REGD. NO. JK—33
In the Matter of :––
Reference under section 10 of Industrial Dispute
Act, 1947.
Appearing Counsel :
Counsel for Petitioner Mr. A. R. Bhat, Present
For Respondent M. D. Cable Car, Present.

AWARD
The Government of J&K referred industrial dispute arising out of
the termination of the services of the applicant to this court under
section 10 (1) (c) of the Industrial Disputes Act,1947 vide SRO No. 157
dated 03-06-2014, on the matters specified below for adjudication :––
1. Whether termination of services of Ms. Tasleema Aziz by
the Managing Director, Cable Car Corporation is illegal,
justified ? and
2. If not, to what relief she is entitled to ?
During the course of proceedings and in response to the reference
the applicant filed the claim application on 26-11-2014 stating therein that
she was an employed person appointed by the Non-Applicant’s Corporation
as a Clerk-cum-Receptionist in J&K Cable Car Corporation, Srinagar in
the month of June, 2009 and as claimed by her she was discharging her
legitimate duties to the entire satisfaction of superiors of the corporation.
She has further stated that she was drawing Rs. 3300 wages per month at
the initial stage and was later on stepped up to Rs.7500 per month. She has
further stated that on 24th of August, 2012 the non-applicant unprecedently
terminated the service of the applicant without payment of retrenchment
compensation and without notice or notice pay as required under
section 25-F of the Industrial Disputes Act,1947 and has left the applicant

for starvation she has further claimed that she has rendered three years
and four months uninterrupted continuous service in the said establishment.
Hence, present application for adjudication under Industrial Disputes
Act.
In response to the application the non-applicant submitted written
objections on 20-02-2015. In its written objections the non-applicant denied
the applicants permanent appointment but have accepted that the applicants
services were utilized in the corporation on need base as casual worker
and on 20-07-2012. She was retrenched as her services were not required
by non-applicants corporation. Further, the non-applicant in his written
objections have stated that they have not violated section 25-F of the
Industrial Disputes Act,1947. The non-applicant has further disclosed
that the applicant was never in continuous service even for one year and
was disengaged and re-engaged as and when need arose in the corporation.
In view of the reference and claim/application of the applicant
and objections of the non-applicant, the following issues were struck in the
case :––
(1) Whether termination of the service of Ms. Tasleema Aziz by
the Managing Director, J&K Cable Car Corporation is illegal,
justified ? and
(2) If not, to what relief she is entitled ?
All the issues are taken together into consideration and the parties
were directed to lead evidence. On 24-03-2016 the applicant produced
copy of recorded statement of a witness on affidavit namely Qazi
Najam-us-Saqib S/o Qazi Farukh Seyar R/o Abu Bakar Colony, Bemina
Srinagar and the applicant also produced recorded statement as his own
witness on affidavit and were cross-examined by the non-applicant learned
counsel on 21-04-2016 .

–––––––—––––––––––––––––––––––––––––––––––––––––––––––———
The applicants witness in his recorded statement has disclosed that
he closely knows the applicant and he has seen her that she was working in
J&K Cable Car Corporation and was posted in Head Office Zum Zum
Complex, Airport, Srinagar and also at Gondola, Gulmarg, for the simple
reason, to deal with the process of e-Ticketing for the corporation. He
further stated that he has no knowledge about the grounds of the termination
of the applicant best known to the management. The applicant in her
recorded statement as her own witness has stated that she was working as
Clerk-cum-Receptionist in J&K Cable Car Corporation from the period of
May, 2009 up to 24th August, 2012 and has rendered three years and four
months continuous service in the non-applicant’s corporation and her services
were terminated by them on their own sweet will and without considering
the requirement of law on the subject which was mandatory for them.
On 23-05-2016 the non-applicant’s learned counsel produced copies
of recorded statements of two witnesses on affidavit namely Sanuallah
Malik S/o Abdul Khaliq Malik, Administrative Officer, JKCCC, Rambagh,
Zum Zum Complex, Srinagar and Gulzar Ahmad Ganie S/o Mohammad
Ramzan Ganie, President, Employee Union, JKCCC. On 23-06-2016 both
the witnesses were put to cross-examination by the learned counsel for the
applicant. In their recorded statements they have disposed in one voice that
the applicant was working as a casual labour and has performed her duties
in different sections of the corporation. They have further disposed that
she was on master sheet rolls and during the course of service has been
disengaged and re-engaged as and when need arises.
During the course of cross-examination the non-applicants witnesses
were put to test when applicants learned counsel invited their attention on
photo copies of attendance-cum-master sheet for the months of
March, 2010, October, 2011 and January, 2012 not produced by them as a
proof/document with written objections. One of the witness Sanullah Malik,
Administrative Officer in principle has accepted that the sheets not produced

