GOVERNMENT OF JAMMU AND KASHMIR,

Notification No. 17-Rev (LAJ) of 2017
Dated 27-01-2017.
Whereas, the land, specification whereof are given in “Annexure-A”
to this notification is required for public purpose, viz. construction of Ring
Road by NHAI at Village Chak Tarue, Tehsil Marh, District Jammu ;
Whereas, on the basis of indent prepared by Project Director,
NHAI, PIU, Jammu, a notification under section 4 (1) was issued by
Collector, Land Acquisition (SDM, Marh) vide No. 25 of 2016
dated 12-08-2016 for land measuring 60 Kanals 12 Marlas situated at
Village Chak Tarue, Tehsil Marh, District Jammu ;
Whereas, the Collector, Land Acquisition (SDM, Marh), Jammu
vide No. SDM/M/2016-17/Road-Ring/438-39 dated 25-10-2016 has
reported that the notification issued under section 4 (1) of the J&K State
Land Acquisition Act by him was served upon the interested persons for
filing objections, if any, to the proposed acquisition but, no objection was
received from the land owners/interested persons within the prescribed
period as required under sections 5&5–A of the Land Acquisition Act ;
Whereas, the report furnished by Collector, Land Acquisition
(SDM, Marh), Jammu vide above referred letter duly endorsed by
District Collector (DC), Jammu vide No. DCJ/LA/Ring-Road/H-Chak/
2016-17/1138-40 dated 15-11-2016 has been examined and it has been
found that the land owners did not file any objection to the proposed
acquisition ; and
Whereas, the Government is satisfied that the land particulars
whereof are given above is required for public purpose viz. construction
of Ring Road by NHAI in Village Chak Tarue, Tehsil Marh, District Jammu.
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat 1990, it is declared that the land measuring
60 Kanals 12 Marlas situated at Village Chak Tarue, Tehsil Marh,
District Jammu, particulars whereof are given in “Annexure-A” is
required for public purposes viz. for construction of Ring Road by NHAI.
Further, the Collector, Land Acquisition (SDM), Marh is directed under
section 7 of the said Act to take orders for acquisition of the said land
after giving prescribed notice to the interested person(s) as required
under the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible
for identification and proper title verification of all types of land involved

Whereas, the Government is satisfied that the land referred above
is required for public purpose viz. construction of Ring Road by NHAI
in Village Tikri Dayalan, Tehsil Marh, District Jammu.
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat 1990, it is declared that the land measuring
61 Kanals 01 Marla and 2½ Sarsai situated at Village Tikri Dayalan,
Tehsil Marh, District Jammu, particulars whereof are given in

Whereas, on the basis of an indent placed by Director, School
Education, Jammu vide No. DSEJ/P/331/2015-16/70658-61 dated
15-03-2016, a notification under section 4 (1) was issued by Collector,
Land Acquisition (SDM), Nowshera vide No. SDM/NSR/LA/43-46
dated 23-05-2016 for land measuring 04 Kanals 15 Marlas situated in
Village Lamberi, Tehsil Nowshera, District Rajouri ; and
Whereas, the Collector, Land Acquisition (SDM), Nowshera
vide No. SDM/NSR/LA/43-46 dated 23-05-2016 has reported that the
notification issued under section 4 (1) of the J&K State Land Acquisition
Act by him was served upon the interested persons for filing objections,

if any, to the proposed acquisition but no objection was received from the
land owners/interested persons in the prescribed time period as required

Whereas, the report furnished by Collector, Land Acquisition
(SDM), Nowshera vide mentioned above and endorsed by the Deputy
Commissioner, Rajouri vide No. AC/LA/394-95 dated 28-11-2016 has
been examined and it has been found that the land owners did not file any
objection to the proposed acquisition ; and
Whereas, the Government is satisfied that the land particulars whereof
are mentioned above is required for public purposes viz. “Acquisition of
land for Middle School, Lamberi by Education Department”.
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat 1990, it is declared that land measuring
04 Kanals and 15 Marlas situated at Village Lamberi, Tehsil Nowshera,
District Rajouri, particulars whereof are given above is required for
public purposes viz. “Acquisition of land for Middle School, Lamberi by
Education Department”. Further, the Collector, Land Acquisition (SDM),
Nowshera is directed under section 7 of the said Act to take orders for
acquisition of the said land after giving prescribed notice to the interested
person(s) as required under the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible
for identification and proper title verification of all types of land involved

45 Kanals 14 Marlas situated at Village Hira Chak, Tehsil Marh,
District Jammu, particulars whereof are given in “Annexure-A”
is required for public purposes viz. for construction of Ring Road by NHAI.

