Subject :—Amendment to Jammu and Kashmir General Rules (Civil) framed

under Section 122 of Civil Procedure Code.

No. 283 of 2021/RG Dated 18-03-2021.

In exercise of powers conferred by Section 122 of Civil Procedure

Code read with all other powers enabling in this behalf, the High Court of

Jammu and Kashmir with the previous approval of the Lt. Governor, hereby

makes the following amendment to the “Jammu and Kashmir General Rules

(Civil) of 1978 Svt.”

This amendment shall come into force from the date it is published in

the Government Gazette.

AMENDMENT IN JAMMU AND KASHMIR GENERAL RULES

(CIVIL), OF 1978 SVT., FOR THE GUIDANCE OF DISTRICT AND

SUBORDINATE COURTS OF UTs OF JAMMU AND KASHMIR

AND LADAKH

CHAPTER VI

After Rule 33 the following proviso is inserted :

“Provided that the process generated electronically through the Case

Information System with QR Code will be authentic without the

signature of the Presiding Officer and seal of the court”.

After Rule 34 the following proviso is inserted :

“Provided that the process generated electronically through the Case

Information System with QR Code will be authentic without the

signature of the Presiding Officer and seal of the court :

Provided further that service of summons/notices may be made by

fax messages, electronic mail service or by any other approved available

electronic mode.”

After Rule 35 the following proviso is inserted :

“Provided that where the process is served through fax message,

electronic mail service or by any other electronic mode it shall be

sufficient proof of service of process if :—

(a)

the fax is sent from the concerned court on the registered fax

number and receipt is generated indicating that the fax has been

received at the remote end ;

(b) the mail is sent from the mail ID of the concerned court on the

registered mail ID of the addressee and receipt of delivery of mail

is generated ;

Registered fax number or registered email ID of the addressee is one

which the concerned department, organization, individual displays on

its website or letterhead or is contained in any arbitration agreement or

any contract entered into between the parties to the litigation and copy

whereof is produced in the court as proof of the same.”

After Rule 135 the following proviso is inserted :

Provided that when the process is served through NSTEP or through

any other similar application prescribed by the High Court, the signature

or thumb impression of the party served on the handheld electronic

gadget of the serving officer shall constitute the acknowledgement

within the meaning of this Rule.

After Rule 136 the following proviso is inserted :

“Provided that when the process is served through NSTEP or through

any other similar application prescribed by the High Court, the signature

or thumb impression of the party served on the electronic gadget of

the serving officer shall constitute the acknowledgement of service

within the meaning of this Rule :

Provided further that the photograph of the party served along with

the geo-tagged photo of the location captured by the process server

shall be sufficient proof of service within the meaning of this Rule.”

After Rule 146 the following proviso is inserted :

“Provided that wherever feasible, the court shall also send the summons to

the nearest court where the defendant resides through NSTEP or through

any other similar application prescribed by the High Court for service upon

the defendant.”

After Rule 148 the following proviso is inserted :

“Provided that the process generated electronically through the Case

Information System with QR Code will be authentic without the

signature of the Presiding Officer and seal of the court.”

After Rule 158 the following proviso is inserted :

“Provided that when the process is served through NSTEP or through

any other similar application prescribed by the High Court, the signature

or thumb impression of the party served on the electronic gadget of

the serving officer shall constitute the acknowledgement of service

within the meaning of this Rule :

Provided further that the photograph of the party served along with

In exercise of powers conferred by Section 477 (d) of Criminal

Procedure Code read with all other powers enabling in this behalf, the High-

Court of Jammu and Kashmir with the previous approval of the Lt.. Governor,

hereby makes the following amendment to the “Jammu and Kashmir General

Rules (Criminal) of 1988 Svt.”

This amendment shall come into force from the date it is published in

the Government Gazette.

