmarg SKI Project. One group of the
applicant workmen has been terminated from the services of the corporation
and the other group has been retained by transferring them to other units at
Delhi and some of them are still in service. The action of the management
is also a violation of the Article 14, 16 and 21 of the Constitution of India on
the ground that the termination of the services of the workmen is arbitrary
and discriminatory as the corporation is having a status of State within the
meaning of Article 12 of the constitution of India. Moreover, the rule of hire
and fire could not be resorted to by the non-applicant management of the
corporation, which is wholly owned by the Government of India and was as
good as the Central Government. Therefore, it was incumbent on it to
absorb these permanent employees like the present applicant workmen in
other units.
The whole gamut of labour legislation is to check, control and
circumscribe uncontrolled managerial exercise of power with a view to
eschew the inherent arbitrariness in the exercise of such actions. Therefore,
the management cannot be allowed to be whimsical and capricious in the
matter of ignoring the interests of labour altogether.
The present workmen were not the employees of SEL Shalimar and
Gulmarg SKI Project at the unit level, but were the employees of the
corporation at the corporation level which is a going concern and the
termination of the applicant workmen is retrenchment. The pre-requisite
for a valid retrenchment as laid down in section 25-F has not been complied
with by the non-applicant corporation. The applicant workmen have been
paid the notice pay and the retrenchment compensation after the lapse of
four or more months through cheques, which is a violation of section 25-F,
and which makes the retrenchment in the present case illegal.
In this connection I would mention the judgement of the Hon’ble
Rajasthan High Court which has held that payment of notice pay and
6

[No. 14-1
––––––––––––––––––––––––––––––––––––––––––––––—–––—————
retrenchment compensation after 6 days of retrenchment is non-compliance
of law. The brief facts of the case are that a workman was retrenched
from service. Notice pay and retrenchment compensation were paid to him
after 6 days of retrenchment by his employer. The workmen accepted the
compensation amount but still raised a dispute before the labour court for
non-compliance of the provisions of section 25-F of the Industrial Disputes
Act of 1947. The labour court held that payment of one month’s wages and
the retrenchment compensation to the workmen, after six days of
retrenchment was a proper compliance with the statutory requirement.
The workman challenged the award of the labour court before the
honourable Rajasthan High Court. The Hon’ble High Court set aside the
award of the labour court and directed the reinstatement of the workmen
into service with the following observations :––
(a) That the workmen had completed the 240 days service in the
respondent establishment prior to his retrenchment i. e.
February 1, 1994, therefore had completed continuous service
of one year in terms of section 25-B of the Act and hence
section 25-F of the Act was required to be complied with while
terminating his services.
(b) Section 25-F of the Act clearly contemplates that if employer
wants to terminate services of the workmen, he has to comply
with one month’s notice or salary in lieu thereof and
compensation which is to be computed on the basis of 15 days
wages of each completed year of service which is required to
be paid simultaneously. The same was considered by this court
in RSRTC V/s. Judge Labour Court, Jaipur, 1994, RLR 981.
(c) The submission made on behalf of the employer that the
workmen had accepted the amount of retrenchment
compensation, has no substance. Mere acceptance will not
obliterate the statuary obligation cast upon the employer to
comply with their mandatory requirement provided under the
No. 14-1]

Act. The finding of the labour court is totally perverse and
contrary to the settled principles of law.
(Hon’ble Rajasthan HC : Sita Ram Pareek vis Judge
Labour Court and another 2007 I LLJ 264)
In the light of the above quoted judgement of
Hon’ble Rajasthan High Court, the present applicant
workmen also approached this court with the same
compliant that they have been paid the notice pay and
retrenchment compensation after affecting their
retrenchment after the lapse of more than four months
through cheques, which is a violation of section 25-F
which makes the retrenchment in present case illegal.
ISSUE (b) : Whether the termination of employees and
their re-engagement on the contractual basis in the same
concern is illegal ?
The present workmen after their termination from service
were re-engaged on contract basis after the gap of about 3
months on the minimum salary of Rs. 4500/- per month and
Rs. 3000/- per month for a period of six months, which was
likely to be extended by the management. All these present
applicant workmen accepted this contractual employment and
joined on their respective places of posting in the SEL Shalimar
and Gulmarg SKI Project.
It means that places of posting were thrown open for all
the employees and the order of closure of both the
establishments withdrawn, which means that the management
wanted to run both the establishments with the help of now
contractual employees on a meagre wages instead of their
salaries last drawn by them. On the one hand, the ITDC
Management has declared closure/retrenchment but on the
8

––––––––––––––––––––––––––––––––––––––––––––––—–––—————
other hand it is running both the SEL Shalimar and Gulmarg
SKI Project through these retrenched employees, who have
been re-employed on contractual basis. The closure is,
therefore false, ruse and pretence.
Moreover, the policy of management appointing their regular
employees on a meagre wages of Rs. 4500/- and Rs. 3000/-
per month on contract basis is wrong and illegal.
ISSUE (c) : If so, whether the retrenched workmen are
entitled for reinstatement with full back wages and
consequential benefits ?
That the Establishment viz. ITDC having its units allover
India is a single industrial establishment having Recruitment,
Promotion, Seniority, Rules, Conduct, Discipline and Appeal
Rules, 1978 and standing orders which apply to all its employees
of the corporation working in its head office, various divisions,
units, regional offices, branches including units managed by
the Corporation, as also employees whose services are deputed/
lent to other agencies. Moreover, the applicant workmen were
governed in all respects by the service rules of the corporation
as also by the standing instructions and the administrative
orders issued by the management from time to time. Moreover,
among other terms and conditions mentioned in the
appointment orders, the services of the applicant workmen
were transferable anywhere in India and to any other unit of
the corporation, including the units of SEL Shalimar and
Gulmarg SKI Project.
Shri Abdul Rashid Dar, one of the applicant workman,
was promoted as Junior Assistant in the pay scale of
Rs. 1200/- 2040/- w. e. f. 26-9-1990 on the recommendations
of the departmental promotion committee, which is on the
corporation level, and with the approval of the competent

authority, issued under signatures of P. C. Arora, General
Manager, (P-R) of India Tourism Development Corporation
Limited. The said order mentions that Shri Abdul Rashid
Dar promoted as junior assistant, will be governed by
the rules, regulations of service conduct, discipline and
appeal rules and standing orders of the corporation that
are in force, and which may be amended, altered or
extended from time to time. It is also mentioned in the said
order that order relating to fixation of pay and place of posting
will be issued separately.
From the perusal of this order also, it is established that the
unit of SEL Shalimar and Gulmarg SKI Project are part and
parcel of the ITDC at the corporation level.
In the light of above facts, I hold that the retrenched
workmen are entitled to reinstatement with full back wages
on revision bases with other consequential benefits along with
09% interest. An award in favour of the applicants is
accordingly passed against the non-applicant management.
The reference made to this court by the State Government
is answered accordingly and award is made in favour of the
applicants and against the non-applicant management. A copy
of the award be sent to the appropriate Government
through its Commissioner/Secretary, Labour Department for
information and its publication in the Government Gazette.
The file after due completion, be consigned to records.