Whereas, the Government is satisfied that the land particulars
referred to above is required for public purpose viz., construction
of Ring Road by NHAI at Village Chak Habib, Tehsil Mandal,
District Jammu ;
Whereas, the Indenting Department/Collector have expressed urgency
for taking over the possession of the land.
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat 1990, it is declared that the land measuring
25 Kanals, 13 Marlas situated at Village Chak Habib, Tehsil Mandal,
District Jammu, particulars whereof are given above at “Annexure– A”
is required for public purposes viz. for construction of Ring Road by
NHAI at Village Chak Habib, Tehsil Mandal, District Jammu. Further,
the Collector, Land Acquisition (SDM, South), Jammu is directed under
section 7 of the said Act to take orders for acquisition of the said land after
giving prescribed notice to the interested person(s) as required under the
Land Acquisition Act/Rules.
Further, in pursuance of section 17 of the Land Acquisition Act, Samvat
1990, it is also ordered that on expiry of fifteen days from the publication of
the notification under section 9 (2) of the said Act, the Collector will take
possession of the aforementioned land in Village Chak Habib, Tehsil Mandal,
District Jammu, required for public purposes, subject to fulfillment of the
conditions prescribed under section 9 (2) and section 17-A of the Land
Acquisition Act and Rule 63 of the Land Acquisition Rules.

Whereas, the land, specification whereof are given in “Annexure-A”
to this notification is required for public purpose, viz. Widening of
Jammu–Rajouri–Poonch road by GREF ;
Whereas, on the basis of indent placed by Officer Commanding, 58
RCC (GREF) a notification under section 4 (1) was issued by Collector,
Land Acquisition (Defence), Rajouri-Poonch, Headquarter, Rajouri vide
No. Coll/Def/17-22 dated 07-04-2016 for land measuring 55 Kanals
07 Marlas situated in Village Thandikassi, Tehsil and District Rajouri ;
Whereas, the District Collector, Rajouri vide No. Coll/Def/578
dated 24-09-2016 has reported that the notification issued under
section 4 (1) of the J&K State Land Acquisition Act by Collector, Land
Acquisition, Defence (Rajouri) was served upon the interested persons for
filing objections, if any, to the proposed acquisition but no objection was
received from the land owners/interested persons within the prescribed
period as required under sections 5&5-A of the Land Acquisition Act ;
Whereas, the report furnished by District Collector (DC), Rajouri,
vide No. Coll/Def/578 dated 24-09-2016 referred to above has been
examined and it has been found that the land owners did not file any
objection to the proposed acquisition ; and
Whereas, the Government is satisfied that the land particulars
whereof are given above is required for public purpose viz. Widening of
Jammu–Rajouri–Poonch road by GREF.

Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat 1990, it is declared that the land measuring
55 Kanals 07 Marlas situated in Village Thandikassi, Tehsil and District
Rajouri, particulars whereof are given in “Annexure–A” is required for
public purposes viz. for Widening of Jammu–Rajouri–Poonch road by GREF.
Further, the Collector, Land Acquisition (Defence), Rajouri-Poonch,
Headquarter, Rajouri is directed under section 7 of the said Act to take
orders for acquisition of the said land after giving prescribed notice to the
interested person(s) as required under the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible
for identification and proper title verification of all types of land involved
in the case for making apportionment of compensation amongst all the
interested persons/rightful claimants, in accordance with the relevant
laws/rules in force, while making the award.