Rule 8 : Service of summons

The provisions regarding the service of summons, contained in Chapter

VI of Criminal Procedure Code should be strictly observed. In addition,

the summons/notice issued by the Court may be served by delivering

or transmitting a copy thereof by registered post acknowledgment

due, addressed to the opposite party or by speed post or by any other

means of transmission of documents (including fax message or

electronic mail service) :

Provided that where the summons/notice is served through fax or

email, it shall be sufficient proof of service of process if :—

(a) the fax is sent from the concerned court on the registered fax

number and receipt is generated indicating that the fax has been

received at the remote end ;

(b) themail is sent from the mail ID of the concerned court on the

registered mail ID of the addressee and receipt of delivery of mail

is generated.

Registered fax number or registered email ID of the addressee is one

which the concerned department,organization, individual displays on

its 'website or letterhead' or is contained in any arbitration agreement

ORDER

No. 30 of 2021/RG Dated 05-03-2021.

In terms of Rule 11 of the Jammu and Kashmir Ministerial Staff of the

Subordinate Courts (Recruitment and Conditions of Service) Rules, 2016,

on the recommendation of the Rules Committee, Hon’ble the Chief Justice

has been pleased to lay down the following guidelines for the purpose of

making reservations in appointments in Subordinate Courts of the UT of

Jammu and Kashmir :—

The Rules and Orders regarding reservations in appointments by

direct recruitment or promotion applicable to Domiciles of the Union

Territory of Jammu and Kashmir shall mutatis mutandis apply to

the appointments by direct recruitment or promotions made under

the Jammu and Kashmir Ministerial Staff of the Sub-ordinate Courts

(Recruitment and Conditions of Service) Rules 2016.

II.

The provisions of the Jammu and Kashmir Civil Services

(Decentralization and Recruitment) Act as amended from time to

time shall apply prospectively to all appointments made under the

Jammu and Kashmir Ministerial Staff of the Sub-ordinate Courts

(Recruitment and Conditions of Service) Rules 2016, so far as the

same pertain to the Union Territory of Jammu and Kashmir :

Provided that the expressions “Public Service Commission” and

“Service Selection Board” wherever appearing in the Jammu and

Kashmir Civil Service (Decentralization and Recruitment) Act shall in

the case of appointments made under the Jammu and Kashmir

Ministerial Staff of the Sub-ordinate Courts (Recruitment and

Conditions of Service) Rules 2016, mean the Authority prescribed/

constituted under Rule 12 of the said Rules.

III.

Notwithstanding anything contrary contained in any Rule/Order/

Instruction for vacancies reserved for the Scheduled Caste

Category in any Divisional or District Cadre, candidates

belonging to that category shall be eligible to apply for said

reserved vacancies irrespective of their residence in the

concerned District or Division.

IV. A member of the State, Divisional or District Cadre shall be

transferable only within his/her own Cadre and shall in no

case be transferable from one Divisional Cadre to another

Divisional Cadre or District Cadre, or from any District Cadre

to another District Cadre or Divisional Cadre posts.

V. The above guidelines shall be applicable in cases of

appointments and promotions and transfers pertaining to the

posts earmarked for Union Territory of Jammu and Kashmir.

Whereas, on the basis of an indent placed by Executive Engineer,

PWD (R&B), Division Doda, a notification under section 4 (1) was issued

by Collector, Land Acquisition (ACR), Doda, vide letter No. 2883-89/

Acq dated 12-03-2014, for land measuring 10 Kanals, 03 Marlas in Village

Hamirpur, Tehsil and District Doda for construction of Dharara link road

by PWD ;

Whereas, the Collector, Land Acquisition (ACR), Doda vide letter

No. 1245-50/Acq dated 10-10-2019 has reported that the notification issued

under section 4 (1) of the J&K State Land Acquisition Act by him was

served upon the intersted persons for filing objections, if any, to the proposed

acquisition, but no objection was received from the land owners/

interested persons within the prescribed period as required under

sections 5 & 5-A of the Land Acquisition Act ;

