Notification No. 90-Rev(LAJ) of 2017
Dated 23-02-2017.
Whereas, the land and specifications whereof are given a
“Aneexure-A” to this notification is required for construction of
Mulwarwan to Nowpachi road Village Dehrie, Tehsil Marwah and
District Kishtwar ;
Whereas, on the basis of indent prepared by Executive Engineer,
PMGSY Division, Doda-II, Kishtwar, vide No. PMGSY/D-II/114-120
dated Nil a notification under section 4 (1) was issued by Collector,
Land Acquisition (ADC), Kishtwar vide No. ADCK/LA/139-144/2016
dated 19-07-2016 for land measuring 15 Kanals and 06 Marlas, situated
in Village Dehrie, Tehsil Marwah and District Kishtwar ;
Whereas the Collector, Land Acquisition (ADC), Kishtwar vide
No. ADCK/LA/2016/299-300 dated 01-10-2016, has reported that the
notification issued under section 4 (1) of the J&K State Land Acquisition
Act by him was served upon the interested persons for filing objections,
if any, to the proposed acquisition, but, no objection was received from
the land owners/interested persons within the prescribed period as
required under sections 5 & 5-A of the Land Acquisition Act ;
Whereas, the report furnished by Collector, Land Acquisition
(ADC), Kishtwar, vide above referred letter duly endorsed by District
Collector (DC), Kishtwar, vide No. DCK/LA/2016/273-77 dated
12-11-2016, has been examined and it has been found that the land
owners did not file any objection to the proposed acquisition ; and
Whereas, the Government is satisfied that the land particulars
whereof are given above, is required for public purpose viz. construction
of Mulwarwan to Nowpachi road Village Dehrie, Tehsil Marwah and
District Kishtwar.
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat 1990, it is declared that the land measuring
15 Kanals and 06 Marlas, situated in Village Dehrie, Tehsil Marwah
and District Kishtwar, particulars whereof are given in “Annexure-A”,
is required for public purposes viz. for construction of Mulwarwan to
Nowpachi road Village Dehrie, Tehsil Marwah and District Kishtwar.
Further, the Collector, Land Acquisition (ACR), Kishtwar is directed
under section 7 of the said Act to take orders for acquisition of the
said land after giving prescribed notice to the interested person(s) as
required under the Land Acquisition Act/Rules.
However, the Collector concerned
shall be
personally
responsible for identification and proper title verification of all types of
land involved in the case for making apportionment of compensation

Whereas,
the
land
specifications
whereof are
given in
“Annexure-A” to this notification is required for public purpose viz. “for
widening/four laning of NHAI” ;
Whereas, on the basis of an indent placed by Project Director, NHAI
vide No. PD/JMU/15011/1998 dated 03-10-2005, a notification under
section 4(1) was issued by Collector, Land Acquisition NHAI/(ADC),
Ramban vide No. 1012-19/ACQ dated 19-09-2016 for land measuring
41 Kanals and 12½ Marlas, situated in Village “Kundi”, Tehsil and
District Ramban ;
Whereas, the Collector, Land Acquisition (ADC), Ramban vide No. 487-
92/ACQ NH-AI dated 08-11-2016 has reported that the notification
issued under section 4(1) of the J&K State Land Acquisition Act by
him was served upon the interested persons for filing objections, if any,
to the proposed acquisition, but, no objection was received the

prescribed. However, some of the land owners approached the Hon’ble
High Court challenging the acquisition proceedings.
The Hon’ble High Court issued stayed order in OWP No. 477-
2010 read with CMP No. 644/2010 and also directed vide order dated
30-05-2010 to proceed ahead with the acquisition proceedings but
restrained from issuance of the final award in the matter. The case
was under consideration of the Hon’ble High Court, which, on 06-
10-2016, while quashing the acquisition proceedings to the extent of
the petitioners, directed that the date of issuance of notification under
section 4(1) of the Land Acquisition act shall be treated as the date
of order passed by the Hon’ble High Court dated 06-10-2016, in respect
of the land involved in the above mentioned OWPs ;
Whereas, the report furnished by Collector, Land Acquisition
(ADC), Ramban vide No. referred above and endorsed by Divisional
Commissioner, Jammu vide 502/2735/Acq/NH-AI/Kundi/Rbn/16/2265-67
dated 21-11-2016 has been examined. Further, in a meeting Chaired
by the Chief Secretary, J&K at Srinagar, the Collector/DC had been
advised to furnish a proposal for seeking fresh acquisition of the entire
case notwithstanding the proceedings having been quashed to the extent
of the petitioners only, with a view to obviating the possibility of fresh
litigation, as the non-petitioners may also get emboldened to resort to
the litigation process in case part of the land is subjected to fresh
assessment of rates on the prevailing value and part of the same is
given old rates already assessed during the earlier acquisition
proceedings, which would further delay the execution of work on ground
; and
Whereas, the Government is satisfied that the land particulars
whereof mentioned are given in “Annexure-A” to this notification, is
required for public purpose viz. “for widening/four lanning of NHAI”.
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat, 1990, it is declared that land measuring
41 Kanals and 12½ Marlas, situated in Village “Kundi”, Tehsil and
District Ramban particulars whereof are given in “Annexure-A” to this
notification is required for public purpose viz. “for widening/four lanning

