In the Matter of :—Claim petition with reference to the no settlement
certificate issued by the Conciliation Officer for Dispute
under section 2A of Industrial Disputes (Amendment)
Act, 2010 for adjudication.
––––––
AWARD
Section 10 of the Industrial Disputes Act empowers the appropriate
Government if it is of the opinion that any Industrial Disputes exist or is
apprehended, it may at any time in writing refer the dispute or any matter
appearing to be connected with or relevant to the dispute to the Industrial
Tribunal or Labour Court for adjudication.
Section 2A, sub-clause (2) after the (Amendment) Act, 2010 empowers
the workman to make an application direct to Labour Court or Tribunal for
adjudications of the dispute referred to there in after the expiry of forty five
days from the date he has made an application to the conciliation officer of
the appropriate Government for conciliation of dispute and in receipt of
such application the Labour Court or Tribunal shall have the powers and
jurisdiction to adjudicate upon the dispute as if it were a dispute referred to
it by appropriate Government.
Conciliation Officer of Industrial Disputes Act, 1947, Jammu issued a
certificate of no settlement between the parties and applicant can take the
matter directly with Industrial Tribunal.
In the claim petition the petitioners submits that he was working in the
above company as driver since 2010 and was getting Rs. 8250/- per month.
That in the ending of July, 2015 his mother was admitted in the hospital for
operation and in this regard he informed the M. T. Incharge Shri Inderjit
Singh as M. T. Incharge is responsible for deputing the drivers for duties
leave and adjustment of duties. That he requested the M. T. Incharge verbally
on 29-07-2015 as usual practice for 5 days leave and from 01-08-2015
there was complete general strike in Jammu regarding AIIMS issue and
most of their vehicles were also off the road and again gone to meet the
M. T. Incharge Shri Sachin Sharma and submitted leave application for
further extension with the request that after leave he may be deputed on
local duty as there is no one else in his family to take care of his mother. The
same application was received in presence of one Shri Nek Ram. Further

submitted in claim petition that he reported for duty on 17-08-2015 and was
deputed on local duty for bringing back a TATA Sumo from Digiana where
it was laying due to some fault and come back at 2 P. M. and then with the
permission of Nek Ram went to attend the mother in the hospital.
That on the next day on 18-08-2015 he attended the duty and was
intentionally asked to go on long route with mala fide intention. He asked
them that there are more than 5 vehicles which are plying on local route and
he may be deputed on local route so that he may be able to attend his
mother and even other drives were agreed for exchange of duty. That on
the next day he was not given any duty. On this he tried to meet the
Manager. He continuously went to the office to meet the Manager but after
5 or 6 days Manager called him and asked to wait for further 3 or 4 days
and will consider to allow him for duty. That on 31-08-2015, Manager called
him in the office and told that his Head Office has refused to take him on
duty and verbally told him that his service has been terminated but no any
termination letter was ever given to him. That no notice, charge sheet was
given to him nor any explanation was called from him and Management
used its colourable powers and terminated his service. He, the petitioner
challenged the termination on the grounds that :—
(a) No any show cause notice was given to petitioner before
terminating the service which is against the law ;
(b) That no any charge sheet of misconduct was ever given to
petitioner ;
(c) That no any opportunity was given to petitioner nor any
explanation was called from the petitioner before terminating
from the service ;
(d) That no any enquiry was conducted against the petitioner before
termination.
On these ground petitioner prayed that termination of petitioner f'rom
the service may kindly be set aside as bad in the eye of law and petitioner
be reinstated on his old post with back wages with interest and continuity of
service and cost of expenses amounting to Rs. 2000 as respondent is
responsible for litigation with mala fide intention.

