transferred/sold while being deposited in a warehouse (hereinafter
referred to as the “warehoused goods”) was clarified. In the said
circular, it was enunciated that from 1 st of April, 2018, the supply
of warehoused goods before their clearance from the warehouse
would not be subject to the levy of integrated tax.
2.
It has been brought to notice of the undersigned that during
the period from 1st of July, 2017 to 31st of March, 2018
(hereinafter referred to as the “said period”), the common
portal did not have the facility to enable the taxpayer to
report payment of integrated tax, in the details required to
be submitted in FORM GSTR-1, for such supplies especially
where the supplier and the recipient were located in the
same State or Union Territory. Hence taxpayers making
such supplies were required to report such supplies as intra-
State supplies and discharged central tax and state tax
instead of integrated tax accordingly. Now, representations
have been received from trade to clarify the same.

In order to ensure uniformity in the implementation of the
provisions of law across the field formations, I, Commissioner,
State Taxes, Jammu and Kashmir in exercise of its powers
conferred by section 168 (1) of the Jammu and Kashmir
Goods and Services Tax Act, 2017, hereby issue the
following instructions.
4.
Supply of warehoused goods while deposited in custom
bonded warehouses had the character of inter-State supply
as per the provisions of Integrated Goods and Services Tax
Act, 2017. But, due to non-availability of the facility on the
common portal, suppliers have reported such supplies as
intra-State supplies and discharged central tax and state tax
on such supplies instead of integrated tax. In view of
revenue neutral position of such tax payment and that
facility to correctly report the nature of transaction in

FORM GSTR-1 furnished on the common portal was not
available during the period July, 2017 to March, 2018.
It has been decided that as a one-time exception, suppliers
who have paid central tax and state tax on such supplies
during the said period would be deemed to have complied
with the provisions of law as far as payment of tax on
such supplies is concerned as long as the amount of tax
paid as central tax and state tax is equal to the due amount

Award/Order
The sequence of events and facts as collected from the record files
available in the court right from the date of reference of the I. D. case for
adjudication by the Government vide SRO-87 dated 11- 3-1998 are
summarized as below :—
(1) The Govt. of JK vide SRO-87 dated 11.03.1998 referred the ID
case of termination of service of the applicants to this IT/LC for
adjudication on two references/issues :—
(i) Legality or otherwise the order of the management
dated 07.05.1996.
(ii) Award appropriate relief, if any, to said employees in case
illegality of the said order is established.
(2) During the course of adjudication before this Industrial
Tribunal cum-Labour Court, the applicant’s grievance of
termination was addressed by reinstating his service and posting
at SEL, Shalimar Srinagar. The court vide interim order dated
10.11.98 directed the N. A. to make his payment of wages and all
other benefits with effect from the date of his termination.
(3) The Industrial Tribunal cum -Labour Court disposed off the case
of Industrial Dispute referred to it by the Government vide above
referred SRO with the observation laid down in the order dated
12.08.2004 and the applicant was granted no relief as his grievance
was redressed already by reinstating his service and payment of
all his back wages.
(4) In between the period the applicant along with other colleagues
of applicant was transferred temporarily to SEL, Red Fort, New
Delhi on the ground of incongenial atmosphere/eruption of militancy
in order to save their institution and for the safety of their staff
members just like other departments, institutions run by the Central
Government did.

3
–––––––—––––––––––––––––––––––––––––––––––––––––––––––—––——
(5)
The Colleagues of the applicant complied and obeyed the order
of their authorities expect the applicant who took refuge under
the fact of running of this case before the IT/LC and wanted to
take benefit of S-33 & 33-A of the Industrial Dispute Act.
(6)
The withful disobedience and non-compliance of transfer order
of the applicant resulted in his termination of service in the year
2002 dated 19.08.2002 after following due procedure of law.
(7)
The applicant again raised the issue of his transfer during the
course of the adjudication of his case before the IT/LC and
subsequent termination of his service was again set down with
no relief to the applicant vide order dated 10.01.2007.
(8)
After lapse of four years after passing of order/judgment dated
10.01.2007 the applicant again approached this Court /Tribunal
with the same issues already settled down vide Court/Tribunal
order dated 12.08.2004 & 10.01.2007.
The above narrated facts depict that his initial grievance of termination
was addressed in the year 1998 and was reinstated with all back wages
paid and attended his duties at Srinagar till May, 1999 when the applicant
along with other colleagues were transferred to Delhi due to the prevailing
situation in the Valley for their safety and protection of their property/
Institution who were forced to do so. It is not therefore the applicant who
has been discriminated, harassed or victimized but his wilful disobedience
and non- compliance of the order of his authorities amounted to dereliction
in his duty and of course warranted a legal action. Which has been affected
on him by way of his termination of service after proper enquiry.
Further, the raising of issues which have already been settled and
decided by virtue of order dated 12.08.04 and 10.01.2007 does not warranted
any further action & is restricted under law to do so in terms of S. II of the
CPC. i. e., Res judicata read with explanation of Sec. V of the said section
of law.
The filing of the cases with the same issues or reference again and
again are barred and limited by Section 5 of the Limitation Act. Every act
has to be reacted within the specific and limited period of time while as the
applicant has approached the court after four years of the passing of the

