GOVERNMENT OF JAMMU AND KASHMIR,

Notification No. 104-Rev (LAJ) of 2017

Dated 06-03-2017.

Whereas, the land specifications whereof are given in Annexure-A

to this notification is required for public purpose viz. consttruction of Ring

Road by NHAI ; and

Whereas, on the basis of an indent placed by Project Director,

NHAI, PIU, Jammu vide PD/JMU/LBG/Ring Road/Vol-II/627

dated 02-09-2016, a notification under section 4 (1) was issued by

Collector, Land Acquisition (SDM), Jammu North vide No. SDM/JN/

LA/2016-17/25-32 dated 08-09-2016 read with corrigendum No. SDM/

JN/LA/2016-17/50 dated 04-11-2016 for land measuring 274 Kanals and

19½ Marlas situated in Village “Kangrail”, Tehsil Bhalwal, District

Jammu ;

Whereas, the Deputy Commissioner, Jammu vide letter No. DCJ/

LA/Ring Road/Kangrail/2016-17/1341-43 dated 01-01-2007 has reported

that the notification issued under section 4 (1) of the J&K State Land

Acquisition Act by the Collector, Land Acquisition (SDM), Jammu

vide No. SDM/JN/LA/2016-17/25-32 dated 08-09-2016 was served upon

the interested persons for filing objections, if any, to the proposed acquisition

but no objection was received from the land owners/interested persons in

the prescribed time period as required under section 5&5-A of the Land

Acquisition Act ; and

Whereas, the report furnished by District Collector (DC), Jammu

vide letter referred to above duly endorsed by Divisional Commissioner,

Jammu vide No. 502/2764/Acq/Ring Road-NHAI/Kangrail/J/16/2836-39

dated 28-01-2017 has been examined and it has been found that the land

owners did not file any objection to the proposed acquisition ;

Whereas, the Government is satisfied that the land particulars

whereof are mentioned in “Annexure-A” to this notification is required

for public purpose viz. for “construction of Ring Road by NHAI”.

Now, therefore, in pursuance of section 6 of the J&K State

Land Acquisition Act, Samvat 1990, it is declared that land measuring

274 Kanals and 19½ Marlas situated in Village “Kangrail”, Tehsil

Bhalwal, District Jammu particulars whereof are given in Annexure-A

to this notification is required for public purpose viz. construction of Ring

Road by NHAI. Further, the Collector, Land Acquisition (SDM), Jammu

North is directed under section 7 of the said Act to take order for

acquisition of the said land after giving prescribed notice to the interested

person(s) as required under the Land Acquisition Act/Rules.

Whereas, the land specifications whereof are given in “Annexure-A”

to this notification is required for public purposes viz. for consttruction of

Road from Seri Chowhana to Shiendra situated in Village Seri Chowhana,

Tehsil Haveli, District Poonch under PMGSY ;

Whereas, on the basis of an indent placed by Executive

Engineer, PMGSY Division, Poonch vide No. PMGSY/P/1915-26

dated 01-12-2009 a notification under section 4 (1) was issued by

Collector, Land Acquisition (ACR), Poonch vide No. DCP/LA/260-68

dated 24-06-2016 for land measuring 49 Kanals, 10 Marlas and

06 Sirsai situated in Village “Seri Chowhana”, Tehsil Haveli, District

Poonch ;

Whereas, the District Collector (DC), Poonch vide letter No. DCP/

LA/497 dated 20-08-2016 has reported that the notification issued under

section 4 (1) of the J&K State Land Acquisition Act by Collector, Land

Acquisition (ACR), Poonch was served upon the interested persons for

filing objections, if any, to the proposed acquisition but no objection was

Whereas, the Government is satisfied that the land particulars

public purposes viz. for construction of Road from Seri Chowhana to

Shiendra situated at Village Seri Chowhana, Tehsil Haveli, District Poonch

under PMGSY.