Respondents were called through notice, Respondent No. 1 inspite of
service chosen to remain absent and on 01-04-2016 ex parte proceedings
were initiated against him.
On 06-08-2017 respondent No. 2 appeared through his counsel and
filed the vakalatnama and file was fixed for objection.
On 22-08-2017 respondent filed the objection and on 08-01-2017 issues
were framed and petitioner was directed to lead the evidence. Respondent
No. 2 also turned absent and on 16-04-2019 ex parte proceeding were also
initiated against him and petitioner was directed to argue the case in
ex parte.
Petitioner examined Inderjeet Singh and himself as his witnesses.
Evidence led by petitioner in the shape of affidavit is hereby reproduced
for appreciation.
Petitioner Som Nath as witness deposed that he was working in the
company of respondent at Jammu on the post of driver since 2010 and his
last salary was Rs. 8250/- P. M. and his mother was in the village to see her
brother where she fell down. He got the information and went in the village,
brought her back and hospitalized her in Government Medical College, Jammu
who was discharged on 18-05-2015. He further deposed that on 28th July,
2015 he requested to Inderjeet Singh incharge MT for 5 days leave, he
being male member of family, and was busy in hospital for mother’s
treatment. Dr. fixed dates for operation but two time dates were postponed
due to old age, High B. P. and Sugar. Operation was done on 11-08-2015.
In between on 07-08-2015 he went to office at that time Sachin was MTD
of vehicle who asked him to give application. Nek Ram wrote the application
for leave till 11-08-20l5. Sachin told him that he will submit the application to
Manager on 13-08-2015. Sachin called him in office. He requested to depute
him in local duty so that he may attend the mother but he forced to go at
Katra. But on this he requested him that he can’t leave mother alone in
hospital. Witness further deposed that on 17-08-2015 he was deputed on
local duty to get back a standed Tata Sumo and came back at 2 P. M.
Thereafter with the permission of Shri Nek Ram he went back to hospital
on 18-08-2015. He went back on duty and was intentionally with mala fide

intention asked to go on long route duty. Even the other drivers were agreed
to adjust him. Thereafter manager called him in office but did not give him
patience hearing rather turned him out. Next day again he went to office
but was not given any duty and Manager asked him to wait for 3 or 4 days.
On 31-08-2015, Manager told that Head Office has refused to take him on
duty and orally told that his service has been terminated. Thereafter on
11-09-2015 filed dispute before Conciliation Officer, Jammu but no amicable
settlement was made out. The Conciliation Officer then issued certificate
to file case before tribunal for adjudication and he filed the claim petition on
29-06-2016. He further deposed that he was terminated from service without
following principal of natural justice. No charge sheet has been given to him
and his service has been terminated without any notice or one month pay
and without any retrenchment compensations.
P. W. Inderjeet stated on affidavit that he was working in the respondent
company at Jammu as M. T. Incharge Shri Som Nath, driver on 28th July,
2015 after duty hours requested him that his mother fell down in village and
he want to bring her at Jammu. So he requested him for five days leave.
He further stated that he allowed five days leave being MT Incharge vehicle.
The mother of petitioner remained in hospital under treatment. He knows
Som Nath, Driver. He was working in the company for last about five
years.
Since the ex parte proceedings have already been initiated against the
respondents as such evidence produced by petitioner remained un-rebutted.
The issue framed before this tribunal were as—
(1) Whether the management of M/s Securitrans India (P) Limited,
Trikutu Nagar, Jammu is legally justified in termination of services
of workman Shri Som Nath, Driver.
(2) If not, to what relief, he is entitled to ?
AR for petitioner argued the matter in ex parte.
I have heard the petitioner and have gone through record carefully.
While appreciating the evidence on record it appears that petitioner
Som Nath, driver was working as driver in the Company of respondent at
Jammu since 2010 and was getting the salary of' Rs. 8250/- P.M. The
mother of petitioner Krishna Devi fell down in the village who was brought

