Indonesia after the commission of the crime and the Investigating

Officer as also the process serving agency have stated that there was

no immediate prospect of the accused being served. Statement of the

Investigating Officer in support of the report and the prayer made by

him has been reduced into writing. Investigating Officer has prayed

for initiation of proceedings under section 299 Cr. P. C. against the

accused. On perusal of the material on record and statement of the

Investigating Officer, this court is satisfied that the accused above

named has absconded after the commission of offence and there was

no immediate prospect of his being served.

Therefore proceedings under section 299 Cr. P. C. are hereby

initiated against the accused above named and the police authorities

of the Union Territory of J&K are hereby directed to arrest the accused

above named, wherever he is found within the Union Territory of J&K

and be produced in this court.

This general warrant of arrest against accused above named shall

remain in force till the accused is arrested.

Copy of the warrant be also forwarded to S P., C. B. I., Jammu

No. 970 Min (01K–05M) but at the S. No. 20 of the notification under

section 4(1) there is Khasra No. 978 Min (01K–05M). The variation

needs clarification ;

Whereas, the case has been persued in the light of observations

made by the Divisional Commissioner, Jammu, and it is revealed that

the actual Khasra No. under acquisition is 970 Min and inadvertently

the same has been recorded as 978 Min in the notification issued by

this office.

In the backdrop of above, the Khasra No. 978 Min (01K-05M)

recorded at S. No. 20 of the notification is hereby rectified to be Khasra

No. 970 Min (01-05M) which shall be considered for the future

proceedings in the instant land acquisition case.

2. Whereas, a base FIR No. 272/2018 under section 380 RPC

and 16 ULA(P) Act, 1967 was registered at Police Station, Shopian

and investigation initiated ; and

3. Whereas, during the course of investigation, it was revealed

that accused Showkat Ahmad No. 87/SPO had stolen/taken away the

arms/ammunition from the personal trunk (box) of the complainant

after breaking open, its locks and wrapping the same in a blanket and

succeeded in leaving the premises by telling the santry on duty that he

has to give the blanket to one of his relative at District Hospital,

Shopian and later he displayed his picture with stolen rifle through

social media. During further investigation, it was revealed that accused

Suhail Ahmad Mir S/o Ab. Majeed R/o Herman (a close relative of

accused SPO) had aided him in commission of offence after hatching

criminal conspiracy and by taking him along with stolen weapon on his

own motorcycle bearing Regd. No. JK22A/S884 ; and

4. Whereas, during the course of investigation, on the basis of

statements of witnesses, the seizure memos and other evidence, the

Investigating Officer established a prima facie case against the accused

persons namely SPO Showkat Ahmad S/o Mohd. Maqbool Sheikh,

R/o Herman under sections 380,201 RPC and 13, 18 and 39 of the

Unlawful Activities (Prevention) Act 1967 ; against accused Suhail

Ahmad Mir S/o Ab. Majeed R/o Herman under sections 380, RPC 13,

18 and 39 of the Unlawful Activities (Prevention) Act, 1967. Accused

SPO has been killed in an anti-militancy operations on 22-03-2019 at

Gadapora, Shopian ; and

5. Whereas, the Authority appointed by the State Government

under sub-section (2) of section 45 of the Unlawful Activities

(Prevention) Act, 1967, has independently scrutinized the Case Diary

file and all the other relevant documents relating to the case and has

come to a definite conclusion that this is a fit case for accord of

prosecution sanction against the said accused person ; and

6. Whereas, after perusing the Case Diary, the relevant documents

and also taking into consideration the observations/views of the Authority

appointed under sub-section (2) of section 45 of the Unlawful Activities

(Prevention) Act, 1967, the State Government is of the view that there

is sufficient material and evidence available against the accused person

for his prosecution under the aforesaid provisions of law.

SRO-644.––Whereas, on 31-07-2018, PP, Khurhama received a

docket from HC Gh. Hassan No. 108/IRP to the effect that he along

with Const. Mohamamd Ishaq No. 436/IRP and others were performing

VIP duty at Cheepora, Kandhar and were busy in clearing the traffic

jam. Meanwhile, terrorist namely ; Bilal Ahamd Shah and others

travelling in a maruti car bearing No. JK09-5230 stopped and fired

upon Const. Mohammad Ishaq No. 436 IRP with intention to kill him.

However, said Const. managed to escape, but the terrorists succeeded

in snatching his INSAS service rifle and fled from the spot ; and

2. Whereas, a case FIR No. 9l/2018 under sections 392, 307

RPC and 7/27 A. Act was registered at Police Station, Lalpora and

investigation taken up ; and

3. Whereas, during investigation it came to fore that accused

Adil Hussain Shah S/o Gh. Mohammad Shah R/o Shartmuqam

was accompanying the terrorists namely ; Bilal Ahmad Shah S/o

Shamus Din Shah R/o Shartmuqam and accused Zahoor Ahmad Mir

S/o Mohammad Akbar Mir R/o Kalaroos and Owais Ahmad Shah, S/

o Gh. Ahmad Shah R/o Saiwan, Towseef Ahmad Shah, S/o Maqsood

Ahmad Shah R/o Shartmuqam and Firdous Ahmad Shah S/o Bashir

Ahmad Shah R/o Shartmuqam aided/assisted them by way of criminal

conspiracy in snatching the weapon from the above mentioned constable.

