ORDER
20-12-2022
1.
The Police Challan at hand was presented in the Court
on 11-08-2022 by the Police Station, Banihal against accused
Mohd. Naveed, Uzma Kossar (both are in Judicial lock up at
District Jail, Udhampur) and in absence of accused Mohd
Waheed who was not present and IO had sought time to produce
the accused Mohd Waheed.
2.
Ld. Sr. P. P. is present for the UT (J&K).
3.
Accused No. 1 and 2 present through virtual mode.
4.
As appear from the interim orders Sh. A. R. Mushtaq, Advocate
has filed Vakalat Nama on behalf of the accused persons 1 and 2.
676 The J&K Official Gazette, 2nd Feb., 2023/13th Magha, 1944. [ No. 44
However, the accused No. 3 namely Mohd, Wahid S/o Abdul
Qayoom R/o Dodaj, Tehsil Darhal, District Rajouri (UT J&K)
was not present and the Investigating Officer had sought time
to record his statement regarding the production of the accused
and submitted that the chargesheet is complete in all respect. It
has also come on record that when the warrant issued against
the accused No. 3 was not return by the concerned police, then
this court vide order dated 01-12-2022 directed the Investigating
Officer to search and produce the accused in the court. Today
the Investigating Officer appears along with the Tamilkunda and
their statements recorded and form part of the file. On perusal
of the report and efforts done by the police to trace out the
absconded accused it appears that the police had gone to search
the accused in his village and get the statements of the Nuberdar
and Sarpanch recorded in connection with the search of the
accused. The statement of the witnesses recorded by the police
during the search of the accused and the statements of the
Investigating Officer, Suhshil Kumar and HC, Dalveer Hussain
it appears that the police had searched the accused but the said
accused could not be located/traced out. It also come on record
that the said accused was not available at his place nor he could
be apprehended and, therefore, the chances of imminent arrest
of the accused are remote and accordingly, a prayer is made for
issuing permanent warrents of arrest against the accused as
also to initiate proceedings under Section 299 of Cr. PC with
respect to him. Admission of the application, the statements of
SI, Susheel Kumar and HC, Dalveer Hussain of Police Station,
Banihal as such are sufficient to proceed against the accused.
5.
Taking into account the submissions made by Ld. P.P. the
statements made by the Police Officer and Official who had
made efforts to secure the presence of the accused, I am satisfied
that the accused Mohd Waheed has absconded and chances of
his immediate arrest and production before this Court are remote.
6.
Viewed thus, General warrant of arrest is isssued against the
accused Mohd. Waheed S/o Abdul Qayoom R/o Dodaj, Tehsil
Darhal, District Rajouri, Jammu and proceedings under
Section 299 of Cr. PC is issued against him. One copy each of