by them are perfect by all practical means issued under his signature as a
competent officer. The same statement was given by the another witness
during cross-examination. On 23-05-2016 the non-applicant was supposed
to produce another witness but, they failed to do and accordingly the evidence
of non-applicant stands closed.
Both the parties were asked to argue the matter on the next date of
hearing and heard the same.
The learned counsel for the applicant during the course of arguments
pleaded that under the industrial law it is well settled that if the services of
a workman who has completed more than 240 days of service in one
calendar year cannot be terminated or brought to an end at the sweet will
of the employer without complying section 25-F of the Industrial Disputes
Act, 1947. The learned counsel for the applicant further pleaded that the
workman Tasleema had completed 240 days of her service in the non-
applicants corporation which is a basic requirement though she has rendered
three years and four months continuous services and was terminated on
24th of August, 2012. He has further pleaded that the non-applicant has
passed verbal cryptic order without hearing the applicant and without
disclosing the process of reasoning. He further argued that the word
continuous service means that if a workman has put in 240 days in service
during a period of 12 calendar months he or she shall be deemed to have
completed one year service in the establishment with the employer. He
further pleaded that a daily or monthly payment is only a mode of payment
and cannot differentiate in determining the status of a workman under
Industrial Disputes Act and also cannot debar a workman to seek the
protection of the provisions of the Industrial Disputes Act. He further pleaded
and invited the attention of the court to a decided leading case of Hon’ble
Allahabad High Court titled Govind Singh V/s. Presiding Officer,
Labour Court, U. P. Agra 1993LLR142, 1993 (66) FLR 560. lt was held
that a daily wages employee cannot be thrown out without following the
procedure as laid down under

section 25-F of the Industrial Disputes Act, 1947. He further pleaded and
quoted Hon’ble Apex Court’s landmark judgement titled Banglore Water
Supply and Sewerage Board V/s. A. Rajappa,1978 Lab. ic. 778, AIR 1978
SC 548, 36 FLR 266, 1978 (i) LLJ 349 which have widened the scope of
the definition of workman under Industrial Disputes Act. It has been
elaborated that the statutory meaning of a workman under Industrial
Disputes Act means any person (including an apprentice) employed in an
industry to do any Manual, Unskilled, Skilled, Technical, Operation, Clerical
or Supervisory Work for hire or reward whether the terms of employment
be express or implied and for the purpose of any proceeding under this Act
in relation to an industrial dispute, includes any such person who has been
dismissed, discharged or retrenched in connection with or as a consequence
of that dispute or whose dismissal, discharge or retrenchment has led to
that dispute. He further pleaded that the applicant is a workman by all
practical purposes and was given status of clerk-cum-receptionist in the
non-applicants corporation and was eligible for protection under Act, 311
(2) of the Constitution. The learned counsel for the applicant further pleaded
that her services were not terminated on any charge and neither a charge
sheet was issued to her and this termination of the applicant is stigmatic
and punitive in the eyes of law. He invited the attention of this forum that a
daily wager do come within the purview of a workman under Industrial
Disputes Act and there are several judicial pronouncement on the said
issue. He further pleaded that even an apprentice or a traince shall not be
deprived of the status of a workman under I. D. Act as was held by the
Hon’ble Madras High Court in a decided leading case titled workman of
PMP Textiles, Coimbatore V/s. Management of PMP Textiles, 2011 LLR
731 hte. He further pleaded that the J&K Cable Car Corporation (State
Government Undertaking) is an “Industry” as has been reflected in Hon’ble
Apex Court Judgement titled [Des Raj V/s. State of Punjab AIR 1988 SC
1182, 1988 LAB IC 1713 wherein it has been held that all Public Works
Departments whether owned by Centre or States are included in the definition
of “Industry” under the Act and an employee whether temporary or permanent
is a workman by all practical purposes under the definition of workman.

[No. 18-1
–––––––––––––––––––––––––––––––––––––––––––––—–––—————
He further pleaded that with regard to unsatisfactory work of the
applicant as disposed by one of the non-applicant witness who being himself
an employee of the corporation has no scope in the eyes of law. He further
pleaded that the non-applicant employer’s establishment is a Government
of J&K enterprise and should have acted in most responsible manner as
compared to common employers. He further pleaded that the applicant i. e.
victim of sheer injustice from all sides, deserves justice from the Court, by
declaring the termination illegal and reinstatement with full back wages
from the date of termination. In response to it the learned counsel for the
non-applicant pleaded that the applicant was a casual labourer and was
engaged in the corporation on need basis and no such provision of law has
been violated including section 25-F of the Industrial Disputes Act,1947 as
the total service of the applicant happened to be less than 240 days in the
last proceeding year which is the minimum requirement for compliance of
section 25-F of the Act.
From the documents shown and produced by the applicants counsel
at the time of cross-examination of non-applicants witness it is established
that the applicant was employed person with non-applicants corporations
and has rendered three years and four months continuous uninterrupted
service in the said establishment and has been illegally terminated without
notice or notice pay. There is no doubt in it that an employee whether
temporary or permanent or holding any position of any nature as apprentice
or trainee is a workman under Industrial Dispute Act.
From the evaluation of material placed in the case file including
recorded statements of witnesses and pleadings of both the learned counsels
of the parties and have come to the conclusion that the applicant was a
workman by all practical purposes of the non-applicants corporation
(Govt. of J&K Enterprise) a commercial establishment and the action of
non-applicant to terminate/detach the services of the applicant is illegal and
unjustified in the eyes of law the termination/detachment order of the applicant

is therefore, set-aside and the applicant is held entitled to reinstatement
with full back wages from the date of termination up to the date actual

Reference is answered accordingly and an award is accordingly
