Pursuant to the judgement passed by the Hon’ble Supreme Court
of India on 11-01-2022 in Miscellaneous Application No. 1852 of 2019
in Criminal Appeal No. 1101 of 2019 titled ‘Smruti Tukaram Badade
Vs. State of Maharashtra & Anr., the Hon’ble Chief Justice has been
pleased to recast the Clause 3(a) of the ‘Protocol for Recording Evidence
of Vulnerable Witnesses’ notified vide High Court Notification No. 42
dated 29-05-2019, as under—

Definitions,—
(a)
Vulnerable Witness-means and includes :—
(i) any child witness who has not completed 18 years
of age ;

(ii) any victim of sexual violence ;
(iii) any material witness in a dangerous crime ;
(iv) witnesses suffering from “mental illness” as defined

Evidence Act, 1872 ;
(v) any witness deem to have a threat perception under
the Witness Protection Scheme, 2018 of the Union
Government as approved by the Supreme Court
in Mahender Chawla Vs. Union of India (2019)
14 SCC 615 ;
(vi) any speech or hearing impaired individual or a
person suffering from any other disability who is
considered to be a vulnerable witness by the
competent court ;
(vii) such other witness as may be deemed vulnerable by
the trial court for reasons therefor to be recorded
in writing.”

Whereas, the land, specifications whereof are given in Annexure ‘‘A’’
to this notification is required for construction of road from Banjar Morh
to Shamthi under PWD (R&B), situated at Village Mundhar, Tehsil
Kastigarh, District Doda ;
Whereas, on the basis of indent placed by Executive Engineer, PWD
(R&B) Division Bhaderwah, a notification under section 4 (1) was issued
by Collector, Land Acquisition (ACR), Doda vide letter No. 877-85/Acq.
dated 21-09-2019 for land measuring 67 Kanals and 12 Marlas in
Village Mundhar, Tehsil Kastigarh, District Doda for construction of road
from Babjar Morh to Samthi under PWD (R&B) ;
Whereas, the Collector, Land Acquisition (ACR), Doda vide letter
No. 1521-26/Acq. dated 19-10-2019 has reported that the notification
issued under section 4 (1) of the J&K State Land Acquisition Act by him

was served upon the interested persons for filing objections, if any, to
the proposed acquisition, but no objection was received from the land owners/

Whereas, the report furnished by Collector, Land Acquisition (ACR),
Doda, vide letter referred to above duly endorsed by District Collector,
Land Acquisition (DC), Doda vide No. 486/LAC/D/19 dated
21-10-2019, Divisional Commisioner, Jammu vide No. 502/3890/PWD/
Mundhar/D/19/2893-94 dated 27-11-2019 and Financial Commisioner,
Revenue, J&K, Jammu vide No. FC-LS/LA-5190/2020 dated 11-05-2020
has been examined and it has been found that the land owners did not file
any objection to the proposed acquisition ;
Whereas, the Government is satisfied that the land particulars whereof
are given above is required for public purpose viz. for construction of road
from Banjar Morh to Shamthi under PWD (R&B) .
Now, therefore, in pursuance of section 6 of the J&K State Land
Acquisition Act, Samvat 1990, it is declared that the land measuring
67 Kanals and 12 Marlas in Village Mundhar, Tehsil Kastigarh, District
Doda for construction of road from Banjar Morh to Shamthi under PWD
(R&B). Further, the Collector, Land Acquisition (SDM),Gandoh is direcred
under section 7 of the said Act to take orders for acquisition of the said land
after giving prescribed notice to the interested person(s) as required under
the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible for
idntification and proper title verification of all types of land involved in the
case for making apportionment of compensation amongst all the
interested persons/rightful claimants, in accordance with the relevent
laws/rules in force, while making the award.

objections, if any, to the proposed acquisition, but no objection was received
from the land owners/interested persons within the prescribed period as
required under sections 5 and 5-A of the Land Acquisition Act ;