Promulgated by the President in the Sixty-eighth Year of the
Republic of India.
An Ordinance further to amend the Banking Regulation
Act, 1949.
WHEREAS, the stressed assets in the banking system have
reached unacceptably high levels and urgent measures are required for
their resolution ;

AND WHEREAS, the Insolvency and Bankruptcy Code, 2016 has
been enacted to consolidate and amend the laws relating to reorganisation
and insolvency resolution of corporate persons, partnership firms and
individuals in a time bound manner for maximisation of value of assets
to promote entrepreneurship, availability of credit and balance the interest
of all the stakeholders ;
AND WHEREAS, the provisions of Insolvency and Bankruptcy
Code, 2016 can be effectively used for the resolution of stressed
assets by empowering the banking regulator to issue directions in specific
cases ;
AND WHEREAS, Parliament is not in session and the President
is satisfied that circumstances exist which render it necessary for him
to take immediate action.
NOW, THEREFORE, in exercise of the powers conferred by
clause (1) of Article 123 of the Constitution, the President is pleased
to promulgate the following Ordinance :—
1. Short title and commencement.—(1) This Ordinance may be
called the Banking Regulation (Amendment) Ordinance, 2017.
(2) It shall come into force at once.
2. Insertion of new sections 35AA and 35AB.—In the Banking
Regulation Act, 1949 (10 of 1949), after section 35A, the following
sections shall be inserted, namely :—
‘35AA. Power of Central Government to authorise Reserve
Bank for issuing directions to banking companies to initiate
insolvency resolution process.—The Central Government may
by order authorise the Reserve Bank to issue directions to any
banking company or banking companies to initiate insolvency
resolution process in respect of a default, under the provisions
of the Insolvency and Bankruptcy Code, 2016 (31 of 2016).
Explanation :—For the purposes of this section, “default” has the same
meaning assigned to it in clause (12) of section 3 of
the Insolvency and Bankruptcy Code, 2016
(31 of 2016).

35AB. Power of Reserve Bank to issue directions in respect
of stressed assets.—(1) Without prejudice to the provisions of
section 35A, the Reserve Bank may, from time to time, issue
directions to the banking companies for resolution of stressed
assets.
(2) The Reserve Bank may specify one or more authorities or
committees with such members as the Reserve Bank may appoint
or approve for appointment to advise banking companies on
resolution of stressed assets.’.

Jammu and Kashmir hereby direct that in rule 104-A of the J&K Minor
Mineral Concession Storage, Transportation of Minerals and Prevention
of Illegal Mining Rules, 2016, for the figures and words “31st March,

SRO-191.—In exercise of the powers conferred by the proviso
to section 124 of the constitution of Jammu and Kashmir read with
clause (c) of rule 2 of the Indian Police Service (Pay) Rules, 2007,
the Government of Jammu and Kashmir hereby makes the following
rules, namely :—
1. Short title, extent and commencement.—
(a)
These rules may be called the Jammu and Kashmir (IPS)
Departmental Examination Rules, 2017.

PART III

(b)
These rules shall be applicable to the direct recruit IPS
Officers of the Jammu and Kashmir Cadre.
(c)
These rules shall come into force from the date of their
publication in the Official Gazette.
Definitions.—
(a)
“Annexure” means the annexure appended to these
rules ;
(b)
“Commission” means the Jammu and Kashmir Public Service
Commission ;
(c)
“Examination” means the Departmental Examination held
under these rules ;
(d)
“Government” means the Government of Jammu and Kashmir
;
(e)
“Officer” means a directly recruited IPS officer belonging
to the Indian Police Service (IPS) of the Jammu and Kashmir
Cadre ;
(f)
“State” means the State of Jammu and Kashmir ;
(g)
“Service” means the Indian Police Service.
3. Examination.—(1) The examination shall be conducted by the
Commission twice in a year at such place and time as may be appointed
by the Commission.
(2) The examination shall comprise of a total of six papers.
4. Syllabus.—(1) The syllabus for the examination shall be such
as is specified in Annexure to these rules.
(2) The Government may, in consultation with the Commission,
modify the syllabus as considered necessary, from time to time.

