Whereas, the land, specifications whereof are given at Annexure
“A” to this notification is required for public purpose viz. construction
of road from Dhanwan to Saloon at Village Saloon, Tehsil Pouni, District
Reasi under PMGSY Scheme ; and
Whereas, on the basis of an indent placed by Executive Engineer,
PMGSY Circle Reasi/Udhampur, Reasi, after completing all codal
formalities, a notification under section 4 (1) was issued by Collector,
Land Acquisition (ACR), Reasi vide No. Col/LA/ACR/Reasi/15/
477-480 dated 12-10-2015 for land measuring 64 Kanals-02 Marlas
situated at Village Saloon, Tehsil Pouni, District Reasi for public purpose
viz. Construction of road from Dhanwan to Saloon under PMGSY
Scheme ; and
Whereas, the Collector Land Acquisition (ACR), Reasi vide
No. Col/LA/ACR/Reasi/15/610-613 reported that the notification issued
by him under section 4 (1) of the J&K State Land Acquisition Act was
served upon the land owners/interested persons for filing objections, if
any, to the proposed acquisition but no objection was received within
the stipulated period in response to the notification as required under
sections 5 & 5-A of Land Acquisition Act ; and
Whereas, the report furnished by Collector, Land Acquisition
(ACR), Reasi vide letter referred to above, duly endorsed and conveyed
by the Deputy Commissioner, Reasi vide No. DC/RSI/16-17/73-74/SQ
dated 11-04-2016 has been examined and it has been found that the land
owners did not file any objection within the prescribed period to the
proposed acquisition ; and
Whereas, the Government is satisfied that the land particulars
whereof given at Annexure “A” to this notification, is required purely
for public purpose viz. construction of road from Dhanwan to Saloon
under PMGSY Scheme.
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat, 1990, it is declared that land measuring 64
Kanals-02 Marlas situated at Village Saloon, Tehsil Pouni, District
Reasi for public purpose viz. Construction of road from Dhanwan to
Saloon under PMGSY Scheme, details whereof are mentioned at
Annexure “A” to this Notification is required purely for public purposes
viz. construction of road from Dhanwan to Saloon under PMGSY
Scheme. Further, the Collector, Land Acquisition (ACR), Rajouri is
directed under section 7 of the said Act to take order for acquisition
of the said land after giving prescribed notice to the interested person(s)
as required under the Land Acquisition Act/Rules.

No. Col/LA/ACR/Reasi/16/11 dated 05-04-2016 reported that the

Whereas, during the course of investigation, on the basis of
statements of witnesses recorded under sections 161 and 164-A
Cr. P C., the seizure memo and other evidence, the Investigating
Officer has established a prima facie case against the accused
person under section 13 of the Unlawful Activities (Prevention)
Act, 1967 ; and
Whereas, the Authority appointed by the State Government under
sub-section (2) of section 45 of the Unlawful Activities (Prevention)
Act, 1967 has independently scrutinized the Case Diary file and all
other relevant documents relating to the case and has come to a
definite conclusion that this is a fit case for accord of prosecution
sanction against the accused ; and
Whereas, after perusing the Case Diary, the relevant documents
and also taking into consideration the observations/recommendations
of the Authority appointed under sub-section (2) of section 45 of the
Unlawful Activities (Prevention) Act, 1967, the State Government is
of the view that there is sufficient material and evidence available
against the accused person for his prosecution under the aforesaid
provisions of law.
Now, therefore, in exercise of the powers conferred by
sub-section (1) of section 45 of the Unlawful Activities (Prevention)
Act, 1967, the State Government hereby accords sanction for
launching prosecution against the accused person, namely Ajaz Ahmad
Lone S/o Abdul Salam R/o Rasoo, Beerwa for the commission of
offence punishable under section 13 of the Unlawful Activities
(Prevention) Act, 1967 arising out of FIR No. 224/2012 of Police
Station, Budgam.