back in Jammu by petitioner got here admitted in Government Medical
College, Jammu. On 28th of July, 2015 after duty hour he requested to Shri
Inderjeet Singh, M. T. Vehicle for 5 days leave w. e. f. 29-07-2015. Being
the male member of family he was supposed to attend the mother. The
doctor postponed the operation two times as the mother of the petitioner
was old and finally the operation was done on 11-08-2015. On 07-08-2015
he went to office and submitted the leave application written by Nek Ram
which was further submitted to the Manager. On 17-08-2015 as requested,
he was deputed to local duty. Thereafter with the permission of Nek Ram,
he left for hospital. On 18-08-2015 he was on duty and was deliberately
with mala fide intention directed to go on long route duty even the other
drivers agreed to adjust him in local duty. It further appears that Manager
informed him in office and asked to wait for some days and on 31-08-2015
called and told that head office refused to take the petitioner on duty as
such the service of petitioner has been terminated. It also reflects that
petitioner filed the dispute before conciliation officer where it was not settled
amicably. It reflects that petitioner was terminated without any notice or
one month pay and without compensation. The statement deposed by
petitioner has been corroborated by the P. W. Inderjeet Singh who deposed
that he is working in the company of respondent. Som Nath respondent on
28th July, 2015 requested him for 5 days casual leave as his mother fell
down in village which was to be taken back at Jammu. He being MT
Incharge allowed for 5 days C. L. Mother of petitioner remained admitted
in hospital from 29-07-2015.
From the perusal of annexure A/I, the copy of discharge and follow
up card, it reflects that Krishana Devi, age 75 years remained admitted in
hospital, Government Medical College f'rom 29-07-2015 to 18-08-2015.
Even from the perusal of objection filed by respondent, it does not
appear that before terminating the service of petitioner, respondent have
conducted any enquiry though it appears from the objection that petitioner
remained absent unauthorized as such he was terminated by Branch Manager.
There is no record with objection which shows that before termination of
petitioner the respondent issued show cause notice to respondent for
explanation.

It has been observed by Hon’ble Supreme Court in a case reported in
1996 LLR 289, the relevant Para is reproduced.
“Before an employee can be held to be guilty of wilful absence from
the duty a proper domestic inquiry should be conducted by the
department by issuing show cause notice and framing charge sheet
and specific finding should be recorded by enquiry officer after due
procedure for domestic inquiry in accordance with law which admittedly
has not been done in this case. Hence the respondents are solely
responsible for their own lapse and for which the petitioner can not be
blamed.”
In an other case of Delhi Transport Corporation V/s Krishan Lal Mason
2018 LLR Del H.C. Hon’ble Delhi High Court held that termination of
service of a workman daily wager who was in continuous service for about
10 years by an oral order without making compliance of provision of
section 25 F of I. D. Act, 1947 would attract reinstatement with consequential
benefits and full back wages illegal termination of service of a workman
who have put unblemished service for 10 years is unfair labour practice and
directing the respondent to regularize the service of workman is justified.
Again in the management of Regional Chief Engineer, PHED V/s
their workman Rep by District Secretary, 2018 LLR 1167 S. C., Hon’ble
Supreme Court observed that award of reinstatement with full back wages
which was held by writ Court as well as by Appellate Court, has no merit
and is liable to be dismissed and was as such dismissed.
As such in view of discussion made hereinabove and the law cited, it
is settled that a workman cannot be terminated for misconduct of
unauthorizedly remaining absent from duty. In the case in hand it is clear
and established that no regular inquiry was conducted by the management
before termination of petitioner. As such termination of the service of petitioner
Som Nath is legally not justified, as such is set aside.
Again so far as back wages are concerned, it is not established that he
remained gainful during the period after termination. It is settled that facts
and circumstances of each case has to be considered before granting back
wages. Respondent being in ex parte failed to produce any evidence which
shows that during pendency of petition/petitioner was engaged somewhere
in gainful service as such it is assumed that petitioner remained unemployed
during the period of pendency of petition and as such is entitled for back
wages uptill his reinstatement.

–––––––—––––––––––––––––––––––––––––––––––––––––––––––—––——
In view of above stated reasons, this tribunal has come to the conclusion
that petitioner has been terminated illegally without adopting due course of
law. As such his termination is hereby set aside with the direction to
respondent that petitioner shall be reinstated on the duty on the post which
he held on the date of termination of petitioner and shall be paid all the
arrears (back wages) up-to-date and other consequential benefits admissible
under rule.
Accordingly an award is passed in favour of the petitioner and against
the respondent Management. Copy of the award be sent to the Government
of J&K through its Commissioner/Secretary, Labour Department for
information and publication in the Government Gazette. File shall be consigned
to record after its due completion.

