AWARD
On 21-01-2016 this court received a reference from Govt. or Jammu
and Kashmir Labour and Employment Dept. mentioning therein that
management of M/s Friends Gun Works, Ashok Nagar, Satwari, Jammu
terminated the services of its workman namely Rajinder Sah S/o Dhanik
Sah R/o Preet Nagar, Digiana, Jammu. There upon workman raised a dispute
against the management of M/s Friends Gun Works, Ashok Nagar, Satwari,
Jammu before the Conciliation Officer (Assistant Labour Commissioner,
Jammu). Whereas all efforts were made by Conciliation Officer during the
conciliation proceedings to settle dispute between the parties but the parties
were adamant to their stand and were not sitting to settle their dispute
through negotiation. Whereas Conciliation Officer submitted his failure report
recommending the case for reference to Labour Court for adjudication.
Whereas the Govt. is of the opinion that an industrial Dispute exists between
the parties and Govt. is of considered opinion that matter be referred to
Labour Court/Tribunal for adjudication.
Finally the Govt. in exercise of powers conferred by Clause (c) of
sub-section (10) of Industrial Disputes Act, 1947 sent the dispute for
adjudication by the Tribunal (Labour Court) on the following issues :—
1. Whether the Management of M/s Friends Gun Works, Ashok Nagar,
Satwari, Jammu is legally justified in terminating the services of its
workman namely Rajinder Sah ?

Advocate appeared on behalf of respondent and filed the power of attorney.
Petitioner sought the time to file claim petition. Again file came for hearing
on 29-03-2016 petitioner cause his appearance and respondent turned absent.
On 26-05-2016 petitioner appeared and filed his claim petition. Respondent
again remained absent. On 27-03-2018 petitioner was present and respondent
remained absent. This tribunal while stating that respondent remained absent
for last so many dates initiated exparte proceedings against the respondent
and directed the petitioner to had evidence in exparte.
On 16-04-2019 petitioner submitted that he does not want to produce
any more evidence as such evidence of petitioner was closed and file came
up for arguments in exparte.
The petitioner in his claim petition stated that applicant/workman was
engaged as DBBL Gun Fitter in the month of November, 2009 by respondent
factory on the same terms and conditions which were applicable to other
workmen working in the factory. That he was engaged as DBBL Gun Fitter
on piece rate basis and minimum wages of applicant was of a skilled workmen
which was Rs. 6,750/- and performed duty as DBBL Gun Fitter w. e. f. No.
2009 till December, 2012 without any interruption and to the satisfaction of
employer. That he performed all duties assigned to him by the dint of his
hard work and no act of commission or omission has ever been reported
against him. That he was duly registered under ESI Act and his provident
fund account was also maintained by the respondent.
Petitioner examined Prabhu Dhayal Sharma and himself as witnesses
'in the shape of affidavits.
Petitioner in his affidavit stated that applicant was engaged as DBBL
Gun Fitter in the month of November, 2009 in M/s. Friends Gun Works on
the same terms and conditions of other co-workman and was engaged on
piece rate basis and minimum wages of Rs. 6,750/- P. M. and performed his
duties as Gun Fitter w. e. f. November, 2009 till December, 2012 without
any break/interruption and his name was duly registered under ESI Act and
also his provident fund is also maintained by the respondent but in the month
of December, 2012 his services was terminated without any show cause
notice or reason. That deponent was not paid any retrenchment compensation
or other dues which are to be paid to the deponent in terms of Industrial
Dispute Act and when deponent requested to respondent to give him his

dues including other compensation, the respondent told him that he has already
closed the ESI of the deponent and will not pay any due to him as he has
become overage but the deponent was only 57 years of the age at that time.
That deponent is entitled to all the benefits including retrenchment
compensation under Industrial Dispute Act along with penal interest. That
the averment made in affidavit are true and correct.
P. W. Prabhu Dhayal Sharma deposed in his statement on affidavit
that he is working as DBBL in Gun Fitter in M/s. Friends Gun Works Industrial
Estate Ashok Nagar Satwari, Jammu since 2008 and in 2009 one Rajinder
Sah S/o Dhanik Sah R/o Rani Talab, Digiana, Jammu was also engaged by
proprietor of M/s. Friends Gun Work and used to get wages of Rs. 6,750/-
PM on piece rate basis. That in the month of December, 2012, the services
of Rajinder Sah was terminated on the ground that he is over age but was
not overage and was of 57 years of age as such he is entitled for retrenchment
compensation and other benefits under Industrial Dispute Act. That the
averments made in affidavit are true and correct to the best of this knowledge.
I have heard the arguments of the petitioner in exparte and have gone
through record carefully. The petitioner also submitted the written arguments
on 16-05-2019.
The petitioner at the outset stated that he was engaged as DBBL Gun
Fitter in the month of November, 2009 by respondent Factory on the same
terms and conditions which were applicable to other workman in factory
and was engaged as DBBL Gun Fitter on piece rate basis and the minimum
wages of the petitioner was of the skilled workmen was Rs. 6,750/-. The
applicant performed his duties as DBBL Gun Fitter w. e. f. November, 2009
till December, 2012 without any interruption and to the satisfaction of
respondent and have performed his duties also by the dint of his hard work
and no commission or omission has ever been reported against him. He
further submitted that he was duly registered under ESI Act and his Provident
Fund was also maintained by respondent. Also placed on record the copy of
identity card issued by ESI Act enclosed as exhibit Rs. 1. Again, the petitioner
submitted that in the month of December, 2012, the respondent without any
reason or rhyme and without any show cause notice retrenched the services
of the petitioner without affording any opportunity of being heard and without
following the mandate of Industrial Disputes Act. As such the termination

