23 dated 17-10-2017 for land measuring 27 Kanals and 15 Marlas situated

Whereas, the Collector, Land Acquisition (ADC), Kishtwar vide
No. ADCK/LA/2017/588-93 dated 17-11-2017 has reported that the
notification issued under section 4 (1) of the J&K State Land Acquisition
Act was served upon the interested persons for filing objections, if any, to
the proposed acquisition, but no objection was received from the land
owners/interested persons in the prescribed time period as required under
sections 5 & 5-A of the Land Acquisition Act ;

objection to the proposed acquisition ;

No. SDM/M/2018-19/Land Acq./Border Fencing/37 dated 11-06-2018 has
reported that the notification issued under section 4 (1) of the J&K State
Land Acquisition Act was served upon the interested persons for filing
objections, if any, to the proposed acquisition, but as per Draft Award issued
by Collector concerned, but no objection was received from the land owners/
interested persons in the prescribed time period as required under sections

Marh vide No. referred to above duly endorsed by Deputy Commissioner,

Village Dharam, Tehsil Gool, District Ramban.
Now, therefore, in pursuance of section 6 of the J&K State
Land Acquisition Act, Samvat 1990, it is declared that the land
measuring 50 Kanals and 03 Marlas (Local Kanal)s/32 Kanals and 12
Marlas (Standard Kanals) situated at Village Dharam, Tehsil Gool, District
Ramban, particulars whereof given in “Annexure–A” is required for public
purposes viz. for construction of Gool Dharam Tatapani road under
NABARD situated in Village Dharam, Tehsil Gool, District Ramban.
Further, the Collector, Land Acquisition (SDM), Gool is directed under
section 7 of the said Act to take orders for acquisition of the said land
after giving prescribed notice to the interested person(s) as required under
the Land Acquisition Act/rules.
Further, in pursuance of section 17 of the Land Acquisition Act, Samvat
1990, it is also ordered that on expiry of fifteen days from the publication of
the notification under Section 9 (2) of the said Act, the Collector will take

Whereas, in terms of the Notification dated 03-11-2018, Inter alia,
various dates were appointed for the counduct of elections to elect
Sarpanches and Panches for Halqa Panchayats and Panch Constituencies
of Block Nowshera, District Rajouri ; and
Whereas, one Gurjeet Kour W/o Harnam Singh R/o Ward No. 2
Rajal/Dhallian, Tehsil Nowshera, District Rajouri filed her nomination for
election to SC (Women) reserved Panch seat for Ward No. 2-Dhallian
of Panchayat Halqa Rajal-A, Block Nowshera, District Rajouri ; and

the same was rejected by concerned Returning Officer on the date of
scrutiny ; and
Whereas, aggrieved of the same, complaint was filed by her before
the Election Authority and the same has been disposed of in her favour vide
Order No. CEO/Pyt/2018/729 dated 25-11-2018 ; and
Whereas, such improper rejection has resulted in vitiation of the election
process from the date of scrutiny onwards for Panch Constituency in the
said Ward.
Now, therefore, considering the above, in exercise of powers under
section 36 of J&K Panchayati Raj Act, 1989, read with Rule 8 of the J&K
Panchayati Raj Rules, 1996, the Election Authority (Chief Electoral Officer,
J&K) hereby notifies and, accordingly, appoints the following dates to elect
Panch in respect of the Ward No. 02-Dhallian of Panchayat Halqa
Rajal-A, Block Nowshera, District Rajouri as under :––
(a) the 26th November, 2018 (Monday) as the date for the scrutiny
of nominations.
(b) the 28th November, 2018 (Wednesday) as the last date for
withdrawal of candidature.
(c) the 08th December, 2018 (Saturday) as the date on which a poll,
if necessary, shall be taken from 08:00 A. M. to 02:00 P. M.
(d) the 08th December, 2018 (Saturday) as the date of counting,
unless notified otherwise.
(e) the 17th December, 2018 (Monday) as the date before which
the election shall be completed.
Further, consequent upon the above, the date on which a poll,
if necessary, for all or any of the constituencies of Panchayat Halqa
Rajal-A, Block Nowshera, District Rajouri, notified vide Notification
dated 03-11-2018, shall now be 08-12-2018 instead of 29-11-2018.