of NHAI”. Further, the Collector, Land Acquisition (ADC), Ramban
is directed under section 7 of the said Act to take order for acquisition
of the said land after giving prescribed notice to the interested person(s)
as required under the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible for
identification and proper title verification of all types of land involved
in the case and apportionment of compensation amongst all the interested
persons/rightful claimants in accordance with the relevant laws/rules in
force, while making the award.

that the notification issued under section 4(1) of the J&K State Land
Acquisition Act by him was served upon the interested persons for
filing objections, if any, to the proposed acquisition but no objection was
received from the land owners/interested persons in the prescribed time
period as required under sections 5 & 5-A of the Land Acquisition
Act ; and
Whereas, the report furnished by the Collector, Land Acquisition
(ADC), Reasi vide referred above, duly endorsed by Deputy
Commissioner, Reasi, vide his No. DC/RSI/16-17/727-30/SQ dated
15-10-2016 and by Divisional Commissioner, Jammu vide No. 502/2482/
Acq/Sangar/GREF/Rsi/2016/2326-28 dated 26-11-2016, has been
examined and it has been found that the land owners did not file any
objection to the proposed acquisition ; and
Whereas, the Government is satisfied that the land particulars
whereof are mentioned are given at “Annexure-A” to this notification,
is required for public purpose viz. for Construction/Improvement of
Bharakh-Ramsoo Asconsite by GREF.
Now, therefore, in pursuance of section 6 of the J&K State
Land Acquisition Act, Samvat, 1990, it is declared that land measuring

Acquisition (ADC), Reasi, is directed under section 7 of the said Act
to take order for acquisition of the said land after giving prescribed
notice to the interested person(s) as required under the Land Acquisition

Whereas, the land specifications whereof are given at
“Annexure-A” to this notification, is required for public purpose viz.
for establishment of AIIMS in Village Chak Diwan Bhim Sen, Tehsil
and District Samba ;
Whereas, on the basis of an indent placed by Director, Health
Services, Jammu vide DHSJ/PLG/217/AIIMS/MF Land/2016-17/611-15
dated 21-08-2016, a notification under section 4(1) was issued by
Collector, Land Acquisition (SDM), Vijaypur vide No. SDM/V/2016-
17/600-609 dated 26-08-2016 read with No. SDM/V/2016-17/830-38
dated 20-10-2016 for land measuring 118 Kanals and 06 Marlas, situated
in Village “Chak Diwan Bhim”, Tehsil and District Samba ;
Whereas, the District Collector (DC), Samba, vide letter No. DCS/
SM/AIIMS(6&7)/16-17/957-62 dated 22-11-2016, has reported that the
notification issued under section 4(1) of the J&K State Land Acquisition
Act by Collector, Land Acquisition (SDM), Vijaypur was served upon
the interested persons for filing objections, if any, to the proposed
acquisition but some of the interested persons/land owners filed
objections with regard to rates of compensation and some sought
employment, in lieu of land acquisition ;
Whereas, the report furnished by the District Collector (DC) vide
letter mentioned above duly endorsed by the Divisional Commissioner,
Jammu vide No. 502/2755/Acq/AIIMS/Chak Diwan Bhimsen/Samba/16/
2360-62 dated 30-11-2016, has been examined and it has been found