order dated 10.01.2007 when the Court/Tribunal lacks the powers to review
its own order except clerical or arithmetic mistakes. The Court/Tribunal
therefore does not feel that any grievance of the applicant has remained
unattended which requires any further adjudication . Therefore all the
applications, cases filed till date by the applicant dismissed without any further
relief to the applicant. The management is however directed to make the
payment of the wages or other dues if not paid be released in favour of the
applicant/petitioner. The case is decided accordingly with costs to the tune
of Rs. 1000/- against the applicant.

In the Matter of :— Dispute under section 2 (A) of Industrial Disputes
Act, 1947 against illegal termination from service on
22.10.2015 by the respondent Management.
Order
Received an application under section 2(A) of Industrial Disputes Act,
1947 against illegal termination from service by this Court/Tribunal for
adjudication on point of termination. On receiving the case by this Tribunal
has issued notices to the respondent and both parties appeared before the
Court/ Tribunal and AR on behalf of the petitioner have filed his claim petition
and the file was fixed for the evidence of the petitioner but on last date of
hearing i. e. 13.03.2018 Authorized Representative of petitioner has made a
request in open Court that all the demands of the worker as mentioned in
the terms of under section 2-A I. D. Act, 1947 have been settled between
the parties amicabley presence of the Petitioner. So he does not want to
pursue the case anymore. As such he wants to withdraw from the claim
petition. AR for the petitioner was directed to think over the matter properly
and moved proper application after consulting the claimant.
Today in presence of the Authorized Representative has preferred an
application for withdrawal from the point of claim petition as demands which
have mentioned in the claim petition before this Court/Tribunal. As such
petitionr has given Affidavit in writing in support of his application statement
has been also recorded and it becomes part of the case file. Ld, Counsel for
respondent are also present and accepted that there is no dispute remaining
between the parties.
In view of the above, this Tribunal has come to the conclusion that as
per petitioners demand raised by the Madan Lal V/s Secretary, Jammu
Club, Jammu pending disposal before this Court/Tribunal has further agreed
that petitioner shall not claim any right or compensation or any monetary
benefits. So he has moved an application/Affidavit for withdrawal of the
claim. Petitioner is not interesting in pursuing the case. As such he moved
Affidavit for withdrawal from the Claim. I have considered the application
and satisfied that there is no need to proceed further in the matter parties
are not interested in pursuing the petition.

promised them to pay the EXTRA wages and more money in the form of
bonus which was also affirmed by the respondent No. 2.

Thus the total 120 number of workers worked for 8260 days by working
more than normal hours of work and earned Rs. l2,39,000/- of amount as
wages. Therefore the total liability on the respondents No. 1 and No. 2 is
Rs. 12,39,000/- but nothing has been paid to the petitioners out of the said
amount. After completion of the work, the petitioners approached the
respondent No. 1 for the payments of their wages as already promised by
the respondent No. 1 on behalf of respondent No. 2 and affirmed by the
respondent No. 2 for immediate payments of their wages. But instead of
paying their wages the respondent No. 1 showed his inability to make the
payment due to non-payments of his bills by the respondent No. 2.
Petitioners again and again approached the respondent No. 1 and also
respondent No. 2 for the release of their due earned wages but till date
nothing has been done in favour of the petitioners, due to which the petitioners
are suffering for their no fault.
At last the respondent No. 1 openly refused the petitioners to pay their
wages when they approached at Jammu to him so the cause of action has
accrued to the petitioners here at Jammu. Hence this Hon’ble Court has
jurisdiction to try and adjudicate the petition. This Court after taking
cognizance of the case called the respondents through notices and asked
them to file their objections/reply to the claim petition.
In reply to the claim petition the objections submitted on behalf of
Respondent No. 1 through Counsel Advocate Sumir Pandita has maintained
that he is not liable for the claim submitted by the petitioners as it was the

