It is for information of all the concerned candidates appearing in

the written test for the post of medical Officer (Allopathic) in Health

and Medical Education Department which is scheduled to be held on

02-12-2017 (Saturday) from 02:00 pm to 04:00 pm that the Admit Cards

have already been uploaded on the Commission’s website. The

candidates are advised to download the same from Commissions

website i.e. www.jkpsc.nic.in.

In case a candidate who has applied for the said post but fails

to get his/her e-Admit Card through any of the source mentioned in the

notice, he/she may immediately contact on or before 28-11-2017 in the

Commission’s Office at Resham Ghar Colony, Bakshi Nagar, Jammu

or Camp Office, Solina, Rambagh, Srinagar, with the proof of submission

of Online Application Form/Bank Challan duly stamped and thereafter

no claim whatsoever shall be entertained.

Note :–

only those candidates shall appear in the written test, who fulfill

the eligibility prescribed for the post as mentioned in the

Notification. However, permission to appear in the written test

is purely provisional subject to further verification of the

documents at any stage of selection process.

2.

The candidature of such candidates shall be rejected at any

stage of process of selection, who are found to have

misrepresented or concealed the material facts having a

Whereas, the land, specifications whereof are given in

“Annexure-A” to this notification is required for public purpose viz. for

construction of Chichian Bandi to Finger road by GREF ;

Whereas, on the basis of the indent placed by Officer

Commanding, 79 RCC(GREF), a notification under section 4(1) was

issued by Collector, Land Acquisition (Defence), Rajouri/Poonch,

Rajouri vide No. Coll/Def/942-47 dated 29-03-2016 for land measuring

Whereas, the District Collector, Rajouri vide No. Coll/Def/

1020-21 dated 14-12-2016 has reported that the notification issued under

section 4 (1) of the J&K State Land Acquisition Act by Collector, Land

Acquisition (Defence) Rajouri was served upon the interested persons

for filing objections, if any, to the proposed acquisition but no objection

was received from the land owners/interested persons within the

prescribed period as required under sections 5 & 5-A of the Land

Acquisition Act ;

Whereas, the report furnished by District Collector (DC), Poonch

vide No. Coll/Def/1020-21 dated 14-12-2016 referred to above has been

examined and it has been found that the land owners did not file any

objection to the proposed acquisition ; and

Whereas, the Government is satisfied that the land particulars

whereof are given in Annexure-A is required for public purpose viz. for

construction of Chichian Bandi to Finger road by GREF.

Now, therefore, in pursuance of section 6 of the J&K State Land

Acquisition Act, Samvat 1990, it is declared that the land measuring

28 Kanals, 18 Marlas and 03 Sarsai situated in Village Qasba, Tehsil

Haveli, District Poonch, particulars whereof are given in

Whereas, on the basis of an indent placed by Officer Commanding,

79, RCC (GREF) vide dated 21-12-2011 a notification under section 4(1)

was issued by Collector, Land Acquisition (Defence), Rajouri/Poonch,

Headquarter Rajouri vide No. Coll/Def/1280-84 dated 30-03-2012 for

land measuring 06 Kanals and 09 Marlas situated in Village “Samote”,

Whereas, the Deputy Commissioner, Poonch vide letter No. Coll/

Def/1220-21dated 01-02-2017 has reported that the notification issued

under section 4 (1) of the J&K State Land Acquisition Act by the

Collector, Land Acquisition (Defence), Rajouri/Poonch, HQ, Rajouri

was served upon the interested persons for filing objections, if any, to

the proposed acquisition but no objection was received from the land

owners/interested persons within the prescribed time period as required

vide letter referred above has been examined and it has been

found that the land owners did not file any objection to the proposed

dated 29-03-2017 has been examined and it has been found that the

land owners did not file any objection to the proposed acquisition ; and

Whereas, the Government is satisfied that the land particulars

whereof are given above is required for public purpose viz. construction

of Ring Road by NHAI at Village Chak Jaffar, Tehsil Marh, District

Jammu.

Whereas, the Indenting Department/Collector have expressed

urgency for taking over the possession of the land.

