Whereas, the final seniority list of Superintending Engineers,
Civil (Hydraulic) of PHE, I&FC Department, as it stood on 01.01.2012,
was notified, vide Government Order No. 148-PW (Hyd) of 2015 dated

Whereas, some Superintending Engineers have retired on
superannuation in the intervening period and their names are required to be
deleted from the seniority list ; and

01.01.2012 issued vide Government Order No. 148-PW (Hyd) of 2015
dated 09.06.2015, was retired from the service under Article 226(2) of
J&K Civil Services Regulations vide General Administration Department’s
Government Order No. 888-GAD of 2015 dated 30.06.2015, and his name
is required to be deleted from the seniority list ; and
Whereas, the seniority of a few I/c Superintending Engineers, whose
cases of regularization/promotion as Superintending Engineers have been
deferred by DPC/PSC on the directions of the Hon’ble Court, shall be
fixed later at suitable places in the seniority list, as and when they are
cleared for regularization/promotion by DPC/PSC, after the final outcome
of the writ petition(s) pending in the Hon’ble Court(s) ; and
Whereas, the year-wise seniority lists of the Superintending Engineers,
from 01.01.2013 to 01.01.2017 are required to be issued to effect further
promotions/regularizations of Superintending Engineers as Chief Engineers.
Now, therefore, the tentative year-wise seniority lists of Superintending
Engineers, Civil (Hydraulic) from 01.01.2013 to 01.01.2017, forming
annexure to this circular, are hereby issued. Members of the service are
accordingly directed to file their objections, if any, in the Administrative
Department (HRM Branch, Room No. 28, 3rd Floor, Main Building, Civil
Secretariat, Jammu) through their respective Heads of Department within
a period of 21 days from the date of uploading of the aforementioned
year-wise Tentative Seniority Lists on the official website i. e.
www.jkpheirrigation.nic.in or the date of publication of an abridged notice
in the leading newspapers stating that the aforesaid Tentative Seniority
Lists of Superintending Engineers, Civil (Hydraulic) have been uploaded on
the departmental website, whichever is later, with documentary proof in
support of their claims after which no objection(s) shall be entertained and
the aforesaid Tentative Seniority Lists shall be issued.
The Dates of Birth of the officers as reflected in the above Tentative
Seniority Lists shall be subject to authentication and verification from the
Service Books/Date of Birth Certificates of the concerned employees, as
envisaged under rules.

Dated 31-03-2017.
Whereas, the land specifications whereof are given in
“Annexure-A” to this notification, is required for public purpose viz. for
Construction of road from Barmneen to Sarsoo in Phase-VII in Village
Sarsoo, Tehsil Ramnagar, District Udhampur under PMGSY ;
Whereas, on the basis of an indent placed by Executive Engineer,
PMGSY Division, Udhampur-I vide PMGSY/Div/Udh-I/2532-34 dated
09-12-2009, a notification under section 4(1) was issued by Collector,
Land Acquisition (SDM), Ramnagar vide No. SDMR/LA/2016-17/
400-08 dated 08-10-2016 for land measuring 50 Kanals and 12 Marlas,
situated in Village Sarsoo, Tehsil Rarnnagar, District Udhampur ;
Whereas, the Collector, Land Acquisition (SDM), Rarnnagar, vide
No. SDMR/LA/2016-17/467 dated 28-10-2016 has reported that the
notification issued under section 4(1) of the J&K State Land Acquisition
Act by him was served upon the interested persons for filing objections,
if any, to the proposed acquisition but no objection was received from the
land owners/interested persons in the prescribed time period as required
under sections 5 & 5-A of the Land Acquisition Act ;
Whereas, the report furnished by Collector, Land Acquisition (SDM),
Ramnagar, vide referred to above duly endorsed by Deputy Commissioner,
Udhampur vide No. DCU/SQ/3000-3001 dated 23-11-2016 has been
examined and it has been found that the land owners did not file any
objection to the proposed acquisition ;

Whereas, the Government is satisfied that the land particulars
whereof are given in “Annexure-A” to this notification, is required for
public purpose viz. for construction of road from Barmeen to Sarsoo in
Phase-Vll in Village Sarsoo, Tehsil Ramnagar, District Udhampur under
PMGSY.
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat, 1990, it is declared that land measuring 50 Kanals
and 12 Marlas situated in Village “Sarsoo”, Tehsil Rarnnagar, District
Udharnpur particulars whereof are given in Annexure-A to this notification
is required for public purpose viz. for construction of road from Barmeen
to Sarsoo under PMGSY. Further, the Collector, Land Acquisition (SDM),
Ramnagar is directed under section 7 of the said Act to take order for
acquisition of the said land after giving prescribed notice to the interested
persons(s) as required under the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible
for identification and proper title verification of all types of land involved
in the case and apportionment of compensation amongst all the interested
persons/rightful claimants in accordance with the relevant laws/rules in
force, while making the award.