Whereas, the land, specifications whereof are given in Annexure‘‘A’’
to this notification is required for construction of road from Dramni to
Sanachora Phase-V under PMGSY situated in Village Komla, Tehsil Ramkot,
District Kathua ;
Whereas, on the basis of indent placed by Chief Engineer, PMGSY
(JKRDDA), Jammu, a notification under section 4(1) was issued by
Collector, Land Acquisition (ADC), Billawar vide letter No. ADC/Blr/2018-
2019/2433-41 dated 18-01-2019, for land measuring 50 Kanals situated at
Village Komla, Tehsil Ramkot, District Kathua for construction of road
from Dramni to Sanachora Phase-V under PMGSY ;
Whereas, the Collector, Land Acquisition (ADC), Billawar,vide
letter No. ADC/Blr/2018-19/3058 dated 22-03-2019 has reported that the
notification issued under section 4 (1) of the J&K State Land Acquisition
Act by him was served upon the interested persons for filing objections,
if any, to the proposed acquisition, but no objection was received from the
land owners/interested persons within the prescribed period as required
under sections 5 and 5-A of the Land Acquisition Act ;
Whereas, the report furnished by Collector, Land Acquisition (ADC),
Billawar, vide letter referred to above duly endorsed by District Collector,
Land Acquisition (DC),Kathua vide No. DCK/LA/2019-20/1344-47 dated
24-10-2019 duly endorsed by Divisional Commissioner, Jammu vide No.
502/3915/Acq/PMGSY/Komla/Kathua/19/2672 dated 23-10-2019 and
Financial Commissioner, Revenue, J&K, Jammu vide No. FC-LS/LA-5145/
2020 dated 10-03-2020 has been examined and it has been found that the
land owners did not file any objections to the proposed acquisition ;
Whereas, the Government is satisfied that the land particulars whereof
are given above is required for public purpose viz. construction of road
from Dramni to Sanachora Phase-V under PMGSY.
Now, therefore, in pursance of section 6 of the J&K State Land
Acquisition Act, Samvat 1990, it is declared that the land measuring 50
Kanals situated in Village Komla, Tehsil Ramkot, District Kathua for
construction of road from Dramni to Sanachora Phase-V under PMGSY.
Further, the Collector, Land Acquisition (ADC), Billawar is directed under
section 7 of the said Act to take orders for acquisition of the said land after

Division Thathri, a notification under section 4(1) was issued by Collector,
Land Acquisition (SDM), Gandoh vide letter No. 714-20/LAC dated
22-03-2018 and read with corrigendum 534-40/LAC dated 02-01-2019 for
land measuring 15 Kanals and 09 Marlas situated at Village Dhossa-II,
Tehsil Bhalessa (Gandoh), District Doda for construction of Bharthi Dhossa
road under PMGSY ;
Whereas, the Collector, Land Acquisition (SDM) Gandoh,vide letter
No. 666/LAC dated 25-10-2019 has reported that the notification issued
under section 4 (1) of the J&K State Land Acquisition Act by him was
served upon the interested persons for filing objections, if any, to the
proposed acquisition, but no objection was received from the land

Unit and a report submitted/preliminary investigation was conducted by
a team constituted by District Collector as laid down under rule 4. The

the Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act, 2013 (Act No. 30/2013), to all
whom it may concern.
A plan of the land may be inspected in the office of Collector,
Land Acquisition/Additional Deputy Commissioner, Awantipora on any
working day during the working hours.
The Government is pleased to authorize Tehsildar/Revenue staff,
Indenting Department, their consultant and their staff to enter upon and
survey land, take levels of any land, dig or bore into the sub-soil and
do all other acts required for the proper execution of their work as
provided and specified in section 12 of the said Act.

Under section 11(4) of the Act, no person shall make any
transaction or cause any transaction of land i.e. sale/purchase, etc. or

Vide SRO-303 of 2011, the market rates of land and build up property in
respect of Urban and Rural areas of District Bandipora are hereby notified
on the basis of market rates communicated by Sub-Distict Valuation
Committee duly analysed by the District Valuation Committee and approved
by the Divisional Valuation Board vide No. Divcom/LAS-649/iv/692
dated16-12-2021 forming Annexure I, II and III to this notification. The
rate shall be applicable w.e.f. 1st January,2022 to 31st December, 2022.
