Notification No. 189-Rev (LAJ) of 2017

Dated 12-04-2017.

Whereas, the land and specifications whereof are given in Annexure-

A to this notification is required for construction of Road from Chingus to

Rani Badhetar under PMGSY in Village Rani Badheter, Tehsil Nowshera,

Distrtict Rajouri under PMGSY ;

Whereas, on the basis of an indent prepared by Executive

Engineer, PMGSY Division, Budhal vide No. EE/PMGSY/R/1096

dated 30-12-2011, a notification under section 4 (1) vide No. AC/LA/

1333-35 dated 29-04-2016 was isued by Collector, Land Acquisition (ACR),

Rajouri for land measuring 44 Kanals and 13 Marlas situated in Village

Rani Badhetar, Tehsil Nowshera, District Rajouri ;

Whereas, the Collector Land Acquisition (ACR), Rajouri vide

No. AC/LA/613-14 dated 04-08-2012 has reported that the notification

issued under section 4 (1) of the J&K State Land Acquisition Act by him

was served upon the interested persons for filing objections, if any, to the

proposed acquisition, but no objection was received from the land

owners/interested persons within the prescribed period as required under

sections 5&5-A of the Land Acquisition Act ;

Whereas, the report furnished by Collector, Land Acquisition (ACR),

Rajouri vide above referred letter, duly endorsed by District Collector (DC),

Rajouri vide No. AC/LA/435-36 dated 02-12-2016 has been examined and

it has been found that the land owners did not file any objection to the

proposed acquisition ; and

Whereas, the Government is satisfied that the land particulars

whereof are given in Annexure-A is required for public purpose viz.

for construction of road from Chingus to Rani Badhetar under PMGSY

in Village Rani Badhetar, Tehsil Nowshera, District Rajouri.

Now, therefore, in pursuance of section 6 of the J&K State

Land Acquisition Act, Samvat 1990, it is declared that land measuring

44 Kanals and 13 Marlas, situated in Village Rani Badhetar, Tehsil

Nowshera, District Rajouri particulars whereof are given in Annexure-A

is required for public purposes viz. for construction of road from

Chingus to Rani Badhetar under PMGSY. Further, the Collector, Land

Acquisition (ACR), Rajouri is directed under section 7 of the said Act

to take order for acquisition of the said land after giving prescribed

notice to the interested person(s) as required under the Land

Acquisition Act/Rules.

Engineer, Construction, Northern Railway, Banihal vide No. W-15/

DYCE/C/Sang/LF-2 dated 12-05-2010, a notification under section 4

(1) was issued by Collector, Land Acquisition (SDM), Gool vide No.

146-55/SDM/G/Rly dated 14-01-2016 for land measuring 03 Kanals

and 02 Marlas situated in Village “Dharam”, Tehsil Gool, District

Ramban ;

Whereas, the Collector, Land Acquisition (ADM), Gool, vide No. SDM/

G/Rly/24-28 dated 09-06-2016 has reported that the notification issued

under section 4(1) of the J&K State Land Acquisition Act by him was

served upon the interested persons for filing objections, if any, to the proposed

acquisition, but no objection was received within the prescribed time period

as required under sections 5&5-A of the Land Acquisition Act ;

whereof are mentioned are above is required for public purpose viz. for

construction of Dumping Yard for T-47 P1 Dharam.

Acquisition Act, Svt. 1990, it is declared that land measuring 03 Kanals

and 02 Marlas, situated in Village “Dharam”, Tehsil Gool, District Ramban,

particulars whereof are given in “Annexure-A” to this notification is required

Whereas, the land and specification whereof are given in

Annexure-A to this notification is required for construction of Link Road

Yurdoo Qaderna Village Yurdoo and Pethgam, Tehsil Marwah,

Whereas, on the basis of an indent prepared by Executive Engineer,

PMGSY Division, Doda-II, Kishtwar, vide No. PMGSY/D-II/114-120

dated Nil, a notification under section 4 (1) was issued by Collector, Land

Acquisition (ADC), Kishtwar vide No. ADCK/LA/145-50/2016

dated 19-07-2016 for land measuring 44 Kanals and 12 Marlas situated in

Village Yurdoo and Pethgam, Tehsil Marwah, District Kishtwar ;

Whereas, the Collector, Land Acquisition (ADC), Kishtwar vide

No. ADCK/LA/2016/293-94 dated 01-10-2016 has reported that the

notification issued under section 4 (1) of the J&K State Land Acquisition

Act by him was served upon the interested persons for filing objections,

if any, to the proposed acquisition, but no objection was received from the

land owners/interested persons within the prescribed period as required

under sections 5&5-A of the Land Acquisition Act ;

Whereas, the report furnished by Collector, Land Acquisition (ADC),

Kishtwar vide above referred letter duly endorsed by District Collector

(DC), Kishtwar vide No. DCK/LA/2016/293-97 dated 12-11-2016 has

been examined and it has been found that the land owners did not file any

objection to the proposed Acquisition ; and

Whereas, the Government is satisfied that the land particulars whereof

are given above is required for public purpose viz for construction of Link

Road Yurdoo Qaderna, Village Yurdoo and Pethgam, Theshil Marwah,

District Kishtwar.