Whereas, the Deputy Commissioner, Rajouri vide letter No. Coll/
Def/1018-19 dated 14-12-2016, has reported that the notification issued
under section 4(1) of the J&K State Land Acquisition Act by the Collector,
Land Acquisition (Defence), Rajouri/Poonch, Hq. Rajouri was served
upon the interested persons for filing objections, if any, to the proposed
acquisition but no objection was received from the land owners/interested
persons in the prescribed time period as required under sections 5 & 5-A
of the Land Acquisition Act ;
Whereas, the report furnished by District Collector (DC), Poonch
vide letter referred to above duly endorsed by Divisional Commissioner,
Jammu vide No. 502/2781/Acq/GREF/Dharana/Poonch/16/2661-63 dated
28-12-2016 has been examined and it has been found that the land owners
did not file any objection to the proposed acquisition ;
Whereas, the Government is satisfied that the land particulars
whereof are given in “Annexure-A” to this notification, is required for
public purpose viz. for construction of BG-HMPR-FDL 481-MDR road
situated in Village Dharana, Tehsil Mendhar, District Poonch by GREF ;
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat 1990, it is declared that land measuring 328 Kanals
and 09 Marlas, situated in Village “Dharana”, Tehsil Mendhar, District
Poonch particulars whereof are given in “Annexure -A” to this notification
is required for public purpose viz. for construction of BG-HMPR-FDL
481-MDR road situated in Village Dharana, Tehsil Mendhar, District
Poonch by GREF. Further, the Collector, Land Acquisition (Defence),
Rajouri/Poonch, Hq. Rajouri is directed under section 7 of the said Act to
take order for acquisition of the said land after giving prescribed notice to
the interested person(s) as required under the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible
for identification and proper title verification of all types of land involved
in the case and apportionment of compensation amongst all the interested

Land Indent dated 29-06-2016, a notification under section 4(1) was issued
by Collector, Land Acquisition (ADC), Reasi vide No. Col/LA/ADC/Rsi/
16/285-90/NSSQ dated 03-12-20 16 for land measuring 86 Kanals and
19 Marlas, situated in Village “Lamsora”, Tehsil Bhomag, District Reasi ;
Whereas, the Collector, Land Acquisition (ADC), Reasi, vide letter
No. Col/LA/ADC/Rsi/16/327-330/NSQ dated 09-01-2017 has reported that
the notification issued under section 4(1) of the J&K State Land Acquisition
Act by him was served upon the interested persons for filing objections, if
any, to the proposed acquisition but no objection was received from, the
land owners/interested persons in the prescribed time period as required
under sections 5 & 5-A of the Land Acquisition Act.

Whereas, on the basis of an indent placed by Supdt. of Police,

Land Acquisition (ACR), Pulwama was served upon the interested persons
for filing objections, if any, to the proposed acquisition but no objection
was received from the land owners/interested persons in the prescribed
time period as required under sections 5 & 5-A of the Land Acquisition
Act ;
Whereas, the report furnished by District Collector (DC), Pulwama,
vide letter referred to above, duly endorsed by Divisional Commissioner,
Kashmir vide No. Div. Com/LAS-Acq/857/965 dated 29-06-2015 and
Financial Commissioner, Revenue vide No. FC-LS/LA-4394/2015 dated
14-07-2015 has been examined and it has been found that the land owners
did not file any objection to the proposed acquisition ;
Whereas, the Government is satisfied that the land particulars
whereof are given in “Annexure-A” to this notification, is required for
public purpose viz. for Group Centre at Villages Lethpora and Ladhoo,

Now, therefore, in pursuance of section 6 of the J&K State Land

PART III
Laws, Regulations and Rules passed thereunder.

(1) Definitions.–––
(a) ‘Advocate’ means a State Subject who is duly registered/
enrolled with a Bar Council constituted under the Advocates
Act, 1961 ;
(b) ‘Advocate General’ means Advocate General of the State
of Jammu and Kashmir ;
(c) ‘Advocates Act’ means Advocates Act, 1961 (Act 26
of 1961) ;
(d) ‘Chief Justice’ means Chief Justice of the High Court of
Jammu and Kashmir and includes a Judge appointed under
the Constitution to perform the duties of the Chief Justice ;
(e) ‘High Court’ means the High Court of Jammu and Kashmir
;
(f) ‘Registrar General’ means Registrar General of the High
Court of Jammu and Kashmir ;
(g) ‘Registry’ means the Registry of the High Court of Jammu
and Kashmir ;
(h) ‘Rules’ means the Jammu and Kashmir High Court
Rules, 1999 ;
(i) ‘State’ means the State of Jammu and Kashmir ;
(j) ‘State Bar Council’ means the Bar Council of Jammu and
Kashmir.
(2) Eligibility conditions.––
(a) An Advocate shall be eligible to be designated as a Senior
Advocate, if he/she––
(i) has attained the position of eminence at the Bar ;