of services of petitioner is bad in law and illegal in the eyes of law and
fundamental rights and other legal rights of the petitioner.
The petitioner again submitted through AR that petitioner earlier
submitted on application before Ld. Assistant Labour Commissioner, Jammu
along with requisite documents for mediation but the same failed and as
such Assistant Labour Commissioner referred the matter before the Hon
'ble Court for adjudication, the copy of the application with other documents
are enclosed and annexed with petition. It is submitted by petitioner that he
is entitled for retrenchment compensation, including all other benefits under
relevant provisions of Industrial Disputes Act. The applicant is otherwise
entitled to retrenchment, as he has not attained the age of superannuation
and finally submitted that he is entitled to monthly wages of Rs. 6,750/-
w. e. f. January, 2013 to January, 2016 including gratuity, leave salary and
other ancillary services benefits as the petitioner attains the age of
superannuation in the month of January, 2016 or in the alternate provide
suitable compensation to the applicant/petitioner for illegal and unlawful
retrenchment/termination of services of the applicant under relevant provision
of law.
From the perusal of record it reflects that petitioner was registered
under ESI Act PIS copy of identity card issued by Employees State Insurance
Corporation is places on record as Annexure ‘A’.
Copy of application presented before Assistant Labour Commissioner
for initiating conciliation proceedings is also on record.
Perusal of failure report of Assistant Labour Commissioner, Jammu
also reflects that respondent though the respondent has taken a stand that
petitioner himself taken the volunteer retrenchment but no document in this
regard has been submitted by respondent. This reflects that respondent has
participate in conciliation proceedings before Assistant Labour Commissioner
which fail.
The statement of petitioner as witness he was engaged in the DBBL
Gun Fitter in the month of November, 2009 till December, 2012 without any
break and is registered with ESI and in the month of November, 2012 his
services were terminate without any show cause notice or reason nor, any
retrenchment notice or other dues which are to be paid to deponent in terms

of industrial Disputes Act were paid on the ground that he has been become
over age where as he was only 54 years old.
PW Prabhu Dhayal Sharma the witness of petitioner also corroborated
the statement of petitioner. As the petitioner produced his evidence in exparte
so their statements remained unrebutted and there is nothing on record to
disbelieve them.
Section 25 F of Industrial Disputes Act provides makes it clear that
requirement prescribed by it is a condition precedent for the retrenchment
of the workman and non-compliance of the said condition renders the
impugned retrenchment invalid and inoperative.
Rule 76 of Industrial Disputes Act, 1947 framed in 1957 is reproduced
as under for appreciation :—
“76. Notice of retrenchment.—If any employer desires to retrench
any workman employed in his industrial establishment who has been
in continuous service for not less than one year under him (hereinafter
referred to as “workman” in this rule and in rules 77 and 78), he shall
give notice of such retrenchment as in Form-P to the Central
Government, the Regional Labour Commissioner (Central) and
Assistant Labour Commissioner (Central) and the Employment
Exchange concerned and such notice shall be served on that
Government, the Regional Labour Commissioner (Central), The
Assistant Labour Commissioner (Central), and the Employment
Exchange concerned by registered post in the following manner :—
(a) Where notice is given to the workman, notice of retrenchment
shall be sent within three days from the date on which notice is
given to the workman.
In Raj Kumar V/s Director Education 2016 LLR 561 (SC) it has been
held by Hon’ble Supreme Court that it is clear that in the instant case
mandatory conditions of section 25F of the Industrial Disputes Act, 1947 to
retrench a workman have not been complied with. Hence the order of
retrenchment is liable to be set aside and accordingly set aside.
In the instant case petitioner who worked as DBBL Gun Fitter with
respondent form November, 2009 till December, 2012 without any
interruption, registered under ESI and his Provident Fund account was also
maintained by respondent and in the month of December, 2012 respondent

terminated him without any show cause notice without affording any
opportunity of being heard and with following the provisions of Industrial
Dispute Act. It appears that such termination is bad and petition of the
petitioner has merits.
From the perusal of identity card issued by ESI the date of birth of the
petitioner has been shown as 01.05.1955 who had not crossed the age of
retirement in 2012 when his service was terminated. But now the petitioner
has crossed the age of retirement as such can’t be reinstated.
Since the petitioner last salary was 6750 which would basics for
calculation.
Accordingly the termination of petitioner is set aside and the respondent
is directed to back wages till the date of retirement and other benefits
available to petitioner.
Accordingly an award is passed in favour of the petitioner and against
the respondent Management. Copy of the award be sent to the Government
of J&K through its Commissioner/Secretary, Labour Department for
information and publication in the Govt. Gazette. File shall be consigned to
record after its due completion.
