Award
Award on being reminded by Hon’ble High Court for determination
of claims vide Judgement dated 02-04-2019 the petitioners herein filed
different claim petitions bearing Nos. 447/ITLC, 448/ITLC, 449/ITLC,
459/ITLC and 511/ITLC appeared before this tribunal for adjudication
of their Bonus and exact quantification of the claims in terms of
Judgement dated 29-11-2019 and also Judgement passed in LPASW
No. 09/2019 and 10/2019.
Since commen question of Law and facts are involved in all
the claim petition hence the same are taken up together for
final determination and are being disposed of by way of a comman
Judgement (Award).
The controversy with respect to entitlement to Bonus in terms
of the Bonus Act, 1965 has been settled in LPASW No. 9/10 of 2019
wherein petitioners are held entitled to bonus and now petitioners
pray from their release of Bonus in terms of payment of Bonus
Act, 1965 in view of mandate of Section 20(1) of the Act of 1965
hence in terms of sub-clause (1) of Section 20, the Act of 1965 would
be squarely applicable to the SRTC undertaking.
Originally reference for adjudication of dispute by this Tribunal is
made by State of J&K through Labour and Employment Department
vide reference No. SRO-93 dated 23-03-2017 and this Tribunal passed
4 The J&K Official Gazette 29th July, 2022/7th Srav., 1944.
[No. 17-1

award dated 24-03-2014 in file bearing No. 68/LC whereby it was held
that payment of Bonus Act, 1965 is not applicable to J&K State Road
Transport Corporation as the corporation falls in the public sector under
taking hence workers/employees of J&K State Road Transport
Corporation are not entitled to statutory Bonus in accordance with the
provisions of payment of Bonus Act, 1965.
It is reiterated that Being Aggrieved, the petitioners/applicants
assailed the impugned award in writ petitions before Hon’ble High Court
and it was opined by Ld. Single Judge in his Judgement dated
29-11-2018 that petitioners are held entitled to Bonus in terms of payment
of Bonus Act which was again challenged before Division Bench of
Hon’ble High Court headed by in LPASW No. 09/2019 No. 10/2019
wherein it was held that employees of State Road Transport Corporation
are entitled to payment of wages as provisions of payment of Bonus
Act, 1965 are applicable to the employees and remanded the matter
to Industrial Tribunal and Labour Court for determination of exact
entitlement of petitioners to receive bonus in terms of the Act.
Being aggrieved thereby the J&K State Road Transport
Corporation filed two appeals before Division Bench of Hon’ble High
Court those were dismissed and it was held that in view of provisions
of sub-section (1) of Section 20 of the Act, J&K State Road Transport
Corporation has to be held to be a Public Sector establishment to which
the provisions of payment of Bonus Act, 1965 squarely apply.
Ld. Division Bench has agreed with the findings of the Ld. Single
Judge that J&K State Road Transport Corporation is an establishment
in public sector which is liable to pay the Bonus to the employees of
the J&K State Road Transport Corporation. Regarding plea of loss
making establishment raised by respondent, it was held that this factor
is required to be considered by Industrial Tribunal Labour Court while

quantification of the Bonus and also held that parties can
make appropriate submissions in this regard before this tribunal which
would assess as to whether the J&K State Road Transport Corporation
is liable to pay the minimum Bonus or any other amount in terms of
provisions of Section 10 and Section 11 of the payment of Bonus Act,
1965.
The parties to dispute appeared before this tribunal in pursuance
to Judgement dated 02-04-2019 claiming Bonus w. e. f. date of
No. 17-1] The J&K Official Gazette, 29th July, 2022/7th Srav., 1944.