Now, therefore, in pursuance of section 6 of the J&K State

Land Acquisition Act, Samvat 1990, it is declared that the land

measuring 49 Kanals, 10 Marlas and 06 Sirsai situated in Village

“Seri Chowhana”, Tehsil Haveli, District Poonch particulars whereof are

given in “Annexure-A” is required for public purpose viz. for

construction of Road from Seri Chowhana to Shiendra under PMGSY.

Further, the Collector, Land Acquisition (ACR), Poonch is directed

under section 7 of the said Act to take order for acquisition of the said

land after giving prescribed notice to the interested person(s) as required

under the Land Acquisition Act/Rules.

However, the Collector concerned shall be personally responsible

for identification and proper title verification of all types of land involved

in the case and apportionment of compensation amongst all the interested

persons/rightful claimants in accordance with the relevant laws/rules in

force, while making the award.

Whereas, on the basis of an indent placed by Executive Engineer,

PW (R&B) Division, Kishtwar a notification under section 4 (1) was issued

by Collector, Land Acquisition (ACR), Kishtwar vide No. ADC/LA/K/

62-68/2016 dated 07-10-2016 for land measuring 02 Kanals and 14 Marlas

situated in Village Kishtwar, Tehsil and District Kishtwar ;

Whereas, the Collector, Land Acquisition (ACR), Kishtwar vide

No. ACR/LA/K/16/95 dated 13-12-2016 has reported that the notification

issued under section 4 (1) of the J&K State Land Acquisition Act by

him was served upon the interested persons for filing objections, if any, to

the proposed acquisition but no objection was received from the land owners/

interested persons within the prescribed period as required under sections

5 & 5-A of the Land Acquisition Act.

Whereas, the report furnished by Collector, Land Acquisition (ACR),

Kishtwar vide above referred letter duly endorsed by District Collector

(DC), Kishtwar vide No. DCK/LA/2016/473-77 dated 31-01-2017 has

been examined and it has been found that the land owners did not file any

objection to the proposed acquisition ; and

Whereas, the Government is satisfied that the land particulars

whereof are given above is required for public purpose viz. for construction

of Link Road from Cherhar to Bonjwar.

Now, therefore, in pursuance of section 6 of the J&K State

Land Acquisition Act, Samvat 1990, it is declared that the land

measuring 02 Kanals and 14 Marlas situated in Village Kishtwar, Tehsil

and District Kishtwar particulars whereof are given above is required

for public purpose viz. for construction of Link Road from Cherhar to

Bonjwar. Further, the Collector, Land Acquisition (ACR), Kishtwar is

directed under section 7 of the said Act to take order for acquisition of

the said land after giving prescribed notice to the interested person(s) as

required under the Land Acquisition Act/Rules.

However, the Collector concerned shall be personally responsible

for identification and proper title verification of all types of land involved

in the case for making apportionment of compensation amongst all the

interested persons/rightful claimants in accordance with the relevant

laws/rules in force, while making the award.

Whereas, vide Notification No. 39-Rev (LAJ) of 2017 dated

06-02-2017 declaration has been issued under sections 6&7 of the Land

Acquisition Act for land measuring 308 Kanals situated in Village Ramban,

Tehsil and District Rambanfor four lanning of the National Highway by

NHAI ;

Whereas, Collector, Land Acquisition (ADC), Ramban vide his letter

No. 913-14/ACQ/NHAI dated 02-03-2017 has expressed urgency in taking

over the land by the Indenting Department.

Now, in pursuance of section 17 of the Land Acquisition Act, Samvat

1990, it is also ordered that on exprity of fifteen days from the publication

of the notification under section 9 (2) of the said Act, the Collector will take

possession of the aforementioned land in Village Ramban, Tehsil and District

Ramban required for public purpose, subject to fulfillment of the conditions

prescribed under section 9 (2) and section 17-A of the Land Acquisition

Act and Rules 63 of the Land Acquisition Rules.

However, the Collector concerned shall be personally responsible