5. Rules and procedure to conduct the examination.—The rules
and procedure regarding the conduct of the examination shall be
prescribed by the commission separately.
6. Application.—Applications to the Commission for appearing in
the examination shall be routed through the Administrative Department
of the officer.
7. Appointment to the Senior Time Scale.—(1) An officer shall
be appointed to a post in the Senior Time Scale of pay, if, having regard
to his length of service and experience, the Government is satisfied
that he is suitable for appointment to a post in the Senior Time Scale
of pay.
(2) He shall not be appointed to a post in the Senior Time Scale
of pay, if he is under suspension or disciplinary proceedings are instituted
against him, until he is reinstated in service or the disciplinary
proceedings are concluded and final orders passed.
(3) Upon the conclusion of disciplinary proceedings, if the officer
is exonerated fully and the period of suspension, if any, is treated as
duty, he shall be appointed to the Senior Time Scale of pay from the
date on which he would have been so appointed, had the disciplinary
proceedings not been instituted against him, and paid accordingly.
(4) If the officer is not exonerated fully, and the Government,
after considering his case on merits, proposes not to appoint him to
the Senior Time Scale of pay from the date on which he would have
been so appointed, had the disciplinary proceedings not been instituted
against him, he shall be given an opportunity to show cause against
such action.
(5) Notwithstanding anything contained in sub-rule (2), (3)&(4)
above, the Government may withhold the appointment of an officer
referred to in sub-rule (1) above, to a post in the Senior Time Scale
of pay, till he is confirmed in the Service or till he passes the prescribed
examination ; or appoint him to a post in the Senior Time Scale of
pay as a purely temporary or local arrangement ; and appoint to such
a post an officer junior to him.

8. Repeal.—All existing rules and orders relating to matters
covered by these rules shall stand superseded from the date of issuance
of these rules.

SRO-210.—In exercise of the powers conferred by
sub-section (1) of section 3 of Jammu and Kashmir Heritage
Conservation and Preservation Act, 2010, the Government on the
recommendation of Director, Archives, Archaeology and Museums
intends to declare the “Cheshma Shahi Spring and Garden, Srinagar
along with the land measuring 130 Kanals and 06 Marlas falling under
Khasra Nos. 82, 410/84, 481/314/82, 85, 86, 87, 88, 100/96, 6/106/
192, 192/96, 181/96, 182/96, 188/96,189/96, 317/96, 318/97, 270/97,
321/98, 334/112, 330/112, 322/111, 389/338/112, 391/49/114, 117, 118,
119, 392/130, 134, 288/130, 289/13, 336/112, 341/135, 136, 280/127,
281/147, 282/127, 242/127, 279/128, 382/128, 322/129, 382/130, 327/
134, 229/135, 220/135, 221/125 and 232/120” as Heritage site within
the meaning of the said Act.
Any person having objection to the issuance of this notification
shall file his/her objections before the Secretary to the Government,
Department of Culture, within one month from the date of publication
of this notification in the newspaper or fixation of this notification
at a conspicuous place on the site.

Subject :—Notification of Market Value Guidelines and the rates of
immovable property for the year, 2017-18.
Reference :—SRO-303 dated 04-10-2011 read with SRO-379
dated 22-12-2011.

Consequent upon the approval of the Divisional Valuation Board to
the market value guidelines and rates of immovable property for different
areas of District Doda as conveyed by the Chairman (Divisional
Commissioner, Jammu) vide endorsement No. CSSJ/734-755 dated
25-03-2017, the District Valuation Committee in exercise of the powers
vested with it under Sub-Sule-(1) of Rule 4 of SRO-303 dated 04-10-2011
read with SRO-379 dated 22-12-2011 notifies the rates of immovable
property for different areas of District Doda for the financial year, 2017-18
on the prescribed Forms I, II and III of SRO-303, forming Annexure-I, II
and III respectively to this notification. Further for determining the rates of
uncultivable land, the rates of unirrigated land of the area shall be applicable.
The rates shall come into force from 1st April, 2017 and remain valid up
to 31st of March, 2018.