liability of respondent No. 2 to pay the wages of the petitioners immediately
after the completion of work and it is only because of the default of the
respondent No. 2 (Company) the petitioners have suffered and have filed
the present case. Rest of the paras the respondent No. 1 has admitted in
total and has affirmed and accepted the work done by the petitioners
and the wages earned by the labourers/petitioners to the tune of
Rs. 12,39,000/-. The respondent No. 1 has also stated that the representatives
of the respondent No. 2 had visited at the work site so many times to check
the work done and ensured the release of the wages of the applicants/
workers at the earliest but after completion of the work the respondent
No. 2 failed to keep their wages but did not make the payment of the earned
wages of the labourers. The Respondent No. 1 even has sent a legal notice
to the respondent No. 2 for the payment of the withheld wages of the
applicants and still no response was received from the respondent No. 2
with the result the poor labourers have suffered and have filed the present
petition. The respondent No. 2 has shown his arrogance and irresponsible
attitude towards clearance of the wages of the applicants which has made
him to suffer and face the wreath of the poor labourers and ultimate these
poor workers suffer who had put in their hard work and sweat in the
completion of the work of the respondent No. 2 within the stipulated period
of time.
In the premises of the above facts and circumstances the
Respondent No. 1 has prayed before the Hon’ble Court that
instant petition kindly be allowed in favour of petitioners and
Judgement be passed against the Respondent No. 2.
The respondent No. 2 did not made their appearance in the Court with
the result they are set in on an ex-parte and the petitioners were directed to
produce their evidence in support of their claim application which they did.
The petitioners in support of their application produced their evidences
before this Court/Tribunal and in addition to that they have also produced
three (3) independent witnesses namely 1. Mohammad Aslam S/o Qasim
Din R/o Majrakund, Tehsil Mahore, District Reasi, 2. Aslam Din S/o Wali
Mohammad R/o Majrakund, Tehsil Mahore, District Reasi ; and

Kotranka, District Rajouri who have backed up their version and in their
cross examination have stated the same as they have averred in their own
evidence in the shape of affidavits.
The independent witnesses also stated that the petitioners have paid
from their own pockets to the engaged labourers by taking a huge loan at a
whooping rate of interest 13% but the petitioners have been victimized for
their no fault and at the cost of respondent No. 2 who has willfully and
deliberately avoided the claim of the petitioners and willfully and deliberately
absented themselves and appearance in the Court. However this Court
passed orders for setting aside the ex-parte proceedings against the
Respondent No. 2 on 25-08-2017 and they filed preliminary objections on
20-11-2017 as under :—
The Respondent No. 2 in their objection have maintained non-
maintainability of the present petition on the ground the present
application has been filed much later than the cause of action has
accrued against the respondent No. 1 as the work of the said project
and the attendance of the petitioners clearly depicts that they have
worked till 28th February, 2009. The present petition has not been
filed within the prescribed period of 12 months in terms of section 15
of the payment of Wages Act nor have satisfactorily described the
cause of delay hence the present application is time bared and is liable
to be dismissed.
The other point raised by the Respondent No. 2 is that the case is not
maintainable so far it relates to the respondent No. 1 because there is no
cause of action accrued against the respondent No. 2 as there is no nexus
between the applicants and the respondent No. 2 as the applicants have
been engaged by the respondent No. 1. Therefore have prayed for the
dismissal of the application against them. However they have stated that
the cause of action accrued to the petitioners if any is against the respondent
No. 1 and not against the respondent No. 2 who have engaged them. Further
they have stated that the respondent No. 1 has engaged the petitioners as
alleged and so the petitioners and respondent No. 1 have entered into an
agreement and so there is an established relationship of Employer and