Whereas, the report furnished by Collector, Land Acquisition (ACR),

Doda vide letter referred to above duly endorsed by District Collector,

Land Acquisition (DC), Doda vide No. 438/LAC/D/19 dated

15-10-2019, Divisional Commissioner, Jammu vide No. 502/3834/PWD/

Hamirpur/D/19/2664 dated 30-10-2019 and Financial Commissioner,

Revenue, J&K Jammu vide No. FC-LS/LA-5182/2020 dated 19-3-2020

has been examined and it has been found that the land owners did not

file any objection to the proposed acquisition ;

Whereas, the Government is satisfied that the land particulars whereof

Acquisition Act, Samvat 1990, it is declared that the land measuring 10

Act by him was served upon the interested persons for filing objections, if

any, to the proposed acquisition, but, no objection, was received from the

land owners/interested persons within the prescribed period as required

under secions 5 & 5-A of the Land Acquisition Act ;

Jammu vide No. FC-LS/LA-5178/2020 dated 19-03-2020 has been

examined and it has been found that the land owners did not file any

objection to the proposed acquisition ;

Whereas, the Government is satisfied that the land particulars

whereof are given above is required for public purpose viz. for widening

Whereas, on the basis of an indent placed by Officer Commanding, 79

RCC (GREF), a notification under section 4(1) was issued by Collector,

Land Acquisition, Defence, Rajouri–Poonch, Hq. Rajouri vide letter

No. Coll/Def/2019-20/787–91 dated 03-10-2019, for land measuring

03 Kanals 09 Marlas in Village Gagrian, Tehsil Mandi, District Poonch for

construction of Khet Sabzian road by GREF ;

Whereas, the District Collector, Land Acquisition (DC), Poonch vide

letter No. 1026 dated 30-10-2019 has reported that the notification issued

under section 4(1) of the J&K State Land Acquisition Act by him was

served upon the interested persons for filing objections, if any, to the

proposed acquisition, but no objection was received from the land

owners/interested persons within the prescribed period as required under

sections 5 & 5-A of the Land Acquisition Act ;

Whereas, the report furnished by District Collector, Land Acquisition

(DC), Poonch vide letter referred to above duly endorsed by Divisional

Commissioner, Jammu vide No. 502/3966/Greb/Poonch/19/4079 dated

24-12-2019 and Financial Commissioner, Revenue, J&K Jammu vide

No. FC-LS/LA–5133/2020 dated 05-03-2020 has been examined and it has

been found that the land owners did not file any objection to the proposed

acquisition ;

Whereas, the Government is satisfied that the land particulars whereof

are given above is required for public purpose viz. for construction of Khet

Sabzian road by GREF situated at Village Gagrian, Tehsil Mandi, District

Poonch.

Now, therefore, in pursuance of section 6 of the J&K State Land

Acquisition Act, Samvat 1990, it is declared that the land measuring

03 Kanals 09 Marlas, in Village Gagrian, Tehsil Mandi, District Poonch is

required for public purposes viz. for construction of Khet Sabzian road by

GREF. Further, the Collector, Land Acquisition (Def), Rajouri is directed

under section 7 of the said Act to take orders for acquisition of the said land

after giving prescribed notice to the interested person(s) as required under

Now, therefore, in pursuance of section 6 of the J&K State Land

Acquisition Act, Samvat 1990, it is declared that the land measuring

03 Kanals and 17 Marlas in Village Dhalwas, Tehsil and District Ramban

for widening of National Highway. Further, the Collector, Land Acquisition

(ADC), Ramban is directed under section 7 of the said Act to take orders

for acquisition of the said land after giving prescribed notice to the interested

person (s) as required under the Land Acquisition Act/Rules.

Further, in pursuance of section 17 of the Land Acquisition Act,

Samvat 1990, it is also ordered that on expiry of fifteen days from the

publiction of the notification under section 9 (2) of the said Act,

the Collector will take possession of the aforementioned land in Village

Dhalwas, Tehsil and District Ramban, required for public purposes, subject

to fulfillment of the conditions prescribed under section 9 (2) and

section 17-A of the Land Acquisition Act and Rule 63 of the Land

Acquisition Rules.
