STATEMENT OF OBJECTS AND REASONS

There is a long pending demand for increase of lower as well

as upper limit for registration under Turn Over Tax (TOT) category.

Notwithstanding the fact that upper limit was earlier raised from

Rupees 20 lacs to Rupees 25 lacs the demand still persists. Moreover

as per J&K VAT (Amdendment) Act, 2014 (XIII of 2014)

dated 22-03-14, the threshold limit for registration raised from Rs. 7.50

Lakhs (Rupees Seven Lakh Fifty Thousand) to Rs. 10 Lakhs (Rupees

Ten Lakhs). In order to remove anomaly and to grant relief to the

dealers so as to make procedure of maintaining books of accounts

simpler and easier for a larger number of assesses, the Bill seeks to

raise the lower as well as upper limit of Turn Over Tax (TOT) of

dealers opting for the scheme from present lower limit of Rs. 7.50

Lakhs (Rupees Seven Lakh Fifty Thousand) to Rs. 10 Lakhs (Rupees

Ten Lakhs) and present upper limit of Rs. 25 Lakhs (Rupees Twenty

Five Lakhs) to Rs. 50 Lakhs (Rupees Fifty Lakhs). Also, the Turn

Over Tax shall be calculated on Gross Turnover basis.

Similarly, to encourage the use of star rated electrical/electronic

appliances as a measure for energy conservation, a scheme of

post sale incentives on sale of such appliances to consumers shall be

introduced wherein an amount equivalent to 25% of the tax paid on

such appliances shall be reimbursed to such consumers purchasing

specified 5 star rated electrical appliances against production of valid

retail invoice.

In this backdrop, we may think to modify the limits of Turn Over

Tax (TOT) in order to respite the dealers by making procedure for

maintaining books of accounts simpler and easier and incentives on sale

of star rated appliances which will aid in energy conservation.

Hence the Bill.

for post sale incentives on sale of electric/electronic appliances to

consumers wherein an amount equivalent to 25% of the tax paid on

such appliances shall be reimbursed to such consumers purchasing

specified 5 star rated electrical appliances against production of valid