(ii) possesses ability, legal acumen, special knowledge or
distinction and reputation achieved in practice of law ;
(iii) has completed 40 years of age and is ordinarily practising
in the High Court of Jammu and Kashmir for not less
than ten years preceding the date of consideration of his/
her case for designation as a Senior Advocate ;
(iv) is a duly assessed income tax payee for the last ten years
and his/her annual gross professional income is not less
than rupees ten lacs in each of the last three financial
years preceding the date of consideration ;
(v) has been assisting the court in administration of justice
maintaining high ethical standards, both inside and outside
the court expected of a Senior Advocate ;
(vi) has furnished at least 15 judgments, in the preceding three
years, where he has contributed to the growth of law :
Provided in exceptional cases, the Chief Justice may
dispense with the compliance of any of the aforesaid
conditions.
Explanation :––
The eligibility condition with regard to
standing as a practising advocate shall not apply
to retired Additional Judges of the High Court
and retired District Judges of the State.
(3) Procedure.––
(i) An Advocate who fulfills the eligibility conditions prescribed
in clause (2) may be considered suo moto by the Court for
being designated as a “Senior Advocate”. The proposal in this
regard shall be processed by the Registrar General after
seeking information and consent from such Advocate in the
format prescribed in Annexure-A to these criteria. The proposal in this

regard shall be deliberated upon by the Full Court and in case
the proposal finds approval, a formal resolution designating
him/her as “Senior Advocate” shall he adopted ;
(ii) The High Court on motion by a Judge or on the recommendation
of the Chief Justice may by a majority of two-thirds of the
total number of Judges present and voting in the meeting
convened for the purpose, designate an Advocate as a Senior
Advocate provided the Advocate fulfills the eligibility conditions
mentioned in clause (2). The views of the Judges shall be
ascertained by a secret ballot in the meeting.
Explanation :––A retired Additional Judge of a High Court,
entitled to practice in the High Court, on his
enrolment with Bar Council, as also the
Advocate General may be designated as Senior
Advocate if he/she intimates the Chief Justice
of his/her desire to be so designated. The
requirement of 2/3rd majority of Judges in this
case shall stand dispensed with.
(4) Undertaking.––An Advocate who has been designated as
“Senior Advocate” shall furnish an undertaking that–––
(a) he/she will abide by the rules regulating the practice and fee
of Senior Advocates ;
(b) he will not draft or file pleadings in any Court and shall in all
cases be assisted by another Advocate ;
(c) he/she shall not directly give consultation to any litigant ; and
(d) he/she shall not make mention or seek adjournments in any
case.
(5) Registration as Senior Advocate.––
(i) Upon furnishing of the undertaking in the manner stated in
clause (4), the name of the Advocate who has been designated

as Senior Advocate, shall be entered in the Register of Senior
Advocates to be maintained by the Court. The order to this
effect shall be issued conferring such distinction on the
Advocate, by the Registrar General. The Advocate
shall thereafter be addressed a “Senior Advocate” of the High
Court ;
(ii) Upon an Advocate being designated as Senior Advocate, the
Registrar General shall communicate the same to the Supreme
Court of India, all the High Courts, Bar Council of India, the
State Bar Councils and Bar Associations of Jammu and
Srinagar.
(6) Review of proposal.––The proposal once considered but not
approved by the Court, shall not ordinarily be reviewed within one year.
(7) Rights, privileges and fees of the Senior Advocates.––
(a) The Senior Advocate shall have a preferential right of audience
in all Courts according to his/her seniority as such Advocate ;
(b) The Senior Advocate shall be, entitled to wear special robes
meant for Senior Advocates ;
(c) The Senior Advocate shall be entitled to the payment of such
fees as may be prescribed by the Court from time to time in
this behalf.
(8) Withdrawal of designation of Senior Advocate by the Court
in the event of violation of rules.––The designation of an Advocate as
Senior Advocate, in the event of it being found that he/she has violated
these rules or any of the provisions of the Advocates Act or Rules framed
thereunder, shall be liable to be withdrawn by the Court, after notice to him/
her in this behalf.
(9) Repeal and savings.––The criteria governing enrollment of an
Advocate as a “Senior Advocate” and in force immediately before the
commencement of these criteria are hereby repealed.

Notwithstanding such repeal, any action taken under the criteria, so repealed
shall be deemed to have been made or taken under the corresponding
provisions of these criteria.