Now, therefore, in pursuance of section 6 of the J&K State

Land Acquisition Act, Samvat 1990, it is declared that land measuring

44 Kanals and 12 Marlas, situated in Village Yurdoo and Pethgam,

Tehsil Marwah, District Kishtwar particulars whereof are given in

“Annexure-A” is required for public purposes viz. for construction of Link

Road Yurdoo Qaderna, Village Yurdoo and Pethgam, Tehsil Marwah,

District Kishtwar. Further, the Collector, Land Acquisition (ADC), Kishtwar

is directed under section 7 of the said Act to take order for acquisition of

the said land after giving prescribed notice to the interested person(s) as

required under the Land Acquisition Act/Rules.

Tender Notice

Sealed tenders affixed with revenue stamps worth Rs. 6/- are invited

from the reputed/registered interested firms for installation/provding of

“networgin in the Press DTP Lab (Urdu and English DTP” including

P/F of below detailed items), should reach in the office of the undersigned

by or before 12-10-2017 up to 12 noon. The interesting parties are requested

to attach a CDR of Rs. 3000/- or minimum 2% of their qouted value of the

tender duly pledged to the General Manager, Government Press, Srinagar,

job in lump sum F. O. R. Government Press, Sempora, Srinagar inclusive of

all charges, installation. The payment to the successful tenderer shall be

made under rules after completion of the job subject to verification to the

remain valid till 31-12-2018. The tenderer whose tender shall be approved

by the department has to execute Agreement with this department and has

to execute the job within a week’s time. The tenders are likely to opened on

2. In case of supply of service specified in column (3) of the entry at

item (i) against Serial No. 3 of the Table above, involving transfer of property

in land or undivided share of land, as the case may be, the value of supply

of service and goods portion in such supply shall be equivalent to the total

amount charged for such supply less the value of land or undivided share of

land, as the case may be, and the value of land or undivided share of land,

Explanation :––For the purposes of paragraph 2, “total amount” means

the sum total of,––

(a) consideration charged for aforesaid service ; and

(b) amount charged for transfer of land or undivided share of

land, as the case may be.

3. Value of supply of lottery shall be 100/112 of the face value or the

price notified in the Official Gazette by the organising State, whichever is

higher, in case of lottery run by State Government and 100/128 of the face

value or the price notified in the Official Gazette by the organising State,

whichever is higher, in case of lottery authorised by State Government.

4. Explanation :––For the purposes of this notification,––

(i) Goods includes capital goods ;

(ii) Reference to “Chapter”, “Section” or “Heading”, wherever

they occur, unless the context otherwise requires, shall mean

respectively as “Chapter, “Section” and “Heading” in the

annexed scheme of classification of services (Annexure) ;

(iii) The rules for the interpretation of the First Schedule to the

Customs Tariff Act, 1975 (51 of 1975), the Section and Chapter

Notes and the General Explanatory Notes of the First

Schedule shall, so far as may be, apply to the interpretation of

heading 9988 ;

(iv) Wherever a rate has been prescribed in this notification subject

to the condition that credit of input tax charged on goods or

services used in supplying the service has not been taken, it

shall mean that,––

(a) credit of input tax charged on goods or services used

exclusively in supplying such service has not been

taken ; and

(b) credit of input tax charged on goods or services used

partly for supplying such service and partly for effecting

other supplies eligible for input tax credits, is reversed as

if supply of such service is an exempt supply and attracts

provisions of sub-section (2) of section 17 of the Central

Goods and Services Tax Act, 2017 and the rules made

thereunder ;

(v) “information technology software” means any representation

of instructions, data, sound or image, including source code

and object code, recorded in a machine readable form, and

capable of being manipulated or providing interactivity to a

user, by means of a computer or an automatic data processing

machine or any other device or equipment ;

(vi) “agricultural extension” means application of scientific research

and knowledge to agricultural practices through farmer

education or training ;

(vii) “agricultural produce” means any produce out of cultivation

of plants and rearing of all life forms of animals, except the

rearing of horses, for food, fibre, fuel, raw material or other

similar products, on which either no further processing is done

or such processing is done as is usually done by a cultivator or

producer which does not alter its essential characteristics but

makes it marketable for primary market ;

(viii) “Agricultural Produce Marketing Committee or Board” means

any committee or board constituted under a State law for the