I have heard the petitioner through AR in ex parte and have gone
through the evidence oral and documentary on record carefully.
This court has no return findings within described limit of the term of
reference identified by the competent authority appointed by Govt. In the
reference this tribunal has to find out legality or otherwise action of
respondent. While terminating the service of petitioner is valid or not. In
case the action taken by respondent in terminating the service of Petitioner
is proved illegal then it is to be seen as what appropriate relief can be
granted to petitioner on account of such illegal action.
In the claim petition, the petitioner averred that she was engaged as
Cook-cum-Sweeper in the year April, 2004 and remained in the continuous
service for nine year till termination from the service on 4th of July, 2012
and her monthly wages was Rs. 150/- P. M. That respondent without any
reason has terminated her from service without following the due process
of law. As no notice prior to termination of service was served upon her nor
any retrenchment compensation was paid to her. Which is the violation of
section 25F of the Industrial Disputes Act, 1947. She further submitted that
respondent terminated the service of petitioner workman in violation of
principles of natural justice.
The witness examined by the petitioner has corroborated the claim of
the petitioner. While stating that he is knowing the petitioner Mst. Zaina
who worked in the Middle School, Rehnote, Education Zone, Gundna, District
Doda on the post of Cook-cum-Sweeper. She remained therein the
employment for 9 years. She was getting Rs. 150/- P. M.
Similarly Mst. Zaina petitioner also fully corroborated her claim
petitioner when she was examined as witness.
It also reflects from the perusal of record that during the reconciliation
proceeding before Conciliation Officer, Doda respondent filed objection.
Wherein he submitted that during the 2011-12 a building comparing three

respondent workman was employed on daily rate basis it 1994 and was not
working on sanctioned post. In the event, the workman and worked for
more than 240 days in a calendar year and his services were terminated
arbitrarily without complying with the provision of section 6 N of Industrial
Disputes Act. The reinstatement could not be ordered as a matter of right.
At the best compensation can be granted.
Again in M/s Floor Tex Collection V/s Vikram Thapa 2016 LLR 899.
It has been held by Delhi High Court that if there is loss of confidence by
management upon the workman, awarding lump sum compensation in lieu
of reinstatement is appropriate.
In University of Rajasthan V/s Trilok Singh 2017 (152) FLR 1104
(Raj H. C.). It was held that respondent was never appointed in accordance
with law nor there was even an appointment letter given to respondent as
such to meet the ends of justice University is directed to pay respondent
workman lump sum compensation of Rs. 3 lacs failing which will carry
interest at Bank rate till date of payment.
In an other recent case captioned as Ram Prasad V/s Presiding Officer,
Industrial Tribunal-cum-Labour Court Hisar C. W. P. No. 19761/2013 Punjab
and Haryana dated 14th November, 2018. Hon’ble High Court of Punjab
and Haryana High Court set aside the order of Labour Court wherein Labour
Court held the termination of service of workman bad due to non-compliance
of section 25F of Industrial Disputes Act, 1947 but denied the reinstatement
and back wages and instead awarded a lump sum compensation of
Rs. 1,20,000/- holding that workman was appointed to the post of cook
helper dehors the rules as no application was called from the general public
for the post the workman challenged the award in writ petition. The Hon’ble
High Court observed that as per law settled on this point of termination
order is rendered void ab initio for non-compliance of section 25F of
Industrial Disputes Act, 1947, the workman is entitled to reinstatement with
continuity of service and back wages. Hence award suffers from error
which is fundamental in nature due to inadequacy of reason in the award in
matter of moulding relief and finally held that workman entitled to
reinstatement will compensation of Rs. 3 lacs this amount is in nature of
solatium damages, cost, compensation or reparation of the wrong done by
deptt. of Govt. the Govt. may recover this amount from responsible official
in the department for disregarding the mandatory procedure.