Among other things, the car used in the incident was recovered at the

instance of Adil Hussain Shah, posters of Burhan Wani and other

incriminating material was recovered from Owais Ahmad Shah. Also

during investigation it was revealed that the vehicle used in the

commission of the crime was arranged by Towseef Ahmad Shah ; and

4. Whereas, during the course of investigation, on the basis of

statement of witnesses, the seizure memos and other evidence, the

Investigating Officer established a, prima facie case against the accused

persons namely ; 1. Owais Ahamd Shah, S/o Gh. Ahmad Shah R/o

Saiwan, 2. Towseef Maqsood Shah, S/o Maqsood Ahmad Shah, 3. Adil

Hussain Shah, S/o Gh. Mohammad Shah 4. Firdous Ahmad Shah

S/o Bashir Ahmad Shah 5. Bilal Ahmad Shah S/o Shamus Din Shah

(residents of Shartmuqam), 6. Zahoor Ahmad Mir S/o Mohd. Akbar

Mir R/o Kalaroos under sections 120-B, 392, 307 RPC, 7/27 A Act, 13,

18, 20 of the Unlawful Activities (Prevention) Act, 1967. However, the

accused 5 and 6 namely; Bilal Ahmad and Zahoor Ahmad have been

killed in an encounter. Besides, the snatched weapon INSAS has also

been recovered from the encounter site for which a separate Case

FIR No. 54/2018 stands registered at Police Station, Sogam ; and

5. Whereas, the Authority appointed by the State Government

under sub-section (2) of section 45 of the Unlawful Activities

(Prevention) Act, 1967, has independently scrutinized the Case Diary

file and all the other relevant documents relating to the case and has

come to a definite conclusion that this is a fit case for accord of

prosecution sanction against the said accused persons ; and

Act, 1967, the State Government hereby accords sanction for launching

prosecution against the accused persons namely, 1. Owais Ahamd

Shah S/o Gh. Ahmad Shah R/o Saiwan, 2. Towseef Ahmad Shah S/o

Maqsood Ahmad Shah 3. Adil Hussain Shah S/o Gh. Mohammad Shah

4. Firdous Ahamd Shah S/o Bashir Ahmad Shah (residents of

Shartmuqam) for the commission of offences punishable under sections

13, 18 and 20 of Unlawful Activities (Prevention) Act, 1967 arising out

of FIR No. 91/2018 of P/S Lalpora, Kupwara.

Article 309 of the Constitution of India, the Governor is pleased to

direct that the cadre of the Jammu & Kashmir, Labour Department

(Subordinate/Non-Gazetted) Services for the Union Territory of Jammu

and Kashmir upon exclusion of the posts of Union Territory of Ladakh,

The J&K Govt. Gazette, 22nd Oct., 2019/30th Asv., 1941. [No. 29-x

recommendations of the Council, hereby makes the following amendments

in the SRO notification No. SRO-GST-3 dated 08-07-2017 namely :–

(1) in the Table in column (3), after item (5), the following item shall

be inserted namely :—

‘‘(6)

Patroleum operations or coal bed methane operations

undertaken under specified contracts under the Hydrocarbon Exploration

Licensing Policy (HELP) or Open Acerage Licensing Policy (OLAP)’’.

(ii) in the Annexure against Condition No. 1. In clause (e) the

following proviso shall be inserted at the end namely :—

‘‘Provided that where the said goods so supplied are sought to be

disposed of in non-serviceable form after mutilation, the recipent of outward

supply or the transferee, as the case may be, may at his option, pay the

tax at the rate of 9 per cent on transaction value of such goods subject

to the condition that the recipient of outward supply or the transferee as

the case may be produces before the Deputy Commissioner of Central

Tax or the Assistant Commissioner of Central Tax or the Additional

Commissioner of State Tax or the Assistant Commissioner of State Tax,

as the case may be, having jurisdiction over the supplier of goods,

a certificate from a duly authorised officer of the Directorate General of

Hydro Carbons in the Ministry of Patroleum and Natural Gas, Government

of India to the effect that the said goods are non-serviceable and have

been mutilated for disposal.’’

This notification shall come into force w.e.f 1st October, 2019.

Srinagar, 25th of October, 2019.

SRO-801.—In exercise of the powers conferred by proviso to

Article 309 of the Constitution of India, the Governor is pleased to direct

that the cadre of the [Government Medical College, Kathua (Subordinate/

Non-Gazetted) Service] for the Union Territory of Jammu and Kashmir,

shall comprise the posts as indicated in Schedule-I to this notification,

subject to any modifications as may be necessary.

This shall come into force with immediate effect.