that there is no objection with regard to the acquisition of the land.
As far as the objection with regard to payment of compensation in
respect of the land allotted under various schemes as per the prevailing
market rates. The matter has been examined and appropriate action
will be taken while framing the award ; and
Whereas, the Government is satisfied that the land particulars
whereof are mentioned in “Annexure-A” to this notification, is required
for public purpose viz. for Establishment of AIIMS in Village Chak
Diwan Bhim Sen, Tehsil and District Samba.
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat, 1990, it is declared that land measuring 118
Kanals and 06 Marlas situated in Village “Chak Diwan Bhim Sen”,
Tehsil and District Samba particulars whereof are given at
“Annexure-A” to this notification is required for public purpose viz. for
Establishment of AIIMS in Village Chak Diwan Bhim Sen, Tehsil and
District Samba. Further, the Collector, Land Acquisition (SDM), Vijaypur
is directed under section 7 of the said Act to take order for acquisition
of the said land after giving prescribed notice to the interested person(s)
as required under the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible
for identification and proper title verification of all types of land involved
in the case and apportionment of compensation amongst all the interested

Whereas, the land specifications whereof are given at
“Annexure-A” to this notification, is required for public purpose viz.
for Construction of road from Chowki to Khurkal, Phase-VII under
PMGSY ;
Whereas, on the basis of an indent placed by Executive Engineer,
PMGSY, Division Udhampur vide PMGSY/Div./Udh-1/2401-03 dated
02-12-2009 a notification under section 4(1) was issued by Collector,
Land Acquisition (SDM), Ramnagar vide No. SDMR/LA/2016-17/446-
53 dated 21-10-2016 for land measuring 35 Kanals and 17 Marlas,
situated in Village “Badhole”, Tehsil Rarnnagar, District Udhampur ;
Whereas, the Collector, Land Acquisition (SDM), Ramnagar vide
letter No. SDMR/LA/2016-17/493 dated 08-11-2016 has reported that
the notification issued under section 4(1) of the J&K State Land
Acquisition Act by him was served upon the interested persons for
filing objections, if any, to the proposed acquisition but no objection was
received from the land owners/interested persons in the prescribed time
period as required under sections 5 & 5-A of the Land Acquisition
Act ;
Whereas, the report furnished by the Collector, Land Acquisition
(SDM), Ramnagar vide No. mentioned above and endorsed by the
Deputy Commissioner, Udhampur vide No. DCU/SQ/2997-99 dated
23-11-2016, has been examined and it has been found that the land
owners did not file any objection to the proposed acquisition ; and
Whereas, the Government is satisfied that the land particulars
whereof mentioned are given in “Annexure-A” to this notification, is
required for public purpose viz. for Construction of road from Chowki
to Khurkal, Phase-VII under PMGSY.

Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat 1990, it is declared that land measuring 35
Kanals and 17 Marlas situated in Village “Badhole”, Tehsil Rarnnagar,
District Udhampur particulars whereof are given at “Annexure-A” is
required for public purpose viz. for Construction of road from Chowki
to Khurkal, Phase-VII under PMGSY. Further, the Collector, Land

Whereas on the basis of an indent placed by Director, Health
Services, Jammu vide DHSJ/PLG/217/AllMS/MF Land/2016-17/611-15
dated 21-08-2016, a notification under section 4(1) was issued by
Collector, Land Acquisition (SDM), Vijaypur vide No. SDM/V/580-89
dated 26-08-2016 read with Corrigendum vide No. SDM/V/2016-17/848-
56 dated 20-10-2016 for land measuring 91 Kanals and 10 Marlas,
situated in Village Shri Partap Singh Pura, Tehsil Vijaypur, District
Samba ;
Whereas, the District Collector (DC), Samba, vide letter No. DCS/
LAS/AIIMS(6&7)/16-17/951-56 dated 22-11-2016, has reported that the
notification issued under section 4(1) of the J&K State Land Acquisition
Act by Collector, Land Acquisition (SDM), Vijaypur was served upon
the interested persons for filing objections, if any, to the proposed
acquisition and some of the interested persons/land owners filed
objections with regard to providing rates of compensation and some
sought employment in lieu of the land acquisition ;
Whereas, the report furnished by the District Collector (DC) vide
letter mentioned above duly endorsed by the Divisional Commissioner,
Jammu vide No. 502/2755/Acq/AIIMS/Shri Partap Singh Pora/16/2476-
78 dated 14-12-2016, has been examined and it has been found that
there is no objection with regard to the acquisition of the land. As far
as the objection with regard to providing of employment is concerned,
the same is not tenable, whereas, the other issue regarding payment
of compensation at market rates is a genuine concern and shall be
taken care of while framing the award ; and
Whereas, the Government is satisfied that the land particulars
whereof are mentioned in “Annexure-A” to this notification is required
for public purposes viz. for establishment of AIIMS in Village Partap
Singh, Tehsil Vijaypur, District Samba.
Now, therefore, in pursuance of section 6 of the J&K State Land