Now, therefore, in pursuance of section 6 of the J&K State Land

Acquisition Act, Samvat 1990, it is declared that land measuring 142

Kanals, 18 Marlas and 148 Sft. situated at Village Chak Jaffar, Tehsil

Marh, District Jammu, particulars whereof are given in “Annexure-A”

is required for public purpose viz. for construction of Ring Road by

NHAI. Further, the Collector, Land Acquisition (SDM), Marh is directed

under section 7 of the said Act to take order for acquisition of the said

land after giving prescribed notice to the interested person(s) as

required under the Land Acquisition Act/Rules.

Further, in pursuance of section 17 of the Land Acquisition Act,

Samvat 1990, it is also ordered that on expiry of fifteen days from the

publication of the notification under section 9 (2) of the said Act, the

Collector will take possession of the aforementioned land in Village

Chak Jaffar, Tehsil Marh, District Jammu, required for public purposes,

subject to the fulfillment of the conditions prescribed under section 9

(2) and section 17-A of the Land Acquisition Act and Rule 63 of the

Land Acquisition Rules.

However, the Collector concerned shall be personally responsible

for identification and proper title verification of all types of land involved

in the case for making apportionment of compensation amongst all the

interested persons/rightful claimants in accordance with the relevant

laws/rules in force, while making the award.

Whereas, an area measuring 02 Kanals, under Khasra

No. 236 Min situated in Village Omala,Tehsil & District Udhampur was

notified by Collector Land Acquisition (ACR), Udhampur vide

No. ACRU/SQ/4623-32 dated 16-02-2016 for construction of an NSSO

Office Building ;

Whereas, consequent upon the issuance of the aforesaid

notification, the interested persons filed objections before Collector

Land concerned stating therein that they had no knowledge of land

having been notified for the department, which has come to their

knowledge now. They further stated that they have purchased the land

in the year 2015, for bona fide purposes and had they been aware of

the fact that the land was proposed for being acquired, they would not

have purchsed the same as also they do not have any alternate land

for construction of their residential houses ;

Whereas, it has further been stated that the land owners have

utilized their entire earnings on this particular piece of land, and have

requested for de-notifying the same, as sufficient state land in thevicinity

is available for the said purpose ;

Whereas, the Deputy Cornmissioner, Udhampur, vide his No.

ACRU/SQ/4657-59 dated 16-03-2017 has recommended the case for

denotification of the aforementioned land from the acquisition proceedings

and for imparting appropriate instructions regarding identification of

alternate land for NSSO Office ;

Whereas, the Divisional Commissioner, Jammu vide his No. 502/

2855/De-req/Omala/Udh/17/108-109 dated 12-04-2017 while endorsing

the recommendations of Deputy Commissioner, Udharnpur has sought

appropriate instructions in the matter ;

Whereas, the case has been examined in the department and it

has been found that the grievances of the land owners are genuine and

need to be given sympathetic consideration ;

Whereas, it has been felt expedient to uphold the objections

filed by the land owners in the interest of the principles of natural

justice.

Now, therefore, in exercise of the powers conferred by section

5-A, read with section 46 of the Land Acquisition Act read with Rule

43 of the Land Acquisition Rules, land measuring 02 Kanals under

Khasra No. 236 min situated in Village Omala, Tehsil and District

Udhampur, notified vide dated 16-02-2016 is hereby denotified from the

entire acquisition proceedings ab initio. The Collector, Land Acquisition

(ACR), Udhampur is further directed to explore the possibility of

identifying State Land (preferably) in consultation with the representatives

section 5 (2) of Prevention of Corruption Act read with section 120-B

of RPC)

Warrants (Permanent/Open ended) of Arrest against the accused

No. 1, namely Aijaz Ahmad Bhat son of Abdul Ahad Bhat R/o Shah

Anwar Colony, Hyderpora, Srinagar, the then Managing Director,

J&K State Forest Corporation.

Whereas, the above-mentioned case is sub judice in this Court

since 25-01-2014 ;

Whereas, this Court, after having satisfied itself that the accused

No. 1, named above, in the case has absconded and that the possibility of

his immediate arrest is remote, has already initiated proceedings under

section 512 of Cr. P. C. against him.