An Act to amend the Jammu and Kashmir Civil Services Decentralization
and Recruitment Act, 2010.
In exercise of the powers vested under Proclamation No. P-l/l8
of 2018 dated 20th June, 2018, the Governor is pleased to enact as
follows :––
1. Short title and commencement.––(1) This Act may be called the
Jammu and Kashmir Civil Services Decentralization and Recruitment
(Amendment) Act, 2018.
(2) It shall come into force from the date of its publication in the
Government Gazette.
2. Substitution of section 3, Act No. XVI of 2010.––Section 3 of
the Jammu and Kashmir Civil Services Decentralization and
Recruitment Act, 2010, shall be substituted by the following section,
namely :––
“3. Applications of the Act.––The provisions of the Act shall
apply to,––
(a) all the gazetted and non-gazetted posts borne on the
establishment of any Department or Service of the
Government ; and
(b) Class-IV posts borne on the establishment of any
Department or Service of the Government or
any Government company, organization and
body substantially owned or controlled by the
State :
Provided that the provisions of this Act shall not
apply to,––
(i) the posts for which any special procedure is
laid down under any enactment of the State
Legislature ; and

(ii) such other posts as may be excluded from
the operation of the Act by the notification issued
by the Government in this behalf from time to
time.”

Whereas, one Smt. Seema Devi W/o Ram Dass R/o Surey Chak,
Block Mandal Phallian (hereinafter referred to as complainant) had filed
her nomination paper for Panch in PC-II, Reserved for SC (Women)
Category, of Panchayat Halqa Surey Chak but the same was rejected
by concerned Returning Officer on the ground of non-submission of
Category (SC) Certificate ; and
Whereas, a report in the matter was sought and the same has been
furnished by District Panchayat Election Officer (Deputy Commissioner),
Jammu and perusal thereof revealed that the nomination papers filed by
her does include a certificate issued of the competent authority (Tehsildar,
Khour in the instant case) and that she belongs to a caste which is very
much included in the Constitution (J&K) Scheduled Castes Order 1956.
It has also been recommended that she should be considered as a
candidate ; and
Whereas, considering the above, the Election Authority reached the
conclusion that there has been an improper rejection, which has resulted in
vitiation of the election process from the date of scrutiny onwards for the
Panch Constituency PC-II, reserved for SC (Women) Category, of
Panchayat Halqa Surey Chak.
Now, therefore, considering the above, in exercise of powers under
section 36 of J&K Panchayati Raj Act, 1989, read with Rule 8 of the J&K
Panchayati Raj Rules, 1996, the Election Authority (Chief Electoral Officer,
J&K) hereby notifies and, accordingly, appoints the following dates for the
conduct of elections to elect Panches in respect of the Panch Constituency
PC-II, reserved for SC (Women) Category of Panchayat Halqa Surey
Chak, District Jammu as under :––
(a) the 28th November, 2018 (Wednesday) as the date for the scrutiny
of nominations.
(b) the 30th November, 2018 (Friday) as the last date for withdrawal
of candidature.
(c) the 8th December, 2018 (Saturday) as the date on which a poll,
if necessary, shall be taken from 08.00 A. M. to 02.00 P. M.

(d) the 8th December, 2018 (Saturday) as the date of counting, unless

as reserved for ‘SC’ category ; however, due to some communication
gap and belated receipt of the said corrigendum by concerned Returning
Officer/Assistant Returning Officer, the said Ward got wrongly notified for
‘open category’ ; and
Whereas, the continuance of the election process in the said Ward by
treating it as ‘open category’ resulted in the vitiation of the election process
in the said Ward right from the process of issuance of Notification dated
06-11-2018.
Now, therefore, considering the above, in exercise of powers under
section 36 of J&K Panchayati Raj Act, 1989, read with Rule 8 of the J&K
Panchayati Raj Rules, 1996, the Election Authority (Chief Electoral Officer,
J&K) hereby declares the election process notified vide Notification dated
06-11-2018 Halqa Ward No. 03 Sarlibagi, Halqa Panchayat Chachwa-A of
Block Sangaldan void and notifies, and appoints, the following dates to
elect Panch in respect of Ward No. 03 Sarlibagi (SC reserved), Halqa
Panchayat Chachwa-A of Block Sangaldan, District Ramban as under :––
(a) the 30th November, 2018 (Friday) as the last date for making
nominations.
(b) the 1st December, 2018 (Saturday) as the date for the scrutiny
of nominations.
(c) the 03rd December, 2018 (Monday) as the last date for withdrawal
of candidature.
(d) the 08th December, 2018 (Saturday) as the date on which a poll,
if necessary, shall be taken from 08.00 A. M. to 02.00 P. M.
(e) the 08th December, 2018 (Saturday) as the date of counting,
unless notified otherwise.
(f) the 17th December, 2018 (Monday) as the date before which
the election shall be completed.
Further, consequent upon the above, the date on which a poll,
if necessary, for all or any of the constituencies of Panchayat Halqa
Chachwa-A of Block Sangaldan, District Ramban, notified vide Notification
dated 06-11-2018, shall now be 08-12-2018 instead of 01-12-2018.