Denotification
Whereas, the Hon’ble High Court has issued direction in a case
titled Krishan Lal and others V/s. Sh. Vinod Kumar Koul and ors. dated
19-11-2015 are reproduced as under :—
1. Respondent Nos. 3 and 4 are directed to identify and measure
the land belonging to the appellants utilized for initial construction
of the road in year 1971-72. This be done within six weeks
time.
2. Respondent Nos. 3 and 4 are directed to identify and measure
the land belonging to the appellants utilized in and rendered
waste and unusable due to widening of Udhampur-Lander road
in year 2007-2009. This be done within six weeks time.
3. All the respondents are directed to take up and conclude
acquisition process qua the land mentioned in paras 1 and 02
above and determine and pay compensation to the appellants/
interested persons at the market rate as was prevailing at the
time of initial construction/widening of the aforesaid road with
simple interest @ 6% from such time till such payment is made
to the appellants.
Whereas, this Collectorate vide No. ACRU/SQ/3284-94 dated
15-12-2016 has issued a notification under section 4(1) without
identifying the land utilized by the PWD Department in constructing
the “Udhampur to Lander” road in Village Latyar, Tehsi1 Panchari and
District Udhampur in 1971-72 and land utilized by the PWD Department
in widening the “Udhampur to Lander” road in Village Latyar, Tehsi1
Panchari and District Udhampur in 2007-09 as desired by Hon’ble High
Court.

Press, Srinagar inclusive of all taxes, charges and installation of dismantled
ACs at New Press Complex, Sempora. The payment to the successful
tenderer shall be made after completion of the job successfully. The
successful tenderer shall have to execute job within 10 days. In case the
approved tenderer fails to execute the job or delays the job a penalty minimum
of 2% of the allotment order shall be imposed by this department. The
entire job of uninstalling/removing of electric items to be executed by the
approved tenderer shall be carried out under the supervision of Asstt.
Manager in presence of I/c Electric Section and Press Store Keeper. All
the electric items detailed from S. Nos. 01 to 13 shall be handed over to the
Press Store Keeper against proper receipt. The Committee reserves the
right to accept or reject any or all tenders without assigning any reasons.

An Ordinance to amend the Jammu and Kashmir Transfer of
Property Act, Samvat 1977.
Whereas, the State Legislature is not in session and the Governor
is satisfied that circumstances exist, which render it necessary for him
to take immediate action.
Now, therefore, in exercise of the powers conferred by
section 91 of the Constitution of Jammu and Kashmir, the Governor
is pleased to promulgate the following Ordinance :––
1. Short title and commencement.––(1) This Ordinance may
be called the Jammu and Kashmir Transfer of Property (Amendment)
Ordinance, 2017.
(2) It shall come into force at once.
2. Amendment in section 140, Act No. XLII of Samvat 1977.–
In section 140 of the Transfer of Property Act, Samvat 1977,––
(a) In clause (e), after sub-clause (ix), the following sub clause
shall be added, namely :––
“(x) the Jammu and Kashmir Energy Development
Agency” ; and
(b) In clause (g), after sub clause (v), the following sub clause
shall be added, namely :––
“(vi) the Jammu and Kashmir Energy Development
Agency.”

No. 01/DCB/Adm of 2017 Dated 31-03-2017.
In pursuance of Sub-Rule (2) C of Rule (4) of Jammu and Kashmir
Preparation and Revision of Market Value Guidelines/Rules, 2011 issued
vide SRO-303 of 2011, the market rates of land and built-up property
in respect of Urban and Rural areas of District Bandipora are hereby
notified on the basis of market rates communicated by Sub–District
Valuation Committee duly analyzed by the District Valuation Committee
and approved by the Divisional Valuation Board vide No. Div. Com/
LAS-649-111/2658 dated 31-03-2017 forming Annexures A, B & C to
this notification. The rates shall be applicable w. e. f. 01-04-2017 to
31-03-2018.