Employee between petitioners and respondent No. 1 as the respondent
No. 1 being the employer is therefore responsible to pay the wages to the
petitioners as per the section 3 of payment of Wages Act, 1936. So it is the
respondent No. 1 who has to pay the wages to the petitioners and also
responsible for waving his contractual liability hence decree may kindly be
passed against the respondent No. 1 and the present application be dismissed
qua the respondent No. 2.
After perusing the record and the documents placed on the file this
Court observes that the Respondent No. 2 has entered into an agreement
with the Respondent No. 1 for undertaking and execution of work allotted
to the Respondent No. 2 by the appropriate Authority within a stipulated
period of time and after fixing the rates of wages for the workers to be
engaged for its execution and completion. Accordingly the Respondent
No. 1 in terms has engaged the labourers for the execution and completion
of the work allotted to the Respondent No. 2 at the specified terms and
conditions of work and the rates of wages. The labourers/workers applicants
completed the work done after putting in their hard work and sweat within
the time of two months but unfortunately their wages were not paid to them
which they were legally entitled to after the completion of work. The
Respondent No. 1 after exercising his approach to personation Thus the
respondent No. 2 did not release and pay the hard earned wages to the
applicants failed in his exercise to clear his liability refused the applicants to
clear their liability because of the non-payment of his bill by the respondent
No. 2 with the failure of the petitioners in getting their due wages from
respondent No. 1 they filed the instance petition before this Court under
section 15 of the Payment of Wages Act for its recovery of unpaid and
delayed wages along with the interest and compensation.
The content of the Respondent No. 2 as stated in their objections, the
Court feels, has no credibility and validity in the eyes of law because in fact
they are the “principal employer” who have engaged the petitioners/applicants
through the contractor Respondent No. 1 for undertaking and execution of'
their work allotted to them by the Appropriate Authority. So it is the
Respondent No. 2 who is wholly and solely responsible for making the
payment of the hard earned wages of the applicants. Section 3 of the payment
of Wages Act, 1936 makes it amply clear that it is the employer or his

representative responsible for the payment to persons employed by him of
all wages. Further section 21(4) of the Contract Labour (Regulation and
Abolition) Act, 1970 specifically makes the “principal employer” liable to
clear the wages of the labourers engaged by his contractor. To facilitate this
provision of Law reads as under :—
CONTRACT LABOUR (REG. AND ABOLITION)
“Sec. 21(4). Responsibility for payment of wages-(4) In case
the contractor fails to make payment of wages within the
prescribed period or makes short payment, then the principal
employer shall be liable to make payment of wages in full or
the unpaid balance due, as the case may be, to the contract
labour employed by the contractor and recover the amount so
paid from the contractor either by deduction from any amount
payable to the contractor under any contract or as a debt payable
by the contractor”.
In addition to the above the Jammu and Kashmir Contract Labour
(Regulation and Abolition) Rules, 1972 casts a duty under Rule 72 & 73
upon the principal employer to ensure the protection of the rights of the
labourers and timely payment of their wages in presence of his authorized
representative which the Respondent No. 2 has never done. Merely saying
that they have made the full payment to the contractor without producing
any document or proof is a vague statement and misleading fact before the
Court. It is the “Principal Employer Respondent No. 2” who is all along
responsible and liable to make the payment of the withheld wages of the
petitioners in pursuance of the above mentioned provision of laws. Of course
a close relationship of employer and employee do exist between them and
the labourers (applicants) who were engaged through the contractor can’t
escape their duty and responsibility to make payment of the delayed and
withheld wages of the applicants. Why the Respondent No. 2 does not
understand it that it was the work of the respondent No. 2 who they got it
done through Respondent No. 1 by engaging the applicants. So Respondent
No. 2 as Principal Employers are held responsible and liable to make the
payment of the wages of the petitioners.

The award is passed accordingly in favour of the applicants and against
Respondent No. 2 who is held liable to cause delay in making the payment
to the applicants and made them to suffer for their no fault. Accordingly the
award is passed in favour of the applicants (Petitioners) and against the
Respondent No. 2 is directed to deposit the delayed an amount of
Rs. 12,39,000/- with this Court/Tribunal within a period of 30 (thirty) days
for onward payment to the petitioners/applicants. Further this Court/
Tribunal also lays a Compensation of Rs. 3000/- against them in terms of
section 15 (3) for causing unnecessary delay and withholding of the hard
earned wages of the applicant without any rhyme and reasons. Failing which
the applicants (Petitioners) are entitled to interest @ 8% per annum. The
file after due completion be consigned to records under rules.