(Act No. XXXVIII of 2002), the Government hereby makes the following
amendments in the Jammu and Kashmir Accountability Commission
Rules, 2005 ; namely :—
1. Sub-rule (1) of rule 7 shall be substituted by the following :—
“The Commission shall have a Registry in its office both
at Jammu and Srinagar and each Registry shall be Headed
by Additional Registrar or Deputy Registrar as the
Chairperson may authorize in this behalf who shall be under
over-all supervision and control of Principal Secretary to
Chairperson who shall be the Ex Officio Registrar of the
Commission.”
2. Sub-rule (1) of rule 23 shall be substituted by the following :—
“The Secretary shall discharge such duties and carry out
the directions issued by the Commission from time to time.”

EXTRAORDINARY

Be it enacted by the State Legislature in the Sixty-seventh Year
of Republic of India as follows :––
1. Short title and commencement.––(1) This Act may be called
the Jammu and Kashmir Panchayati Raj (Amendment) Act, 2016.
(2) It shall come into force from the date of its publication in
the Government Gazette.
2. Amendment in section 4, Act No. IX of 1989.––In section
4 of the Jammu and Kashmir Panchayati Raj Act, 1989 (hereinafter
referred as ‘the Principal Act’),––
(i) sub-section (4) shall be omitted ;
(ii) in sub-section (5), for the words, “the Naib-Sarpanch”, the
words “the Sarpanch and Naib-Sarpanch” shall be
substituted ; and
(iii) sub-sections (5), (6), (7), (8) and (9) shall be renumbered
as sub-sections (4), (5), (6), (7) and (8) respectively.
3. Omission of section 40, Act No. IX of 1989.––Section 40
of the Principal Act shall be omitted.
4. Amendment in section 42-A, Act No. IX of 1989.––In section
42-A of the Principal Act, in sub-sections (1) and (2), the words,
“or Sarpanch” shall be omitted.
5. Amendment in section 43, Act No. IX of 1989.––In section
43 of the Principal Act, in sub-section (1), for the words, “as Sarpanch,
Panch”, the words, “as Panch” shall be substituted.

OFFICE OF THE MUNICIPAL COMMITTEE, CHADOORA
Notification
Whereas, in exercise of the powers conferred under section 66 of
the Jammu and Kashmir Municipal Act, 2000, Municipal Committee,
Chadoora hereby notifies to impose and recover tax for the items classified
under clause (1) of section 66 of the Act as per the schedule annexed with
the notification ; and
Whereas, under section 70 (2), the committee is supposed to publish a
notice for the information of the inhabitants of the Chadoora Town ; and
Whereas, the inhabitants of Chadoora Town have a right to file
objections, if any, in writing within thirty days from the date of publication of
this notice under section 70(3) of Jammu and Kashmir Municipal
Act, 2000.

Now, this notification is issued under the seal and signature of
undersigned along with the proposed schedule of tax inviting objections
from the inhabitants of the town to be filed in writing in the Office of
Municipal Committee, Chadoora within thirty days from the date of publication
of this notification.
In case no such objection is received within the above specified
period, the schedule of taxes shall be affected after one week from the
date of expiry of limit.

An Ordinance to amend the Jammu and Kashmir Panchayati Raj
Act, 1989.
Whereas, the State Legislature is not in session and the Governor
is satisfied that circumstances exist, which render it necessary for him
to take immediate action.
Now, therefore, in exercise of the powers conferred by
section 91 of the Constitution of Jammu and Kashmir, the Governor
is pleased to promulgate the following Ordinance :––
1. Short title and commencement.––(1) This Ordinance may
be called the Jammu and Kashmir Panchayati Raj (Amendment)
Ordinance, 2016
(2) It shall come into force at once.
2. Amendment in section 36, Act No. IX of 1989.––In section
36 of the Principal Act, in sub-section (1), the second proviso thereto
shall be substituted by the following, namely :––
“Provided further that for purposes of holding general elections
under this Act in the year 2017, the superintendence, direction
and control of the preparation of electoral rolls and to conduct
of, all elections in accordance with this Act shall vest in the
Chief Electoral Officer.”
3. Amendment in section 36-D, Act No. IX of 1989.––
In section 36-D of the Principal Act, in sub-section (2), the
after clause (cc) the following proviso shall be inserted
namely :––
“Provided that for the purposes of holding general elections
under this Act in the year 2017, the power to determine and

delimit halqa panchayats in accordance with this Act shall vest