appointment to date of retirement in light of verdict passed in LPASW
No. 09/2019 & LPASW No. 10/2019. Parties made submissions and
respondents filed their written arguments along with claim of each party.
They have admitted the claim of petitioners with respect to payment
of Bonus in toto but expressed that financial health of the corporation
is critical. It is further argued by Respondent Corporation that due to
circumstances beyond the control of the corporation, the claim could
not be satisfied till date. Respondent corporation has further highlighted
their poor financial position as corporation is a major sufferer as it
has faced the brunt of unfavourable conditions, prevailing in J&K
for last more than 2½ years due to abrogation of Article 370 & 35
A of Constitiution of India relating to State of J&K and also due to
Covid 19 Corona Virus Pandemic. It is pleaded that the liabilities of
the corporation has accumulated to about 435.30 crore up to October,
2020, the petitioners in rebuttal argued and stated that the corporation
has been established on commercial principles to provide service to
the public in general and the entire income of the corporation is derived
by plying commercial vehicles and now Hon’ble High Court/Tribunal
vide its award dated 24-03-2014 allowed some claims of the employees
of the union namely ‘‘J&K Rajyapath Parivahan Nigam Karamchari’’
but rejected the claim for payment of Bonus under the payment of
Bonus Act, 1965. And this award dated 24-03-2014 passed by this
Tribunal before was challenged Hon’ble High Court in WP No. 135/
2015 titled J&K Rajyapath Parivahan Nigam Karamchari Union
Vs. J&K SRTC with a further prayer to quash the award to that
extent whereby bonus was declined and subsequent writ petition bearing
No. 2058/2015 titled ‘Tarlochan Singh & Ors. Vs. J&K SRTC’ was
filed in Hon’ble High Court and now this proposition with respect to
applicability of provisions of payment of Bonus Act, 1965 is settled by
Hon’ble Court and the matter were further remanded to Hon’ble tribunal
for determination of exact entitlement of the petitioner to receive the
Bonus in term of payment of Bonus Act, 1965 and on the same analogy
present writ petition titled ‘‘Gurcharan Singh & Ors Vs. J&K SRTC’’
and “Dev Raj Bali & Ors Vs. J&K SRTC’’ were filed and those were
also allowed by Hon’ble High Court and directed this Tribunal to
determine exact entitlement of the petitioners to receive the bonus.
Heard. Perused entire material on record meticulously. The matter
as projected through these claim petitions before this tribunal can be

precisely adumbrated. Thus the facts which are uncotroverted between
the respondents are that the petitioners were employees of JK SRTC
those were appointed as Drivers/Conductors and were plying vehicles
of J&K SRTC and are held entitiled to Bonus in light of aforesaid
judgements of Hon’ble Court.
Since the Hon’ble High Court has settled the controversy
regarding the payment of Bonus in the above-mentioned judgements,
hence petitioners are held entitiled to Bonus as prayed for.
The respondent’s tangible plea is that ‘‘J&K SRTC’’ is not having
good financial status. It is further argued that now since Hon’ble High
Court has held that provisions of Bonus Act are attracted in the facts
and circumstances of the petitions in hand but due to financial crunch,
the answering respondent is facing difficulty in releasing of huge amount
though respondents have approached J&K Government for financial
assistance of 44 crores, to able the corporation to clear the current
liabilities including claim of claimants in the present case and prayed
that award may be passed in the claim petitions considering the financial
plight of the Corporation Parties have reiterated their arguments.
Respondents have filed their respective version by filing claims of each
claimants/petitioners those are not reverted.
As the case goes, precisely stating there is voluminous
documentary evidence evincing that petitioners have put forth their
genuine claims and are eligible for all benefits as agitated under Industrial
Dispute Act.
There is an ample evidence on file that petitioners being employees
of the corporation are held entitled to Bonus in view of order passed
in LPA as well in other writ petitions. Regarding petitioner’s claims,
respondents have admitted them in toto, so suffice, it would be say
that the petitioners are held entitled to Bonus w. e. f. their respective
date of appointment to date of retirement including interest and in light
of judgement passed by Hon’ble High Court petitioners get an
indefeasible right to get Bonus as prayed for. Thus in view of above
said, this Tribunal find substance in the aforesaid petitions.
The most canvassed and pivotal point of discussion is payment
of Bonus to the petitioners which was denied to them earlier and now

bonus and in this regard.
Now, question before this Tribunal is determination of exact
entitlement of the petitioner to receive the Bonus in terms of the payment
of Bonus Act, 1965. So far as payment of Bonus to the petitioners
is concerned respondents have filed detailed statement in each case
for each claimant and there is no rebuttal by petitioners to the Bonus
